States Say Healthcare Bill Is Unconstitutional, Sue Federal Government

States say healthcare bill is unconstitutional, will sue federal governmentAfter president Obama signed the newly passed healthcare reform bill into law, 14 states challenged the legislation by filing suit in Federal Court.

Twelve states joined Florida’s Attorney General in the suit filed in Pensacola’s Federal Court. They are South Carolina, Nebraska, Texas, Utah, Louisiana, Alabama, Michigan, Colorado and the commonwealth of Pennsylvania. The commonwealth of Virginia filed suit separately.

The plaintiffs claim they want to protect individuals’ freedom to pay their healthcare bills on their own rather than be forced by the federal government to buy insurance.

“This is a tax or a penalty on just living, and that’s unconstitutional,” McCollum said, adding that “there’s no provision in the Constitution of the United States giving Congress the power to do that.”

Meanwhile, the American Legislative Exchange Council (ALEC) has said 38 states have either filed or announced their intentions to file ALEC’s Freedom of Choice in Health Care Act that would “stop ObamaCare at the state line.”

The act has already been passed by one legislative chamber in Georgia, Missouri, Oklahoma and Tennessee, and is expected to be heard on the floor in Alabama, Kansas and Michigan.

      It is imperative that we, the people, regain control of the wild eyed treasonous idiots that now represent us. With the right choices, this legislation can be repealed starting in 2010. Let there be no mistake about it, we must take control of our government and put it back in the hands of representative that believe in the American constitution and Bill of Rights and the oath they took and swore to uphold and protect this country, against enemies both foreign and domestic, with their hand placed firmly on the bible.

        Fellow Patriots,

        Before the ink dried on the health care boondoggle President Obama just signed into law, fourteen states sprang into action to defend their sovereignty by filing suits in federal court against ObamaCare’s individual mandate.

        Thirteen states – Alabama, Colorado, Florida, Idaho, Louisiana, Michigan, Nebraska, Pennsylvania, South Carolina, South Dakota, Texas, Utah, and Washington – filed suit jointly in Pensacola, Florida, citing the “Patient Protection and Affordable Care Act” as an “unprecedented encroachment on the sovereignty of the states” and basing their case on the 10th Amendment.

        Virginia’s Attorney General, Ken Cuccinelli, filed suit separately in Richmond, Virginia.

        Thanks to the tremendous work of Virginia Campaign for Liberty Executive Director Donna Holt and the tireless lobbying efforts of VA C4L, the “Healthcare Freedom Act” recently passed the Virginia General Assembly and was signed into law by Governor Bob McDonnell. This law effectively declares the individual federal mandate null and void for citizens of Virginia.

        The Healthcare Freedom Act has given Attorney General Cuccinelli unique standing on which to base his lawsuit. The Virginia law reads, “No resident of this Commonwealth…shall be required to obtain or maintain a policy of individual insurance coverage….” As the Cuccinelli suit states, “The collision between the state and federal schemes also creates an immediate, actual controversy involving antagonistic assertions of right.”

        It continues: “…thus far in our history, it has never been held that the Commerce Clause, even when aided by the Necessary and Proper Clause, can be used to require citizens to buy goods or services.”

        The federal government, despite boasts to the contrary, knows the individual mandate rests on a perversion of the Commerce Clause that it has been allowed to get away with for far too long.

        In addition to action in the courts, states around the country are also voicing their opposition toward this unjust, unconstitutional usurpation of power through legislation. Along with Virginia, Utah and Idaho have signed into law variations of Healthcare Freedom Acts, and similar legislation has been introduced in more than 25 other states!

        It is invigorating to see states finally beginning to reassert their sovereignty against the tyrannical powergrabs emanating from Washington, D.C. The momentum will only continue to build as additional states join the fight, but for that to happen, we must remain diligent in spreading the word and continuing to fight for free market health care reforms.

        Campaign for Liberty members nationwide have been turning up the heat on their local politicians, demanding they act against the overreaching federal government and its schemes to take away our liberties. Our members continue to collect petitions, testify before committees, and hold their elected officials responsible for their actions.

        Indeed, we were successful in pushing back against this latest intrusion for far longer than anyone would have thought possible. What was supposed to be a done deal with the election of President Obama became a knockdown, drag-out fight that will continue into the November elections and beyond.

