New Mexico Sheriffs Standing Tall

Gun Owners of America member Dr. Ray Seidel alerted me to the stirring of freedom that is taking place in his village of Ruidoso, N.M. I have already reported on the first battle with Mayor Ray Alborn and how he tried to impose an unConstitutional gun ban in the village.

I recently interviewed Seidel on my Gun Owners News Hour weekly radio program and asked him about several acts of local interposition in the surrounding counties — all of which underscore the importance of the office of the sheriff and the militia.

For example, near Deming, N.M., is the Gila National Forest. The U.S. Forest Service wanted to make almost all of it off limits for people — until the militia of Luna County intervened. The militia told the Feds that it would resist any effort by the Forest Service to restrict access to visitors. The result? Visitors have continued to access all of the Gila National Forest.

In the Southeast corner of the State, many landowners have working oil wells on their property. The Environmental Protection Agency told the oil operators they would have to stop operating their wells because there was too much risk of harming the environment. At a town hall meeting convened by the EPA, a woman in her 60s rose to address the Feds. She pointed out that her land had been in her family for more than 200 years, and she was not about to let some official from an unConstitutional bureaucracy tell her what she could or could not do with her land.

The woman ended by warning the Feds that her family has many guns and a huge supply of ammunition and they would use all of it, if needed, to keep the EPA off of their land. The locals who had packed out the hearing room jumped to their feet with a shout and prolonged applause. That was in August. So far, oil is still being pumped at full tilt.

In Otero County, villages in the mountains are surrounded by forests. The county commission voted to establish an 80,000-acre plan to manage forest overgrowth. Residents wanted to cut fire breaks to protect their homes in Cloudcroft, but the Forest Service said, “No.” The residents responded that they had to for safety’s sake and were going to construct the fire break in spite of the Forest Service. Residents were told that if they cut down any trees, they would be arrested. But Sheriff Benny House told the Forest Service that if they made any arrests, they would be arrested for false arrest.

Not only were the trees cut down with no opposition from the Feds, but the first tree was cut down by Representative Steve Pearce (R-N.M.). I wish there were many more people like Pearce. The folks in New Mexico’s Second District are blessed with a Constitution-supporting congressman and a number of Constitutional sheriffs backed by the militias of their counties. This is the way that local governments can push back and help the Feds live within the limitations that have been placed upon them in Article 1, Section 8 of the U.S. Constitution.

As you can see, there’s a lot happening in New Mexico. Seidel has been at the center of a lot of it. Two weeks after the people of Ruidoso prevailed in the gun ban debate, the mayor decided to seek revenge. He went to the State capital of Santa Fe and met with Federal officials there. That same week, Seidel got a notice from the Internal Revenue Service stating that he had until a certain date to file his taxes, which he has refused to do for several years.

Seidel makes no secret of his refusal to submit to the IRS, which he considers part of an unConstitutional regime in Washington. The IRS intended to encumber his assets if he did not bend his knee. Seidel visited the county sheriff, who understood what Seidel was trying to do and told him he would have his back. The same was true for the village police chief, the same officer who refused to have his men arrest people who were defying the Ruidoso gun ban by carrying openly in the village council chambers.

Not only were the sheriff and police chief alerted to the possibility of IRS action against Seidel, but so was the militia in Lincoln County — more than 200 men who keep their rifles and battle bags in their vehicles 24/7. They can muster in about 30 minutes at any place in the county.

Seidel visited with the village assessor, who would be the official to place the encumbrances on his assets. Seidel explained (as he does with everyone) that Title 42, Chapter 1, Subchapter 1, Section 1983 of the Federal code would be used to sue her personally for violating his civil rights. That is, he would sue her if any of his assets were encumbered without having first secured a warrant from an Article III court.

Seidel has frequently argued that he will gladly submit to a Federal court (authorized under Article III of the U.S. Constitution) as opposed to a mere tax court (which is an unConstitutional creature within the IRS). As with many administrative agencies, the combining of legislative, executive and judicial powers within the same four walls constitutes the very definition of tyranny, which James Madison warned us about in Federalist 47.

Seidel has used Title 42 on other occasions. One involved a state trooper with an anger-management problem who falsely arrested Seidel’s son. Since being served with a Title 42 suit, the officer has been able to control his anger.

The deadline is long past and the IRS has done nothing, so the assessor is off the hook for now. But New Mexico is becoming a textbook example of how the Founding Fathers envisioned the States would rein in an out-of-control government.

As stated by Alexander Hamilton in Federalist 28: “It may safely be received as an axiom in our political system that the State governments will, in all possible contingencies, afford complete security against invasions of the public liberty by the national authority.”

If there were more sheriffs like those in New Mexico serving around the country, we would be well on the way to safeguarding our liberties against Washington’s “invasions of the public liberty.” It also might occur to the Congress that more examples of sheriffs interposing themselves might result in shrinking down the Federal government to do little more than just funding the national defense.

      I for one think it’s refreshing to see that DC cannot lay claim to keeping everyones testicles in a jar on the mantle.
      KALIFOHNIA may let them eviscerate them,and publically humiliate them,in the name of following suit,in lock step with the marching tree huggers union.But that doesnt mean that all states and local officials have to keep their heads firmly planted in the progressive collectives backside.
      Yay to the individuals rights to tread on U.S.soil,and not the gubments right to keep you off’n it.-CC.

        This is great. It’s exactly what I’ve been harping about all along: we must refuse to comply with this out-of-control, illegitimate government, making clear that they DO NOT have our consent.

        Speaking of California…I saw a video of a town meeting up north…Amador county, I think…where law enforcement and the local government has awakened to the intrusion of the feds, and are refusing to comply with the land grabs. It was so refreshing to see such determination among those who wield some force actually standing up for the citizenry, and pledging to follow the Constitution against this stampede of tyranny.

