Supreme Court Sets Schedule For Obamacare Hearings

On Monday, the Supreme Court of the United States agreed to take on three separate cases challenging the Constitutionality of President Barack Obama’s healthcare overhaul.

The Court set aside five and a half hours for oral argument that is set to begin in March regarding the Federal health law, according to SCOTUSblog. The discussion is to be segmented to address challenges to the legislation separately: two hours of discussion will focus on individual mandates for health insurance, 90 minutes will focus on whether the law can even function barring individual mandates, one hour will be spent discussing whether the Anti-Injunction Act bars some or all of the challenges to individual mandates, and one hour will be dedicated to the Constitutionality of Obama’s planned expansion of Medicaid under his healthcare law.

The Court reportedly examined appeals from 26 States regarding the healthcare overhaul to create the schedule and issues of discussion. It did not review petitions by consumer-advocacy group Thomas More Law Center and three of its members, or by two Liberty University employees.

According to The Associated Press, Supreme Court experts already are trying to speculate on the outcome of the hearings, which will fall sometime around the final few months of the Presidential election season. Many experts believe that the law will be upheld by a lopsided vote, with Republican and Democratic appointees ruling in its favor.

    Perhaps they should add in 2 hours to discuss the real impacts of this law. For example, health care premiums have increased for everyone; many compnaies will drop their employees and pay the penalty – leaving those employess worse off since they’ll have to buy their own insurance with the modest money given to them by the government; Medicare and Medicaid will get cuts to benefits. We’re doing all this so 30 million people who lack insurance – but can get free care at emergency rooms – can now get preventative care. Haven’t we learned after 30 years of HMOs and preventative care that preventative care is a fallacy? For people in Medicaid, the trade off of losing dental and vision care so they can get preventative care is simply ridiculous. This 2-hour session would be the most important, as it would show Obamacare doesn’t improve our health care situation and it doesn’t decrease costs.

        Capitalist, I agree. We can also add the complete failure of our safety nets. If you become unemployed, unemployment compensation doesn’t even begin to cover your expenses. It’s another mismanaged government program that started as a good (albeit socialist) idea. The ultra rich and the poor are unaffected by our economic problem. If you are poor and lost your job, you still have free housing, food, health care, and utilities. If you are a middle/upper middle class worker, you’ve been added to the uninsured rolls.

        Sounds more like no change to me.

        Considering the “right bias” of the setting justices I would think it clear what their desired final ruling might be. However, it is a Court and any final outcome I would expect to be based on legal merit and not some personal preference.

        This professional prudence is what I would expect of any sitting court justice. Now, ~ where we get it is another matter, as I remember one court judge installing 43 for his second term which goes far beyond being highly irregular.

        This decision should prove most interesting as it will be viewed by all in the naked light of day.

      Unfortunately, that proposed two hours would include opposing view points that show how universal health care is great. Never mind that if you truly listed the statistics from those other countries you might find it is not the pretty picture that the progressive paints. For example they have lower infant mortality (after removing certain categories of infant deaths in those other countries that get counted here in America). It would be a nasty numbers game. Two hours wouldn’t be enough because you would have only about half that to show that the law was bad, and knowing that the opposition is going to play loose with the statistics, you would have to spend your hour (planned in advance) to address the opposition by showing the lies to the numbers you suspect they will bring forward. Such as clarifying infant mortality in common numbers supporting universal health care, showing that they ignore whole swaths of deaths that we include in our statistics in America.

      The optimist in me hopes that we’ll see health care repealed. The pessimist in me knows it will survive the Supreme Court. That it will have to be repealed by Congress… or just by the total collapse of America. Right now I only see two paths. Libertarians and the Tea Party take back America or the total collapse into a totalitarian government (in which case we won’t see the end of most of the government intrusions until a future generation relearns the founding principles of America).