        Without the intense efforts of Campaign for Liberty members taking action all across the country, the final legislation could have even been much worse. Our elected officials may now try to convince themselves that the outcry will die down and our Revolution will fade away, but we must ratchet up the pressure even more and make sure they know we will not rest until we take our neighborhoods, our states, and our country back.

        While ObamaCare’s passage was widely heralded by the mainstream media as a defeat of our movement and a victory for Obama, you and I both know that this is only the beginning. There comes a time in each generation when people must decide whether to stand up and defend their natural rights or bow down before the seat of power. Let us steadfastly maintain our resolve to see this battle through to victory!

      SC, I agree, I posted this statement on another part of this blog roll, “that Reagan warned us, that passing off Socialized Medicine as an Humanitarian effort would come like a thief in the night!” and it has___The Dems claim we’re hollaring before we’re hurt because, we haven’t given this healthcare bill a chance, we can’t for 4 years!___but are being taxed apparently right away__I’d like to know how in the hell our lawmakers know for a fact that this will work, this particular plan has never been done and if there is something in place that’s even close to it, it’s never been done on this grand a scale, so it’s a crap shoot with our future!___No one knows if the language is Constitutional___I for one say it’s not!__Never in 53 years have I heard ANY of our Presidents passing into law, that we must purchase a good or service or be pentalized, taxed or what language there calling it these days___And there is already mistakes, the bill is still being worked on, question is, what are they changing this time?___perhaps a new strategy, against the lawsuits of the states questioning the Constitutionality of the bill?__They say we can read it__via PDF__WHY?__it’s constantly being changed!Underhanded and Sleazy!

        What happened in Russia, Germany and China, when those people were supposed to ‘wait and see’? People in America can’t afford to stand by and watch America burn to the ground while an in-house Nero stands back, watches and smiles.
        Obummer’s “talents” are needed in Venezuela, Cuba and North Korea. Let him show THEM what he can do THERE. I’ll fork over some funds so he can write and let us know ‘what happens.’

          SC, yeah Obambi’s vast experience___all that I knew about him was his 151 days in the Senate__It’s only when I heard he was going to run for President, did I search for info and read up on his bio.__ Quite frankly, Like Queen Victoria would say “We Are Not Amused”__When I read it!__But_I know the states are gonna spend alot of money, a lot of money we don’t have on these lawsuits on the Constitutionality of this bill, but we can’t just let this stand, and at this point with a majority of liberals in congress & senate, this is really all we have to go on.

    I’ll tell you something that really irritates me. Yesterday I followed a link to email my congresswoman to voice my displeasure with the health bill. When the email form came out, it starts with “to the Honorable_____, Congresswoman from the 3rd District of ___________”. I want to know why I have to address this dispicable person as “Honorable”! Grrrrrrr!!! November to Remember!!! We won’t forget, as pelosi has told you. I kept it civil. No profanities. No threats. When her re-election ads come on TV, I’ll just use that time for a potty break.

    Ok are you required to carry auto insurance people, this is not rocket science. I live in Texas, sadly, and am very disappointed in the way the state is handling this matter.Instead of trying to improve or change anything we would rather keep everything the same, which is obviously working so well for people. How many people do you know who have had to file for bankruptcy due to medical bills, how many children can the insurance companies deny coverage and ultimately let die before you old fat white guys decide to pay a little more so more people have a happier and longer future. Yeah it is a strain, yeah you will probably have to pay more in taxes, grow up and look at what is more important your bank accounts or peoples lives. I am a doctor in Texas who has actually seen suffering of impoverished people , we are privileged here in America, so stop whining and help fix the problem instead of making it harder.

          I, too, had the easy way out back in 2007. I chose to survive my health problems and used the alternatives offered to me. Thanks to a great hospital staff, doctors and friends, I am here today, richer for the experience. My friends stepped up and their help was re payed and our friendships endured. I now share a house with one brother that shared and offered his kindness, and I was too proud to ask for it. He has lost his home to foreclosure and works for himself because his job shut down and it’s tough out there. I am able to ease his burden just a little bit. I guess the saying; “when the going gets tough the tough get going is” true. America will survive all of these attacks on our liberty, but it will take every patriotic American that believes in freedom to defeat these globalist zealots.