          Kate8, I don’t know about “Amador”, but can tell you that the town of Yreka, northern CA, in Siskiyou County, recently had a large gathering about the closing of the river(s) / taking over individuals property rights. The liberty of the individual landowners is supported by the local sheriff, and numerous other counties in both northern CA and southern OR (this geographical area also known as State of Jefferson) and their militia. “Power to the people!”

      It would be interesting to hear from the other side of the story. Although everything said in this article is relevant it comes across like a lynch mob in gloating about militias taking over and Seidel not paying any taxes. Government overreach can be a cancer yet all involved in this Sheriff’s department give me pause in support.

        Well i for one give full support! It’s about time someone stood up to these bullies. And this is exactly how it should be done. We cannot rely on the corrupt courts and the communist judges twisting our laws to suit their agenda. We have no other recourse but to use the threat of physical force and i have been saying this for a long time. What ails us cannot be solved through the courts and the ballot box. There are too many stupid people voting in communists masquerading as Democrats. It will eventuallycome to a real life version of the movie Red Dawn except the enemy will look and speak like Americans instead of Russian or Cuban but they will truly be the enemy within. I don’t see how any other outcome is possible. There can be no compromise between what defenders of Liberty believe in and what communists believe in. We are as different as night and day. Just as there could be no compromise between the Allies vs. the Nazis, The Colonies vs King George, The North and South in the Civil War, East and West Germany, North and South Korean and so on. One side or the other will have to prevail and the other side is going to have to surrender or die. We cannot keep going the way we have with the two sides always trying to steer the same car. It doesn’t work and it’s not what the FF envisioned. They never meant for their to be 2 political parties always fighting for their vision of this country to prevail. Gov’t was just supposed to be very limited and basically just provide national defense and everyone was just supposed to go about their lives. It was never meant to be this bohemeth it has become.

And THAT is exactly why this will eventually come down to a physical fight – The Second Civil War. The communists have infiltrated our gov’t and instead of descending on us via paratrooperswith guns blazing like in the movei Red Dawn, they have taken over our schools, our gov’t, our institutions etc and they have brainwashed millions of people into thinking like them and so instead of us fighting Russians we are fighting fellow Americans and we are supposed to be “tolerant’ of their views. In American, Communists are free to roam our streets and go on talk shows and even get voted into office and destroy our country silently and stealthily instead of being shot. Millions of Americans are infected with the disease called Marxism and once they are infected it’s like a cult – it’s very difficult to get them to snap out of it. So what do we do?

            The solution is simple to say, but hard to carry out. First, McCarthy was right about Hollywood! Vote with your feet and cut off their funding. The next thing to do,if possible, is move away from liberal areas. You’ll get no support there. Move to a conservative small town/suburban area with like minded people around you and organize the way those people did. We must also support local food growers and resist the FDA. Get them out of our food supply. By supporting local farmers, you’re choking corporate farms, giant food corporations and the FDA. There’s more, this is just a start. Let’s keep it rolling.

          Your commentary is essentially correct. The government has become the enemy rather than the protector of the People’s rights. The right of the People to protect themselves from tyranny no matter the source, shall not be infringed. A well armed populace is a powerful adversary.

          The viewing of all comments, which all are well taken . The first step, in my opinion, is to use the ballot box as a must in being the first line of defense. Secondly, a well regulated militia, under control of every county sheriff, is almost impossible in the present stage of an out of control Federal Government. Granted, the situation currently demands some degree of response from the people. However, how and when can a militia be governed by undecided “elected” individuals, which are standing on the fence in determining which side is the greenest.

          The local, city, town and village policing authorities, have demonstrated their allegiance of loyality, see world news reports and/or publications, to the system of big government rather than that of the people. When push comes to shove. Where will the majority of this nations military and law enforcement stand? It is very doubtful, that a county by county rag tag militia would tand any chance at all of being successful.

          I live in a state, which has 102 Counties, that have been unable to reach one issue of common agreement for decdades. Now I ask you, how is there going to be a militia properly trained, controlled and being successful in reaching a goal in defeating tyranny ? How can such issues of tyranny be defeated by the people, when the Nation’s Congress turns a blind eye to facts of such actions ? Politics are politics and politicians are “life long” dedicated parasites of corruption in government. Once again, in my humbled opinion, the first step is in the power of the ballot box in voting term limits not to excede two consecutive two year terms of office. Having the terms of election to be on the last year and first year of the sitting President’s last of the first year and first of the second year. The “””GOOD OLE BOY Click”” issue would be nearly impossible to exist.

        eddie I think a large part of the story has not to do with Seidel not paying the income taxes (That is something a great many people myself included question both validity and fairness). It was also about the Second Amendment and the likelihood that there would be armed resistance against an overreaching federal government.
        Can you imagine the headlines should the EPA decide to shutdown the oil wells during a shoot out? Or how about Forest Service shoots homeowners over firebreaks? It would have made a public relations nightmare for this administration. On a personal note I think that we need more of this kind of disobedience. It might end up forcing some common sense into the business of governing. As it stands now as exampled by attitude there is a mindset of superiority and not equality that permeates the fed. I doubt that the fed will just let these incidents lay. They can’t allow this to grow.
        By the way unless I made myself clear I support fully these actions. Replace the income tax with a sales tax where everyone pays including the 48% and I will support that too.

Lets get back to the basics we all stand behind this document but so few have actually read it “Constitution for the united States of America” (1787) adopted circa 1791. This document says nothing about a Democracy it does however say that we the people do have the right to do what NEW MEXICO has stood tall and made me proud to be an American. They have a right under the “Constitution for the united States of America” (1787) adopted circa 1791. We are a Republic always have been! An American and a UNITED STATES CITIZEN are two entirely different Beings One is real and one is FICTION We need to separate the two before we can understand what has happened to America and our Constitution. Every city every town every county every state needs to stand up tall while we still have States County’s And City’s to fight for. And it appears to me that the good people of New Mexico Have read the powerful document and understand it. Power is with the People. PAY TAXES WHAT your tax dollars don’t go to pay for any thing you need in your Community if it did most people would not be hurting What Pay Taxes So We can go POLICE The WORLD so we can create more WAR for the BANKSTERS! There is a National Movement underway now across America http://www.Republicfortheunitedstates.org consisting of those who want to re-establish our REPUBLIC government by “We the People” not the “Bankers’ Our present system of Government is a CORPORATION. Look at your driver’s license- All CAPITOL LETTERS… Look at your Social Security card all CAPITOL LETTERS. The movement is a “peaceful one” we just want our De Jure Government back not the De Facto one we have!

