The Gross Injustice Of Obamacare

As a writer for the US~Observer, I’m accustomed to finding injustice within government and the justice system; but one injustice among many from the Patient Protection and Affordable Care Act, otherwise known as Obamacare, is particularly shameful.

I’m talking about the fines that people will have to pay for not signing up for having their money taken and receiving little, if anything, good in return from Obamacare. Many people who don’t have healthcare now don’t because either they don’t want it or can’t afford it.

For those who currently want healthcare but can’t afford it now, they really won’t be able to afford Obamacare with rates for healthy individuals allegedly doubling or even tripling, according to a July 2013 article in Forbes by Avik Roy. Estimates like this are typical from those analyzing the higher costs associated with the boondoggle. But when people don’t sign up for it because they can’t afford it, they’ll be fined. According to Henry Blodget of Business Insider, in 2014, the fines will be $95 per person. Then in 2016, the fines will increase and start at $695 for households making between $9,500 and $37,000 a year and go up from there for households with greater incomes.

Imagine fining someone for something he is physically unable to do. And therein lies the most egregious injustice of Obamacare.

For those who don’t want Obamacare or any other health insurance, one can hardly blame them.

Back in 2000, the Journal of the American Medical Association reported that doctors are the third leading cause of death in the U.S. The study upon which the article was based found that many deaths in hospitals for patients under doctor “care” were a result of: unnecessary surgeries, infections, medication and other medical errors, and “non-error, negative effects of drugs.”

As of 2011, the statistic hasn’t changed much, with nearly 784,000 deaths in that year attributed to doctor screw-ups or 24.5 times more than all gun-related deaths combined. It’s a small wonder why some people choose to opt out of healthcare coverage altogether, and there is every reason to believe that things will be worse under Obamacare.

Also, just because some opt out of health insurance, it doesn’t mean they can’t afford to pay for it; some choose to pay out of pocket or carry catastrophic coverage instead.

In 2009, when Obama was busy misrepresenting the alleged 46 million people who did not have healthcare coverage in the Nation, he conveniently left out the fact that about 17.6 million of the 46 million made enough money to be able to afford it. But for various reasons like the one mentioned above, simply chose not to buy it, which was and still should be the right of every American.

It is a travesty of justice to fine people for something they don’t want or can’t afford and shouldn’t have to pay for to begin with. But when you allow socialism/communism to slither into power, this is what you get.

Take a page out of the US~Observer playbook and become proactive! Contact your representatives immediately and demand they alter or, better yet, abolish Obamacare. If they don’t listen, find out what they have to lose by not listening to their constituents. Then go after them publicly, without mercy and make sure they lose whatever it is. Look, there are so many citizen reporters out there doing great work; dig into the officials. If they are taking bribes, find out. If they are cheating on their spouses, find out. Then they have a choice: Do what is right and what is wanted by the people or face ruin.

It’s time to demand accountability.

you have a choice – but the government will fine you if you do not chose O-care – so how is that a choice?

    • smilee

No insurance then that money goes to pay for you when you have to be seen in the EM of which health care you have no chose to make either.

The answer to the present income tax code is not the Flat Tax, but a Fair
Tax that applies equally to all, and as encompassed in the Maslar “Three-Page Tax Plan” (TPTP) that imposes a no-exception, no exemption 3% National Sales Tax (NST) across the board, taking the poisonous sting out of lobbyist fangs. E-mail copy available from

TPTP makes spending of all organizations, for profit or not, along with 100%
of the population, illegal or not, whether income is from legal sources or not,
or from under the table, drugs, crime, investment, gift, or whatever, subject to the 3% NST when spent. According to a study published by Lanny Davis in ‘The Hill” tax revenues would be about $4 Trillion for budget, $4 Trillion to pay
down National Debt, and $4 Trillion for Universal MediCare (UMC) for every
legal resident in the US. UMC will save many States from bankruptcy, as State
administered budget-busting Medicaid will no longer be necessary.

