Feinstein Says Free Press Only Means People On MSM Payroll

Senator Dianne Feinstein (D-Calif.), backed by Senator Dick Durbin (D-Ill.), has proposed an amendment to a journalist shield law sponsored by Senator Charles Schumer (D-N.Y.) approved by the Senate Judiciary Committee earlier in the month. She wants to choose who can and who cannot be considered a journalist.

Schumer’s shield law bill’s purpose is aimed at protecting journalists’ sources. A renewed push for stronger media shield laws came after disclosures earlier this year that the Justice Department secretly subpoenaed two months’ of telephone records for phone lines used by reporters and editors for The Associated Press and secretly used a warrant to obtain the emails of a FOX News journalist.

“We need a strong media shield bill now more than ever,” Schumer said. “This is an important step forward that strengthens this bipartisan bill and should give it even more momentum to clear the committee and the Senate by the end of the year.”

The New York Democrat’s effort came complete with a four-page explanation of who would be protected under the law, summarily, a person “with the primary intent to investigate events and procure material in order to disseminate to the public news or information concerning local, national or international events or other matters of public interest.”

Though Schumer has declared that organizations like the government leak clearinghouse Wikileaks would not be protected by the language in his bill, the proposal would protect independent bloggers and citizen journalists.

But Feinstein wants to place further limitations on the definition of journalist because she is concerned “that the current version of the bill would grant a special privilege to people who aren’t really reporters at all, who have no professional qualifications.” The Senator has proposed that only people who are salaried or at least affiliated with a news “entity” should receive media shield protections.

Specifically, the Feinstein amendment requires a journalist to meet one of the following definitions:

  • Work as a “salaried employee, independent contractor, or agent of an entity that disseminates news or information;”
  • Either (a) meeting the prior definition “for any continuous three-month period within the two years prior to the relevant date” or (b) having “substantially contributed, as an author, editor, photographer, or producer, to a significant number of articles, stories, programs, or publications by an entity . . . within two years prior to the relevant date;” or
  • Work as a student journalist “participating in a journalistic publication at an institution of higher education.”

Her amendment also reaffirms problematic language in the original version of the bill, which gives Federal investigators broad room for abuse, requiring people seeking protection under the media shield to regularly participate in journalistic activities. Specifically, the amendment requires:

  • That individuals “engage[d] in . . . the regular gathering, preparation, collection, photographing, recording, writing, editing, reporting or publishing on” matters of public interest; or
  • That individuals “regularly conducted interviews, reviewed documents, captured images of events, or directly observed events.”

The Electronic Frontier Foundation contends that Feinstein’s crusade to define “who” is a journalist with vague language about paychecks is bad news for independent bloggers, journalists and anyone on the media fringe.

The organization said in a statement:

Sen. Feinstein’s amendment is riddled with vague language, failing to define key terms including “agent,” entity,” “substantially contributed,” and “regularly”—on which the definition of who’s a journalist turns. Non-traditional journalists are at a disadvantage when the interpretative waters are muddy. Why? Because such vagueness invites interpretations that exclude those who are on the margins of status quo journalism, and who are often in a more vulnerable position and unable to hire legal counsel to sort through the law’s ambiguities. As a result, independent bloggers and citizen journalists would likely be interpreted out of Feinstein’s definition of journalist.

Of course, Feinstein is probably well aware that her amendment endangers citizen journalists and thousands of bloggers keeping a keen eye on the criminal class in Washington. That’s the point.

    I wonder if, under Feinstein’s proposed redefinition of the term “journalist”, Alexis de Tocqueville — best known for his treatise “Democracy in America” (Volume I, 1835 and Volume II, 1840) — would have qualified.

    And what about OTHER outspoken independent thinkers and political philosophers and explorers of any particular political, social, or of other condition that might have come into their focus, regardless of whether or not that individual was or wasn’t — or is or isn’t affiliated — with a “news entity” (whatever THAT is) or receiving a “salary” for having his or her views on the matter disseminated?

