The Battle For Florida

June 6, 2012 by

The Battle For Florida
Once again, Florida is a battleground.

Two huge battles are under way in Florida that could have a major impact on the Presidential election and the validity of the voting process. These must be closely watched in the coming days.

First is a challenge to President Barack Obama’s eligibility to be on the Florida ballot. Democrat Michael Voeltz filed the challenge which claims that Obama is not a natural-born citizen as defined by the Minor v. Happersett ruling of the U.S. Supreme Court because Obama is not the offspring of two citizen parents.

In the case, Obama lawyers filed briefs claiming the discovery process would place an undue burden and expense on the State. Florida Circuit Judge Terry Lewis rejected that argument and ruled that Obama lawyers must cite the authority on which they based their argument that it isn’t necessary to have two citizen parents to be a natural-born citizen as required by Article II, Section 1 of the U.S. Constitution.

It is the first time that a judge hearing an Obama eligibility case has not dismissed it based on standing or “because the issue was settled by snopes” as one judge ruled. Lewis, who was appointed to the bench in 1998 by Democratic Governor Lawton Chiles, set a hearing for June 18.

The second case involves a looming battle between Florida election officials and the Obama Department of Justice and criminal enabler and racist Attorney General Eric Holder. The DOJ has ordered Florida election officials to stop their efforts to purge the voter rolls of “noncitizen voters.”

Florida officials are indicating they may fight the DOJ and have expressed frustration that the Obama Administration has stonewalled the State’s noncitizen voter hunt for nine months. Election officials say they have identified about 2,700 noncitizen voters. Florida was decided by just 236,000 votes out of more than 8.2 million cast in the 2008 Presidential election.

Ooh, not a good day to be a “progressive”. End of an era? Yep!

    • MAP

We can only hope and pray, Warrior. The European financial collapse, with our own approaching collapse, has proven, once again, the unsustainablity of socialism. Unfortunately, the Leftist dream world has no place for failure. They perceive even total failure as success. When they do acknowledge failure, it is always to point the blame at others. Our hope lies in the masses finally seeing through this charade and realizing the Leftist dream world has no connection whatsoever with the world of reality and is, therefore, totally unworkable.

      • matt giggey

        Well said

      • eddie47d

Wall Street Capitalism tanked our economy and MAP and Matt still blames it all on socialism. When are you going to admit failure and allow this country to move ahead or are you still hoping for that right wing theocracy to kick in? The Right has their own charade going on.

It does’nt matter who caused our condition. you better have supplies laid back to see your family through the upcoming colaspe of our economy (?) and that mean several nmonth of food and a stash of money.

Good news. Democrats have reclaimed the Wisconsin Senate. New Majority Leader Mark Miller comments, “If Walker tries to pass extreme policies that bust unions, hurt women, or attack middle-class families, we will have one word for him: No. We will demand laws that benefit the middle class and start repairing our state.”

      • Patty

Not so fast. There will be a recount and as my friend from WI has said, they need to count how many dead people, cartoon characters, felons voted for him first. They are pretty close to the IL border so who knows what shinanigans went on. There is only a 779 vote lead. Maybe they will do what they did in MN and suddenly find more votes in the trunk of someone’s car.

    • Speak2Truth

I hope the American People can prevail. Obama has illegally taken office and has been there far too long.

Just two years after the Constitution was ratified, the US Congress spelled out the legal conditions under which they would recognize someone as a Natural Born Citizen, specifically that person MUST be born to parents who are US Citizens.

Why did the Founders want to exclude anyone born to foreigners? To prevent either parent from passing down foreign loyalties or ideology.

The original law defining Natural Born Citizen status read as follows:

“And the children of citizens of the United States that may be born beyond Sea, or out of the limits of the United States, shall be considered as natural born Citizens” – Naturalization Act 1790

“May” be born beyond sea only indicates possibility and includes those not born beyond sea. This was later modified to exclude those born outside US Jurisdiction by

“and the children of citizens of the United States, born out of the limits and jurisdiction of the United States, shall be considered as citizens of the United States” – 3rd Congress, 2nd Session

What remains is best summed up as:

“every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.” – Representative John Bingham of Ohio, a principal framer of the Fourteenth Amendment

This was most recently applied by the Democrat-controlled Senate in 2008 when confirming that candidate John McCain was legally a Natural Born Citizen and therefore eligible for the Presidency:

“Whereas John Sidney McCain, III, was born to American citizens on an American military base in the Panama Canal Zone in 1936: Now, therefore, be it Resolved, That John Sidney McCain, III, is a `natural born Citizen’ under Article II, Section 1, of the Constitution of the United States.” – Senate Resolution 511

      1) Born to US Citizens? Yes

      2) Born under US Jurisdiction? Yes. The Panama Canal Zone was under US Sovereignty until the Torrijos-Carter treaty of 1977 handed it back to Panama.

