Massachusetts Politician Suggests Random, Unannounced Police Searches Of Gun Owners’ Homes, Locals Get Angry

A local politician in Swampscott, Massachusetts, recently said residents’ 4th Amendment protections should be explicitly violated if they insist upon exercising 2nd Amendment rights in the town.

Swampscott Selectman Barry Greenfield claimed that because local police “need the ability to enforce the state law” which “requires Massachusetts gun owners to keep their firearms locked away or rendered inoperable,” officers should not be hindered in their ability to walk into local gun owners’ homes unannounced and verify compliance.

If that sounds like a proposal for complete violation of the Bill of Rights, it’s because it was such a proposal.

Commenters on the story about Greenfield’s proposal published in the Swampscott Patch quickly called the Constitutionally-clueless politician out.

“Go ahead show up at my door and ask. you will get a loaded 357mag in your face. I am a law abiding citizen and gun owner. This moron obviously has never heard of the 4 th amendment. You know the one about unwarranted search and seizure,” one commenter wrote.

Another posted, “Frog march this guy down the steps of Town Hall, he’s unAmerican and has no place even being near an American government of any size. And, as I understand the impact of one of the recent SCOTUS decisions, (DC or Illinois?) when the licensed gun owner is at home, the guns do NOT have to be locked up and ‘rendered inoperable’. There is little point of having a gun in your house for self defense if it has to be locked up.”

And another commented: “Have any of you back there ever read or even know what the US Constitution is? Your inspection program would be an infringement on the 2nd Amendment causing a violation of the 4th Amendment. You folks need to remove you head from your lower intestine and get some fresh air.”

The public backlash, both online and, presumably, throughout the town, lead Greenfield to rethink his proposal.

He said in a statement: “I’d like to take a minute to apologize to any individual who believes my intentions were to create any type of procedure that would violate any amendment in the Bill of Rights. I have no interest in having our town seek out the ability to violate the fourth amendment and perform warrantless search and seizure of personal property. If anything I have said or written gave that impression, I apologize.

“My intention was simply to learn more about whether or not an existing law could be enforced within the strict boundaries of the Constitution.

“In regards to those who seek my resignation, I will say this: I have spent every day of my seven years in Swampscott – whether as a parent, teaching volunteer, coach, committee member or selectmen – trying to make this town a better place to live. I will continue all of those efforts for the foreseeable future.”

    • ThomasThePaine

They will not: We are a threat to their ambitions. . .

      • Daniel F. Melton

So, we end the threat by ending their ambitions.

      • Deerinwater

They ? being people like this?

  • fahkir1

I seriously hope the local towns people vote this jackhole out next time possible. Or even do a recall on his butt!.

    • podunk1

How could anyone with an 8th grade education not understand one sentence with 27 unmistakable words and defy it, knowing it is a supreme law of the land that takes a ratified amendment to change anything about it? The Constitution is a covenant guaranteed TO and for the people, not government corruption. How many ways can they engage in sedition and treason without RECALL! The folks on this site are talking Constitution, recall, and fact – it’s the only way to save the USA.

Amendment II: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” IT’S NOT NEGOTIABLE!!!

Constitution Article 6 Clause 3: “The Senators and Representatives
before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution…”

Judicial (#2 of 2 oaths) oath of office (all): “I, (name), do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. [So help me God.][62]” HOLD THEM TO IT – FEDERAL, STATE, & LOCAL!!!

Put the fear of God, country, and Constitutional justice in any who will mock or defy the Constitution. Pass it on!

  • profchuck

Do we have clear cut penalties for violating the constitution? If not we should have.

    • Valor

No. And in today’s post Constitutional America they would be ignored if we did.

  • OLD FART MARINE

Would like to see this politician find a more fitting line of employment, perhaps in the food service or industrial cleaning fields! In addition, re-read the constitution and all the amendments to include a book report of no fewer than one thousand words.

    • http://www.thefreedomtrainusa.com/ FreedomTrainUSA

How about moping floors in a Federal Prison….

      • Valor

        I vote for that!

        • OLD FART MARINE

I’ll second that nomination. “Be it hereby resolved that he shall serve the remainder of his term in the Local Federal Prison, as “The keeper of the dirt”

    • rivahmitch

I was thinking more along the lines of an ingredient for fertilizer. Semper Fi!

    • Deerinwater

how does people that have such ideas manage to get elected?

  • Valor

As I have said for years, if one Amendment in the Bill of Rights is swept under the rug, so can and so will the rest. In this case, this smarmy politician advocates throwing out two at the same time. We are witnessing the systematic destruction of the Constitution and Bill of Rights, This is not happenstance. This is the plan of big government advocates of both political parties, If the American People do not wake up, and be quick about it, they will have no rights remaining. Here is another example of what I have said. The people of Massachusetts must have a license to exercise their 2nd Amendment Rights. Anytime you license a right, it ceases to be a right and becomes a privilege at the pleasure of government. A privilege that can and will eventually be withdrawn.

