Law would boost gays' job security Lawmakers have introduced a draft law that would prohibit employment discrimination on the basis of sexual orientation and gender identity.

An inclusive Employment Non-Discrimination Act (ENDA), whose lead sponsors include Massachusetts Representative Barney Frank and IIeana Ros-Lehtinen, a Florida Republican, would make it illegal to fire, refuse to hire or refuse to promote an employee based on their sexual orientation or gender identity.

"Employment should be based on who is the most qualified person for the job, and not on the personal prejudices of those who are doing the hiring," says Jody M. Huckaby, executive director of Parents, Families and Friends of Lesbians and Gays.

"LGBT Americans, like their straight co-workers, go to work each day to contribute to their communities, support their families and keep our economy running," he adds.

Among the opponents of the measure are Southern Baptists, who have expressed concern the proposed law could threaten Christian organizations from hiring in accordance with their religious beliefs, according to Christian Post.

Current federal law provides legal protection against employment discrimination on the basis of race, sex, religion, national origin, age and disability, but not sexual orientation or gender identity.

Windy City Times reports that in 30 states it is still legal to fire someone based on his or her sexual orientation, and in 38 states it is legal to fire someone for being transgender.

    as long as the homosexuals do not interfer with busines they should recieve equal treatment however if they cause internal problems thru their choice to act or be different they should be terminated.history proves the later choice to be thier choice

      John, To an extent I agree. However the term gender identity would include using the private facilities of the opposite sex with whom they may identify. This would create workplace issues and disrupt the environment. It would be easier to create one standard and comply with it than to make continuous exceptions for a behavior rather than a physical need.

        Nice point Chris. The most qualified is not always the best choice. Compatibility in the work place is critical to assuring harmony leading to greater productivity. Forcing employers to hire without taking these factors into account is daft.

        Your gender identity is the identity that you assume in the drab world. That identity may be male, female, queer, or something else. We can’t tell from your name. Some native American tribes recognized seven different gender identities.

        I sincerely doubt that a person who identifies as ‘x’ would use “the private facilities of the opposite sex with whom they may identify”. They would use the appropriate facilities. Use of those facilities is a physical need, not a behavior.

    Then leave it be! It’s not broke, so why fix it!? I certainly do not want to find myself in a company restroom with a guy in a skirt! I think it is a wrong lifestyle, and because of the many people in my family that served in the military, I have the right to that opinion. Barney Frank is disgusting as a person. How he ever got into politics is beyond me. Now he wants his gay agenda to infiltrate the corporate world. There was a time when people who were gay kept to themselves. I am sure that I have been along side a lot of them in the course of my lifetime and the various positions where I have been employed. I don’t hate gay people; I just don’t agree that they need special rights. If this proposal is passed, it is going to open up the door for all kinds of perversion. Let the law stand as it is.

      This whole issue with the gay’s is a very dangerious one. To go and great special laws for them is a farce. I do not see anyone passing special laws for me or you or any of us. If you do that then yes you have caos. A gay should be able to hold a job just lilke the rest of us. But I do not believe that they have the right to be almost making out in public as many of them do.(I have seen it). And it is shocking, and I am not talking a quik kiss on the lips. I don’t know it is the kind of thing that you would not even expect from a Heterosexual.

      Barney Frank, is undermining the government as it is without the gay agenda. There
      are many people who are of the opinion(live and let live),this can be fine until you see an agenda that goes against what we stand for. Is that we want for our children? I do
      not think so. As far as I know,I think that we are the only country that accepts the gay
      community to this extent. If someone can correct that then please do.

      It is one thing to hate the person,it is quik another to hate a lifestyle. And this a lifestyle choice that I find vulgar and I can not support and I hate”IT”, and I do not believe all that is said that they have no choice. We all have a choice. We have free will. No one is twisting their arm to be with another man. Just like no one twisted my arm to get married. I could have remained single or I could have spent my life as a Playboy,but I didn’t. Or perhaps be a gay myself. There are those who have gone away from the life style and will not go back theybelieve it is wrong and now they are married with a nice happy family. The bottom line is as humans we have choices that we can make,some good some not so good. And heaven forbit you should mention the word sin. It is something we all do,but most of us admitt it.