        Obamacare is designed to be a stepping stone to universal health care. After millions of people get dropped by their employers due to the low penalty fee vs high cost of insuring them, they will go into government exchanges. Tax payers will fund those exchanges as will private insurance – just as private insurance funds Medicare/Medicaid. Doctors/hospitals lose money on Medicare/Medicaid people, so they charge higher fees to private insurers. Once there are more people in the govt programs, private insurance will become so expensive that no one will be able to afford it. Companies will have to drop employees due to the costs. Anyone who knows people from countries with socialized medicine already knows the realities. Ignorant people who simply listen to their TVs believe it is utopia. Do any of these people see Europe crumbling due to their socialist programs? Do any of these people realize that Medicare/Medicaid are 2 of the biggest drains on our economy? Why would we want the govt to manage more health care programs when those are poorly mananaged and full of waste and fraud? If the Supreme Court doesn’t strike this down, very bad days are ahead for the US.

      You’re right….preventative care is a fallacy…..when you rely on what your “looking out for the health and wellness of the Americans” health fallacy people tell you. Why would “they” the FDA allow Giant Companies like Monsanto to pollute all the Americans food, with ingredients that are known to cause all kinds of different sicknesses in the body, and then come out with their great food pyramid? Do you know that if you didn’t eat all these food, that would be preventative health care?         See that Perry gets to be our next President, from Texas. They have proved their efficiency, intelligence and humanity.
        He comes in like a Tsunami, wipes away all laws that help poor and middle classes, drops all allies, starts a few wars, we get the country working on making bombs, sends our young people to fight the wars.       It is extremely dangerous for Courts to focus on the “practical effects” of a law rather than its compliance with the Constitution. The decision “legalizing” Social Security completely ignored the Constitutional issues raised by the plaintiffs; instead the majority opinion simply asserted that if they ruled Social Security unconstitutional, old people would be starving in the streets, so they weren’t going to let that happen. (This, BTW, was a false choice fallacy; other means of ensuring the care of the elderly would have been found, and not necessarily by a government agency.)

      The practical effects of a law are properly the business of the other two branches of government, particularly Congress, except where the effects include violations of Constitutional rights or contradict previous statutory law without proper amendment by Congress. In the case of Obamacare, the practical effects include numerous egregious violations of the Bill of Rights, the 13th and 14th Amendments, and the limits of Congressional and Executive authority in the original body of the Constitution. The individual mandate is only the most prominent of these. A listing of these with a brief description of each violation would be at least as long as the Obamacare bill.

      Weren’t you at least a little suspicious when, all during the pumping up of obamacare, Pelosi, Reid, and even Obama all claimed that they would be EXEMPT from his wonderous program for the rest of us? They will, under this “law” be allowed to keep their current healthcare perks AT TAXPAYER EXPENSE THAT INCLUDES PREMIUM PAYMENTS! Just like the Student Loan garbage that is buried in the obamacare law, that exemption is there for anyone who cares to read it. The US Supreme Court should declare the entire bill/law UNCONSTITUTIONAL.

    Why are the voters of America not being allowed to vote on this issue? The scoundrels in Washington are deciding these issues for the American people and we know they do not give a damn about anyone but themselves. If this nation was a true democracy, we the people should be given the right to vote on an issue of great importance that directly affects all of us. The scumbag politicians know that two thirds of the American people will vote to reject this illegal law – obamacare. We have no rights anymore they have been hijacked by the fatcat politicians who go to Washington DC for one purpose – to enrich themselves at the expense of the voters and public that voted them into office.

        So can you explain what happened to the Republic of Mexican or that it couldn’t happen here?

        North America has enough laws to make every man, woman and child a criminal at will. The selection of which laws to enforce insures winners by selection. If you are in the loop GREAT! If not, we don’t approve of whinny sore losers.

        As I fail to see how just changing a label to uncertain unknown ingredient hoping for a cure is any guarantee to success.

        How might a republic, a empire of laws change what is happening today?

        The majority would not longer rule? Then who would? and how are those mountain of laws any different from today’s mountain of laws?

        All valid question I would think.

        Then too, there is this small matter of republicans that are not really republicans and Christians that’s not really Christians to deal with.

        Will two democrats and one mule equal a Republican, one Christian and a elephant? How’s this labeling process suppose to work. Like Wall Street?

          When a representative in a republican government accepts bribes or otherwise takes undue advantage of his office for personal gain, he no longer represents his constituents, he represents himself and the people who bought him. Likewise, when a representative defers to tenured staff and executive bureaucrats for information and advice without independent input, he fails to represent his constituents. When a representative seeks to expand the influence of his office by accreting power to the government outside the proper scope of the government, he steals power from his constituents. When this happens on a regular basis, the republic becomes a republic in name only; it has devolved into an oligarchy. This is what happened to Mexico, and it is a serious problem in the U. S.