            Our Nation is following in the “footsteps” of the Roman Empire 1. Too many taxes and 2. Policing too much of the world. Rome expanded too much and overtaxed the people- History repeats itself!

        In case you haven’t noticed, the “other side” of the story (the “official” government lie) is ALL we get from the MSM, if we hear anything at all. After all, they can’t have us hearing how people are defying the “Law” and defending their Constitutional rights and everything they’ve worked for all of their lives. It just might catch on.

        But you just go ahead and keep on siding with the enemies of freedom. We’re all used to that, so anything else would make everyone suspicious.

          Believe it or not Kate and Mike there is another side to the story so don’t drift off to sleep yet. Yesterday anti-tax “champion” Douglas Bruce in Colorado was found guilty of fraud and avoiding taxes. Douglas has even run for public office and says the same things I hear on this site. For better or worse he is a constent cog in the wheel always jamming things up in Colorado. He once had alot of supporters but few follow him anymore because of his extremism’s. It’s one things to want fair taxes or even lower taxes but he didn’t want to pay any. You know,make the other guy pay. Well we are all the other guy! You have the Freemasons(militia) in Montana doing the same thing and refusing to pay any taxes. They also have mucho guns to prove that they won’t succumb to “government tyranny” (pay any taxes) as they say. How about the Sovereign Nations who refuse to pay taxes and killed those two police officers in Memphis over a traffic stop. They figured any one who works for the government deserves to be shot.There is way too much insanity on the right to fall for this entire story in the article. So I have no intentions to “emulate them” as Mike says.

            That is the thinking of the brainwashed masses. We are supposed to be free from direct taxes. The 16th amendment (which is what is professed as the act that allows for personal income taxes)changed nothing. The IRS has conned everyone into thinking so. It is unconstitutional. In states of the union the constitution affords the federal government very limited jurisdiction. Our labor is our god given right and the federal government has no right taxing it. The personal income tax is a fraud and hopefully one that will soon be exposed!

            Why would we want to finance our own slavery and demise, even if some of us somehow justify the slaughter of other people in their own countries?

            I would very much admire anyone with the guts to defy the money-grabbing feds, aside from the fact that such taxation is a violation of our humanity. When it is being used for things that we abhor, and yet those things are being done in our name, it is right and just to refuse to pay up.

            I can’t believe that you still believe that government is our benevolent BigBro, and has our best interests. That speaks volumes, eddie, about your mentality.

        So you agree with the unConstitutional laws being handed out by D.C.? The IRS is not a legitimate part of the federal government. The Constitution trumps all other “laws” passed out by D.C.

        I am seriously considering moving to New Mexico and joining a militia myself. The rerst of the country needs to emulate them, not denigrate them.

    It’s great to know that Uncle Scam’s addiction to power also has a downside. Cloudcroft, in particular, is located in an area where it takes effort to get there. It’s beautiful, and the idea that Uncle Scam has ‘plans’ for that area sickens me.
    Uncle Scam’s power addiction has limits, and like all bad habits, it will be countered by those who know the difference between justice and raw criminality. Way to go New Mexico!

They had been marching to their own tune until the tea parties across America rose to the occasion…had it not been for them, the debt ceiling would have been raised to God know where without a single heart beat. The Demorats should change their name to the Socialist/Marxist party as that is what they have become. Vote in 2012 like your very life and that of your family depends on it, because it literally does. If we allow these people to collasp America, we will never be able to get our Republic back. Every state should be doing what New Mexico did. When Gov. Perry of Texas tried to stop TSA from groping and violating your constitutional rights at the airports, Obama said he would shut down airlines from coming to Texas….had I been governor, I would has said go ahead if you think you are big enough…stop the airlines, and I’ll stop the flow of oil north. We have to, at some point, stand our ground and draw a line in the sand and dare them to cross it. The states, according to the Constitution, trump the feds on most things, and it is time for us to show them that they do not have tolitarian rule.

          Yes, you’re correct. The underpinnings of the fascist “union” started with Lincoln. Although Lincoln was venerated when I was taught in grammar school, it wasn’t too long before my opinion changed. However, I am one of the few, as can be noted by the fact that the Lincoln memorial still is maintained as is Mt Rushmore.

          You are also correct in pointing out that the federal government has been taken over primarily by those whom I would classify as sociopaths. Why not; what better platform for people with limited consciences to feed their egos and pocketbooks than in an overwhelming bureaucracy?!

          I can only hope that the stirrings which are evident result in a breakup of the USA union. It served its purpose in prior times, but it’s grown to cancerous size.

            I agree. Lincoln was one of the worst Presidents in our country’s history. He trampled the Constitution as if it were nothing, and every President since has used him as a model of how to strip our rights. He was forced into signing the Emancipation Proclomation, and that only freed the slaves in the rebellious states. Washington, D.C. is rapidly losing touch with the real world. They are starting to act like the aristocrats that the original colonists rebelled against. Some families (Kennedy in particular) seem to have hereditary seats in the House and Senate. If we the people don’t start acting, we will soon lose what freedoms we have left. Try to encourage everyone you know to vote. Remind them that it is their DUTY to do so. Too many people think that their vote doesn’t count. This is true only when they don’t vote. The people of this country need to get involved again, and fix the mess we have allowed to happen.