The Democrat-controlled Senate KNEW that Barack Obama cannot pass the legal requirements. His Father was a British Subject, so he fails the first of the criteria. That is why the DNC provided him with lawyers to fight off anyone trying to legally establish his eligibility, an effort that began with a Democrat attorney named Philip Berg long before the 2008 election.

Obama dangles those apparently fraudulent birth document images on the web to keep the battle focused on the place of his birth – and away from his birth to a British Subject.

He cannot possibly meet the legal requirement for office even if he was born in Hawaii. And he knows it.

      This is a coup.

      • Eric Jones

        Foriegn ideaoligy? NO SUCH THING.

      • RW Ice (@LTCRIce)

concur with all you have stated here. Want to add that McCain is a putz because he understood the citizen requirements and he told us all to shut up and sit down. He basicly backed OBAMA.. Obama is not a legal citizen.

  • kerijay

It’s a shame the officials take an oath to uphold the constitution and and all are afraid of the Obama administration. He won in 2008 from voter fraud and McCain handing him the election (nice speech McCain).

The RNC didn’t have the guts to demand his records be opened and still don’t but the DNC can vet all Republicans even demanding Palin’s emails. I guess we’ll see who running scared by the outcome of Obamacare.

    • Ken

Keri – McCain didn’t hand it to him “accidentally”….besides, you and I both know he would have been just as lame as Sotomo or perhaps even WORSE!

      • DaveH

Worse in the sense of Growing Government more slowly, less perceptively, thus not waking up the citizens.

    • Anthony”Not a foolish Liberal” Rotan

I read the Constitution and according to IT (paraphrasing,) ” ….a person born IN the US, or born TO an American citizen has US citizen designation. Last I heard, Hawaii is a part of USA, AND his mother is from Kansas!!! When are those people holding on to the obfuscating BS

      • Patty

It may make them a citizen but it does not make them a natural born citizen. Schwarzenegger is a US citizen but he is not able to run for president either.

      • SheriffRowdy

It takes two to have kids bro. BOTH parents must me citizens. Not just one. DUH.

  • flajim

Sure hope the Fla Secretary of State sticks to his guns. What the DOJ is involved in is obstruction and intimidation, pure and simple. The only ‘right’ a non citizen has is the right to be escorted out of the country.

As for dead people and felons, apparently all three of these groups are an important part of the Dem base.

    • Brad

seems there was a Texas felon that beat BHO ass in Virginia.

      • SailAway

It was the Primary in West Virginia and the Texas inmate won either 41 or 42 percent of the vote. In Kentucky’s closed Democrat Primary 42% chose uncommitted rather than choose Obama. In Arkansas there was a little-known candidate in their DEM Primary that also got more than 40% against Obama.

According to a compilation of numerous polls (including Rasmussen, PPP, Mason-Dixon and others) Obama has lost ground compared to his 2008 percentages in 25 of 28 states he won in 2008. He has lost a combined 172 points or an average of 5.93 (when D.C. included with the 28 states he won). In 14 (half) of the states he won in 2008, he is down in current polls by 8 points or more. He is even down 8 points in California, one of the most liberal states in America.

Let’s keep up the pressure on all fronts and get everyone out to vote in November to defeat this President. Then we can worry about further investigation of his eligibility when he cannot use the power of the Presidency to intimidate investigators, lawyers, politicians, and judges.

Massive voter turnout is the best counter to Obama team’s planned vote fraud aided by La Raza, ACORN, and others. If the majority of Americans vote then they cannot succeed with their planned fraud.

    • EatTheElite

Eric Holder and the DOJ should be tried for treason!

  • Ken

Where are the dingbats we usually spar with here – all the lame *ss arguments the espouse are dismantled in light of this article, the judge’s ruling and most importantly, Constitutional Law!

Still, should Romney win we won’t have much to celebrate! It’ll be another 4 years of a Rombama like Govt!!!

    • Patty

Not if we don’t stop and hold their feet to the fire. That is what it is going to take.