Wall Street type transactions would be taxed at 1/2 of 1%, putting smaller
investors on a par with giants that do “High Frequency Trading (HFT) in nano seconds while ordinary investors are the first to lose and the last to
gain. Programming errors caused panic that dropped a thousand points on the Dow Jones Industrial Average in minutes.

Congressional Budget Office (CBO) must score the TFTP, but it takes a
Representative to do the submission, difficult for an individual, as most
Representatives ask for zip code first but do not allow e-mails from anyone
    outside their district.

You are one sick puppy, sir. The answer to the present federal tax code is its total repeal, and necessarily defunding the federal government of all the unconstitutional functions it has usurped. The feds should only perform those 18 enumerated functions provided for in the constitution – nothing else!

      • Albert Maslar

Ain’t gonna happen though we all know that to be true.

    • ‘Barbara Messmer

I’m confused; in the first paragraph it is described as applies “equally to all” and “no exception, no exemption” but then in paragraph 3 Wall Street is only taxed at “1/2 of 1%”. That means that even the so called Fair Tax gives Wall Street a 2 1/2% advantage. Is it really “across the board” or just the “end users” that pay the 3%? What about food, medicines, both prescription and OTC, first aid supplies?

      • Albert Maslar

The “1/2 of 1%”. Wall Street transaction tax is ADDITIONAL to the 3% they will still have to pay on any other purchases or expenditures.
There are no exceptions because that would let lobbyists continue to feed greedily at the public trough. Free Universal Medicare is very expensive as evident from ObamaCare costs, and therefore NO EXCEPTIONS or EXCLUSIONS.
Income of $30,000 if all is spent results in an annual tax of $900 and conventional wisdom is that family HealthCare is worth in the $1.000. per month range.
What makes my plan work is 100% participation and taxing expenditures of the money coming from not taxed sources other than wages etc.

  • ObamaCanKissMyA$$

I am one of the people that can not afford Insurance, but that is ok he will tax me anyway, so I will lose a little more weight by not being able to buy groceries to pay this tax. I will not apply for SNAP or any other government assistance, would rather eat dirt than become a government slave.

    • smilee

The ACA will subsidize your premiums and it is based on your income. Don’t pay it and the tax for not buying it will cost you more. I hope you find dirt tasty as it is your choice if you eat dirt as you do not have to.

    • smilee

It is constitutional and you think it is socialism so are you saying the Constitution is a socialist document. I do not think so and calling it socialism does not make it so and it is not.

  • securityman

the only ones that will be making it off of this are the lawyers when they start taking the cases to fight this thing.

Add to this the destruction of the minimum wage job, talking to some of my friends that live in the hood, all businesses are cutting people back in hours, now you cant even work at mcds and expect to pay rent, or bills because now you cannnot get a full work week,

It was the insurance companies that required everyone to pay up, i think it was a nova program that looked at the whole obamacare program and its passing, in fact it almost was scuttled because the must enroll thing was seen as too far out there and dropped, then the insurance companies backed out and used all its might to make sure that bill would not pass, and then to make sure the must pay bill was passed.

So the government and the insurance companies take all your money, if you want health care or not, and then the govt fines you if you decide not to pay at all.

Its all about money and the greed of the insurance companies.

It was never about affordable health care, or getting costs under control, it was about the big moneylenders squeezing you dry. even if your are 100% hale and healthy.

Obamacare does not need tinkering with it needs abolished. and now.

I want to sue the congress for abandoning its duty, for not reading a 1300 page bill, the obama admin for promising open govt, for punitive punishing of the american people at the behest of the insurance companies.

This is the worst kind of government a government that does not serve the people, that does not read the bills big business is writing for them, And backtracking on curbing it even when they saw the problems in it, because insurance companies cried foul and could write bigger checks than john q public could.

If there is a class action lawsuit sign me up.

  • scott miller

What happened to my comment it vanished?

How about the destruction of the minimum wage job? Talking to my friends from the “hood” they cant even get a paycheck to pay the rent because obamacare forcing companies to cut peoples hours back. Thanks to this bill everyone will need 2 or 3 jobs to pay anything nevermind obamacare.