        Insurance companies have routinely used the “pre-existing condition” clause to fraudulently weasel out of paying insurance claims.           1. I don’t know anyone that has filed for bankruptcy…especially over health care bills. I do have dozens of very responsible friends and responsible family members, so I guess that makes me the lucky one here.
          2. Parents that have allowed their children to die because of “pre-existing” conditions that could have been saved with care should have used the resources available through the state and federal services. No emergency room in any hospital would been allowed to turn them away. Have you ever heard of “The Hippocratic Oath”?

          To you, I may sound insensitive. I’m just realistic and not living in your little bit of fantasy land.
          If I were to travel to your fantasy land, would I make a left at the Unicorn or a right at the Rainbow. Get back to me would ya’?

          Leonard, Leonard, when are you going to wake up and smell the coffee? I also have never know anyone to file for bankruptcy due to medical bills. At my hometown hospital when you are being discharged, of course, they hand you your bill, but that’s not the end. If you can’t afford to pay the ending balance on the bill, they have a lady there and she’ll work with you on how to pay. It’s like paying for a car. You pay a certain amount a month till its all paid off, just no interest. I’ve also known people to use credit payment companies to make agreements with health institutions, so you don’t go belly up. A friebd of mine owed the hospital $25,000 and, of course, he couldn’t just go to the bank a make a withdrawal. So he went to a credit solutions company and they worked out a contract with the hospital for him to pay only $50.00 a month till it was paid off. He can pay more if he wants to though. I’ve even known former soldiers that I served with that if they owed a good sum of money to some company, etc., he would tell his wife to go work and help pay it off. It always works to have someone, something, or have a set system in place to help pay things off. Raiding taxes on hard working Americans (Those who earned the right to be called Americans) because certain people are too lazy to work or get insurance is wrong and unconstitutional (Look at the 10th Amendment, if you can read that is).

          Also Smilee. Don’t you ever get tired of trying to pass yourself off as an American, but haven’t earned the right to be called such? Next time, please don’t use the foul language you consistantly use towards people. Remember, “An American shall have the right to speak out against their elected officials, without anything happening to them. This freedom of speech shall not be taken from any American.” 1st Amendment to the Constitution. Swearing at someone is not covered in this passage. Thank you, you athiest communist!!!!!

Never in the history of the US has the poulation been so polarized, never before has government been so unConstitutional.           Leonard – I know someone personally that filed bankruptcy for medical bills and credit card debts. My brother. Seems he is an alcoholic and likes to go on benders. When he does this he runs up massive credit card debt among other things. When he was picked up for a DUI he was thrown in jail. During his stay he started detoxing and went into convulsions. He was rushed to the nearest hospital and was in intensive care for three days, then in a room for another 5 days. During that time he wouldn’t give personal contact information so they could not get rid of him. His total bill was small compared to his life ($15,250.00). Instead of thanking the people that saved him, he paid nothing, filed bankruptcy and walked away without debt. He even got a home loan during the Clinton era when everyone deserved a home.

          My point here is that people need to take responsibility for their actions. If I have no say in their lifestyle choices, why should I have to pay for the results of them?

        Before you get upset, read my whole post here. I do know somebody that went bankrupt for medical bills for two reasons. One, he ran bills sky high with out EVER trying to pay a little here, a little there. He just ignored them. They finally went after him after about five years. Two, right before the end, he applied for two credit cards and one had a limit of 12,000 dollars. He maxed both out to the tune of about 15,000 dollars on things like clothes, drapes, all kind of things that he knew they wouldn’t reposess, came home cut the cards up and the next day went out and seen a lawyer to file bankruptcy!!! He had no intent to pay for any of this stuff and to me it was just a legal way of theft!!! We the consumers have to pay for this in terms of higher prices, higher interest rates, and making it harder to get credit in the first place. I my opine they should have investigated the dates of purchase and put the sucker in jail for about 5 years!! Personal responsibility? not here anymore!!!

            I have known hospitals to offer payments to people to pay their bill. I have seen payments as low as 20.00 a month!! I also personally know a person who lost her job and the Lake county West hospital got in touch with her and said if she could come in and verify that she had no income they would forgive her hospital bill. That didn’t include the Dr bill, but it did make her bill about 6000.00 less!!

        JeffH, you are well-spoken. I also know no one who had filed bankrupcy due to med. bills. In fact, I choose to be self-pay and recently had knee surgery. The hospital and docs were great and I set up a payment plan that is very much within my budget. Our health system is not broken–it’s just that the gov. got involved and seriously hurt it. The hospital was more than happy to work with me as an “uninsured”. I was just willing to pay for their services, not waiting for someone else to “take care of me”.