  • Long Colt

This person has no business in any political scene. Just like odumma, I didn’t say that, I said this, kind of ignorant arrogance. Recall, fire, impeach, whatever it takes to make sure he never has a leadership of any kind. I think he should also not be allowed to teach in any form.

  • ThomasThePaine

The Second Amendment is there to protect the others. . . This Obamahole is the reason why ONLY an armed citizenry can have a free state.

It’s way overdue time for a practical demostration on what the Second Amendment is really for!

  • Muffin Man Mashinksy

OK, Ignoramus, but only if police can perform unannounced random warrantless searches in every ghetto in America to root out all the illegal guns that gangbangers use to commit about 75% of gun murders & violence in USA!!!!

    • Valor

Not even then! We cannot afford to make any more exceptions to our remaining liberties.

      • Muffin Man Mashinksy

Yes, I know….I was attempting a bit of sarcasm!

        • Valor

          I understand. Thanks.

  • Alan

Looks like Mr. Greenfield is proposing armed conflict which is certainly what will erupt should police officers begin kicking-in gun owners doors at unspecified times, especially during the night. What an idiot! These sort of people are the very reason our society has become such a dangerous place to live in within any spectrum.

With liberals it is the thought that counts. Not the substance.

      • http://www.voltairepress.com Paul Anthony

Your giving them too much credit. They “feel” they are right. They don’t “think”. Thoughts just get in the way of their utopian dreams.

        • Valor

          Good point!

      • Daniel F. Melton

        Or the consequences.

  • rivahmitch

If these twits who live in the Peoples Republic of Taxachusetts are unwilling to kill and die to defend their rights and freedoms, they deserve to lose them. The local police should be afraid to violate people’s Constitutional rights.

    • Valor

      They aren’t. Why fear sheeple?

      • rivahmitch

        You make my point.

  • http://www.thefreedomtrainusa.com/ FreedomTrainUSA

This Liberal MORON….Need to be locked up as a Traitor……and under the Little Boy Dictators rulings….He could be permanently detained without any right to a trial or legal representation…I wonder how he would like that????

  • Libertarian58

Another classic example of the abuse of statutory laws. One abuse always leads to continuous abuse and the next thing you know, we have a police state. This has been going on for so long that most Americans now consider such laws to be “normal”. Nearly all politicians, lawyers, courts, judges and LEOs support this travesty of justice. Remember your right as a juror to nullify such laws.

  • True American

Only and first in the state of Massachusetts will this first happen . Where the killings are far more over whelming and without parental control . Hell is in Connecticut , where do they cut their own necks and kill one another over neglect of TRUE LOVE FOR EACH OTHER . It is where Barack O. and his entire ObamacRATic Sinister Administration are presently from , AND SO , this is why they ALL DO NOT care for The American Nation AND YOU !!! .

    • paendragon

And here I thought Obama was currently listed as being from Chicago.

  • squeeze127

Time has come to let these jokers that pose as politicians know their time is coming to a close when the Constitution comes into play. They took an oath to uphold it and they act like they’re above it! Let them know where the wild goose goes!

    • paendragon

Like all criminals, they want rights (like to boss citizens around, while getting paid to do so) without any responsibilities (like obeying the law)!

  • marylou

    Gestapo tactics!

  • Daniel F. Melton

This boy wants to be the guest of honor at a rope dance.

  • Guest

Aka, “We politicians decided to see how far we could trash the fourth amendment before anyone thought to push back”. Whoops, guess Greenfield did not realize that someone has read, and actually exercises, the very Constitution he is willing to violate, and pushed him back.

  • paendragon

i.e: “I’m sorry you misunderstood my attempt to violate your rights as just that.”

  • paendragon

Are there any actual penalties written for any attempted Constitutional violations? Because usually attempted crimes are still considered to be crimes themselves!

    • Valor

No, there aren’t. Even if there were they would be ignored in today’s post constitutional America. Examples: Eric Holder is in contempt of Congress. Nothing has happened to him. The IRS has violated the civil rights of conservatives, but the FBI does nothing.

      • paendragon

Kind of remiss of your Founders to neglect to list any penalties!
Do your judges have a duty to strike down unConstitutional laws?

        • Valor

They were even more remiss in not establishing term limits for politicians. Judges are supposed to have such a duty, but they are appointed by the politicians. So much for that. Add to these problems an ignorant electorate and you can see why we are in the mess we are in.

          • paendragon

In stead of having two elected chambers, perhaps the second one should simply BE the court – where judges could instantly review proposed legislation to rule on its Constitutionality before it gets made into law to cause problems.

          • Valor

That’s what the federal court system is supposed to do, but they are politically appointed, and are more inclined to legislate than judge. At any rate, the system is broken. And I doubt fixable.