  • orples

I don’t understand why anyone would even consider a non-citizen eligible to vote in our elections. Please, someone tell me of one/any other Nation that would allow outsiders to elect their leaders? It is time we bring justice and integrity back to America. Getting Obama out of the White House is the first step to progress in that arena.

    • Patriot

orples, agreed! I would take this 1 step further, if you do not pay taxes, sorry no vote for you!

      • orples

I think I’d revise that a bit, to if you’ve ‘never’ paid taxes, no vote for you. I suspect there are a lot of older folks that have been wiped out from inflation and living on fixed incomes that don’t have enough money left to have to worry about taxes. That doesn’t mean they’ve never paid taxes though. We might want to apply that rule to those that have made a career out of living on welfare though. Of course, if that were the case, I suspect a lot of Democrats would be sitting in the unemployment line right now. What we really need to do is put a lid on voter fraud, beginning with Acorn, and then move on to the rigged voting machines. That also includes showing ID at the polling stations, and if you’re not an actual citizen, no vote for you!

      • Steve E

They should make voting fraud and act of treason. That way you can apply the death penalty to it. That should stop the fraud.

      • DaveH

If we could muster the votes to stop non-taxpayers from voting, we could muster the votes to reverse the 16th Amendment which would be a lot more important given that the biggest draw for ignorant voters to the Welfare State is the redistribution of other peoples’ money.

      • Patty

Since Novembers votes are being counted in Spain by a George Soros company, what kind of fraud do you think will take place?

    • FreedomTrain

Removing as many of the Liberal D-Rats and RINO’s in congreess will also greatly help in this process. Getting as many conservatives in Congress, will thwart the actions of the WH, regardless if Romney gets elected (And I am No Romney Fan), or God forbid is ZERO is re-elected.

      • orples

Right now, my biggest fear is losing our Sovereignty altogether. Look at how the UN is trying to take over. I’ve read quite a few stories in the recent past that really make me wonder how much longer America will maintain her identity. I wish the people had enough brains to put Ron Paul in the White House, although I suspect he would be assassinated before he ever got the chance to take his oath of office. Look at what happened to JFK when he tried to expose the Elite puppet masters and introduce the Silver Certificate to compete with the Federal Reserve Note. I sometimes, wonder if, short of a repeat of 1776, America even has a chance at maintaining her borders. And look at those drones Obama is introducing. Maybe I have a vivid imagination, but I think we are being set up to be overtaken, whether we like it, or not.

    • Average Joe

The last time I checked, everyone pays taxes of one sort or another. Do you buy gasoline?…You pay taxes on that. Do you buy any products at all?…You pay taxes on those products. Do you own a home?…you pay property tax on that home. Do you own a car?…You pay taxes on that too….there isn’t much that we don’t pay taxes on (yet).

Now, if you are talkiing about Federal income tax…please show us the law that makes us liable to pay them…..(the Federal Government and the IRS…have been unable to produce such a law, so I am patiently awaiting your proof of such a law).

Sadly, John Cryer passed away on June 4, 2012, but he has left behind a wealth of information and hope for the citizens of America.

Enjoy the videos, site link and wealth of information contained within.

      Vote for America, Vote:
Ron Paul / Andrew Napolitano 2012!

      • Average Joe

Sorry, my bad. I meant to say “Tom” Cryer…had a phone call going on with a friend while writing…his name is…John….oops.

      • orples

You are absolutely correct, Joe. I stand corrected. How could I overlook all of the taxes on everything from A-Z, including inflation? I was stuck on the illegal Federal income tax, admittedly when I replied to ‘Patriot’. By the way, you think like I do. I would love nothing more than to see Ron Paul, teamed up with Andrew Napolitanto, take the White House. There would be real hope for this Nation. With the two of them working together, we might have a chance of resurrecting our Constitution. I can’t believe the masses can’t see that FACT! Maybe at the very least, Dr. Paul will gather the necessary delegates, to be heard in Tampa. Wouldn’t it be something, if the people actually listened to him, and slid him in through the backdoor?

      • Average Joe

Over the last year Ron Paul has been asked several times ,who he would choose as a running mate. Each time he has replied,”I really haven’t given it much thought, but I sure do like Judge Andrew Napolitano”. I am guessing that will be his choice.
For now, all we can do is keep grabbing those delegates and hope that we can pull it off at the convention, in August ( I personally believe there is going to be a rude awakening for the GOP and Romney supporters in Tampa). I am planning to attend the convention and hope to be part of a New Beginning for America.