          I’ve come to think that Abraham Lincoln probably did exceed his constitutional powers when he invaded Southern states to forcibly keep them from seceding from the union. However, I don’t think this was the beginning of the federal government’s over reach. You can actually see signs of this beginning in George Washington’s administration. It seems many of our Founding Fathers, Alexander Hamilton chiefly among them, were in favor of a strong federal government from the very beginning. So, the struggle between Hamilton and Jefferson has never been resolved in the minds of the American people regardless how the courts have ruled, and will likely continue until the American population finally resolves it one way or the other.

Some Americans did rather well during those years while many did not fair a well.

            Today , we still suffer from what Reagan unleashed. Those were the beginning years of “disparity” that continue today. The years when lobbyist setup shop on Capitol hill and was warmly received.

CONGRESS, specifically the House creates the budget. The president merely asks for money from them. THEY are the ones who provide the money. Even the senate merely oks the budget. So to see who or what is really the cause you need to dig deep into which party is in Congress and how much more or less than the President asked for did they authorize.

            This is a non trivial task.

            Since Bob brought up President Reagan as one of the spendthrift Republican Presidents let us look for a moment just at his situation.

          There are many ways to look at the national debt. One thing is for sure. Our federal government has been accruing more and more debt year after year, regardless which political party held the Presidency. Another thing is for sure. We cannot sustain our government with all of its obligations at the current rate it is accruing debt. Most experts I listen to tell me that our social programs, especially Medicare and Medicaid, are the chief drivers of federal debt. It doesn’t appear to me that the new Obamacare law will do anything but make this situation worse.             My reading of the data tells me the federal debt has already gone up to just over $15 trillion with much more coming in social spending that’s on “auto pilot.” The owners of this debt can be divided into near equal thirds; 1) Federal reserve, Social Security, and other government programs, 2) foreign countries, and 3) American public. The sad part is that the real owners of #1 are largely American taxpayers because ultimately the only way to pay back loans made from government programs like Social Security is to increase tax revenue. In other words, the way Americans will get the benefits from these government programs is to increase taxes on themselves. At some point, the cost will exceed the benefit, so even if we increase taxes enough to sustain these programs, the cost in additional taxes will be more than the benefits we will receive. The other thing that Americans should know is that bondholders (#2 & #3)will take priority over American citizens who are promised social benefits. When the crunch comes, the government will have few options to balance the books. One will be to cut social benefits, because defaulting on their bonds will always be the last thing they will do. The sooner we modify these social programs to reduce costs, the less pain there will be.

They had brought in a true volunteer judge and real attorneys, and huge numbers of people showed up. It went on for a number of days, yet was completely ignored by the press.

            How many of you have heard anything about these citizen actions? The press ignores them, so officially they don’t exist.

            I’ll bet that if we could come together, all of us who seek justice and remedy for the superimposition of an false government upon the people of America, we could make an impact. I am a federal employee, removed from a supervisory position after making a private statement to a peer about my Christian beliefs regarding the Gay lifestyle.     Most inspiring and uplifting to know or become aware of like-minded patriotic conservatives.

    The part about banning access to public lands is a particular sore spot for me. In my state the proceeds from fishing, hunting and a multitude of other licensing and permiting fees generated by sportsman and outdoorsman are used by state sponsored agencies in the purchase of distressed ranches, farms and undeveloped properties. One of the main problems with this is that only a small pecentage of these properties are made usable by the public, and the majority are closed or not even known of by the public. In at least some cases these properties are leased out for cattle raising or mined for there resouces like timber. All of this occuring unbenounced to the public who finance 100% of their unconsented actions.

    As an example, several years back the state game and fish authorities annouced an out of season all you can kill hog hunt with no size or sex limitations in a previously unheard-of management area. I thought it peculiar, but my father was fond of advising his offspring never to look a gift-horse in the mouth, so I loaded up and headed out. Upon arrival I found a sign announcing the name of the management area that was so new that the paint was probably still wet. Shortly after entering we passed through new cattle gates and barbed wire fencing. These too were so new that the displaced earth from installing the fence and gate post had not yet been rained on. Before long we came accross our intended prey and proceeded to do what we came there for. At the end of the day and after we were sure that the adrenaline levels had subsided enough to deminish the gaminess of our catch, we proceeded to field dress. We immediately noticed that the flesh was an inordinate bright red color and possessed of a putrid odor which neither of us had encountered in a lifetime of hog hunting. After quickly examining the other animals amongst our kill we came to the conclusion that the animals were diseased and unconsumable.

    While leaving the area and trying to digest the idea that since all the animals were affected that the game and fish authorities had to be aware and willing to subject un-aware hunters to whatever disease that was beseiging these animals, that the final assault on us was yet to come when suddenly we found ourselves being stopped by a wildlife officer who proceeded to ransack our vehicle searching for God only knows what.

    Hind-sight being 20-20, I have put together a an un-confirmed scenario that to me anyway, logicaly explains the happenings of that day.

    As I mentioned earlier, the state uses proceeds to purchase property and in some cases leases said properties to cattlemen. I suspect this was just about to happen when the prospected cattlemen discovered that the ferel hogs present on the property were found to be diseased which would put in jeopardy the eventual sale of cattle.

    Well the state had to do somthing quick and in leiu of hiring professional hunters they opted to employ the public who not only work for free, but also pay for the privilege.

    As a result of this and as you may well expect, this and other government agencies have earned the right for me to trust them about as far as I can toss an elephant. Beware, my friends!

They regulate oil, gas, and geothermal activity in New Mexico and “gather well production data; permit new wells; enforce the division’s rules and the state’s oil and gas statutes; make certain abandoned wells are properly plugged; and ensure the land is responsibly restored.”

I was glad to see this article on people standing up and glad to see people are getting a clue about our government. I talk to everyone I come in contact with about the NDAA bill and corruption in DC. 8 out of 10 are oblivious to the fact that their elected would even entertain the thought of detaining American citizens. It is our job to inspire others to pass the plate of information, even if we don’t always agree on every thing. This opens other minds to explore and take appropriate action within their own communities.