        When I was small I had to spend two weeks in the hospital. My dad took on two other jobs to pay that bill. He never once thought to cry to the government or file for bankruptcy. There was pride in taking care of our obligations and being responsible in those days. Most people then just wanted to be left alone to take care of themselves. They didn’t purchase things they couldn’t afford, they saved for things. They didn’t run up credit card bill and just walk away. They didn’t buy houses that couldn’t afford no matter how good the deal sounded. They were – dare I say it – fiscally conservative.

          Meteorlady, it is simply called “responsibility”! Something this government and too many people know nothing about. When you grow up getting what you want, never having to work for it, having the welfare programs support you, provide section 8 assistance for your housing, you almost never know how to get out of it. Nobody has taught you any differant. The attitude becomes “the rich owe me”, hey don’t need all that money. I heard Hannity on the radio talking to one of those people yesterday. The guy had no clue about anything, but felt the government and the rich folks were supposed to support or improve his life and people like him. Amazing how easy it was to expose that mentality. That mentality is being nurtured by our government, our Marxist president and the Democratic Socialist Party and those that support that line of thought, everyone.

We’re not saying that we don’t believe people fall on hard times…..and yes, I’ve known several who have fallen victim to collection agencies, bankruptcy, etc….and yes, most were all good people…but they all made victims of themselves, because they never believed in planning (in the advent of down times)…they just walked through life with blinders on….kind of like what you seem to be doing now.

            I’ve even had a few rough moments myself…when I was young and clueless…but guess what…I did not ask for or receive a bailout….I just had to give up on some “want” things until my finances were healthier…and until I paid back what I owed.

            while driving to the mall today, I was listening to the English guy that took over for Rush, and he made a good point. This generation may be the first generation to not be able to have a better life than their parents. through out the history of this country, or at least the last 150 years of it, every generation has been able to improve on their parents life. In Europe, if you were a serf or farmer your children were very likely to be one too! the one big difference was a man could come to the U.S. and start out in a dirty one room apartment with his wife and by the end of his life be living in a two or three bedromm flat. his children, however, would have the chance to move to the better side of town, get an education, and a good paying job, you know, get ahead. this generation,however, may not do that without some very drastic changes, changes in the type of criminal politicians we get!!!

      There’s a big difference between auto-liability insurance and healthcare insurance. One is to protect others from you, the other is to protect you from yourself and it doesn’t even do that. Insurance is a losing bet for most people. Adding a middle man to the equation insures that we will spend more on our healthcare across the country. Who protects us from the forcers in Government?

      Just wait Doc untill the government says all you can earn is $100,000 a year, and your office call is only $30 each, and you must treat only government health care and not uninsured people. Wait until you patient has a brain tumer and you have to wait 6 months to have an MRI or Catscan, and then find out that because your patient is 75 years old and the govenment refuses to pay because the patient is to old. Lets see if your opinion changes. It’ll be to late then.

    What a stinking mess. These states will be spending money they do not have and the taxpayer will have to pick up the tab. These lawsuits will go on for a long time, it will be a slow process and who knows what the outcome will be. Although I do not approve of this health reform, I keep in mind that they can be voted out in 8 months. I do not approve of the violence and vandalism. Someone cut the gas line to a guy’s house with kids in the house. This guy was the politician’s brother. A big mistake. What about this guy’s neighbors? Were their gas lines affected? A whole damn block could have been blown up. This crap happens when people go off half-cocked. Innocent people will be caught in the middle. I would post this even if it were a Republican the dissenters were going after. Violence solves nothing but more of the same. Death threats and vandalism is not the way to handle this mess. If a person commits a crime, no doubt they will get caught and go to jail. A lot can happen in 8 months, and it scares me but I pray nothing bad will happen until November.

    For too long we have been too complacent about the workings of Congress. Many citizens had no idea that Congress members could retire with the same pay after only one term, that they didn’t pay into Social Security, that they specifically exempted themselves from many of the laws they have passed (such as being exempt from any fear of prosecution for sexual harassment) while ordinary citizens must live under those laws. The latest is to exempt themselves from the Healthcare Reform that is being considered…in all of its forms. Somehow, that doesn’t seem logical. We do not have an elite that is above the law. I truly don’t care if they are Democrat, Republican, Independent or whatever. The self-serving must stop.