        Vote for America, Vote:
Ron Paul / Andrew Napoltano 2012!

  • JDN

I lived in Florida for over 20 tears and Snow Bird voting is a real problem . They own a winter home in florida so they get to vote then they get an absentee ballot from their home state and vote twice . Scoff all you want it happens alot . On a side note it warms my heart to hear Democrats challenge Obama .

    • eddie47d

Federal Election ballots are not forwardable even for temporary voters so only a few get under the radar.

    • skippy

I agree with that side note JD!!! :)

    • Average Joe

I have been living in Florida for 24 years now. I don’t really see the “Snowbirds” as being a problem. On my street (and community in Central Florida), most of our “snowbirds” don’t start arriving until the first two weeks of December and leave in the last two weeks of March.
So, the General Election isn’t an issue. On my street, there are five families that live here year ’round..the rest are from Maine and while they are down, we discuss politics and voting….and all of them say that they vote in thier home states and not in Florida ( that includes absentee ballots)… None have ever given me a reason to doubt them (especially since all of thier ID’s etc are from thier home state and not Florida).

      I just don’t see it as a problem…..

  • Sirian

I fully agree that Obummer is not eligible to hold the office of the President – there is no longer any doubt to that. An immense left denial would persist and in actuality, never end. Yet the juries “doubt factor” from the evidence available is growing closer and closer to “nil” than ever before. But from this lies a problem which is undoubtedly the main determent. Any action being taken by any member of Congress concerning this issue will be grandly scoffed at by the majority of Congress if not totally ignored. BUT, IF Obummer were brought up for Impeachment due to his “ineligibility” and it was carried out to it’s fullest, what would the end result result in? Simple, everything – laws, directives, EO’s, agreements with foreign countries/powers would be stricken down and or negated immediately. Thus, ObummerCare would be non-existent, NDAA would be in the same position, basically, as well as all the rest. With that being the trump card, so to speak, Congress as well as the SCOTUS and several other contributing departments, agencies etc. would not be in the best of light due to what has taken place since Obummer has been in office. What number of other persons, those that are the side players not commonly seen, could then also be brought up on charges of one type or another that may be very much deserved? This could lead to who knows how much turmoil on Capital hill along within several heavily left leaning states and municipalities – Chicago/New York?? Florida is but an example of what should would be boldly followed by all states whether it pertains to voters or otherwise. Arizona is another that has been forthright in their actions whether it lead to lawsuits by Holder or not. To many it is the right thing to do. If only the RNC would have done the right thing for our nation in ’08. Will they now? Don’t count on it. . .

    • Ken

The facts speak for themselves – he NEVER WAS eligible – which leads us to the question, how was all this overlooked in the FIRST place!?

This is a crime of major magnitude – he is a criminal, a terrorist AND a turncoat. How is all this not TERRIBLY apparent?!

He has broken his oath of office and is a tool of his puppet master Soros (etc.).

      • Michael J.

Would you like to know how to get the MSM to do their job? Convince journalist to properly vet candidates?

The results would be breath taking, and overnite transformation. We would be presented with every aspect of the candidates life since before his ancestors stepped of the Mayflower. Every horse thief or snake oil salesman, whether real or invented would be dredged up and plastered across every medium to include TV, movies, internet,Billboards,Blimps, municipal busses, T-shirts and bumperstickers. It would be blasted 24-7-365 until everyone on the planet has heard about it more times than the OJ trial.

That’s how we get them to start doing their job again.

      • Patty

Pelosi and Reid vetted Obama. Remember, we have to pass it to see what is in it. They did the same thing with Obama.

    • tiredofbums

Please read carefully. We do not want to impeach Obama. You cannot impeach someone who was never eligable to be president. He knows this. Congress knows this. The senate knows this. Now you know it.The supreme court would have to decide if he is in fact a usurper. Articles of impeachment do not include usurpers. There is a reason for this. Law sets precedent. If he should win by some imaginable luck, then any one who is a non citizen could site this precedent and become president themselves. It would be better to get all the proof we can about our ursurper, then try him, convict him and then execute him in public. He has made a fool and mockery of our nation. I personally will sell popcorn and candy if there’s public execution

      • John Illinois

While execution by hanging would be the appropriate penalty for Obama, life Imprisonment in solitary confinement, or even exile to Kenya or some other hell hole in the 3rd world would avoid making him a martyr, plus, of course, wiping out everything he did, including Sodamyer (SP?), and Kagen (SP?) to the Supreme Court.