The whole must enroll thing was insisted upon by the insurance industry. I think it was nova that looked at the passing of obamacare, And it was almost scuttled because that must enroll was taken out by the admin itself because it was nervous about it. The insurance companies stormed off lobbied and took out ads against it and made sure it was readded and passed that way.

How about the pressure obama put to get this thing passed? remember we could not even read the bill, we were promised to be able to review every bill written, oh but not this one. your own senators did not even read it, nevermind you, oh but what people did glean out of the thing even then is that this bill was a monstrosity of big business and huge government.

We need to sue, and sue big. sue congress for not doing its job in not reading the bill and not protecting the interests of the american public.

Sue the obama administration for lying about choice and the ability to review.

Or skip it all and just say everyone that voted for this bill and insisted this bill pass is a traitor to the amercan people.

Should business and industry have a say in leglislation? sure. but it should not be more say than the american voters. Not because multimillion dollar corps can write checks and because of those checks insist on provisions that are purely unconstitutional, sacraficing the american voter, american jobs, and american freedom in one fell swoop.

People should not be afraid of their governments, governments should be afraid of their people. And we sure are nearing a near perfect storm of outrage, when i hear poor people talking about how this bill is bad for their jobs and their community, as much or more than “middle” class people are you know a tidal wave is coming as our leaders trash our economy, as they trash our dollar, as they anger the world markets inflating and devaluing their currency, and continue to be beholden to china, we will have a tipping point.

The real question then becomes do we learn from our mistakes or keep on the same treadmill.

And if there is a class action lawsuit agaisnt obamacare sign me up.

You cannot sue the government to get rid of a law especially after it has been found conatituional. Only Congress can do that so dream on sucker.

  • disqus_gjl3EwoNV

If these people can’t afford to sign up for this UNAFFORDABLAE health care, how can they afford to pay the fine?
This ULNAFFORDABLE so-called health care needs to be repealed in it’s entirety.
Maybe what we had before wasn’t the greatest, but it was a damn site better than this obummercare.

    • smilee

      Never Happen

    • Betta

According to the law, if you don’t or can’t pay the fine you get three hots and a cot in jail. That’s what’s in the bill that nancy PIGlosi said you had to pass it to see what’s in it. Like she was talking about a bowel movement. She passed it, looked in it and found lots of corn.

As the Good Book says about abominations and liars from Proverbs Chapter 6 , 11,12,26 and Revelation 21. Old and New Testaments judgments…

    Proverbs 6:
    The Wicked Man
    12 A worthless person, a wicked man,
    Walks with a perverse mouth;
13 He winks with his eyes,
    He shuffles his feet,
    He points with his fingers;
14 Perversity is in his heart,
    He devises evil continually,
    He sows discord.
    15 Therefore his calamity shall come suddenly;
Suddenly he shall be broken without remedy.

16 These six things the Lord hates,
Yes, seven are an abomination to Him:
    17 A proud look,
    A lying tongue,
    Hands that shed innocent blood,
18 A heart that devises wicked plans,
Feet that are swift in running to evil,
19 A false witness who speaks lies,
And one who sows discord among brethren.

    Proverbs 11:1
Dishonest scales are an abomination to the Lord, But a just weight is His delight.

    Proverbs 12:22
Lying lips are an abomination to the Lord, But those who deal truthfully are His delight.

    Proverbs 26:25
    When he speaks kindly, do not believe him, For there are seven abominations in his heart;

    Revelation 21:
    8 But the cowardly, unbelieving,
abominable, murderers, sexually immoral, sorcerers, idolaters, and all
liars shall have their part in the lake which burns with fire and
brimstone, which is the second death.”
27 But there shall by no means enter it anything that defiles, or causes an abomination or a lie, but only those who are written in the Lamb’s Book of Life.
Jesus said to “send forth His Gospel (His word, the Bible)to the uttermost parts of the world” Pass this on…

Any and every time government “takes over” It becomes bloated with red tape and bureaucratic nonsense. Add bureaucrats to anything has and always will add more expense, lower the quality, and become totally corrupt.
