New poll reveals Americans oppose gun regulation by cities As the Supreme Court hears arguments in a case that aims to overturn the Chicago handgun ban, a new Rasmussen poll has revealed that an overwhelming majority of Americans believe that cities have no right to impose similar bans.

Specifically, the survey found that 69 percent of the respondents say cities do not have the right to ban legal handgun ownership, while 25 percent believe they can do so.

“[This result] clearly shows that Americans have grown weary of anti-gun municipal demagoguery,” said Alan M. Gottlieb, executive vice president of the Second Amendment Foundation (SAF), an organization that brought the lawsuit.

“A victory in our case before the Supreme Court should send a clear signal to gun prohibitionists that arbitrarily disarming law-abiding citizens under the guise of fighting crime is an idea that has no place in this country,” he added.

SAF is joined in its case by the Illinois State Rifle Association and four Chicago residents, including Otis McDonald, for whom the Supreme Court case is named.

If the high court overturns the Chicago ban, its decision will incorporate the Second Amendment to state and local governments through provisions in the 14th Amendment.

The decision is expected some time this spring.

Since they don’t have any use for the Second Amendment, then EVERY dwelling [house, apartment, trailer, etc.] of these wonderful human beings should have a sign on the front door that says ‘We don’t believe in the right to bear arms. There are NO weapons in this dwelling. We HATE the Second Amendment.’
      Do you think they might have a damned fast change of heart? Do you think they’d see the “flaws” in their braindead philosophy?

          Tell your Gore-like neighbor that when someone breaks into his house, you will honor his belief that no private citizen needs weapons for any reason. Remind him that his lofty, anti-weapon ideals will be honored.
          Tell him he can thank whoever convinced him many years ago that every conscientious criminal who breaks into houses always listens to ‘reason’ (Mary Poppins said so).

            Now, regulations on guns? Sure…there are restrictions on what type of weapon can be owned by individuals already and as society and technology change, there will be others…get over it. NO RIGHT IS ABSOLUTE!!!

    If we don’t fight hard enough for the right to own guns and have permits to carry, we will lose that right. We are also having to fight to keep a person’s obsessiveness that everyone have a governmental run health care system from being crammed down our throats, too. It still amazes me we have to Fight to Keep a Right.

    I realize alot of people are scared of crime and domestic terrorism, but disarming law abiding citizens is not the answer to our problems. Every country that has imposed gun bans have watched their violent crime rate increase dramatically. Gun bans are not a way of fighting crime, they are a way to bring entire populations to their knees before a ruling class. We can not allow our freedoms to be disallowed, because once they remove one they just move on to the next one. If you diagree with gun ownership, your freedom of free speach and freedom of religion are also on their agenda. We can not allow them a single one of our freedoms. not one!

    Obama wants to control every aspect of our life from the day we a born to the day that we die. They are going to save money by dening care to the elderly first, then they will find others. Because they have bankrupted the social security system. The second admendment was writen in to the constitution to make sure that the states would never be able to infringe on any American citizen.     Criminal’s don’t care what law is passed or if there is a law or not. Does anyone really think that because you write a law on paper they are going to stop? I live near Chicago and even though there is a gun ban – crime and drive by shootings have continued and some years even excalated.
    Banning guns in Chicago was a hope to bring crime down and stop the daily drive by shootings caused by the idiotic useless and misdirected hoods that were involved in turf wars. Obviously it did very little good if any. People need fixing. Removing our constitutional right to bare arms only disarm regular citizens that need to protect themselves.

They wanted to prepare for the worst case senario in which our government would overstep their power, and deprive us of our right to life, liberty, and the pursuit of happiness.     ” … the right of the people to keep bear Arms shall not be infringed.” (It may be noted that the preamble phrase of the 2nd Amendment has no bearing upon the statement above and may be ignored as irrelevant to the understanding of statement)

    The 2nd Amendment is:
    1) An enumeration of a “right” (to “keep and bear arms”).
    2) An enumeration of an “individual” right by use of the lower-case “p” in “people” which refers to the “individual” rather than the collective, upper-case “P” in “People”.
    3) A “prohibition” against that enumerated “right” being “inhibited”.

    Under the 10th Amendment, this clearly applies to the United States government but what is often missed in reading the 10th Amendment is: ” … , nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    Thus, under the 10th Amendment, the 2nd Amendment is clearly a “prohibition” and therefore applies equally to the United States and the State governments. State governments are “prohibited” from “inhibiting” an “individual” from the “keeping and bearing of Arms”. It should also be noted that the upper-case “A” applies to the “collective” of arms disallowing any specific type of arm as might have been possible had it been spelled in “lower-case” (an individual arm).