    I’ve been saying this for sometime, but the Obama healthcare law has nothing to do with health, and everthing to do with insurance. The problem with this plan is that the doctors were not considered. Soon we will have all kinds of insurance, up to our eyeballs (no pun intended) and we will still have to pay for medical care. Doctors are not required to take insurance. My mother’s doctor has already told her that he will no longer accept Mediscare patients and that she will need to find another doctor. We are only beginning to see the tip of the iceberg.

      It isn’t just the doctors who were not considered, Bev, but the people themselves were not a consideration. obamacare and romneycare are the products of a powerful lobbyist group representing insurance companies and the people who are their primary backers…just as they won more than a decade ago the fight to take the final medical treatment decision from the physician and limit you to a selected number of medical providers (HMO), they are now fighting to determine whether you have the right to live or die because it is they who will decide the treatment plan and NOT the medical practitioner (who will face criminal charges and imprisonment if he/she fails to follow those orders). Not one part of this so-called law is an improvement for the citizens and it denies all of us the right to make an informed decision. We will have no need for Advanced Directives with this so-called law because the Federal Govt will decide who lives and who dies under obamacare. And isn’t it interesting that part of the law exempts the ones who imposed it upon us? They may retain, for life, their current health perks and receive only the best care available while their appointees tell the rest of us we cannot have the proposed medical treatment deemed best by our personal physician.

    The News groups, CBS, CNN and even Fox never cover the waiver list that exist. Look on the HHS.gov anf the list considts of large and small corporations and union entities that do not have to participate in Osamacare.

      The waivers have to do with how the premiums are collected and paid to the insurance companies…it has NOTHING to do with the treatment plans which will be decided by the medical panel appointed (like federal judges) by the incumbant administration. In other words, the person working at an ‘waived’ company/corporation pays the insurance premium as they are currently doing. However, when it comes to medical treatment decisions, the physician must still present it to the ‘death’ panel and abide by THEIR determination of what is ‘good medical practice.’ These members of the death panel, by the way, are NON-MEDICAL INDIVIDUALS WHO HAVE NEVER BEEN TO ANY MEDICAL SCHOOL…and we will be forced to accept THEIR decision. Because, if the physician fails to follow those orders then he/she will be criminally charged, tried, and if convicted, will serve many years in prison, be stripped of their license and be forced to pay a hefty fine as well. This law already stipulates that those with life-threatening illness/injury will be denied medical care if it is shown that they will NOT lead a viable life upon recovery; this includes neonates with severe medical problems (ie: premature infants, infants who develop serious life-threatening illness where a recovery means they will be mentally deficient). This law also ends hospice care, which is why Pelosi and Reid were furiously promoting the brochures on how to care for the dying at home–sans hospice–when they were fighting to have this law passed (and mind you, it was the majority democrats ONLY who voted for this ‘law’–so is it legitimate from that perspective?). I read this bill and found non-related issues imbedded in those 2007 pages and it included how the government was to get control of the student loans—what has that got to do with healthcare??? There are other spurious pork-barrell issues buried in the obamacare law. If none believe this, then read it for yourself. I am appalled at the things this government has done under the guise of obamacare in the removal of our legitmate civil rights covered under the Bill of Rights in the US Constitution.

    Michelle Bachman may have it right when she said “Everyone should pay taxes even if it’s ten dollars, the price of a happy meal”,Just like insurance, if everyone paid a little today it would reduce the tax burden on the taxpayer.When the uninsured go to a doctor or a hospital today the rates are at the maximum and not negotiated down like the rates of the insured.The taxpayers are the ones that are left paying those bills of the uninsured because it’s the law.It should also be a law that everyone has to pay into insurance so the taxpayers don’t have to pay for the losers or just plain unlucky.

      Couldn’t disagree more……We need to REDUCE the revenue to the government if we ever wish to reduce it’s size and ability to influence our lives, and regulate everything we produce and do.Revenue neutral or revenue increases mean keeping government big or growing it. The two go hand in hand…always have and always will. I don’t want to see the 47% who don’t pay in have to join us in being plundered by government….I want to join them in being free from government theft. We cannot solve our problems by using the same thinking that got us into them.

