What Happens Now?

July 6, 2012 by

No justice at Justice. Surprise, surprise. The Justice Department announced last Friday that it will not prosecute its boss, Attorney General Eric Holder, for contempt of Congress. Deputy Attorney General James Cole sent a letter to House Speaker John Boehner declaring that “We will not prosecute an executive branch official under the contempt of Congress statute for withholding subpoenaed documents pursuant to a presidential assertion of executive privilege.” What happens now? My bet is a lot of bluff, blustering and rhetoric, but not much else.

Encouraging people to steal. An op-ed article in The New York Times several months ago carried the subhead “Why I stole Wi-Fi for years – and you should, too.” The author claimed that her neighbors’ decision to leave their Wi-Fi networks password-free “was essentially a gift, an ethereal gesture of kindness.” Sure it was.

More proof the free market works. Here’s an amazing statistic: The southern white rhinoceros, which was almost extinct a century ago, has enjoyed an amazing comeback. There are now an estimated 20,000 of the beasts in Africa. What made the difference? Encouraging private ownership of the animals. This promoted breeding, permitted controlled trophy hunting and even allowed rhino horns to be harvested humanely. (They grow back.) As a result, death from poachers, starvation and natural predators has all but disappeared.

A dramatic way to make the point. College students who want to show how offensive it is to base anything — including student admissions — on race have been known to organize a treat of an event: affirmative action bake sales. Wikipedia states: “A typical pricing structure charges $1.00 for White and Asian males, $.75 for White and Asian females, $.50 for Latino, Black, and Native American males and $.25 for Latino, Black, and Native American females.” The protests have taken place at many campuses across the country, much to the dismay of liberal groups and some college officials.

No Justice for Justice; how sad is it when a so called Constitutional scholarly lawyer; aka, Barack Hussein Obama intentionally misuses and abuses power with the help of many in the justice department (whom could have been his students at one time?) These guys and gals amount to nothing more than overpaid, suited snake oil salespeople in an increasingly failed legal profession. We can forget about right and wrong in this country anymore, its about who has more skill in feeding the public trough for soap opera style b.s. while their self appointed, above the law, pimp-daddies prevail and their fluoridated constituents, instead of demanding truth, demand more of the same.

I think we can safely say that Barry O was no Constitutional Law scholar , unless it be that of Communist Constitutional Law . It also appears that Communism has been installed at Justice in the form of , ” We are the law , how can we break it ? Law is what we say it is “.

If the DOJ will not prosecute Holder, then the House needs to impeach him. Fast and Furious was beyond ill-advised, it was illegal and a border patrol agent and hundreds of Mexican citizens were murdered. Holder and whoever else was involved, even the president, need to be held accountable. If there is no justice coming from the DOJ, then what good are they? Does this mean if you are part of the Obama administration, you can break the law with no consequences? Holder has lied and that is enough to impeach him, so the House should have the couage to prosecute him.

prosecute, hell…get the tar torches and pitchforks…they;’re guilty beyond a reasonable doubt, case closed

That is the ONLY way America will see any “change”. Believing in politicians’ promises at this point is like believing in the Tooth Fairy. We are becoming a dictatorship, and nobody cares.

Nobody with the authority to do so has the fortitude to try.

All Boehner needed to do was contact the Sergeant-at-Arms of the US Congress and have Eric Holder arrested on the spot for Contempt of Congress. He could be held indefinitely until he intends to comply. He can STILL do this if he wants, but I’m not deluded in the least to think he ever will resort to this drastic measure which hasn’t been used in quite some time. Boehner’s heart was reported to have never been into this Contempt proceeding because of its political distraction in an election year. Congress could pursue this with its own Independent prosecutor, but I have no faith whatsoever in ANY of the federal courts in this entire nation as witnessed by the free pass they have given Obama on the over 130 or so ineligibility challenges and the insanely ridiculously contorted logic used to thrust Obamacare down the throats of 26 Sovereign States. I agree with Chip: It will now all fade to black. I will go so far as to say that Eric Holder will remain the Attorney General because Obama knows now that he can get away with murder or anything under the sun if he so desires. Obama knows he has been coronated Dictator of the USSA.