Now in his second go-around as the Gov.he has decided to abandon the death penalty totally during his current term. My point being is that the people are asked what they want and express their desires in the form of a vote yet this bozo thinks he has the right to ignore the very people that put him in office. Now the worst part; the good voting citizens of Oregon haven’t got the kahonies to stand up to him & fight. I certainly would if I had the where-with-all.         Kitzhaber is a well admired and respected governor. He refused to sign death warrants because the system has flaws and there was the chance of an innocent being snuffed wrongfully.

        FYI…here is a VERY interesting read. A letter to the Editor by the death row inmate who’s scheduled execution Kitzhaber placed on hold. Now I don’t know about you, but if this guy thinks getting snuffed is better than staying locked up, I’m not one to be sympathetic to his wishes.

        On Nov. 22, 2011, Gov. Kitzhaber with a tear in his eye knocked the dust off his conscience and committed an extraordinary act of heroism — he spared me from an eternal dirt nap that would have taken place Dec. 6, 2011. On Dec. 7, I awoke and said to myself “I love the smell of sweet limbo in the morning.” Four more years of incapacitation, to me, feels like Death by Kitzhaber.

        Rumor has it that Kitzhaber’s reprieve (one that I did not request) carries with it no appellate rights to challenge this intrusive intervention. As in the early days at Guantanamo Bay when enemy combatants could be held indefinitely without due process, Kitzhaber (by virtue of his reprieve) has declared me an enemy combatant to his conscience.

        Like the folks at Guantanamo I have been stripped of any due process or due course of law for the duration of this moratorium. Ironically, my rights have been taken away in favor of this war on an “inequitable system” and an “unworkable system that fails to meet the basic standards of justice.”

        I am not able to appeal or challenge this reprieve. Perhaps the governor was referring to some other basic standards.

        By the way, I know that some people have opined that my hope of attracting publicity to the injustices of capital punishment in Oregon through my own execution somehow meant that I was “delusional” and had an “irrational understanding” of the death penalty. Since it turns out the governor shares some of my basic concerns, I wonder if the same labels will be applied to him by the anti-death penalty crowd who wanted to save me from myself?

        Anyway, in light of Kitzhaber’s reprieve, I have decided to change my name for the duration of this mora-”horror”-ium to Gary Che Bin Laden Sir William Wallace Bobby Sands Haugen. Thank the Gods I still have that right left.

    This is a great article and I thank you Mr. Pratt for writing it. Fed. Encroachment on State’s Rights, and thereby on State’s Citizens is becoming more and more commonplace. It would not hurt one bit, to start making Fed. Officers, Agents, etc. show their credentials, show the paperwork that they claim justifies what they claim to be authorized to do, and arrest them for False Representation if what they say is not true. Stopping them for trespassing is also a way to keep government snoops from searching property. Fear of them keeps us down. We shouldn’t have to fear our own Govt., but then that is what the Second Amendment is all about, isn’t it.

          They(government) do have the right to have certain usage on public lands. Some are strictly recreational,some are watersheds with no development and some are allowed for grazing. Doesn’t mean anyone can go in and cut down trees when ever they like. That is more like stealing or destroying what belongs to everyone. Now if you don’t like paying taxes then don’t pay them.That is your choice when they come after you so don’t be crying to us. There is a difference between bravery on issues and being stupid which forces someone else to pay more.

            First…read the article “The Commons” by Barry Commoner. That will give you a good concept behind the national parks and federal lands. The Commons is also the foundational theory for our enironmental laws, most of the Power of the cetnralized form of givernment we have, and our military defense make up. It’s not just the locals who have an interest in those lands…it’s all of us.

            Recall ever hearing the preamble “WE, the People of the United States …”. That dicument recignizes to people of this nation. Each of us as individuals, and as a whole. The people and The People. The many and the one.

            As to the 16th not being part of the Constitution (as amended)…I’d say there are a few folks sitting in prisons around the country who have argued that line…and received the same response from the Courts as everyone in history has. Have fun thinking it through cooling your heels in the Big House.

            Interesting enough…you will not be tossed into jail for not filing tax returns. They can’t do that. What folks get tossed into jail is filing false returns. THAT is the crime… Not filing is not a jailable offense (I don’t think). But they can come after you and take all you have collecting the debt owed to The People.

            Chew on that for awhile…

        Flashy, I don’t claim to be a History PHD holder but I remember that big businesses and the Crown were stealling from the Colonists. They wanted a different enviroment then what they had in Europe and the Crown followed them here to continue there rule. Our country has gone down that road and the basic wants and desires of the citizens are not considered anymore. Although this article doesn’t show both sides of the argument it points out one thing. The citizens in this case are tired of it and are not going to take it anymore. That is what I meant by remembering our history and the revolution. Nothing political in my comments at all.

      FYI..Obama signed the law and attached a signing statement that he intended not to implement said provision. Such practice was sued rarely by sitting Presdients up through 1980. up to then, it was used 75 times the first being by Munroe. It has been viewed by a majority of Constitutional scholars as being unConstitutional enforcement of Presidential duties but never challenged in the courts. George Bush II issued over 500 “signing statements’ during his eight years, the next highest usage being Ronald Reagan, Bush I then Clinton. Obama has issued 18 to date. The least since Carter.

      The most controversial uses of “signing statement’s” were by Bush II who accompanied the statements with ‘explanations” which in effect reversed the statutory language.

      In theory they carry no weight of law after the term of the signing President as they are only announcements of intent by the sitting administration.