          • snowdog76

As long as “we the people” are unwilling to wipe our own butts and noses, and instead opt to let the government try to solve our problems, nothing will change, let alone improve.

          • Valor

That pretty well sums it up!

  • William

I think it is time for Americans to bear arms and march on Washington and let those fools up there know just exactually who it is that pays their salary and take away their rights to vote themselves pay raises and lucrative benefit packages, that should be put on a ballot and voted on by what they do for us the people. “We The People of The United States of America,” should have a say in which laws should be passed and those that should not. They make laws like popping popcorn. Some are ok and some are plain silly. I say Obozocare should disappear completely and go back to the way things were. Obozo should have to forfeit his salary and all book sales and royalties and seize all his assets for what he has done to Medicare. Unless you have worked and paid in Social Security you should not be allowed to DRAW a penny or have medicare. It came out of my check when I worked a public job now they hit me when I file self employment taxes I have to pay double.

    • Oldmonkey

Impeached for high crimes & mistermeanors, then convicted and incarcerated for fraud is preferable.

      • William

NO TREASON!!!!! Is a much higher crime! For what he has done he should have to face a firing squad!!!

        • Oldmonkey

Let’s grab the low hanging fruit we can get 1st on what will stick. Enough Democrats and drones will be screwed to get the votes. There will be plenty time when he is in jail, to follow up with Bengausi, IRS, and other crimes to last his entire life. His treason, frequenting gay bathhouses, will be historical “Teachable Moments” for decades in schools, and political science classes. Think Alger Hess.

Selectman Barry Greenfield is the very type of person who has no personal history of personal achievement, distinction or accomplishment that flocked to the ranks of the SD and SS of the National Socialist Party in Germany 80 + years ago. He would love a uniform so he could strut around violating peoples rights. Go get ’em Barry, What a guy! People like Barry, once they come out of the fascist closet and reveal themselves, should be removed from office immediately, with prejudice if necessary.

Frog marched, It has been done once in Louisiana, in the 30’s against a corrupt political bunch of gestopo style sheriffs’ dept and a gov.and mayor of a south central town.. Trying to remember, was it Heuy Long? Anyone remember reading about it? They shot it out with them, then arrested them with La. dept of investigation agents! All those guys went to state prison for a long time!

  • amazed108

The only thing he is missing is a brown uniform with an SS badge on the collar

  • amazed108

They have already done this in MA. There are multiple videos of gleeful media reporting on SWAT teams removing people from their homes without warrants and then searching the homes while the owners were being herded down the street at gunpoint when they were looking for the second Tsarnaev brother in Boston.

  • Alan

As a MA, resident, and holder of a MA. LTC, I am aware of the laws about securing my firearms. They will have to rely on my word that firearms are secure, because they sure as hell are not coming in without warrant.

  • Al Chemist

The guy is a would-be Nazi. If he continues to hold his office, it will say a lot about a majority of the people in that town.

  • simpleman56

These progressives have found their way into local, city, State & federal government, their plan to force their socialist-Marxist ways has been going at lighting speed. No standing army could ever do the damage they have done from with in. The Republic is all but gone as with the true rule of law. A sad state we find the USA in & if the true rule of law is not restored & the progressives of both parties stripped of all power & banned from any office & teaching their progressive ways, it’s over!

  • Timothy Thompson

His explination of his seven years in going from one political position to another really tells a story of how these marxist, communists have infiltrated our political system, slow and methodical. In every corner of our nation we have people who now are in positions that they want to dictate to us, set aside our constitution and take away our liberties. Recall this sorry politician.

  • http://batman-news.com Jim B

Should’ve elected a gun owning politician. Here is some tips for dimwitted voters…, make sure your guy or gal owns a gun or many guns, or his/her father owns a gun(s), then they’ll not be so quick to think up stupid gun laws (M. CUOMO you idiot)!. Also preferable that they owns a home, drives a car, motorcycle, snowmobile, or ATV, is a business owner, was a service member or can show some disciplined thinking/capabilities (that’s Character over hype and pompous noise that comes out of so many of their mouths … BHO). Just some qualities that must exist before even considering them for political office next time. Shame on you if you let this communist takeover continue to happen in your own back yard!

  • Robert Messmer

“because local police “need the ability to enforce the state law” which “requires Massachusetts gun owners to keep their firearms locked away or rendered inoperable,” officers should not be hindered in their ability to walk into local gun owners’ homes unannounced and verify compliance.” I noticed he did specify “gun owners’ homes” which IF gun buyers didn’t register them they would have no way to know whose home to go into. He did not specify, however, that anyone had to be home at the time they wanted to search. See we told you they wanted a list so they could confiscate them, because somehow I have the feeling the police would have found all of them to be in violation of state law. And if no one is home when the police enter, there is no way to prevent them from planting drugs to come back and arrest you so you would not be allowed to own guns.
