Paul Amendment Would Put Supreme Court (And The Rest Of The Federal Payroll) Under Obamacare

If Senator Rand Paul (R-Ky.) has his way, Supreme Court Chief Justice John Roberts — who sided with the liberal wing of the High Court in upholding Obamacare as a “tax” on individuals back in June 2012 — will join the rest of Washington, and the country, in signing up for healthcare coverage under the Affordable Care Act.

Questioned by The Daily Caller about his proposal to outlaw any healthcare coverage exemptions for Federal employees, Paul — an advocate of fair play rather than the Obamacare plan itself — said he believes all government employees ought to buy their coverage in the same manner as the rest of the American people.

Paul’s proposal — outlawing any special exemptions for government employees — would mean all federal workers would have to purchase health insurance on the new Obamacare exchanges instead of getting taxpayer-funded subsidies. Some critics say those subsidies amount to special treatment. The Obamacare health insurance exchange opens Oct 1.

“My amendment says basically that everybody including Justice Roberts — who seems to be such a fan of Obamacare — gets it too,” Paul explained. “See, right now, Justice Roberts is still continuing to have federal employee health insurance subsidized by the taxpayer. And if he likes Obamacare so much, I’m going to give him an amendment that gives Obamacare to Justice Roberts.”

Fearing a Washington, D.C. “brain drain” — a potential mass exodus of well-compensated intelligentsia working both within and on the periphery of government — if Congressional staffers and other Federal employees had to pony up the same money as everyone else to receive the same quality of coverage as everyone else, the Office of Personnel Management said last month the government would subsidize about 75 percent of the cost of premiums for member of Congress and Congressional staff.

    Rand has the right idea if he can pull it off. If the general public has to use obamacare then all the feds should have to use it too no exceptions.

      Liberals are constantly telling us that obamacare is good for us. So if it is good for us then it is good for our employees (agents of government) and we should see to it that they get it.

    For the most part, I don’t like Rand Paul. This, though, appears to be a good idea. If the Feds are going to force Obamacare on us, then it’s only right that it be thrust upon all federal employees. As the old saying goes, “What’s good for the goose is good for the gander.” When Obamacare got passed, it’s supporters claimed it was not a tax. However, when it went before the Supreme Court, the government argued that it was constitutional because it WAS a tax.

    I say YES YES YES!!! The Supreme Court re-wrote parts of Obamacare in order to justify their decision that it is a TAX on the people and therefore Constitutional. As a mandated health law – it is a socialized healthcare mandate and 100000% illegal according to our Constitution.
    Forcing the advocates of this insanity to also “reap” the non-benefits of this train-wreck would be the ultimate of gifts to the communists that have succeeded in taking over our government. Poor Pelosi – she would have to pay for her botox out of pocket instead of billing it to us daily…

    We should pass a Constitutional amendment that states that the Congress shall not be exempt from any legislation they pass. That way they will think about what they make law before they create monstrosities like ACA.

    I’ve always said there should NOT be 2 sets of laws in this country, one for us and one for them. With laws like legalized insider trading, exemption from Obamacare and lifelong pensions after only 4 years service, instead of 20 years or more WE have to work. Add in bodyguards/Secret Service protection, for the connected and gun control for us. This nonsense has got to end NOW.

      By law, Secret Service protection for all Presidents elected after 1 January 1997 was decreased from life to 10 years after leaving office. January 2013 Obama signed law re-instating lifetime protection for George W. Bush, himself and all future Presidents.

    Rand Paul is not stupid, but he certainly thinks you are. To say “certain people are “exempt” from the ACA” is like saying non drivers are “exempt” from car insurance, or that rich people are “exempt” from Medicaid. It’s nonsense! If you don’t now have health insurance because you can’t afford it or you have a pre-existing condition, the law provides a way for you to get coverage. If (like most Americans) you have some other means of getting health insurance (your employer or Medicare), then it doesn’t apply to you at all. Almost all large organizations (including local, state and federal government) provide health insurance for their employees. The few large employers (mostly restaurant chains) that don’t now provide insurance will be required to do so by next year.

    Rand Paul and his buddies understand that when the people who need the coverage actually sign up (next week) and start getting coverage (1/1/14), they won’t want to go back to the emergency room. That’s why they are mounting this disinformation campaign to try and generate support for a “defunding”. If they thought the program was as bad as the claim it is, they would just sit back and wait for those awful effects to be made clear, and then vote to repeal it next year.

      Irrespective of the unconstitutional nature of this law, and as much as I wish to see those who cannot afford insurance find an affordable product to serve their needs, this law as it stands will fundamentally destroy the American economy.