    In other words, an individual has the “right” to arm themselves in whatever manner as may suit them and to be armed wherever they may be.

Throughout history, especially under Nazi and Socialist/Communist governments, the first action of dictators is to seize weapons from the citizens. Then it was easy for governments to kill 200,000,000 of its own citizens to consolidate power and seize total control over the surviving citizens.

    When was the last time a crime was committed and the police were there to protect the victim? They come AFTER the crime has happened and then investigate and usually don’t arrest anyone. My guns is my policeman until they arrive and I intend to protect myself from anyone that threatens my life, property or my family.

    If you follow the bleeding heart gun control people’s view, then it would follow that a pencil misspells words. People kill people whether by hand to hand, a knife, or a gun. A gun just doesn’t wake up in the morning and think it should go out and kill someone.

    I could point out a lot of instances where having a gun would have been good, like the Luby’s Cafeteria some hears ago. One woman inside had a gun and permit to carry, but it was in her car. She had to lay on the floor and watch her parent slaughtered by a nut case, but if she had had her gun she could have done something to stop it from happening. There’s the 10 year old girl that was home alone when home invaders kicked her front door in. She ran across the hall and got a shotgun, loaded it and blasted the first one as he got to the top of the stairway. The second one was shot as he was half way up. The two invaders had murdered someone a few miles away during another home invasion and were fully armed.

      When SECONDS count the police are just MINUTES away. Sometimes you just have to rely on yourself and we should be allowed to do that, as it is our right to as stated in the Bill of Rights. Not all murders are commited with a gun, but many have been prevented by the use of one.

    In the original Constitution (1789), the powers that were delegated to Congress (Article I, Section 8) made no mention of rights, and about half of the Founders believed that would suffice to prevent the new federal government from legislating over rights. However, others thought future congresses might misconstrue those powers, to include rights, and insisted upon adding a Bill of Rights (in 1791). The Preamble to the Bill of Rights reads:

    THE Conventions of a number of the States, having at the time of their adopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restrictive clauses should be added.

    Thus the stated purpose for the Bill of Rights was to add “restrictive clauses” “in order to prevent misconstruction or abuse of its powers” with respect to rights, where ‘its powers’ referred to the federal government. The Second Amendment reads:

    A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

    Viewing the Second Amendment out of its Bill of Rights’ context has misled many to misconstrue its “shall not be infringed” as a proclamation to all governments, including state legislatures as well as Congress. But, just as the First Amendment’s “Congress shall make no law,” obviously applies exclusively to the federal government, so also does the Second Amendment.

    In Barron v. Baltimore, 32 U.S. 243, 247 (1833), Mr. Chief Justice Marshall said: “The [U.S.] constitution was ordained and established by the people of the United States for themselves, for their own government, and not for the government of the individual states…the fifth amendment must be understood as restraining the power of the general government, not as applicable to the states.”
    In United States v. Cruikshank, 92 U.S. 542, 553 (1875), a mob of whites had disarmed two blacks (in Louisiana) and the issue was whether that action had violated the Second Amendment right of the blacks. Mr. Chief Justice Waite said: “This is not a right granted by the Constitution. Neither is it in any manner dependent upon that instrument for its existence. The second amendment declares that it shall not be infringed, but this, as has been seen, means no more than that it shall not be infringed by Congress. This is one of the amendments that has no other effect than to restrict the powers of the national government.”
    In District of Columbia v. Heller, 554 U.S. ____ (2008), the U.S. Supreme Court said: “We consider whether a District of Columbia prohibition on the possession of usable handguns in the home violates the Second Amendment of the Constitution.” After meticulous analysis of every word and clause in the amendment, the Heller Court stated: “In sum, we hold that the District’s ban on handgun possession in the home violates the Second Amendment, as does its prohibition against rendering any lawful firearm in the home operable for the purpose of immediate self-defense.”

    Just remember that that decision involved an ordinance of a territory (the District of Columbia), which falls under federal jurisdiction, it has no effect within the States. The Heller Court cited Barron, Cruikshank and other High Court decisions as precedents.
    Stated otherwise no State law has ever been held violative of the Second Amendment. In McDonald v. Chicago, the case now before the High Court, the issue is whether a state’s city ordinance, which prohibits handgun possession in a certain area, has violated the Second Amendment. Based upon previous High Court decision, it obviously does not, but whether it violates the “liberty…without due process of law” clause, of the Fourteenth Amendment remains to be seen.