  • Patriot

The silence of the liberal/progessives that normally post is deafening!

    • eddie47d

Not really because it is the same tired old argument on everything and the right political side is often as wrong as the left political side. On the Florida issue they have 11.2 million voters where 41% are registered Democrat and 36% Republican. Independents hold the key in most states these days. Colorado has 1/3 in each group so a win is never guaranteed on either side. In Florida 2,700 non-citizen voters out of 11.2 million is a drop in the bucket and apparently they are now purged.

    • Michael J.

They are all Vampires, haunting the darkness doing what Vampires do prevents them from being early risers. This is why the mere mention of the Christian Cross burns them horriblely and sends them into a zombie-like rage, growling and fervently ripping the flesh of anyone within their grasp. So be careful what ye wish for, such inadvertent incantations may roll back the stone.

    • skippy

Do you think Patriot that they are licking their wounds in light of the GREAT STATE of Wisconsin??!!! What a great day for America/American’s!!! :)

  • hipshotpercusion

When I moved to Florida and got my drivers license changed over not only did I have to show a real copy of my BC but I had to first register to vote so that I could prove I lived here. Just for fun, I asked the clerk if what O-Bozo presented as a BC would get him a license in Florida, she laughed out loud. Get the gay Muslim out of our White House now!

  • ImListening

Wow, a weakness has been found in the Obomatronics System. Perhaps we can still hope and pray for a complete meltdown of the Progressives. Perhaps the running out of Our Money has made a cohesive response they didn’t expect. Or maybe it’s the Wholesale Trashing of our Constitution. What ever it is, it’s great to see.

  • Paul Larson

Wisconsin; Walker only won by 3%, I wonder how much more he would have won by if there was a voter I.D. law in place, and if you think there might have been some voter fraud here, just wait til November. With the votes all being tallied in Spain, there is no way to investigate fraud at local levels, so I hear……..scarry

  • ImListening

Yes, I read that article too Paul. I wonder if Soros owns the Spainish Voting Machine Company? Our future and freedoms all depend on it. That’s a great way for our political system to wash their hands of any wrong doing.

  • Keith Breedlove

Keeping non-taxpayers from voting would disenfranchise 47%+ of the tax-eligible population, and what’s the likelihood of that passing?

  • RichE

As a result, the State of Maryland declared Lafayette — and all of his male heirs forever — “deemed, adjudged and taken to be” natural born citizens of the State of Maryland:

I wonder if they can run for president?

  • RichE

The term appears in a 1785 letter from future President John Adams to future President Thomas Jefferson:

“The Briton’s alien’s duty is a very burdensome thing, and they may carry it hereafter as far upon tobacco, rice, indigo, and twenty other things, as they now do upon oil. To obviate this, I think of substituting the words ‘natural born citizens of the United States,’ and ‘natural born subjects of Great Britain,/ instead of ‘the most favored nation.’”

I’m not sure what Adams meant.

  • RichE

Pre-Constitutional seemed to use “natural born subject” and “natural born citizen” interchangeably.

  • RichE

“natural born citizen’” can be traced to “the Law of Nations” by Emer de Vattel’s ten years after the constitution was written when a British translator translated the word “indigenes” to “natural born citizen”.

  • boyscout

Democrat Michael Voeltz and Florida Circuit Judge Terry Lewis would be wise to closely watch their backs as we all know that accidents do happen. For quite some time now noncitizen voters, votes from the grave, hung chads, and tweaked electronics all seem especially problematic in the Florida system. No big problem there as we can count on some as yet unnamed official to calmly explain it all away and decide for us who actually won. And there might actually be some difference between really voting and pretending to vote; hey, who knows?

  • Silas Longshot

0bama’s ineligibility is key to keeping him off as many state ballots as possible, but with his homey Holder in charge of the “justice” department, this issue will be stonewalled for years, never mind being resolved by November.
And the zombie voters and illegals are crucial for throwing the election, which is why Holder goes after every state attempting to purge the dead from the books or require voter ID.
Gonna be a long summer, and he may pull something in desperation to keep power.
    Prepare, click the name.

  • D.O.T.C.

I don’t for a second believe Obama is legal. But even more important than that is his atack on our liberty and freedoms. If legal that makes him a traiter to our constitution.if not legal he is an enemy hijaking this nation.Of coourse that my opinion.