Now don’t be like this other person that’s says you have a choice and you can buy from any private company you want. That is a hoax perpetrated on the citizens. They all charge the same and some just charge more for added goodies.Either you pay their premiums or plain and simple do without.

        Dude, you can tell any corporation it can keep its products because you won’t buy them. They can’t touch your or your money for that. Try telling the local sheriff he can keep his handcuffs because you won’t pay the property taxes to prevent being evicted from your land. Better yet, try telling an IRS agent you won’t pay for research on cow flatulence or any one of the other millions of items Congress deems worthy of your funds.

    the supreme court need’s to amend the law and throw it out what they realy need to do are start cracken down on the Insurence company’s hospital’s doctor’s over charges like they give you a asprin that cost a penny but charge you two hundred dollar’s hand it to you now that’s what rong with the medical system and insurence corperation’s just look back when nobody had any kind of insurence like car,home,health,life,insurence dotor’s, lawyer’s hospital’s lived a hole lot better and had more then they do now with out debt now everybody owe’s the insurence corperation’s every month and it goes up every day so throw the health care law out because just like the song goes under the health care law when you reach a serten age your going to die with no med help

      The insurance company only pays what the hospital/physician charges, the insrance companies actually do not set the fees. When my spouse was hospitalized, I took his medication to the hospital for them to dispense it in order to cut some of the costs. Well, imagine MY surprise when the itemized bill showed the hospital charged me $200 to dispense the more expensive drugs and $75 to dispense simple Tylenol!!! After challenging them over these exhorbitant fees (and notifying my insurance carrier of what the hospital did–who, by the way, backed me 100%), I had those charges eliminated from the final bill. I also challenged the hospital for other fees and was able to get some reduced. Of the nearly $6000 bill, I was able to knock it down to just over $3500. It is outrageous that you have to be that diligent in scrutinizing what you are charged–whatever happened to honesty and truthfulness?

      I think that every American should join together and kick ALL of these S.O.B’s OUT! if we sit back and let them get away with this type of “law” it is our fault for letting them get away with it. So what will they do next?
      I think that the majority of Americans know damm well that this has nothing to do with health care and everything to do with the government controlling yet another private sector enterprize ( insurance ) When the government rules more than 50% of the economy we will all be SLAVES….

    The Supreme Court has become another political body and as such will rule like one. Obama was very cavaliar in having this taken up by them, and I think that he is “pretty sure” it will end up in his favor. First of all Kagan must recuse herself since she was in the WH when the Obamacare was being written up and gave her input. But she will not. The Supreme Court should take ONE HOUR or more to look at ALL the exceptions that have been given, and ask why they have been given to the Unions and other big corporations, while “ordinary” people are having this shoved down their throat. Every time I (a Senior) go to refill a pill, the generic has changed and if I ask for the old generic I am told Medicare will not cover it anymore. So, who is making money on this?? It has become so ridiculous. A friend of mine of suffers seizures had her generic changed on her, and after years of using one generic and keeping well, this change of generic gave her a seizure after 8 years!! And prices have skyrocketed, not gone down as was promised. And like Pelosi said, you have to read it to know what is in it, and it looks like many surprises ahead. Let us see just how separate a body the Supreme Court is, and whether politics does play a role in this decision.

      Unfortuantely, Rachelrao, Kagan will NOT recuse herself–she didn’t in another case where she made a decision on it prior to her appointment and she won’t now. Also, notice that all 9 Justices will make the decsion and the prediction is a 5-4 split; the split in whose favor is nothing more than speculation at this point and it depends on who is presenting the argument. Some say the split will favor obama, others say it is in favor of the American public.

      Sorry, John, unless you can prove they committed a capital offense, execution is not the final sentence (unless, of course, we are like China, Korea, Russia, or the Middle East) these crooks can receive. However, there are enough charges that, if laid back to back, can put them in prison for life–those 5 – 10 felonies can really rack up the time! I do agree that they should be ousted for treason and sedition, then tried and convicted for their crimes against America.

