The Clinton Impeachment

Fourteen years ago yesterday (Nov. 19, 1998), President Bill Clinton became the second U.S. President to be impeached.

Contrary to conventional wisdom, Clinton was not impeached over his sexual affair with Monica Lewinsky. The articles of impeachment charged him with lying under oath to a Federal grand jury and obstructing justice.

Granted, the whole sordid incident centered on Clinton’s sexual proclivities. On May 6, 1994, Paula Jones, a former employee of the State of Arkansas, filed a sexual harassment suit against Clinton and former Arkansas state trooper Danny Ferguson. Jones’ claim was that then-Governor Clinton crudely propositioned her. Ferguson had escorted Jones to Clinton’s hotel room and stood guard. He claimed that Jones said she would not mind being Clinton’s mistress.

Jones’ suit was filed in U.S. District Court in Arkansas. Judge Susan Webber Wright, who had taken a law class under Clinton at the University of Arkansas School of Law, ruled that a sitting President could not be sued and deferred the case until the conclusion of his term. The case was appealed to the 8th Circuit of Appeals which ruled in Jones’ favor, finding that “the President, like all other government officials, is subject to the same laws that apply to all members of our society.” The U.S. Supreme Court later affirmed the Appeals Court decision.

On April 1, 1998, Wright granted summary judgment to Clinton in the case, but that didn’t end the President’s troubles.

In 1996, Lewinsky had begun telling co-worker Linda Tripp about her sexual relationship with Clinton. Tripp began recording those conversations. The following summer, Tripp encountered Kathleen Willey leaving the Oval Office “disheveled. Her face red and her lipstick was off.” Willey later claimed Clinton groped her.

In January 1998, Tripp had contacted Whitewater Independent Counsel Kenneth Starr to talk about Lewinsky and their taped conversations detailing the affair with Clinton and conversations Clinton and Clinton friend Vernon Jordan had with Lewinsky instructing her to lie about the affair. Tripp also gave Starr’s team a document headed “Points to make in an affidavit,” which allegedly came from Lewinsky, that coached Tripp on what to tell Jones’ lawyers about Willey in order to discredit Willey’s testimony.

On Jan. 17, 1998, Clinton was deposed in the Jones lawsuit. In his deposition he denied having a relationship with Lewinsky. It was his lies and actions during the Jones deposition that resulted in Wright’s finding Clinton in contempt of court for his intentionally false testimony. He was fined $90,000, and the case was referred to the Arkansas Supreme Court’s Committee on Professional Conduct. The Arkansas Supreme Court suspended his law license for five years and fined him $25,000. Clinton agreed to the deal in order avoid being disbarred and end the investigation of the Independent Counsel.

That deposition was turned over to the Independent Counsel. It and numerous other depositions and mounds of other evidence were turned over to the House of Representatives on Sept. 9, 1998. On Oct. 5, 1998, the House Judiciary Committee voted 21-6 to begin a full impeachment inquiry. On Oct. 8, 1998, the House voted 258-176 (including 31 Democrats) to begin a wide-ranging impeachment inquiry.

After 13.5 hours of debate over two days, the House approved the two articles of impeachment. Clinton vowed to finish his term and appealed for a bipartisan compromise in the Senate.

The fix was in. The Senate, eager to get the whole dreary saga behind it, agreed to hear and see only enough evidence to appear it was interested. Fifty-five Senators voted to acquit Clinton on perjury. The obstruction charged failed 50-50. Clinton would remain in office.

On Nov. 1, 2001, on the last day he was eligible to contest the disbarment, Clinton resigned from the Arkansas Supreme Court Bar. In doing so, he surrendered his license rather than face penalties related to disbarment.

        Mira, sounds like you need some help, and not of the kind to be found in the bottom of a bottle of liquor. Mr. Obama has been legally elected, twice, yet you declare he is not YOUR president. I beg to differ, for as long as you are a citizen of this great country, he IS your president, like it or not. You have been free to do all those things and more since the day you were born. As far as churches being told what they can say, no one I know of has told a church what can be said inside their sanctuary, but many have been told what they can NOT do outside of that place. One of the big things they have been told they can NOT do is actively campaign for any particular person. And yes, some churches have bought air time or ads in newspapers to speak out against individuals rather than just ideas.

      He never won anything honestly in his life. And most Americans did NOT vote for him in either election; quite the contrary. The 2012 was the most FRAUDULENT election in US history. How much do they pay you trolls?

    As I remember, what got Clinton in all that hot water was a congressionally appointed special investigator named Ken Starr who was assigned to look into the Whitewater mess. Mr. Starr kept expanding what he could look at until he finally found something he could actually say Clinton might have been guilty of, then the judge who heard Mr. Clinton’s testimony actually had to change her own stated definition of sexual relationship. At first, her definition meant only conventional intercourse, which Clinton never did have with Lewinski. After Clinton denied having a sexual relationship with Lewinski, using the given definition, she changed her definition to include ANY sexual contact, of any sort. Incidental to this story, the Whitewater investigation was so actively looking for bodies to hang that one man who got caught up in it was told by his own lawyer that he didn’t have enough money to be found innocent of all charges.

    Because what he was convicted of had no impact on hid job of being President, he was not removed from office.

      Dear Tgeer,

      You write: “Because what he was convicted of had no impact on hid (sic) job of being President, he was not removed from office.” The President “shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.”–Article II, Section 4. Perjury and obstruction of justice certainly qualifies as a high crime and misdemeanor, by any standards. It’s impact on his job of President is irrelevant. However, I wouldn’t expect you to understand this as you have proven multiple times the Constitution is irrelevant to you.

        I have had enough of this crap. You have accused me, multiple times, of not caring for our Constitution. I have pointed out to you, repeatedly, that if I didn’t care I wouldn’t be here. Yet you still come back with these childish comments, as though if anyone who disagrees with your point of view is wrong.

        Wrong, disagreeing with someone only means that they disagree. For most things there are more than one way to do it right.

    Impeachment is not a judicial proceeding. It is not punishment. It is removal of one who is unfit for office; therefore, one not need to be guilty of a crime on the books to be impeached.

    If a CEO had done what Clinton done with a subordinate at work, he would be fired.

    We should not lower our standards for the office of the President.

    Funny thing….Obama/Davis and his witchy wife both surrendered their attorney licenses in Illinois. I know there’s a big old bad story on the reason, but don’t know what it is. If someone knows….please enlighten me and the general public.

        According to the Attorney Registration & Disciplinary Commission of the Supreme Court of Illinois, neither of the Obama’s have any disciplinary findings or even actions being looked into.

        For those people who choose to believe everything negative that you hear, here is the link to their website. When it comes up but “Obama” in the last name text box and click on Submit. You will see two Obama’s – Barack’s and Michelle’s. If you click on each name you will see the date that they were admitted to the Illinois Bar Association.

        For instance, on Michelle’s record it says that her license is Voluntarily inactive and not authorized to practice law. That means that while is not using it, she doesn’t have to pay the Bar Association Fee’s that are required year. To make it active again all she has to is let the Bar Association know that she will be using it again and pay that years fee. Also, on her record, is Public Record of Discipline and Pending Proceedings: None.

        For our President, it says this – Illinois Registration Status: Voluntarily retired and not authorized to practice law. If he wishes to reinstate his license he must do it as anyone who takes the bar exam must do it. Public Record of Discipline and Pending Proceedings: None

        Now, for Bill Clinton, here is a link to the order of the court regarding his law license (suspended for 5 years and a $25,000 fine).

        As for Hillary, Starr tried his hardest to find anything that she had done that was illegal. Starr was not able to.
