Supreme Court To Hear Chicago Gun Ban Case

Supreme Court to hear Chicago gun ban caseIn one of the biggest cases to come before the Supreme Court in years, justices are hearing arguments today in McDonald v. Chicago over the city’s 28-year-old handgun ban. It has also prompted both proponents and opponents of the ban to once again voice their cases.

The court’s role will be to decide two fundamental questions, namely whether strict state and local gun control laws violate the Second Amendment rights and whether an individual’s right to own a weapon extends beyond federal jurisdiction, according to CNN.

Community activist Otis McDonald is the key plaintiff in the case, arguing that the ban should be overturned.

"We are in a war," he told the news provider, adding that the case is about "the innocent law-abiding citizens against the drug dealers and gang bangers."

However, Illinois Council Against Handgun Violence (ICHV) says that ruling against the ban would result in more gun suicides, homicides and unintentional shootings.

"The court must not ignore the longstanding and robust history of effective gun laws in this country for purely political or ideological reasons," said Thom Mannard, executive director of ICHV. He added that the case was "completely manufactured" by the gun lobby in order to dismantle America’s gun laws for their own profit.

The ICHV also cited polls that suggest an overwhelming majority of NRA members and gun owners nationwide favor common sense gun laws.

Meanwhile, critics point out that although Chicago’s ban is one of the most restrictive in the U.S., the city continues to be among the most violent in the nation.

    Yeah, like the purely political or ideological reason that it is against the Constitution. These Liberals are unbelievable. They are all for saddling us with every sort of law imaginable, but they don’t want to obey the main law of the land themselves.
    In fact, I had neighbors, both of whom worked for the local police department, who told me that it was okay for them to break the law because the laws were meant for people that didn’t know any better. You might guess which Political Party they voted for.

      You’re forgetting something about liberals: they don’t follow the main law of the land, the U. S. Constitution, because they consider is an illegal document. They only follow it if they can find something in it that they can twist to further their agenda.

    Did you ever wonder why gun control is always tried as a remedy to high crime areas. Most of these cities are troubled with minority gang problems. The people the laws disarm are the innocents. Does anyone really believe that criminals will obey the laws? It is also amusing that people in western states can have pretty much whatever they want in the way of firearms, but in reality, don’t have as much to fear from criminals as do the people who live in eastern cities?

    The NRA is brilliant in selecting an black man to be the party represented in Chicago and a gay man in SF who claims he needs protection from gay-bashers.

    I lived in the Chicago suburbs for most of my life and can’t recall how the ban on handguns came into effect. A party on FOX News last night said it was the “will of the people.” I don’t think the people ever voted. It was the “will of city council.” Does anyone know for sure how this ban came into effect?”

    No one seems to remember that during times of violence, people have called for police and not received assistance. Some tried to sue and courts have ruled that the right to police protection is “general” and not specific, so people should be able to defend themselves and sorry, but handguns are the best means. Illinois has a firearms owners ID card which is issued by the state police and is required to buy ammo or any firearm. Chicago is still suffering through increasing numbers of murders involving teens. One was beaten to death with a board outside a school. Reasonable gun laws are OK, but Daily doesn’t know what that means. There should be no reason the court should rule against the NRA suit. If it is constituational that’s all that matters. This federa vs. state is bogus. How can you be deprived of your rights in one area, but not in another?

    I live in Seattle, and as you say, when people call the police for assistance they don’t always receive it. For twenty-nine of the last thirty-five years I have made a living as a security officer. We are not allowed to be armed with any kind of a weapon. If we get into any type of trouble we need to call the police for help. I would say that about ninety percent of the time when I have called the police for help they have not showed up. When I called them back to find out where they are, I am told that they had already been there and had cleared the scene.

    For fourteen of the last thirty-five years I worked for the security department of the largest bank in Washington State, now part of Bank of America. Part of my job was monitoring the alarms for all our bank branches in the state. When we got an alarm from one of our Seattle branches, and it was a confirmed robbery, Seattle PD would tell us they would not respond until we told them who robbed the bank and where they went. We’d explain that we were not at the branch and did not have that information. The only way we could get them to respond was to remind them that our next call was to the FBI and we’d be informing them of SPD’s failure to respond. Then, and only then, would they respond. We finally stopped telling them if it were a confirmed alarm.