    This is a good way to do that. It is an idea whose time has come, Jim.

    Proposed 28th Amendment to the United States Constitution:

    “Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Congressman, Senators and Representatives; and, Congress shall make no law that applies to the Congressman.             That my friend is where you and I differ. I Believe that healthcare is a right not a privlige and that everyone should have. It is all in how you believe or read the constitution. The constitution like the bible is open to ones own interpretation, for the bible it is the churches, for the constitution it’s the courts. Therefore I do not believe that this bill is Unconstitutional.

            “God” does not appear in the constitution once. The only two references to religion include the right to practice ones own religion (as long as it does not infringe on any one else’s constitutional rights; as with all rights outlined in the constitution) and the prohibition of religious tests for possible office holders.
            Even though the framers of the U.S. Constitution were white, protestant, wealthy men they were careful not to mention “God” or his supposed wishes.

            I am not certain why so many sites answer this question with a “zero.” That is only true if you entirely omit the appendix of the Constitution, penned at the same time by the same men. Both “God” (directly written) and as our Creator are plainly spelled out in the appendix

I have spent six months researching them and it is frankly a little frighting what would have to happen for them to gain power. If you think they really believe in smaller government, just check Ron Pauls earmarks for 2009. 75 million for his district in just one budget. That isn’t shrinking government, that is taking a large amount from that same government. The reason that party hasn’t grown much since the 70′s is that most people can’t stomach chaos.

    it’s plain to me we are defeated at the ballot box and the liberal courts. our political party is in shambles and we have nothing left to fight with except what we are doing here, calling liberals names.
    you can dream all you want to about the coming elections, even if the republicans can pick up some seats and even get a small majority they won’t be able to repeal anything, so stop dreaming about overturning the health care law. its going to take a drastic movement in this country to change our politics and i don’t think there’s enough volunteers out there to do it. god help us.

Then I go to the grocery store to spend my money and see others who have food stamps and are buying cigarettes and alcohol (not with food stamps) along with their food stamp purchases. So I only have so much of my own money to spend so I limit my budget to necessities because I have a job and my family is not subsidized by the federal government

            So the person in line using food stamps has taken my money that I worked for to supplement their alcohol and cigarette purchases. Or they have to many children and can’t afford to support them all. Does that make me selfish or them? Hint – they have their hands out for my money, I don’t have my hand out for their money.

It makes me sick. Where is their honor and integrity? The people that are able to work and choose to sit on their duffs and draw welfare apparently do not have any pride. If they do not want to work, they should be taken off of welfare and whatever happens to them happens. This is extremely cold-hearted but I have seen enough. I get sick of going to the grocery store and seeing people with their “Link” cards buying 2 carts of groceries. Sometimes I think they eat better than I do. I see what they have in their carts! I also get sick that they pump out babies to get more money. Well, the women should have their tubes tied, and the men should have vasectomies. My Mother always said you reap what you sow, you are judged by the company you keep, you keep your mind and body clean, do not complain about what you don’t have, be thankful for what you do have. Do not complain about having no shoes, be thankful you have feet. (That one stuck in my brain.) When I became a teenager I remember her saying “you have one life to live, live it honorably.” Learn from your mistakes and if you are lucky to come out unscathed, never do it again. You are responsible for yourself and your actions, no one else is. She was full of those sayings. But I will always remember her words. She is in a better place now, but I still miss her so much. I wish she was here and I could wrap my arms around her and tell her how much I love her.

    There’s always a “whining tantrum period” after a great political loss. The fact is that until folks who elect NOT to purchase any kind of health insurance agree NOT to call for a doctor or an ambulance when they suddenly start having chest pains or have an accident, then everyone needs to contribute to the system to make it work. You don’t allow someone to register a car until they get insurance. Every breathing human body should require coverage too. Of course, if we suddenly were to become civilized and go to a single-payer publicly operated system for health care, profit motive would be eliminted (along with most of the waste and fraud that is rampant in the current system) and nobody would have to worry about buying insurance. Health Care is an issue of humanity, not politics. Fighting to hold on to a piece of a crumbling system just because some folks are afraid of change is nonsense.

