In response to Mr. Wood I would first like to share agreement with him on the cause of the Civil War not being nullification. I would also agree on the need to question authority and protect individual libery. However I disagree with him on Progressivism. As a progressive and a student of history I know all too well the dangers of Nationalism. My desire is not for a devote obedience to governmental authority but rather allegiance to the flag and to the Republic as the pledge so quaintly goes. My only concern is in keeping with the spirit of Lincolns famous maxim “A house divided cannot stand”. On matters of governmental authority or privilage perhaps I worry more about incompetent or unjust abuse of such authority rather than authority itself in certain fields or departments. Afterall I think very few object to having government regulations and agencies to prevent toxins or unhealthy chemicals from entering our water or our food supplies. And I think we can all agree that having regulations on child labor, women voting, and agencies to monitor pollution and help support our department of defense in ensuring domestic peace and safty is a rather good thing . Although on the last one perhaps we have gone a little too far so maybe in that area I would be all for reduction of the number of offices, agencies, and funding for that field-within reason of course. My point is as a progressive I can sympathize with Mr. Woods desire for questioning and managing authority. Where we disagree is that I feel that Mr. Woods comparison of progressives to nationalists is just as absurd an argument as saying we should be concerned by the Tea Party. Progressives and Nationalists are two different things. To believe in keeping united as a Republic is not the same as giving up personal liberty. With all due respect I have found that when people lose faith in a Republic is usually when they lose their freedom.

As Tom Woods points out so clearly. The supremacy clause is for CONSTITUTIONAL laws. A law that is in violation of the Constitution is null and void from its INCEPTION so can not possibly be part of the laws mentioned in the supremacy clause.

Who decides the constitutionality? The Supreme Court, the States and in the end WE the PEOPLE. Without our consent no law nor even the Constitution can have any power.