    The site I currently work at is in a drug area. I work alone and am unarmed. If I need help, I’m screwed, since I can’t count on the police showing up if I call them. So, people have to rely on their own means of protection because the police can’t be relied upon to show up.

        I don’t even think felons should be deprived of the right to self-defense guaranteed by the Constitution. If they’re deemed to be potentially murderous then keep them in prison. But Misdemeanors? Unbelievable.

    It is indeed interesting that Chicago has what is considered the toughest gun ban law in the country, yet violent Gun crime continues to grow. It is also interestering that other states belive we have a right to defend our self, family,and property. But our elected officials in Illinois want to keep us unarmed and at the mercy of the Chicago criminal element. Apparently our officals care more for the criminals than the law abidding citizen, curious how that works out huh? Makes me wonder what hold the Chicago Criminal element has on our elected officals?
    I say let Chicago keep their Gun Ban Law since it is working so well (sarcasim) but let us downstaters arm our ourselves with concelled carry. That way when the criminals have depleted Chicago we can defend ourselves when they come downstate.

    If this idiot is arguing that gun laws are “EFFECTIVE” at stopping crime, and bothers to put any “FACTS” or “STATISTICS” forth to the justices, they will laugh at him for DISPROVING his own statement, and his side of this case.
    Gun control has NEVER stopped, deterred, or even diminished crime. It has always had the OPPOSITE EFFECT! Statistics prove this, and have shown that crime goes UP commensurate with gun control being established, because criminals NEVER turn in their guns, only some law abiding citizens do, which leaves them defenseless against the criminals.
    It has been proven in our own cities, as well as in other countries such as Australia, and Canada. Why don’t they just admit what it’s really about?     MOST AMERICANS SAY CITIES HAVE NO RIGHT TO BAN HANDGUNS

    BELLEVUE, WA – A new Rasmussen poll has revealed that an overwhelming majority of Americans reject the notion that cities have a right to ban handguns, siding with the Second Amendment Foundation’s position in its lawsuit to overturn the Chicago gun ban.

    Oral arguments in the SAF case were heard by the U.S. Supreme Court on Tuesday. Court observers predict the high court will overturn the Chicago ban, thus incorporating the Second Amendment to state and local governments through provisions in the 14th Amendment. Results from Rasmussen’s national telephone survey found that 69 percent of the respondents say cities have no right to ban legal handgun ownership, while 25 percent believe cities can ban guns.

    “The Rasmussen survey clearly shows that Americans have grown weary of anti-gun municipal demagoguery,” said SAF Executive Vice President Alan M. Gottlieb. “A victory in our case before the Supreme Court should send a clear signal to gun prohibitionists like Chicago Mayor Richard Daley that arbitrarily disarming law-abiding citizens under the guise of fighting crime is an idea that has no place in this country.”

    SAF is joined in its case by the Illinois State Rifle Association and four Chicago residents, including Otis McDonald, for whom the Supreme Court case is named.

    The Rasmussen poll also found very little difference between current public sentiment and earlier surveys that noted 70 percent of American adults believe the U.S. Constitution guarantees the individual right to own a firearm.

    “For years,” Gottlieb said, “the anti-gun lobby has been claiming majority support for its Draconian agenda, but polling data like this new information from Rasmussen shows that the public is not about to surrender a significant civil right. We believe the Supreme Court is on the verge of expanding the scope of that right by applying the Second Amendment to the states.”

      Let me make it very clear. The Supreme Court will not expand that right to the states or anyone else. Hopefully they will do what is right and confirm that right to the entire country. We already have that right. It is the God-given right of self defense as affirmed by the Second Amendment. “The Right of the People to Keep and Bear Arms Shall Not Be Infringed.” How much clearer can you get? What part of Shall Not Be Infringed do you not understand?
