Three Felonies A Day:How The Feds Target The Innocent by Harvey A. Silverglate

This is a timely book about the breakdown of the rule of law in the United States.

Individual freedom and the rule of law is gone in America. Oh, they haven’t come for you yet? You haven’t broken the law? Well, Harvey Silverglate proves in Three Felonies a Day: How the Feds Target the Innocent that the Feds (U.S. prosecuting attorneys) target the innocent. He says the, “federal prosecutors are abusing their power by using the criminal law to prosecute law abiding citizens…” They are seizing illegal power by twisting marginal and highly questionable interpretations of criminal law.

Silverglate believes that we are in danger of becoming a society in which prosecutors alone become judges, juries and executioners because the threat of high sentences make it too costly for even innocent people to resist the prosecutorial pressure.

Federal judgeships are drawn largely from U.S. prosecuting attorneys simply because they enforce the system upon citizens. They ensure that all cases are decided for the government agenda.

The pattern is to intimidate all criminally charged defendants today to plead guilty to “reduced” charges rather than risk a trial with the threat of draconian sentences in the implied event of a conviction. No trial? This means that the Federal prosecuting attorney is the judge and the jury.

Unless we have missed the point here, all Americans are now subject to entrapment. Innocence or guilt has nothing to do with a judiciary gone wild.

You can commit a Federal crime in America and not even know it. People are targeted and a crime is found to fit.

Silverglate writes, “it is only a slight exaggeration to say that the average busy professional in this country wakes up in the morning, goes to work, comes home, takes care of personal and family obligations and then goes to sleep, unaware that he or she likely committed several Federal crimes that day.” Why?

The answer lies in the huge volume of Federal criminal laws which are broad and impossibly vague. They have become dangerously disconnected from English common law tradition.

There is a crime for all of us. Currently there are 4,450 listed criminal offenses. These listed Federal offenses have exploded well beyond the statute books and into the morass of the Code of Federal Regulations, giving Federal prosecutors thousands of additional vague, complex and technical prohibitions removed from congressional authority or any authority but the Federal prosecutors themselves.

Will citizens ever understand the danger posed to civil liberties when our normal daily activities expose us to potential prosecution at the whim of a government official?

Silverglate writes, “No field of work, all corporate officers, all social classes are not safe from this illegal and unconstitutional executive and judicial overreach and social control.

“When every citizen is vulnerable to prosecution and prison, then there is no effective counterweight to reign in government overreaching in every sphere. The hallowed notion of a government of laws becomes a cruel and cynical joke.”

What we write about here is the exact Soviet system and evil empire that Americans have been taught to hate.

All we have to do now is remove the mask of “democracy” to view our modern American Soviet system.

It is also the exact same old English Star Chamber system that early Americans fought to escape in the Revolutionary War with England. The English Star Chamber was abolished in 1641. It was Royal oppression with corporal punishment using torture, mutilation and life imprisonment. It met in secret whereas today the Federal judiciary uses esoteric language to subvert the intent of the law. It is more “benevolent” but just as wicked.

We have come full circle and sadly not one American in a million even suspects it. Here is the great danger, as Silverglate states:

“Today the Justice Department encourages Federal prosecutors to do exactly what the Garber Court condemned. In particular, Federal prosecutors’ novel use of long standing, but utterly formless ‘anti-fraud’ laws, which cover increasingly vast areas of American life, threaten honest (and apparently law abiding) business executives and other professionals, as well as other ordinary citizens. In 2003, Michael Chertoff, then second in command of the Justice Department’s Criminal Division, even went so far as to boldly declare that federal prosecutors should exploit anti-fraud provisions to indict business executives because ‘criminal prosecution is a spur for institutional reform.’”

The thrust of the Federal government and its untouchable Justice Department is to expand the reach of the law. My friends, this is characteristic of all governments. But the U.S. today is our concern. Even commonly used statutes of conspiracy, bribery, extortion, etc. are all designed forms of entrapment by a rogue system.

“Even the most intelligent and informed citizen (including lawyers and judges) cannot predict with any reasonable assurance whether a wide range of seemingly ordinary activities might be regarded by federal prosecutors as felonies.”

Any sober and alert person should read this book. The shock of his revelations should evoke max alert with all deliberate preparations to defend our lives, our families and our assets. To view the contents as anything other than modern tyranny under the color of law is naiveté in the extreme.

In my 45 years of writing I have never come close to recommending a book with such high and timely revelations for every American citizen. Get this book immediately. I am surprised to see it in circulation.

    I guess I’m just an old fart, but I remember when Jack Kennedy needed some laws to get the Mafia, the Rico Law was passed. Today, anyone can be charged with violating the Rico Law simply by discussing anything the government considers subversive. And now the Terrorist Act has allowed the government to do as they please to pressure anyone to comply to their wishes and charges. People need to read about Russia after their revolution and the purges Stalin did in the name of national security and protecting the Communist government.

    I thought we were no longer America anyway, we are now the land of the offended. When the prosecutor is allowed to have his/her own interpatations the laws are worthless. Maybe Eric Holder will sue the state of Arizona and divide our country some more.

      You have one brilliant idea….I couldn’t agree with you more! Maybe Arizona can lead the way; I wonder how many other states would step up to the plate and how long might it take? I do pray every day that the Obamiac would be impeached this year (what a delicious thought!) but if that doesn’t happen, your idea would be such a wonderful thing….we could all decide on a new Capital once the dust settles!     I’m always tempted, when I see an “Obama for President in ’08″, or a “Hope and Change” bumper sticker to write over it with a big black felt-tip pen the letters…..F*** Obama…….But I resist, because I fear this would be cosidered a “felony”. California is a three-strikes state………Can you imagine, having 3 felonies for “defacing private property” and going to jail for life? Not funny, but I sure think about it allot, lol.

