Woman suing TSA over alleged invasive search at Sunport

    I think the other item that was cut short concerning the man who refused to show his “papers” needs to be told as well. Last I checked he was not even driving a motor vehicle.

      Vicki, I wonder what the charges were as well. If he didnt show ID at a traffic stop I might understand but this? Do these TSA agents now have police power? I think this lawsuit just might determin our flying fate here. If the court decides against her then they are basicly declareing that TSA agents have police powers and what ever they do becomes fair game at that point. Mike L.

    The 4th amendment of the US Constitution is quite clear. The only exception ever provided was the “Terry Search” which allows police officers, when conducting a street inquiry of a known criminal, to make a cursory pat down of the criminals outer clothing for weapons so as to protect themselves from potential harm. “Terry” does not allow further search into pockets, etc.

    TSA searchers do not have such police powers. Therefore, if singled out for a pat down search, ask the searcher if they know your name. The answer will be no! Then ask them if they believe you are a criminal. Again the answer will be no! Then ask, by what Constitutional authority do you presume to search me? If you do not know my name, or that I have committed a crime, then where is your warrant, supported by oath or affirmation, specifying who and what is to be searched and what is sought. You can tell them that they are not even allowed to conduct a “Terry Search”. Remain calm and be civil and submit to the indignity that will surly come. Then take down the TSA searchers name ,and the supervisors if possible, and as quickly as possible, file a law suit for sexual battery, and violation of the 4th amendment. The 4th does not allow for warrantless searches and no order by any government official can mandate a TSA screener or even a policeman, to do so.

      These people don’t care about your Constitutional rights, George. The Constitution was written to protect us from overzealous Government and they aren’t likely to enforce it upon themselves. The only way things will change is for people to wise up and then rise up in mass to demand that Government obey the Main Law of the Land, The Law they swear to uphold, but just ignore as much as they can.

    we have a lost of freedom today because more sheeple will not stand up to this Nazi type government we have….
    It isn’t the fight of women but of men, yet some women or doing what men should be stopping today by force of hand,,,,thank God for our founding fathers who stood up against tyrants….were is our patriotism?
    Its time for a revolution!

      The revolution we need, Jim, is a revolution in education. We have sat idly by for decades as the Public Schools propagandized our children into a Big Government Loving stupor. We need to change that. We need to demand vouchers to send our kids where we know they will get the best education, not the best brainwashing.

    Why dont they just take their body scanners down to the border states and make all the illegals go threw them before they allow them them the free pass to enter our country.We could put up signs saying in spanish and Iragi and yemenise or what ever if they dont go threw them they would be shot on site.Sarcasm aside I dont feel they are going to use air travel to create there next jihad I feel they are going to set off bombs in cities all over the nation to get attention,most likely a dirty bomb in a mall or stadium who knows but then it would have a much greater affect than burning your balls off in a plane.

    people, people, ,, you missed the point, when you buy a ticket on “public’ transportation, you give up lots of your “rights”, , , go read up on common carriers and other things the State and Federal Gov. have gotten into through interpretation of the Constitution by the law enforcement or the courts, most of this derives from the interstate commerce clause, other wise how can they keep you locked up in a plane for 11 hours sitting on the runway, , thats kidnapping right?

    By presenting yourself at the check point you are submitting to the inspection willfully (read the signs just prior to the checkpoint). It would only be a forced search if you couldn’t choose to decline. In this case, you can pass on your flight, exit the checkpoint and no one will search you. Having said that, the groping is unnecessary. Wake up America! A police state is not a good thing!!