      So admitt it and move on,you may not think that you can change,but at least you have made the first step. As it has been said you can tell by the fruit it bears and all I can see is that it is rotten.

    Really now!? I wonder if this new law will protect ‘Heterosexuals’ and those people who have chosen to be married ‘as a man and a woman’? Discrimination cannot be defined in such literal terms that it excludes so many other ‘groups’ of people. The state of Colorado is an ‘At Will State’ and this bill is completely irrelevant to us. The Laws already on the books should be sufficient to cover the problem.     Doesn’t Congress Get it? Even here in California the “People” have voted twice to not allow Gays and Lesians to marry. Is Congress and Barney Frank going to keep trying a different approach so that maybe we won’t recognize the true content of a new law? After all Congres doesn’t read legislation before they vote it into law. I don’t think the American people are naive enough to allow this to pass. We have to all write our Congressman and just say STOP this insanity. Gays and Lesians are already protected. Leave it be.

      Excellent point, Roberta. But the militant gays view themselves as a major political force with which to be reckoned. The self-designated “alternative and ‘tolerant’ ” now wish to be elevated to the respectability of Traditional. Like Princess Pelosi, et. al. they’re only trying to “get while the gettin’s good” Flaming liberal in Office!..go for broke!–no pun intended. These are NOT equals, these are people with a psychological disorder seeking to force acceptance of their disease as normal, natural, and nice. This alternative lifestyle is characterized by the spread of lethal blood-borne pathogens, mental and emotional instability, gross promiscuity, and a completely amoral code of conduct. Reminds one of Congress, does it not? Now we know why Congress pushes such idiotic agendas

    If those of us subscribing to this site are truly into defending liberty we should think twice before we start talking about limiting freedom and taking away the power of choice.
    BTW- one of the liberties we in the USA enjoy is freedom of religion which extends to being free to not have a religion. What is up with fundamentalist Christians saying they are for liberty and freedom, then wanting to restrict those liberties and freedom to fit their own particular religious views?
    My wife is a Quaker and the Christians in Massachusetts tortured and killed Quakers for their beliefs. Such is the type of “religious freedom” our earliest forefathers granted. How can the conservative evangelical fundamentalist Christians of this nation push for religion based liberty limiting laws while condemning Muslim nations religion based liberty limiting laws?

    Hello?? any COMMON SENSE left out there?? Should the whole of a work place be disrupted due to one or more personal choices to flagrantly and flamboyantly advertise a CHOSEN behavior? Case in point: I work as a medical insurance underwriter, in my office there is a self-defined “trans-gendered” person who was born a man and has somehow decided that he should actually be female, he/she/it has decided to live openly as a woman,READ: HAS DECIDED. Now, the rest of us are forced to accept this fruit loop’s CHOICE? Every work day is now dreaded by the entirety of the office due to the daily “fashion show” that we must all mutely endure in all it’s tacky flamboyance for fear of “discriminating”. The flouncy-frilly Little BoPeep outfits with lacy ankle socks and bows in it’s hair. The outrageous and feigned simpering over hair and make-up and loud vocalizations over ill-fitting undergarments. The distraction, absurdity, contrived drama, and embarrassment is proving catastrophic on multiple levels. Would that it would save it for the weekends AT HOME and not in our work space. It just does NOT need to be, this has no place in the professional world. A law as stated above is clearly a demand upon society to “love me, love my illness”..so if it decides it’s Tarzan next week, then what?

    Since when does the government have the right to tell me whom to hire and whom to fire?
    It’s my business. It’s my personal investment and I have “paid my dues” to be the owner.
    How come there are people who feel they should tell me whom to hire or fire?
    Is this what freedom is about?

    Homosexuality is wrong, it’s a sin and it’s disgusting! Homos existed since Humanity exists on this suffering Earth, but until they stayed behind doors with their deviant lesbian, or gay behaviour, very few people cared about it.

    Now, they want influence our children in schools and in every aspects on public view. That’s bad, that’s wrong. I don’t want this evil, vicious out-of-control judaized government tells me that my child – as young as 5 years old! – has the ‘right’ and must to know about ‘alternative lifestyles’. They call 2 homos or lesbians partnership as ‘marriage’. That’s anti-God. That government has to be dismantled and overthrown by force.