      Here we go again. Since the Constitution only gave the Federal Government Limited Powers, none of which were the right to control guns, there would be no need to have a Second Amendment that only applied to the Federal Government. It would be redundant.
      It’s interesting to me that Liberals don’t argue that the First Amendment applies only to the Federal Government. Why is that?
      For decades their argument was that it wasn’t an Individual Right; that it only appied to a Militia. That was shot down in Heller v. DC.
      So now they are trying another tactic – That it only applies to the Federal Government. These people are slippery Devils whose main purpose is to find a way, any way, around the Second Amendment.

      Chicago’s gun ban ordinance was enacted in 1982 to stem the increasing use of firearms in crimes in the city. From the beginning, the ordinance has been an utter failure in accomplishing that goal.

      The U.S. Supreme Court heard oral arguments Tuesday in a case brought by Chicago residents who want guns for self-defense but are barred by the ordinance from possessing them. Judging by the justices’ questioning, a majority appeared to be leaning toward ruling the gun ban — and Oak Park’s similar ordinance — unconstitutional. That is the right thing to do.

      The argument turned on constitutional niceties. The Bill of Rights, including the Second Amendment right to keep and bear arms, originally applied only to the national government. As time went on, various amendments were “incorporated” so they applied to the states as well — the First Amendment right to free speech, for example. The issue before the court is whether the Second Amendment should apply to the states and their municipal subdivisions. A ruling is expected in June.

        JeffH, cite one case where a state law has ever been held violative of the Second Amendment. You will never find one. The confusion arises over equating the right to bear arms with the Second Amendment. Stated otherwise, there is no such thing as a Second Amendment or constitutional Right to bear arms, the right existed in the people before that. Every American had the right to bear arms before the federal government was created. The Bill of Rights was a restriction the States placed upon that government.

            JeffH, I wasn’t debating the issue, I quoted the highest court in the land as to what the Second Amendment means, and to whom it applies. If you would like, there are other High Court decisions (right up to and including Heller, which agree with that) that I could quote. If one’s belief disagrees with what the U.S. Supreme Court has held concerning to whom the Bill of Rights pertains, then one’s belief should be questioned. Rights are not dependent on any document for their existence, they are fundamental, natural rights that every american citizen has at birth. However, they do fall under the police power of one’s State.

Guns promote violence in a society. read the literature/statistics about death by guns. NRA states that “guns don’t kill people” that is the thinking of unrealistic nonsense. If you do not have a gun then you will not use it to kill someone. Hunting for food is a different story. I would not ban hunting for food. That is a right of anyone here in USA – but having a handgun where it is so easy to load and in the heat of an argument use against a loved one (most crimes of passion – handguns are used on loved ones) You can disagree just like I can disagree with what you say. This USA is a free country.

        Why do you think the Founding Fathers put the Second Amendment in the Constitution? If you can live with the idea that America would be safer without the Second Amendment, please consider moving to a country where people can’t have weapons.         Show me where the Founding Fathers relied on emotions over feelings. Josephine, do you know ANYTHING about history? Do you care?
        Go to a public library, do some quick research and learn what happens in countries where people can’t defend themselves. If you are not free to defend yourself, you can’t be free.

    I believe that legislation on hand gun control is the only way that this country will be safe. In New Mexico a new bill allowed concealed weapons to be carried into restaurants so these guns would not be left in cars. Is this country insane. This country has more deaths, homicides, accidents involving guns than any other in the world. Is this the civilized society that we want our children to grow up in – what example are we showing the next generation. That violence is the only thing we know. That without guns we are defenseless? Where does a free society draw the line? Using shotguns for hunting is another matter. People who hunt and eat their bagged animals need guns for their survival. But hunting and killing people are another matter. Think everyone about this subject deeply before being for any kind of weapon, for thinking that gun ownership in any shape or form is the basis of a civilized society. The wild west is over. We live in towns, cities that have rules to live by. Handguns should be banned. Also free speech is a right of this country. Remember that.

      Well Josephine, since you like your first amendment right so much, think about this. Without the 2nd amendment, you will not have the first amendment for very long, or any of the other amendments, or the C.O.T.U.S. itself. Why do you think the framers of the Constitution put the 2nd amendment in there?

      You say the wild west is over and we live in towns and cities that have rules to live by? So what? DO YOU THINK CRIMINALS FOLLOW THESE RULES? NO THEY DON’T! THAT’S WHY WE HAVE PRISONS & JAILS AND THEY’RE ALL FULL!!
      Do you live in a town or city where there is NO CRIME? I rather doubt it. Even if you happen to be a wealthy person of means, and live in a gated community/neighborhood, YOU ARE NOT IMMUNE TO CRIME!