    In today’s America, would that person — as Feinstein would perhaps have it — NOT be (even if in regard to a single disseminated output) entitled to be accorded the title “journalist” and NOT be entitled to be protected (even if in regard to a single disseminated output) by a journalist “shield law”?

    But why even argue those points; the key issue here is that, IMO, Feinstein is trying to CONSTRICTIVELY NARROW what has ALREADY been traditionally defined — and which is still evolving toward even greater openness — as to the who is and who is not “permitted” to be considered a “journalist”.

    First of all, SINCE WHEN do I, or anyone, need GOVERNMENT PERMISSION to be a journalist?

    Also, as traditionally accepted, and also per the term’s definition in prominent dictionaries and sources even today — at least as per my understanding — there is NO requirement that says that in order to qualify as a “journalist”, a person must:

    “Work as a ‘salaried employee, independent contractor, or agent of an entity that disseminates news or information’;

    “Either (a) meeting the prior definition ‘for any continuous three-month period within the two years prior to the relevant date’ or (b) having ‘substantially contributed, as an author, editor, photographer, or producer, to a significant number of articles, stories, programs, or publications by an entity . . . within two years prior to the relevant date;’ or

    “Work as a student journalist ‘participating in a journalistic publication at an institution of higher education.’ ”

    IMO: Feinstein’s proposed redefinition would, in essence, place into Federal law such restrictions on the application of the term “journalist” — and would consequently also deny important legal protections to any person who, regardless of being otherwise qualified as a “journalist”, does not meet Feinstein’s definition of “journalist” — that Feinstein’s redefinition of the term becomes tantamount to a veiled threat of censorship and increased Government-corporate control of any news or commentary that may ever get a chance to see the light — if that news or commentary gets a chance at all.

    But, Feinstein aside, perhaps we do have a conundrum, especially if we consider how modern technology has already changed the field of “journalism” and “commenting” and “reporting” and “blogging” or “vlogging” (“video blogging”), and any combination of those terms and more of that nature.

    If a person writes, or otherwise presents, and disseminates, his or her reportage or commentary about any particular issue or set of issues, does that — and should that — constitute “journalism”? What if, in that presentation, the person makes a lot of sense — or makes no sense at all? What if that presentation, regardless of whether or not (or to what degree) it follows a reasonable or logical line of thought, might be objectionable to you or to someone else? What if that presentation praises, or lambasts, an official corporate or Government policy — or a corporate or Government official –, with whose views you do or do not agree? What if that presentation, whether or not its line of thought is reasonable, tears into a group that you favor — or even tears into YOU?

    Should the person presenting that presentation — or in any of these instances, for example — be accorded — or be refused — the title of “journalist” and the legal protections that “journalists” might receive?

    Now suppose that that same person does any of the above things as part of a “Governmentally-recognized” “journalistic entity”, or does any of the above things for a “salary”: why, if at all, should THESE “Governmentally-approved” qualifications make any difference to your answers to the above questions?

    Or SHOULD they?

    What IS a “journalist”? What IS “journalism”?

    Fore that matter, what IS “the press”?

    Does the term “the press” itself need to be redefined?


    The FIRST AMENDMENT of the United States’ Constitution specifically states as follows:

    “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances”.

    In that regard, Feinstein’s proposed redefinition of what is and is not a “journalist” most assuredly does not — in my opinion — meet Constitutional muster, and — in my opinion — could itself well qualify as being a direct violation of the Constitution’s First Amendment.

    And what did the framers of the Constitution write of the intended meaning of the terms “freedom of speech, or of the press”? More than I can write in this little commentary, but, I submit, they appear to have put far greater thought to the meaning and importance of the concept of FREEDOM — and placed far higher value on protecting and maintaining that FREEDOM — than appears to me to be evident in Senator Feinstein’s proposal.