      You need to do a little research. Here In Ohio, all you do to get car plates is to sign a paper SAYING you have insurance, no proof!!! A lot of the states are that way!! The most important part, though, is that you have a CHOICE to drive. It is a PRIVELEDGE, not a RIGHT!!! If you don’t drive you don’t pay!!! Also in most states they accept a cash surity bond in lieu of insurance. Is this plan going to take into consideration a persons ability to pay the bill themselves??? Like is Bill Gates going to have to buy insurance, too??? NO!!!! There’s your difference. Stay the hell out of my pocket!!!

        Joe you are right you do no have to drive, it is a privilege and you can still live, disease and accidents do not always give you that option nor in most cases can you control either, medical treatments at those times are your only option, you can choose not to drive but without medical treatment you may have to choose not to live and that is tantamount to suicide and it is that choice you want to force on others and your to dumb to know until it happens that you could be situation some day too. Most likely you will want help either from insurance or the government or the right to file bankruptcy and stiff the doctors with it, a very large part can no longer afford to protect themselves and living for them may no longer be their right, remember life, liberty and the pursuit ofo happiness and you want it for yourself but to hell with anyone else it is ok if they suffer and probably die. Last fall some flu victims had medical bills over a million dollar can you handle that??

          Flue victims? OMG that’s a seasonal thing and happens every single year. Did our government not pay for a goodly portion of the H1N1 vaccine when it didn’t really work, was untested and not all people wanted it? How much did that cost the American taxpayer. It was a hugh boom for the drug companies. Wake up – if people choose not to have insurance they can either pay for their medical treatment or they can get it free through Medicaid or hospitals who are mandated not to turn away anyone in their emergency rooms.

          Of those 30 million (curious how it started out as 47 million), 50% are able to pay for the health care insurance but CHOOSE not to, some 27% are eligible for Medicaid and the others are illegals. Tell me again who this is going to help?

        These liberal lunatics keep comparing auto insurance with health insurance. But if I towed a really badly damaged car with a blown engine into an auto insurance company, they would tell me to get it repaired before they could insure it. That is analogous to insuring someone with pre-existing conditions. With either one, the insurer would be guaranteed to lose money. Not only that, America has always led the way in developing pharmaceuticals. Almost all of them came from the USA (a few in Europe). Now with the tax the government is going to put on them, there won’t be much incentive to discover new life-saving drugs.

      Win–To me, this issue has nothing to do with who wins or loses. We are all in the same mess established by many administrations that chose to do nothing about a lot of real important issues when they were in office. They were all too busy working on their “pet projects” in order to secure re-election. They were all too busy catering to the donors of their campaigns, and this fact is continuing.
      Whining “after a great political loss” is without merit. You would be whining if the Republicans were elected. I think the tide will no doubt change beginning in November and will continue through 2012. Nothing is written in stone. We cannot take anything for granted. There is too much dissent and disaproval in the mishandling of issues with the current administration.
      The health reform issue leaves a lot to be desired. I do not approve of fining people for not having health insurance. Does this administration think there will be jobs galore in 4 years? I don’t think so. And people need jobs to pay for insurance.
      I do not think the majority of Americans are afraid of change. But keep in mind, changes should be for the better, not the worst. If changes are made, they are to be thought out rationally, logically and reasonably or don’t do it.
      Medicare and Social Security are socialized programs but I believe they were/are good programs. The American citizen paid and are paying into these programs and the government had no right to use this money for their out of control spending and pet projects. It was NOT their money to use. All administrations dipped into this money. Now they are doing it again. And don’t tell me people should save more money, how can they if they don’t have a job? How can they if life has dealt them numerous blows and they could not save? In this day and age with the cost of everything how can they save if they have kids to raise? How can they save if and when they help put their kids through college? There are so many factors to be considered in the process of saving money.
      Why wasn’t a public option or single-payer system put in this health reform bill? I believe there are too many discrepancies. This health reform bill was initiated and now the insurance companies will be going crazy increasing their rates. It is already happening. My Blue Cross/Blue Shield supplement currently is $298.00. It will increase to around $362.00 shortly. And who knows what my husband’s will be since he has so many health issues. As far as I am concerned, this health reform bill is/will make money for the insurance companies. Same thing when they passed the credit card fiasco and the interest rates were increased.
      Change–I am for it if truly needed, but only if it is constructed properly, legally, ethically, morally, and for the good of America and all Americans.

      Yes, a whole year of haggling over this Gov,’t takeover of Insurance, forget about jobs. There still are no new jobs. Forget about the economy improving, its not. Recently Obama’s ratings went up in the polls but it was only the Dems. that approved. Still down with Independents and Repubs.

