Obama Trying Gun Control End Run


President Barack Obama’s end run around Congress to establish onerous laws to infringe on the 2nd Amendment rights of Americans goes through the Department of Health and Human Services and its director, Kathleen Sebelius.

She is writing regulations to amend privacy regulations in the Health Insurance Portability and Accountability Act of 1996 (HIPAA) that would waive Federal privacy laws and encourage your doctor to report you to the FBI.

First, some background. The Veterans Disarmament Act of 2007 contains Bill Clinton-era Bureau of Alcohol, Tobacco, Firearms and Explosives language that encourages physicians to report their patients if they suspect the patients are a “slight” danger to themselves or others or are deemed unable to manage their financial affairs. This has already cost 165,000 military veterans their gun rights.

But as recent efforts in New York have shown, it’s moving into the private sector as well. Bureaucrats are combing through firearms registration and purchase records and supposedly private medical records and then confiscating the guns of individuals based on mental health information.

As Gun Owners of America points out:

According to gun rights reporter, Dan Roberts, firearms are now being confiscated from gun owners because of their mental health information. For example:

“[John Doe] received a letter from the Pistol Permit Department informing him that his license was immediately revoked upon information that he was seeing a therapist for anxiety and had been prescribed an anxiety drug. He was never suicidal, never violent, and has no criminal history.”

So now taking anxiety pills can result in one’s forfeiting their Second Amendment rights in New York!

If these regulations become law, you can bet that the filthy, greedy lawyers will be lining up to sue physicians and psychiatrists who fail to report any patients if those patients later go out and use a gun in a criminal act. The result will be that any person who sees a psychiatrist or admits to his physician that there are guns in the house will be ratted out by the doctors who don’t want to risk being sued. Many lawful gun owners will lose their gun rights this way.

And don’t neglect to keep the pressure on the elected class, which has to be reminded that while their largess comes from K Street, their constituents live on Main Street.

    yes, to make us defenseless, then take us to the ditch where they will dispose of us by the millions. We have seen it all before, now we stand in front of the same scenario, it is hard to believe that our Lawmakers would even allow such tactics. Shame on our Government, shame on our Lawmakers, piss on Obama and his clan, they can all go to Iran, where they are worshipped, then one rock will dispose of all of the tyrants at one time. But don’t depend on our congress to take action, we, the citizens will have to take action, or be the victim.

    sebelius wasn’t too bad as governor in kansas. she is now getting to be just like president obunhole. i wonder if she was still governor of kansas , she would have passed the law overriding the federal covernment gun control. that brownback let pass. sseems all democrats follow right along with owebunholes losing ways..

    You know guys, I went & read the Federal Register section related to this proposal. It states:

    “On January 16, 2013, President Barack Obama announced a series of Executive Actions to reduce gun violence in the United States, including efforts to improve the Federal government’s background check system
    for the sale or transfer of firearms by licensed dealers, called the National
    Instant Criminal Background Check System (NICS). Among those persons
    disqualified from possessing or receiving firearms under Federal law are
    individuals who have been involuntarily committed to a mental institution; found incompetent to stand trial or not guilty by reason of insanity; or otherwise have been determined, through a formal adjudication process, to have a severe mental condition that results in the individuals presenting a danger to themselves or others or being incapable of managing their own affairs (referred to below as the ‘‘mental health prohibitor’’).”
    So it clearly is intended to limit access to persons who are deemed mentally incapable of the responsibility of gun ownership through a formal legal process. As I read it, it does not suggest or state that your doctor will have the authority to input his opinion on your ability to own a gun directly into the NICS system. The proposed rules would simply make it possible and easy for the individual states to participate in the NICS system, as it relates to those persons who are deemed mentally incapable of owning a firearm.

      The detail you missed is

      individuals who have been involuntarily committed to a mental institution;”

      Then you look into how the process which ignores due process in all the states I checked can be and is abused.



      And of course you can use the information posted in the article written by Bob Livingston to see how these innocent sounding regulations are being abused.

        But, but they said they didn’t want to take our guns…ahhh, but they never said they wouldn’t make every effort to regulate gun and ammo purchasers either.
        It all depends on what the meaning of “is” is…?

          Yep. It’s all about defining “is”. :)

          Of course the real problem of the gun control debate is that liberals confuse mis-use of a tool with mere possession. The 2nd is quite clear that there shall be no regulations on the possession and carrying of arms.

          There can be and are laws regulating the mis-use of them. Such as murder and assault.

          We don’t need ANY laws regulating the possession of arms and we have plenty of common sense laws regulating the use of them.

            The biggest problem I’ve always seen is that those that make the laws have no common sense and those that support the making of those laws mirror the same kind of common sense of the law makers.

            Which takes us back…It all depends on what the meaning of “is” is…clearly progressive logic.

      That is already the case as the NCIS requirements stand now!

      Section 922(g) of the Gun Control Act prohibits certain persons from shipping or transporting any firearm in interstate or foreign commerce, or receiving any firearm which has been shipped or transported in interstate or foreign commerce, or possessing any firearm in or affecting commerce. These prohibitions apply to any person who:
      – 18, U.S.C. §922 (g) (4)
      Has been adjudicated as a mental defective or committed to a mental institution

      NICS is located at the FBI’s Criminal Justice Information Services Division in Clarksburg, West Virginia and provides full service to FFLs in 30 states, five U.S. territories, and the District of Columbia.

      Currently state participation is voluntary but every firearms licensee is required to contact the NICS system before transferring any firearm to an unlicensed individual. The NICS results determine whether receipt of a firearm by the prospective purchaser would be in violation
      of law.

      Also current to the NICS, In addition to local, state, tribal, and federal agencies voluntarily contributing information to the NICS Index, the NICS Section receives telephone calls from mental health institutions, psychiatrists, police departments, and family members requesting placement of individuals into the NICS Index.

      The point is that the HIPPA laws are being modified in VIEW of an EXECUTIVE ORDER that may well PROHIBIT firearms ownership to EVERYONE who has sought psychological counseling OR is taking a medication with psychoactive effects. Veterans who sought treatment for PTSD have been so denied.

    That’s how it worked in the old Soviet Union. All opposition was ruled to be mentally defective and sent to the camps. Soon, simply wanting to own a gun will be ruled a mental defect, and thus all applications to own guns will be denied. If you are mentally ill, you can’t have a gun, and if you want a gun, well, you must be mentally ill. See how that works?