      You may wish that YOU have a gun some day when some burglar/robber/rapist breaks into your house, and you have no defense except a cop on the other end of your phone line, who is going to arrive too late to help you. Think about it Josephine. A gun for your protection, is a lot more of a deterrent to a criminal trying to do you harm, than a cop on the other end of a phone line, that might be 10 minutes, or MORE away, & may not arrive in time to save you.

      Josephine Houser–A million laws can be made to prohibit handguns, however, criminals and lowlife will always get guns. The responsible people are NOT the ones shooting up the town and killing people. Why should the responsible people be held accountable for what the criminals are doing? With the economy the way it is, and all the crime in America, I prefer to be able to protect myself. Wild West? The criminals and gangs in America are to blame for this. Have you any idea how evil gangs and criminals are? Are you aware of the atrocities these creeps commit and the sadistic nature of these beasts? In some situations my mace and trusty old crowbar may not do the job. I will keep my little handgun and I know my husband will never part with his guns.

      Josephine, As I stated earlier, When SECONDS count the police are just MINUTES away. Sometimes you have to count on yourself. The Second Amendment states we have a right to KEEP AND BEAR ARMS, not the right to hunt and target shoot. The rest of us that keep and bear arms will help keep YOUR freedoms, while you ride on our backs and don’t help yourself. In fact you’re such an ingrate you don’t even realize, let alone apreciate that we are the ones doing that for you.

          James, enough all ready. We’ve seen you come back on every gun related/2nd Amendement post and use you lawyer babble. The Bill of Rights and the 2nd Amendement do protect that right which is a “guarantee” that our right to bear arms cannot be infringed upon. By saying our right “will not be infringed” is a protection that is a guarantee, no matter how you put it.

            JeffH, I agree that the Second Amendment protects and guarantees the right to bear arms from federal infringement, but saying that without the ‘federal’ qualifier implies the amendment’s “shall not be infringed” applies to all governments – and it doesn’t.

      Hi Grover, When the Second Amendment was written the definition of a militia was different than it is now. It meant a citizen army, there was no National Guard, it hadn’t been invented yet.Your uninformed statement has no validity.Every other amendment in the Bill of Rights is about individual freedoms, what makes you think the 2nd isn’t? You can’t interpret something written in the late 18th century with 20th century definitions.

        Absolutely EVERY ‘freedom’ given to us by the Bill of Rights comes w/ restrictions and regulation. The 2nd is NO different,and is already restricted and has been for decades. It’s a matter of public debate and discussion as to how far the 2nd is restricted,like everything else…it is not absolute. If it were,then the gun zealots could possess any weapon they pleased,like nuclear arms,dynamite,rockets,
        RPG’s,fertilizer bombs and on and on. Get over the fact that the people have the right to impose regulations on all rights,when those rights endanger or infringe on the safety of the greater society.

      There is no contrary evidence from the writings of the Founding Fathers, early American legal commentators, or pre-twentieth century Supreme Court decisions, indicating that the Second Amendment was intended to apply solely to active militia members.

        There is not, and never was, any “active” militia, unless and until activated by the need to defend against danger. An “active militia” is an ARMY. The militia referenced by the founding fathers consisted of every armed citizen in a given area, who could be, and were, summoned to active duty in time of war. The movie THE PATRIOT, with Mel Gibson, demonstrates that principle and practice, as known in colonial times, very well.

      The National Guard is no longer a state militia. Under Regan I believe the guard was declared to be the same as the army reserve. Also if you notice the Guard is being used as the army reserve now and if the reserve still exists it is much smaller than it used to be.

      Grover, I agree with Jim H. here. The D.C. v. Heller (2008)decision held that a D.C. ordinance, which outlawed possession of handguns in the District, had violated the Second Amendment, and voided it. While handguns are certainly general issue in the U.S. Army (I carried one) it isn’t exclusively a militia-type weapon. The Heller decision eatablished that the amendment’s “shall not be infringed” applies to individual-type weapons as well as militia-type, that is, it applies to all types of weapons now. That decision is now precedent in all federal territories – but not in the States, as many think.

      The gun zealots won’t admitt that guns kill far more innocent people than they save in self defense. Something like 20,000 homicides a year w/ handguns and only a tiny number of people defended by guns.
      We have saturated our society w/ guns of all sorts to the point where kids walk into schools w/ them and criminals can get them for next to nothing on a street corner. Very often cops are out gunned by automatic high power guns in the hands of crooks.
      We can thank the NRA and all the people who support it for this ridiculous state of affairs and literal arms race on our streets and schools and homes.
      It’s one thing to want to own a single gun for self defense in one’s home,though kids are more often the victims than criminals are, but to glorify and love guns and to support the drowning of our culture in increased numbers and fire power is sick.
      We think of America’s love of money as our new god,but guns are quickly becoming the bigger god still.