    We’re where we are because our ‘watchers’ are no longer watched. Without functional ‘watchers,’ there are no checks and balances. Jefferson knew that without honorable people in government, the republic would die a slow death.
    The Founders knew the danger of relying on professional, ‘career’ politicians who would divide America via political parties. A two-party system puts Americans in the niddle of a continual power struggle, and politicians reap the rewards of instant job security by promising that which we can’t have.
    Once and for all time, we MUST stop anyone who plans to have a career in Washington. People who value freedom more than the empty promises of a compassionate dictatorship have no choice but to
    rekindle the fires of liberty and see the true worth of those who promise everything but never deliver anything worth having.
    Let this battle for freedom begin in Arizona and spread through all 50 states.

    OUR FEDERAL GOVT is in the process of creating the largest employer in the world.Even larger than the Chinese Army.This union operated [SEIU] govt administrated “company” will guarntee DEM leaders large majorities in our legeslative branch of govt.The “company” will be called USHS and be modeled after the British Health Service, even though the British now recognize the unsustainable cost , unacceptable lack of MD’s and horrifying lack of personal medical care is not working.

    The Three Felonies a day has been going on too long and the revolution is just around the corner…remember the storming of the Bastiel in France when Louie and Antionette were beheaded? This was the straw that broke the camel’s back and it will be revisited soon.We have a rogue govt and I knew when the Supreme court started legislating the laws, it woldn’t be long before the hammer dropped. There is a song by Steve Voss the Revolution’s comming and the country’s on the line! Truer words were never spoken!!

    We may have won a battle (the so called cold war with the USSR), but we miserably lost the war against communism and socialism. The beginning of the end was when the public education system was taken over in 1947 and evicted God and founding principles. As a result, We The People have become ignorant, lazy, hedonistic and cowardly.

    When things don’t make any sense, there is a reason. We The People can’t understand most of what the government is doing because they don’t work for us.

    Not long ago I saw a Judge and a DA dismiss prospective Jurors because they raised their hands when asked if they supported the idea that more evidence should presented than just the Officers word and an arrest report.
    The subject was that the County didn’t have video cameras in their cars and there was no supporting video evidence.
    Wasn’t that just free speech?
    That same Judge and DA almost came out of their chairs when the Assistant DA stated to the Judge that what the Defense Attorney had just stated was Jury Nullification and therefore none admissible.
    I raised my hand and was asked what I needed.
    I said, “Sirs, my understanding is you are obligated by the Constitution to inform the Jurors of their responsibility in regards to Jury Nullification.
    If you don’t you are in violation of the Constitution.
    I was damned near arrested for that statement!
    Needless to say I was not chosen as a Jury member that day.

    Note:
    I think I read somewhere there is no such thing as none admissible evidence!

    If a cop violates a law and obtains absolute proof of a crime via evidence gained while committing a crime then if it actually proves guilt without a doubt then convict them/him/her of the crime based on the evidence.
    Then try the cop for crime committed in gaining the evidence illegally!
    Be ten times as harsh on him/her/them and any other person in a position of high trust. Example the traitor Bill Clinton, “Lippo Group!”
    Try Bill for High Treasion and if found guilty, I volunteer for the firing squad!
    I’m mad as hell and don’t know what to do so I probably commit more than three Felony’s per day.

    The problem with us conservatives is that we are the only ones believing we have a corrupt government. The a–holes drawing welfare,living free in govt. housing,etc plus all the illegals, including the president, like the country just the way it is. If there was someway to convince that bunch to what’s going on and get them to rally also, we might get somewhere and turn this country around. I’ve believed for a long time that getting the freeloaders on our side is a losing battle. about 25 years ago i read that in order to live as good as people in public housing a person would have to make about $17,000 take home per year. today it’s probably double that amount.
    They get free housing,medical care, food, utilities. I.E. everything the rest of us have to/or have worked for. When the poop hits the fan economically, as many including myself think it will, they’ll be the ones raiding peoples home, looting, killing, etc.
    Earlier, someone said keep your powder dry. i second that. don’t hesitate to pop a cap, they won’t.

    STICK A FORK IN US. ITS OVER. Imagine if what is happening today took place 50 years ago?? the American people would have stormed Washington DC burned the White House. Physically removed obama and his comrades and hanged them on the Washington mall Where are the American People today ??? This is a result of years of brainwashing. The 1965 civil rights act destroyed the rights of the majority. A government of the people, for the people, and by the people ceased to exist. In late 1950′s Kruschev proclaimed to the world and america that the US would be destroyed via its education/schools and its children The first attack by the civil rights act was America’s education system destroying a world class system based on the success of the majority replacing it with a totally failed system based on the succees (or failure) of the minority. The results are astoundingly obvious The rest of America’s collapse is a given also Destroy the White Race the peoples who founded this country, its principals, its liberties. Take the values, beliefs, actions, attitudes, morals and ethics of those on the bottoms of the social, economic, and educational levels and put them on pedistals to emulate America’s collapse is imminent

    But unfortunatly America has allowed this to happen, thinking that our vote doesn’t make a difference or sitting back and hoping the other guy does the right thing. The funny thing is that the census has shown us that there are more people that don’t vote. And for years I was that way too. I was waiting for the demacrats and republicans to come up with a Good Person for the job but to this day they can’t find ONE.

    There Is more of us(citizens)than there is of the Goverment.We are the most heavily armed people in the world.I’m sure the Goverment realizies this!!They will have their hands full if they try to take over!!President Eisenhower(wished he was still in office)warned the American people about this very same issue!!!