      Caterpillar was hurting and had to lay off about 20,000 employees. The stimulus that was supposed to help them didn’t help them a bit. Now with this stupid HCB they are hurting even worse. I know they have closed up several stores, and now probably will close more.

      Obama is not about to help our economy, he wants to become our dictator and turn us into a Communist Country. After all, we need to pay for our sins of being a Blessed Nation.

            Jana– I was so happy for my daughter. It has been a rough time for her and her husband since he was laid off too. Only he has not been called back to work, he works for a different factory. You know, when I think of all the booming industries (steel mills, etc.) we used to have here in the United States, I want to cry. So many of them closed, so many people put out of work. The damn unions did a number on America. There may be some good unions, but still and all, it is a dirty shame. On my way to work on a busy street, a new Dairy Queen went up and it opened this past Friday. There were about 30 guys picketing there all week.
            A lady in my office is about to lose their home. She is now on medication for her nerves. She is now calm and serene. So I guess the medication is helping her. Her husband has been out of work for over 2 years. He is a union guy, and it seems like he has to be “careful” about where he works if he finds a job. He had a chance for a job awhile back and could not take it, at least this is what the lady said. I remember she said “oh, he can’t work for them.” I thought what the hell. Forget the union, take the job!! I just do not understand this.
            I have lived in my home for 32 years. Half of my life. I would be devastated if I were to lose my home. So many memories, so many good times as well as the not so good times. A person would just have to pick up the pieces and keep going. Keep plugging away. And face each new day with the thought “there is a brighter day coming.” God bless all of us.

To think that the Republicans thought the partisan Health Care Bill wouldn’t be good for the American people or that government controlling health care and 1/6th of our economy was a problem.     Well at least the Attorney Generals in the states that are filing have read the bill – or some of it anyway. Health care is a state right, not the federal governments. That is where all the energy of the liberals should have been directed toward – the states. But……. it’s much easier to control public officials at the state level than the federal level so liberals don’t want that to happen. It’s about control, not about people working with their state representatives to get things done. The federal government cannot stand state rights because it drills down to where people can actually see and talk with their representatives.

    I applaud the idea that they are suing, but don’t plan on anything happening because very seldom do people win in federally controlled courts.

    As for money being wasted – what the heck – we will be wasting billions on the health care plan anyway. We already do on the other three government run programs – Medicare, Medicaid and VA. Why didn’t the federal government just fix those programs – especially Medicaid since that’s the people they were trying to cover anyway.

Seniors depending on their Medicare and the Advantage Plans will sit by and watch $500 Bil of that money go to Medicaid while their services get reduced! I’m one that will see my hard earned $ and my payments directed into Medicaid while my services will be reduced. But I will be accused of being a hypocrite for even using the “socialist” Medicare Advantage Plan by the anti-Americans on this site. OH WELL! I guess I’ll use everything available to me now until those cuts take place.

    Obama an expert on Constitutional law should know that a usurper is ineligible for the Office of the President. One cannot faithfully execute the Office of the President of the United States because;

    His every act in the usurped Office of the President is a criminal offense as an act under color of law that would subject the People to the deprivation of their constitutional rights, and entitling no obedience whatsoever from the People;
    As a usurper acting in the guise of the President you could not legally function as the Commander in Chief of the Army and Navy and of the militia of the several states, as such forces would be under no legal obligation to remain obedient to you;

    No one in any civilian agency in the Executive Branch would be required to obey any of your proclamations, executive orders or directives, as such orders would be legally VOID;

    Your appointment of Ambassadors and Judges to the Supreme Court would be VOID ab initio (i.e., from the beginning), no matter what subsequent actions the Senate might take as well as rendering any such acts by such appointed officials void as well;

    Congress would not be able to pass any new laws because they would not be able to acquire the signature of a bona fide President, rendering all such legislation legally VOID;