    Having lived half my life in the great state of New Mexico I look at this story with a juandiced eye. Sure the southern half of the state is great but also sparsely populated. It has a very good Congressman, Steve Pearce, and its largest city is less than 200,000. Half or more of the land of NM is owned by the Fed. Its fantastic that people are standing up to these lunatics. If you consider the northern half then that’s a different story. There you have Albuquerque and Santa Fe. Both are overflowing with liberals, and assorted nuts and flakes. When the fedgov says jump, THEY JUMP! If you think the Santa Fe ring was stopped before NM became a state, you should check it out now.I think its great that folks stand up to the fed nincompoops but, they will receive NO HELP (from the rest of the state) if the gov pushes harder!     Great story. Too bad many of the posters support one portion but when it comes to the tax issue fall back into THEIR SOCIAL CONDITIONING. I bet not one of those individuals who questioned the validity of Dr. Ray Seidel’s position on the IRS have even read one sentence of the TAX Code. The tax code which is 100% Constitutional when it is applied correctly. We as a society have been tricked, conned and bullied into providing “false witness statements of taxable activity” against one another through the various forms that are signed and attested to by people who have not even read those forms or what they actually imply.

    THE PERSONAL INCOME TAX IS NOT AN EXCISE TAX

    The personal income tax is not an excise tax.

    Lately, there is a lot of information, including that from a few attorneys, arguing that the personal income tax is an excise tax. This is not correct, nor is this a legitimate argument, and this short paper is provided to explain why the personal income tax is not properly recognized as an excise, but as a tariff.

    First, both tariffs (imposts) and excises are indirect taxes under Article 1, Section 8, Clause 1 of the Constitution of the United States, which states:

    “The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;”

    Blacks law dictionary tells us that a tariff is a tax, or schedule of rates for a tax, imposed upon foreign goods being imported into the country, or imposed on foreign activity occurring within the United States (America, – including the fifty states).

    The Constitution, in Article 1, Section 8, Clauses 3-5, gives the federal government absolute jurisdiction over all foreign matters, affairs, and agreements with foreign nations, and over foreign persons in the U.S. This is done so that the fifty states may present one consistent face to the world to deal with in trading with the United States, rather than having to keep track of fifty different agreements, depending upon which state they were doing business in. This jurisdiction over foreign affairs gives the federal government the power to tax both imports into, and the foreign activity of foreign nations and persons in, the United States.

    An excise tax, on the other hand, as stated by the Supreme Court in Flint v. Stone Tracy Co., 220 U.S. 107, 31 S.Ct. 342, 349 (1911), are:

    “Excises are taxes laid upon:
    (1.) the manufacture, sale or consumption of commodities within the country,
    (2.) upon licenses to pursue certain occupations, and
    (3.) upon corporate privileges;”

    In further identifying and describing the nature of an excise tax, the court held:

    “.. the requirement to pay such taxes involves the exercise of the privilege and if business is not done in the manner described no tax is payable … it is the privilege which is the subject of the tax and not the mere buying, selling or handling of goods.”
    Flint, supra, at 151 -152

    So we see that excise taxes are taxes on taxable activities involving commodities, the possession of a license (like ATF licenses), and corporate privileges. Excise taxes are not taxes on general occupations (or on the work of citizens conducted by constitutional right), rather than on work conducted under a federal license or corporate banner, or involving commodities.

    Some of the confusion on this issue of “Is it an excise or a tariff ?” comes from the Supreme Court itself. This is because the Court appears in the Stanton decision in 1913, where the court is testing the legitimacy of taxing the income of a mining corporation derived from its mining activities, to uphold the CORPORATE part of the income tax provisions of the tested legislation as an indirect excise. Also, in the Brushaber v. Union Pac. R.R. Co., 240 U.S. 1, 36 S.Ct. 236 (1916), the court stated,

    “Moreover in addition the conclusion reached in the Pollock Case did not in any degree involve holding that income taxes generically and necessarily came within the class of direct taxes on property, but on the contrary recognized the fact that taxation on income was in its nature an excise entitled to be enforced as such unless and until it was concluded that to enforce it would amount to accomplishing the result which the requirement as to apportionment of direct taxation was adopted to prevent, in which case the duty would arise to disregard form and consider substance alone and hence subject the tax to the regulation as to apportionment which otherwise as an excise would not apply to it.” Brushaber, supra, at 16-17.

    However, one should carefully note that despite its above referenced reasoning, the Pollock court did not uphold the income tax legislation tested in that case as an excise, but rather struck down the legislation completely as an unconstitutional attempt to tax directly without apportionment. Also, this statement by the Court seems to ignore the fact that “income tax” had already been previously enacted once in 1861 as an “Income Duty” laid on foreign imports, and also as an “Income Duty” on the pay of officers in the employ of the United States, i.e.: the federal government, Union army, or navy.

    So apparently, “income tax” is not simply “in its nature an excise entitled to be enforced as such”, but is actually, only entitled to be enforced in exactly the manner in which it is actually written in the specific piece of legislation being tested by the Court. That legislation generally identifies itself what type of tax the income tax laid by that specific piece of legislation is deemed to be.

    So, what we really see, is that any income tax laid by any specific piece of legislation, is not necessarily an excise tax, because each specific piece of legislation must itself be carefully examined to correctly identify the true nature of the tax laid by that legislation, without assuming anything about the nature of that tax or type of tax in previous pieces of legislation, or previous legislative attempts that were rejected, like in Pollock.

    So what does the Supreme Court tell us about the income tax legislation tested in 1913? The first sentence of the Brushaber v. Union Pacific R.R. Co, 240 U.S. 1 (1916), states,

    “As a stockholder of the Union Pacific Railroad Company, the appellant filed his bill to enjoin the corporation from complying with the income tax provisions of the tariff act of October 3, 1913.” Brushaber, supra, at 9

    Here the court clearly tells us that when dealing with the provision of the income tax, we are dealing with the provisions of a tariff (specifically, the Underwood-Simmons Tariff Act). Tariff acts do not lay excise taxes applicable in the fifty states, they generally lay and impose a tax in the form of a tariff on foreign goods or foreign activity entering the U.S, or as an impost in the form of a duty on income, as was done in 1861. Tariffs on foreign goods and imposts on foreign activity, however, do not tax domestic activity in the fifty States.