      Millions upon millions of people are going to be getting notices when they walk in the door for their shifts after Oct 1 stating that they have been reclassified as part time (below 29 hours) workers. Do you notice that even though Obama waved the employer mandate for another year (illegal action) he made no such move for the individual mandate? The good thing I see is that employers are not waiting for the year to pass to start reclassifying employees. They are doing so right now.

      This $2200 per employee TAX on business(s) MUST be passed onto the consumer. So here we go, with the most horrible economy that I have ever witnessed in my lifetime lets simply throw another log on the fire and simply burn the whole dam thing down.

      That is your mindset on the other side of the isle. We can solve this by requiring that those who run for Congress or the Senate must have started a business from scratch and been successful at it before they can even submit the paperwork to run for elected office.

        This law is the clearest example of “the road to Hell is paved with good intentions”…there has got to be a better way to insure those who cannot afford insurance to get it, not 2,700 pages of fines, taxes, regulations, etc that will just hurt everyone else, employer & employee….Then again, this is probably just the first step toward complete govt. run healthcare.

        Dr. Ron Paul a few years ago when this monstrosity was being crafted, had a ten point plan for healthcare reforms for USA & his main provision was to decouple it from employment. He said that one thing alone would boost the economy like wildfire. As in most things he put forth, I believe he was right!

          I am uninsured and cannot afford to buy my own insurance. Affordable is far from what this plan is. It’s slap in the face. And try finding a doctor that will accept this “plan”. The largest healthcare provider in our area of the state is already setting up clinics to accept Obamacare patients because the Dr.’s offices they own won’t accept what the exchange pays. You might see an intern or PA but not a doctor. And hopefully you don’t need urgent care because appointments will be tough to get. We need a solution to our healthcare problem. This is not a solution. It is attack on the American public by our government.

            I’m sorry to hear that for you….Before any real healthcare reform is put in place, premiums have to go down, but everything in O-CARE has already raised them & will raise them to the point of unaffordability. The single biggest thing that must be done is to open up insurance across state lines to drive competition & lower prices. Since this can only be done by an act of Congress & since to my knowledge, there has never even been a vote on it, I have to assume the health insurance lobbyists have paid off many on both sides of the aisle!

      So since its sooooooooo wonderful why the special exceptions for congress and their staffs, why are the formerly supporting unions demanding special entitlements, why has Obama delayed the employer mandate? The last one is simple…by delaying the employer mandate he is hoping to delay the inevitable effects of the mandate until after the mid-term elections. If the law is so damn good implement it in full, with no special treatment for congress, the unions or anyone else.

    Obamacare is illegal and any one with half a brain should realize that it, in fact, is un-Constituional. SCOTUS even said during their ruling that it is a TAX, not a penalty. A tax is a revenue-gathering method for the government. According to the Constitution, any revenue-gathering bill must originate in the House of Representatives. Obamacare originated in the Senate, and is therefore un-Constitutional.

That is why the law was written, not as a tax, but as a fine or penalty for NOT having insurance. This is how the govt. was supposed to argue the validity of the law, but when they saw it was not going well with the supposed swing judge Kennedy, they decided to shift gears and argue it was a tax. The Chief Moron, Roberts ILLEGALLY allowed them to argue it was a tax in complete ignorance of how the law was written, for as Scalia said, “Roberts re-wrote the law for them & signed off on it being Constitutional” Couple that with Robert’s decision to NOT hear arguments for Komrade Kagan’s recusal, in the clearest example of a conflict of interest you will ever see, means he should be disbarred & removed from the Court. After that, he should rot in jail for awhile!!!

      BTW, a few parliamentary procedures were also violated for it even to come to a vote in the Congress!

        The more one digs into Roberts personal affairs, the more you realize that he should be removed from the bench. It is possible that he was blackmailed into his decision due to what looks like an illegal adoption of two Irish children in violation of Irish law.

        He had initially written the decision for the elimination/overturning of the ACA, then made an abrupt 180 degree turn on his position. The question you have to ask is why?

        Being that we are now looked upon as a threat by our own government and are subsequently being spied upon as a result, would that not mean that “Justice” Roberts phone conversation(s) would be stored on a server somewhere at the NSA/CSS? If enough information were to be gathered to open an investigation, would that not justify a warrant to retrieve that data? Or were Roberts family just simply “visited” numerous times by Obama’s thugs?

        Either way, we have a serious problem if the SCOTUS is now simply an extension of the executive branch. The ACA unfortunately is not the largest concern for Americans, it is the precedent that one can now be taxed for inactivity.