    I am starting to hear that some of the so called reports of threats and violence to the representatives in Congress were fabrications or down right mis information that has been sensationalized by the national media. Make me wonder who is promoting what for what purpose? The accused always seems to be the “Tea Party” people. I remember not long ago they were considered “astro turf” and not considered a voice of anybody but a bunch of geriatric patients. Now, they are an “evil force”, without leadership, promoting violence and hatred throughout the land. I, my mom and dad and many other parents and grandparents and relatives around the country are starting to get the same headlines Charles Manson got for the Tate-La-Bianca murders back in ’69. This MSM is a real hoot that can be depended on for their accurate and responsible reporting. Yeah, right! Of course, so can the Inquirer!
    1. Gas line cut that leads to a Congressman’s brothers house…ends up to be a line to a BBQ.
    2. Congressman’s office window in Cincinnati has huge rock thrown through it….ends up that this guys office is on the 30th floor and the Reds need to find and sign that big arm to pitch for them.
    3. Congressman finds a coffin on his lawn…No coffin close to his lawn and he wasn’t even responsible enough to correct the report.
    4. Tea party protesters hurl racial insults at congressmen. Tea Party protesters reportedly spit on one lawmaker…No video exists that can substantiate these allegations that this did nfact occur and no one was ever arrested.
    There exists in this country all kinds of people, both liberals and conservatives that have a fringe element capable of these types of acts. To promote or sensationalize any incidents such as has been reported is irresponsible on the part of those doing so. Give me the facts, just the facts without all of the little insensative self serving bells and whistles. None of those involved are innocent, from those reporting, to the Congressmen and women whose majestic speaker Pelosi has done more to damage the image of Congress, Democrats and incite the anger in the American people through her thoughtless comments and I know wht’s better for you than you do attitude.

    In defense of JeffH, as a retired RN after 30 years working in several medical fields, I can tell you truthfully and accurately that anyone in this country can walk into any emergency room of any hospital, explain the medical problem and if that hospital cannot help they will see that you get to one that can!
    Every hospital of any size and many small ones have funds set up for just those emergencies! I do not believe he knows anything about how the best healthcare system in the world works or he would have known better than to make such a stupid statement! To claim to be a medical DOCTOR is not only reprehensible but illegal!

      God bless those angels in white!!! Without them the Dr.s couldn’t do their job!! I spent 50 days in a hospital after spinal surgery and getting a staph infection. those ladies in white were true Angels on earth. I sent them candy and flowers also got in touch with their supervisor and told her that I didn’t know how much they were paid but in my honest opinion it couldn’t be enough!!! God Bless ya Lady!!!

      Marilyn, I know this all to well as I spent 29 days in the hospital with no medical insurance in 2008. Medicare paid about 10% of the bill and my nurses and doctors were wonderful caregivers, and the billing coordinator and the Social Service coordinator were extremely helpful with their advice. I still had to pay for some services, but took care of all of that with my first SS Disability check. I was able to use the resources that are available to those that take the time to use them, and believe me when I say it wasn’t easy to ask for help, but I had only two choices, die or be humbled for life. I chose life over death because my life did expire at one point, ever so briefly.

    I do have to say, though, that McCain also got money from Soros. He

    The Truth About the Health Care Bills – Michael Connelly, Ret. Constitutional Attorney

    Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

    To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

    The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.

    However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

    The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.

    The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

    This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide…

    If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.

    So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law It doesn’t stop there though.

    The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;

    The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

    I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights… Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation to support the Constitution.” If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.

    For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

Many citizens had no idea that Congress members could retire with the same pay after only one term, that they didn’t pay into Social Security, that they specifically exempted themselves from many of the laws they have passed (such as being exempt from any fear of prosecution for sexual harassment) while ordinary citizens must live under those laws. The latest is to exempt themselves from the Healthcare Reform that is being considered…in all of its forms. Somehow, that doesn’t seem logical. We do not have an elite that is above the law. I truly don’t care if they are Democrat, Republican, Independent or whatever. The self-serving must stop.

    This is a good way to do that. It is an idea whose time has come.

    Proposed 28th Amendment to the United States Constitution:

    “Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Congressman, Senators, Representatives and the President together with his/her staff; and, Congress shall make no law that applies to the Congressman, Senators, Representatives, and the President together with his/her staff that does not apply equally to the citizens of the United States”.

    This 28th amendment to the Constitution of the UNITED STATES Will apply to all passed, present and future
    Presidents an their staffs , Congressman, Senators an Representatives.
    Just think of all the money this would save the tax payers!!!!!

    I think the Senators, Representatives or Congressman that comes out strongly for this will be our next President.

    I certainly agree We do need another law passed that would control our spoliation’s no matter the political party. I am tired of us paying for their way for ANYTHING.