    All we can do is hope that the US Supreme Court vots for the majority of the American Publc…it is shameful that the two appointees by obama are to be on the review panel since they have a vested interest in obamacare. The reality is that both obama appointees should be barred from the decision-making process, leaving 7 of the 9 Justices to hand down the final verdict. Personally, the bill is totally unConstitutional because it not only reflects the over-reaching of the obama administration, but because the so-called law contains UNRELATED ISSUES never discussed publicly (student loans for example) and it was passed illegitimately by our congressional members.

The best thing they could do is rip that whole thick book of their’s up and start over with people that are honest and caring, and look at the reality of true changes that need to be made and then change them. Those that are trying to get something for nothing, unless there is a real good medical reason, shouldn’t. We are being sucked into a system of thieves and this is not what we want, nor is it right. Yes, change has to come, but the right kind of change. We have to stop this form of abuse by phone calls and petitions.     Whichever way the SCOTUS rules, we need to be wary. If Obamacare is struck down, there’s a strong possibility that the democraps will ignore the SCOTUS. What do we do then?? As we know, today’s leftwing democrap party has nothing but contempt for our Constitution in many aspects of our lives. And if the SCOTUS upholds this raw deal, then the answer is simple. We need to defeat BHO and as many of his socialist democraps as possible in 2012. As for the primaries, here’s another good reason to defeat the RINO Nitwit Romney. He says he will repeal Obamacare, but what will he replace it with?? Perhaps with something like Romneycare?? We already know that’s really no better. While the majority of Americans oppose Obummercare, it’s pathetic that opposition is not yet a landslide. The only ones who should still favor Obummercare should be the drones who think they’ll get something for nothing, as well as the politicians who forced it upon us (while exempting themselves of course!!) Here’s a good riddle: What should proponents of Obummercare do with it?? Answer: The same thing they would do with Preparation H!!!!

    Juan Jimenez must have been reading Hitler’s Mein Kampf the Nazi bible. Hitler devised a very cheap and effective health care system. He ordered all mental patients, people with TB, VD and permamently cripled patients, including Germans, to be euthanized. The empty hospitals were put to other uses. Imagine the savings. He also sent all polical and potential enemies, again also Germans,Communists Jews, Poles, Soviet POVs and subhumans to death or concentration camps. Death camps got rid of people quickly by gassing them, the other camps killed the inmates slower by starvation and cruel overwork. My half German father was taken away without charges or due process to an infamous camp and was dead in two months. He was deemed to be a pontenial leader of actions against the Nazis. This didn’t cost the Nazis much money because they recovered gold and other valuables from their prisoners dead or alive. How do I know that ? I lived five years under Nazi occupation.

    Just think that by starting wars like Hitler, the arms factories would be running 24/7 ensuring full employment along with plunder of defeated countries. But the much maligned democracies put a stop to that evil.

    Obama is jumping the gun on his Obama care! But isn’t that what he always does? His recent statement telling the American people that he would have to use his executive power to get things done because congress won’t back up his jobs stimulus bill!
    Now he is jump starting his Obama care with the same dictatorial power. He is powering up the health care process by appointing the brown shirts who will be dividing up a free health system to control everything from hospitals, a common cold and abortions. His ACORN and SEIU union groupies will be looking for big paychecks and those great government benefits. Another part of his invaders will be taking over the control of medical equipment and the gold mine drug market. He is making good on his promises with his progressive supporters before the Supreme Court rules that Obama care is unconstitutional. Any one that has common sense who has read the constitution knows that Obama care in against the law of our land. When the decision is made his brown shirts will probably get millions in severance pay or be transferred into another government job. When Obama is voted out, Washington will need an enema to flush out the source that has caused the constipation of the American economy.

    When it first looked like it was going to pass, my insurance premiums went up so high that I had to drop it. It was either keep it and work two more jobs to pay them, then live on the street. A few months later the premiums went down enough to where I could get back on it. At least for me I had the VA, but my wife had to get medicaid for awhile. This goes with what I said, that this bill would just make a great many of us criminals. Some time ago I heard of internment camps being set up here in the US. Later I saw that show with Jessie Ventura. They not only showed some of them, but also showed huge stacks of plastic coffins for mass burials. As they were filming them, trucks suddenly arrived to load them up and take them away. As for the camps, they looked like small low income housing except they were surrounded by fences and razor wire. Inside there was even playgrounds for kids.