        It ( the ACA ) decision must either be revisited or over ruled by a new constitutional amendment. This ruling is not a slippery slope, but a shear cliff that we are about to simply walk right over.

    Why is any federal employee or official not under obamacare? It’s the law and we all know that laws are supposed to be enforced equally (sarc off)
    If it’s not good enough for them, why should anyone tolerate the illegal tax that is obamacare?
    Ask “justice” roberts why a tax can be originated in the Senate when all revenue measures are Constitutionally mandaed to originate in the House of Representatives?

        And Sarvis needs reminding that the president is not a dictator. He needed House and Senate passage of the bill to make it law, and he did not receive ONE Republican vote in either chamber. After Americans voted out Dems in sweeping numbers from the House in 2010, largely a result of the Obamacare fraud, the House has voted over three dozen times to defund all or part of it, but has been thwarted by the still Democrat Senate.. The American people DO NOT WANT Obamacare, and they have made that plain.

          Yes the Republicans in the House spent $60 million in those > 3 dozen votes. Thanks for THAT! They did so knowing that those votes, at least after the first one or two, were just a waste of time and our money. The American people “make it plain” that they don’t want “Obamacare” but they have also made it plain that they want what the Affordable Care Act provides us.
          Even Ted Cruz knows that once the Affordable Care Act is fully implemented Americans will NOT want to return to what little we had before. Sure there are adjustments to be made in Obamacare. The President admits that. Why Republicans want to deny Americans from a plan that will help them all with their health care costs is obvious to most Americans. All they care about is obstructing when they could be making improvements to the bill that was passed by Congress, signed by the President, and upheld in the Conservative Supreme Court.
          Nowhere did I say that President Obama was elected purely on his position with health care, but it was a dominant theme in the ’08 elections.
          By all estimations, Roberts IS a Conservative.

Let me remind you that Obama had Repubs. in for a luncheon & to get their advice while bill was being created & he shot down ALL of their suggestions, one of which was serious tort reform, but DEMs being in bed with those lawyers would not go for it! It is a noble thing to try to get insurance for those who cannot afford it, but not when it will hurt everyone else, employers & employees. This bill is 2,700 pages long with a plethora of fines, regulations & hidden costs backloaded into it, so as years go by it will get worse & worse…there has got to be a better way!!

            Not me, Doc. I don’t want it because I love the expensive plan we BUY now, and I know I’ll not get that good coverage with Obamacare. Plain and simple. I’m not rich, just ill, and so we spend about 1K a month for the coverage, and then pay copays and such.
            My objection really is that simple. Not an obstructionist, just afraid.

Do you really think he will rein in the costs of Big Pharm and Big Insur?             Let the patient and the doctor deal between themselfs! No fricking Government or AMA control. If the fee a doctor charges is too high, pretty soon he’ll run out of patients. If a patient has to pay the doctor’s fee from his/her pocket, will not go to see the doctor just to have a nice conversation about weather, and actually wasting doctor’s time.

      That is quite interesting because the Constitution does not say that they are SCOTUS for life. What it says is “shall hold their offices during good behaviour”. Does not state what is “good behaviour” or who can accuse/prove otherwise.

    It’s a simple message. I applaud Senator Paul for bringing this into the open. After all both of the Senators from my state have backed this President on everything he has ever done because it’s for the Party. I have already written to both Senators who have been vocal supporters of Obamacare asking if they support any amendment to make them get their insurance from the same exchanges. I haven’t received one response from them. Nothing. They won’t even admit what we already know. It will be important for everyone to write their Senators letting them know they support Mr. Paul. Defunding Obamacare didn’t just get done in the house. It was because the people of this country took the Republican Party to task over this and demanded action. Maybe the Republican Party is tired of getting their butts handed to them in elections and are actually considering listining to the millions of voters they inspired to stay home instead of toe their line. We can only hope.

    There are 2 classes of people in the USA. The citizens and the government employees. It is mind boggling to imagine that in America government employees do not have to follow same rules as the rest of us. It is a matter of common sense to implement a law equally on everybody. No wonder our legislature continue to formulate laws that people don’t like because they and others in the government are exempt form those laws.

      It is mind boggling the lawmakers are not subject to the laws they own are passing! It is mind boggling bribe is legalized, aka “lobbying”! It is mind boggling that an illegal imigrant, who, not only wasn’t born on US soil, but has to use a deceased person’s Social Security Number to fill his tax returns, got in the Wite House! And now, to thank to his biggest supporters, who put him in the WH, the HMOs, with a strike of a penn, forces any American to pay a tribute to them!…
      But, afterall, this is America, the land of opportunity!!!…What’a Hell happened with “The land of the free” part?…
