A Federal judge has ruled that it is not a violation of the 4th Amendment for police to install surveillance cameras on a person’s private property if they expect a crime is being committed.

Officers in Wisconsin charged Manuel Mendoza and Marco Magana of Green Bay with Federal drug charges after discovering an alleged 1,000 marijuana plants growing on a heavily wooded, 22-acre property. Agents with the Drug Enforcement Agency gathered video evidence on the gated, posted property without a warrant. Magana and Mendoza, facing life imprisonment and $10 million in fines, asked U.S. Magistrate Judge William Callahan to throw out the video evidence on 4th Amendment grounds.

On Oct. 8, however, Callahan agreed with a 1984 Supreme Court case ruling in Oliver v. United States allowing for the warrantless search of open fields on private property by the government and extended the ruling to video surveillance.

“That one’s actions could be recorded on their own property, even if the property is not within the curtilage, is contrary to society’s concept of privacy,” wrote Brett Reetz, Magana’s attorney, in a legal filing last month. “The owner and his guest… had reason to believe that their activities on the property were not subject to video surveillance as it would constitute a violation of privacy.”

“Curtilage” is a legal term for property closer to a residence which traditionally is more protected by privacy rights.

Federal Judge William Griesbach rejected a request for repeal in the case. It has also been noted that it is unclear Magana had complete ownership of the property or was leasing the land, according to reports. A jury trial has been scheduled to begin Jan. 22.

    With this ruling, what is to stop the police from deciding they want to put cameras inside of our homes? If they choose, they can come knocking, if they choose to knock, at our doors and demand to be allowed to put cameras in any and every room in our homes. No warrant required. What happened to our constitutional right of protection against illegal search and seizure?? More and more of our rights are being taken away from us since Obama took office.

      Such invasions of privicy were in full practice before Obama took office, as witness the Patriot Act and like legislation, during the GW Bush administration. And, the law-and-order Republicans in a Romney adminstration are sure to push for even more police cameras, on the ground and in the air, “to keep us safe.”

    This judge needs a refresher course on the fourth amendment text and meaning…

    “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

    Both the text and meaning are clearly spelled out-it should be real clear to everyone that a warrant IS REQUIRED to place video cameras on private property-whether that property is owned outright,or leased-a lease or rental agreement in no way means you give up ANY of your rights.

    They based their decision on one from 1984. However that does not make the decision from 1984 right. Prior precedence should not be allowed in any case. Court decisions should be based on law — not on what some prior judge/jury has decided in any particular case.

      The legal system in the U.S., including the SCOTUS has always used legal precedent-decisions rendered in prior related cases-according to law.
      That is why precedents are allowed-the past decsisions were based on laws-the current decision is supposedly based on law and precedent,however, that does NOT mean that this judge interpreted the law,or the precedent correctly-that is why we have appellate courts.
      I highly doubt that this ruling will stand-it will be overturned on appeal,due to the fact it blatently disregards the 4th amendment protections against unreasonable search and siezure,no warrant was issued,and those being spied on by camera did have a reasonable expectation of privacy on their property.

    Americans have not fought for their percieved rights since the Civil War . Small groups and minorities have but Americans as a whole have not , nor are we likely to any time soon . The trend has been one of defeatism and apathy through the decades . I think Americans will fight harder to protect their big screen TV than they ever will for their rights and our politicians know this . There are a few that are willing but they do realise that a few against the establishment are nothing more than malcontents or at worst domestic terrorists and quickly written off by the masses . The status quo will rule us till our demise no matter which direction it takes . This is just the way I see these things and must say I am not alone . Everyone I talk to face to face is in agreement and always end the conversation with what can we do or there is nothing that can be done without being the fool in jail or dead .

        It’s a terrible thing to suffer from a guilty conscience JDN. I am not saying I’m a saint, far from it. I just go to bed at night with not a worry as I know that in the past 24 hours I broke no laws. And if I did, it would be such a minor one that it would most likely get thrown out of court or not even get thar far to begin with. My point is that too many people are trying to beat the system and that is where they get in trouble with the law to begin with. Being a good person is not that difficult a job to do! YOUR TURN!

        There are some interesting books about little known laws that are on the books with the sole purpose of convicting those whio have done no real wrong and yes the penalties are at the sole disgression of the judges . A few I remember off the top of my head . In New Jersey it is against the law to whistle under water , after being accused by a duly sworn officer of the court whos testimony is always taken as truth , please tell me how one would prove your innocense ? And don’t laugh people have done jail time for this . Same as its illegal in Texas to call out from a second story window . Illinois it is statutory rape if a man is not wearing a belt in public or in private while in the company or presence of a woman . And yes men have done jail time for this offence . In New York I believe it is illegal for a woman to knit in public . Pennsylvania its illegal to curse and be heard by anyone . Lets just say there are so many of these laws on the books out of the millions of laws that the one book I read was about 400 pages long and it only covered the most absurd laws that people have been arrested and done time for and it covered every state .Point is if someone in power wants people jailed there are the laws to cover everyone let alone the laws it is impossible to defend against .

When you consider the real agenda behind the war on drugs, this possible sentence becomes outrageous. The people who benefitted most from the prohibition on alchohol were the criminal organizations and even more, law enforcement organizations, as in a huge increase in budget and personnel, and more importantly an ability to run roughshod over your Constitutional rights. This has only gotten bigger and badder since then. I believe in law and order and I don’t do drugs – especially pharmaceuticals – but stupid and evil laws are still stupid and evil laws. You strike me as one of those [comment had been edited] who obeys the law just because it’s the law, good or bad, right or wrong. The powers that be who have dismantled and corrupted the American Constitution love people like you, especially when you publicly voice idiotic comments like you did. What about the ‘judge’ who acted against the 4th Ammendment, do you not condider that criminal?

And at that point the message is: Let me suck on my doobie and leave me alone. Hemlock also grows naturally so are you saying you would ingest it also. And I am far from what you or anybody would call a mindless goody-two-shoes that follows rules and regulations just because they are on the books. If you new my history you would agree.
        Again pal, all I’m saying is you have to go out of your way to not live your life without following those rules and regs.

    Here is another corrupted decision maker that should be removed from the system. There was no common sense used in this ruling, only the maneuvering of cunning folks and friends and the total disregard of “Property Rights”.