    So let us examine, how the tax is implemented in the law, and contrast that with what we know about each of the two types of indirect taxes at issue here.

    First of all the income tax is laid on the “taxable income” of “individuals” under Section 1. Excise taxes are not laid on “taxable income”, or “individuals”, according to the Supreme Court in the Flint decision identified above, but on: 1 – commodities, 2 – licenses, and 3 – (corporate) privileges. Is “taxable income” a commodity, a license or a corporate privilege? No it is not. But could there be “taxable income” in regards to a duty to pay a TARIFF on foreign activity? As was already done once before by the federal government?

    Excise taxes are not laid on “individuals” or “taxable income”, but is laid on the taxable activities identified in law (ATF licenses, gasoline fuels, etc.). Excise taxes are not graduated, and do not have tax “brackets” for different groups of persons, because under the Constitution the excise tax must be uniform. Excise taxes are not dependent upon nationality, residence, or citizenship (or lack thereof) for their collection, as the collecting the tax at the source is dependent upon being effected by the withholding of tax only from non-resident foreign persons. Excise taxes are imposed on everyone involved in the taxable activity, not just foreign persons. A tariff on the other hand only applies to foreign goods and foreign NON-RESIDENT activity.

    Next, the excise taxes under U.S law are contained and codified as the provisions of Subtitles D and E of Title 26. The income tax is in Subtitle A, and in fact, Subtitle A is, in its entirety, simply the codification of the original Underwood-Simmons Tariff Act of October 3, 1913 identified by the Supreme Court in the first sentence of the Brushaber decision, and nothing more. There is no domestic “excise”, deceptively, intentionally hidden inside the tariff act. Again, Subtitle A contains the tariff act and its provisions, and Subtitles D and E contain the excise taxes laid under U.S. law. The income tax is in Subtitle A, laid as a tariff that is collected at the source by federal tax collectors in the form of Withholding Agents who shift the burden of the tax they pay from themselves to the subject persons from whom the tax is collected by withholding money as tax from payments made to those subject persons. The income tax is not contained in Subtitle D or E with the other excises.

    Finally, if the income tax were in fact an excise, its provisions would not specify different treatment for subject persons based on nothing other than residency or citizenship. An excise is collected from everyone engaged in the identified taxable activity, without exception, in order to be uniform in its operation as required by the Constitution. Excise taxes do not provide for different treatment of persons based on citizenship or where they reside. If they engage in the taxable activity, they pay the excise regardless of where they reside or who they are. Ask anyone with a liquor license.

    So, when we see that the Withholding Agents are required to deduct and withhold income tax only from foreign persons in the form of non-resident alien individuals and foreign corporations, but not from resident aliens or domestic corporations involved in the same activities, we can readily recognize that this is not an excise on taxable activity, but a tariff on foreign activity conducted in the United States, laid as a duty imparted on domestic entities to collect the federal income tax from foreign subject persons (see 26 U.S.C. Sections 1441, 1442, 1443). Again, as soon as the non-resident (alien) becomes a resident (alien), the collection at the source of income tax by withholding from his or her pay terminates completely and is ended, because U.S. residents are not required by law to pay a tariff on their domestic activity or earnings.

    If the income tax was in fact an excise tax, this differentiation of treatment of the two foreign parties would not exist in the law. It only exists to properly limit the application of the tariff ONLY to foreign activity, and never to DOMESTIC. As soon as the non-resident alien individual becomes a resident, his economic activity is removed from the jurisdiction of the federal government over foreign affairs, and is moved under the jurisdiction of the State in which the alien now resides. As activity under the domestic jurisdiction of a State, the “income” earned by the resident alien is no longer subject to collection at the source by withholding of the federal income tax tariff that he/she was subject to as a foreign person conducting foreign activity under the jurisdiction of the federal government, as a non-resident alien.

    That would not be true if the income tax were an excise tax – which doesn’t care if you are resident or non-resident, domestic or foreign, only that you engaged in the activity taxed by the excise legislation. Only a tariff differentiates between foreign and domestic activity to determine subjectivity to the tax.

    THE INCOME TAX PROVISIONS IN THE LAW ARE STILL THE ORIGINAL TAXING PROVISIONS of the (Underwood-Simmons) TARIFF ACT (of October 3, 1913). As such the personal income tax laid in Subtitle A IS A COLLECTED TARIFF, NOT AN EXCISE. If there had ever been another law enacted by Congress, expanding or replacing the income tax provisions of the original tariff act, THERE WOULD BE SOME OTHER CASE besides Brushaber (and Stanton) addressing the constitutionality of the (new) tax. There are no such intervening Supreme Court cases because there has never been a new law that changed the original implementation of the original tariff act. So, no other challenges to the law were ever necessary, or allowed. Unfortunately now, those original, standing, controlling Supreme Court decisions are just ignored by the federal courts, because they are no longer understood by the courts (making a distinction between personal and corporate taxation), who cannot understand (or admit) the monstrous travesty perpetrated on the American people across the last 65 years of de-facto federal tax collection and enforcement operations, since the nationalistic patriotic fervor of the American people after the end of World War II led to their allowing the direct withholding of federal taxes from their pay WITHOUT STATUTORY SUBJECTIVITY TO THE SUBTITLE A INCOME TARIFF TAX ever existing in law.