The House could ask a judge to convene a grand jury to investigate its allegations against Eric Holder, and there would be nothing the AG or his minions could do to stop them except to continue stonewalling – a process sure to irritate the jurors as well as the House. It would not be the first time a recalcitrant official was served with a grand jury indictment.

Lawful remedy? Congress impeaches Holder (we know that ain’t gonna happen until the Socialist Libs & Neo-Con/RINO legislators are ousted from Congress first & the next chance to do so is coming up fast), then follows up with holding the entire DoJ under Contempt. How?

Article 2, Section 4 REQUIRES charges for indictment after impeachment. The exact wording is “The President, Vice President and all civil Officers of the United States shall be removed from Office on Impeachment for, and conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.” That is “SHALL be,” not “MAY be.” The Contempt charge on the DoJ as a whole can be cited to a direct act in Breech of Oath for the Sworn/Affirmed Officers in the DoJ that REFUSE to perform their duties.

By the way, Congress does not need to rely on the DoJ to initiate prosecution…They can do that on their own. If the DoJ still refuses to prosecute Holder, even after the Contempt charge on the DoJ itself, Congress can then start prosecution of the DoJ, either individually or as a whole for Dereliction of Duty under Oath.

    • midnightdstroyer

Keep in mind that We the People are the employers of ALL of our Officers…We have every legal & Lawful Right to enforce the Constitution over them because the Oath of Office is what binds every individual Officer to fully comply with it. It is, essentially, a contract of employment and the terms & conditions for employment (& continuation of employment) are specified.

Please tell me that’s not all for Holder. You have to be kidding me!

I as many are thoroughly disgusted with the out come of this investigation. Mr
Issa wasted a lot of money and time on this whole investigation with the
results of Holder being held in contempt. He should be prosecuted, yet the
D.O.J. will not do one thing to him. That is totally preposterous. What did Mr.
Issa and his committee accomplish, absolutely nothing. We all agreed that
Holder was in contempt and lied to Congress and our decision came about shortly
after the interviews and the stonewalling of evidence. Because Congress is
permitting him to get away with these crimes, they have done nothing but waste
our time and money when they could have been working on correcting the economy
and creating jobs. Holder is appointed and has no immunity from anything, yet
this is being permitted by the very department he heads up. My heads up to
Congress and the American people is that we should vote all the bums out of
office and clean up a BIG mess. Mr. Issa has done nothing but try fool us into
believing he and his committee were REALLY accomplishing something good for the
American people. More deceit by the deceitful politicians.

“Mr. Issa has done nothing but try fool us into
believing he and his committee were REALLY accomplishing something good for the
      American people.”

Ah, but he has accomplished good. Without his investigation this would have dissappeared long ago and we would not be discussing it today. In fact without his investigation it is doubtful most people would even be aware of the atrocity known as Fast and Furious.

Obama has decided to go all in on this issue, and he must for he is right in the middle of this F and F situation. This is action of the DOJ and the ATF is a crime under International Law and that is exactly the next move by Congress. They need to file charges against our DOJ/ATF in International Court for the crime of Smuggling Firearms into Mexico which were delivered to Drug Cartel gangs and ask for Prosecution of the offenders under International Law due to the deaths of hundreds of Mexican Citizens and U.S. Border patrol agents.
They should copy all of the relevant documents to the International Court (UN) and the proceed to Prosecute the DOJ and do a full investigation of the President and his links to this fiasco.
Obama wants to play rough, it is time to play rough in return…. Congress must not back down from this issue. The Nation is at stake….

100 % true about the rinos. You want to save an endangered species? Turn it into a commodity. When everybody (the state) owns something, its as if no one owns it.

  • Dave

Jeannette says, “If the DOJ will not prosecute Holder, then the House needs to impeach him.”
That won’t work. JD’s offense is against the SCOTUS, not against the House. The response to this assault on SCOTUS authority must come from the SCOTUS. They should declare that JD is now a rogue authority and that all of its other prosecutions are now null and void and will be overturned when they reach the SCOTUS.

Well, then charge the whole Justice Department for withholding information leading up to the arrest of Holder. This means they are holding back evidence. I’m no law scholar, but you can’t tell me there is no way to get the truth out of a CRIME !!???????? This is NOT RUSSIA !!!!!!!!!!!!!!!