    Great! The same Kennedy was talking about and was trying to stop. The secret society.The Feds and CIA get to big as they say for their pants. Has me even wondering if they did not have something to do with Lincoln’s death too as Booth may well have been just another Oswald patsy??? Kennedy had listened to 5 star General Douglas McArthur’s advice and quickly corrected his mistake of even sending a small number of troops to Nam. His exe. order was sent to halt any action of war there and have the troops come home and let the north and south Vietnam hopefuly settle things with diplomacy but he was killed off my LBJ and his boys in Texas and the CIA and HE REVERSED Kennedy’s order and actually started the war and sent many troops to later come back in body bags….I do not think he cared as his buddies were making money off the war selling arms to the gov. Jack Ruby knew Oswald as they did a gun deal or so and that is why Jack Ruby one of LBJs gofers wanted him snuffed. Go to YOU Tube you can see Kennedys body guard to his righ shrug his shoulders several times as if to say WTF??? They were ordered off so the CIA could get clear shots unlike in Tampa,Fl Nov.18,1963 where they are all in place protecting the president so you can see Kennedy did not order them off just to get more votes as some numbnuts stated. See also Hunt’s death bed confession(former CIA)and LBJ’ former mistress saying LBJ told her the night before the murder that Kennedy would never humiliate him again and he said that is not a threat it is a promise. Bobby Kennedy asked LBJ later…Why did you have my brother killed? Bush sr was part of the CIA then and NIXON knew about the plot. He said the warren commission was the biggest hoax in history. You can hear his recently released taped phone message as well as LBJ calling Ford asking for a favor and getting it later.Jerry had no choice as LBJ had put him on the warrent commission years earlier.Check it all out. TRUE we have to watch out and also let others know of Gov.tricks.

    I think you are refering to Jefferson’s personal letter and not to the constitution as the constitution does not say anything of seperation of church and state to my knowledge. Many people over the ages have mixed them both up.

    I think you need to check as one of many of the “founding fathers” Ben Franklin did not even have to pay income taxes in his day. They were FREE. They did not get away from the tax tyrant in England just to come to Free American then to put their necks back in the tax noose. Come on people. Wise up.

    Some clear thinking analysts of our current situation have said that the basis of this country’s skewed government is that the anti-monopoly laws have not been enforced. The monopoly’s stranglehold on our elected representatives, the courts, regulatory agencies is ASTOUNDING! If we do not take back this tool all our attempts to bring about change are no more than “gumming” them to death.

    Will you please verify that section about what portion of the U.S. Code that Dr. Seidel used to protect himself. I just tried to look up Title 42 Chapter 1, sub chapter 1 and I don’t see anything that make me think that it could be used as you have described. Here is the URL I followed:

    I have said it once before Mit Romney almost hit the bullseye yet miss the target completly when he said “the goverment is broken” No the goverment is not broken it is run by corrupt people. There is a simple solution We The Peopel need to put forth a Balot proposal that requires every one in the Congress to adhear to all laws that they pass, and make it retroactive for say, 20 years, removing any statute of limitations. Call it the, All Men are created Equal, ballot. Anyone found to have broken laws are to face a ‘Citizens Cort and Judge” with the punishment to follow the law at the time of the crime and any benifits recieved from the breaking of the law to be removed with intrest and returned to the debt of the country. if the have hidden the assets then take thier asets and those that have benifited from the unlawfull actions. See simple.

    The original plan was that the States were the tax payers and the Federal Government was the ‘State’ for people in the possessions and territories. The only definition that I have found in Federal law for income is an 1885? Supreme Court decision that labeled lawyers fees as ‘income’.

    That the money flow has been reversed and goes to the States depending on seniority and effectiveness of representation seems to be the start of the malfunction.

    Better than term limits might be paycheck limits – the Government could issue 12 years of pay without a special bill for each check. No amendments or riders. No exemptions. That would root out empire building rogues like j edgar as well as most of the ‘sold’ people.

    We have the best Congress money can buy – problem is they won’t stay sold.

    We are having trouble getting contact information on many of the sheriffs in the various states. If you are able to help us with this, it would be fantastic!! We need the county, sheriff’s name, address if you have it, phone number and email address. It is vitally important to get these as soon as possible so that we can get the invitation out to all of them. Please, if you have this information for your entire state, it would be super. Someone told me that he, at one time, had a list for sheriffs for the whole country but cannot find it. We have lists of some of the states but most of them, we do not.

    Please help us with this. We have placed the invitation on the web site, http://www.countysheriffproject.org, at the bottom of the page. You may print it off and hand it to your sheriff just to make sure he/she was not overlooked. Encourage him/her to attend. We have some sheriffs who were sent the invitation already and claim not to have received it. Our system is not perfect. However, we are doing our best and have some outstanding people onboard helping. Your assistance would be greatly appreciated.

    Fortunately, there are many people who can see how important this project is. Unfortunately, there are not enough of you who understand just how important this project is. If we can get enough sheriffs onboard and in alignment with the Constitution and Bill of Rights, it could apply enough pressure around the country to all the others who are yet non-compliant and still status quo. You may be surprised at how many sheriffs and even governors who are unaware that the State’s power/authority supercedes that of the US government.

    If you all understood how important this project is, we would not still be groveling for donations and working so hard to get exposure. There are a handful of us who have put a tremendous amount of time into this effort. It is an effort that will benefit EVERYONE of us. This is one of those things that in order for us to fix it, we must fix it for everyone and not just ourselves.

    Tom Woods, Joe Bannister and others are going to be part of the educational platform at the convention. All the sheriffs who have been standing up against the federal government are going to be attending and many of them will be speaking. I cannot stress enough the importance of this conference and getting your sheriff to it. Getting Constitutional sheriffs and getting them informed is critical to bringing our country back under control and in the hands of the People. Now this is a private conference by invitation only but on Tuesday, the day after the conference, there is a public meeting scheduled at the hotel to brief the public about the conference.

    The federal and even state governments are trying to figure out ways to neuter our county sheriffs. In Connecticut, the state legislature voted to remove elected sheriff positions. So Connecticut doesn’t even have sheriffs. Some governments are cutting their sheriff’s salaries to poverty levels trying to force them out. I heard that some salaries have been cut to $26,000 annually for a sheriff!!!!!! How insulting is that??

    This is sooooo important that I cannot even articulate its importance. The time available to get something done is collapsing quickly. Your support in this matter is absolutely crucial!!!! Please help get this information out!
