Florida Attorney General Proposes Strict Immigration Laws

Florida attorney general proposes strict immigration laws Florida Attorney General Bill McCollum has unveiled a historically aggressive immigration bill proposal that he said would go "one step further" than Arizona’s controversial new law, which was recently stripped of its key provisions by a Federal judge.

Similar to Arizona’s legislation, McCollum’s proposal would require law enforcement personnel to verify the immigration status of individuals who they "reasonably suspect" of being an illegal immigrant. Furthermore, the bill would mandate that legal resident aliens carry their immigration documentation at all times or face up to 20 days in jail.

However, the legislation would go beyond Arizona’s measure by requiring businesses to utilize a national database to verify a person’s immigration status before hiring them. It would also allow judges to impose stiffer penalties on illegal immigrants who break the law.

"This legislation will provide new enforcement tools for protecting our citizens and will help our state fight the ongoing problems created by illegal immigration," said McCollum. "Florida will not be a sanctuary state for illegal aliens."

McCollum—a Republican who is in the midst of a heated primary election race for governor—was heavily criticized for unveiling his plan two weeks prior to the election, according to The Miami Herald.

"It’s clear the only way to get McCollum to take any action on anything is when he’s down in the polls," said Rick Scott, his opponent in the upcoming primary race.

      Joe H, you don’t even know that in Fl, most of the illegal immigrants are Cubans who physically set foot on US soil. They don’t go through the legal process, and they are given all rights, including SS even though they have never worked in this country. We don’t have that many illegals from m Mexico here, but we do have a migrant work force, that pales in comparrison to the Cuban population most of which came here illegally. Why do you think Cuba gets such favored treatment??? Open your eyes and start asking why you are paying for the cubans along with the mexicans.

    I’m all for it. Wouldn’t it be interesting if Florida’s law is tougher than Arizona’s, but it doesn’t get treated like a red-headed stepchild by a rotten, knuckle-dragging judge this time?
    I would almost admit to being a hardcore pessimist, but I suspect the word is “out,” and any judge who gets a chance to slam dunk Florida’s new law and doesn’t do it will feel the full wrath of a twit named Holder.

      Rick Scott says, “It’s clear the only way to get McCollum to take any action on anything is when he’s down in the polls”. That tells me that We the People support tougher immigration laws. I hope that even if McCollum loses the primary, he continues with the proposal. It’s still just a proposal and I hope it’s written into a bill and signed by the governor. When Holder goes after Florida, more states should then make their proposal.

      You are right. I heard of a judge a few years ago who was dealing with a case of the government against someone. The someone was innocent but the government informed the judge that he was to find the person guilty since they wanted to make an example of him.

      The next year the judge was arrested and charged with tax fraud. It seemed that the government went to his accountant and told his accountant to falsify the judge’s income tax return or they would shut him down. The judge lost his job, most of his funds, and spent several years in jail for something he didn’t do – just so they could punish him for not following orders.

    My personel choice would be Rick Scott however, either candidate would be better for Florida than Charlie Crist, the closet Democrat.

        If tons of cocaine and millions of illegals can come into this country, then what is to prevent our enemies with suitcase sized nuclear weapons from coming in.       We actually don’t need new laws for immigration…we need to enforce the ones that we have. But if making some new laws will get our states/government to actually start taking care of the immigration problem…then so be it. This all stems from the Federal Government not doing their job…if they were, all these problems wouldn’t exist. However, due to the Agenda that is being played out its obvious that they don’t WANT to enforce the laws..they want to let all these illegals to become future democrats due to being granted amnesty. <— What a bunch of CRAP.

      All illegals should be gathered up and removed from the country. Period. If this were done…many, many, MANY problems would go away. I'll not even bother to list the benefits of such an action…common sense should prevail and I believe this Nation is moving in that direction.

      If I remember right, California is also having problems with illegal immigration and it tends to be (Not all areas of course) lib. Why? I don’t know. Here in Indiana, we are also having immigration problems and would like our governor to set up our own laws also. It’s not about hate, death, and destruction, but it is about protecting this country and the people that live in it. FOR GOD AND COUNTRY!

        We live in a canyon near the Mexico border and have for over a week now been hearing Arabic voices and the Arabic languages spoken by people traveling through our area on the same paths the Mexican illegals use. It is not just about Mexican, Central and South American people coming here illegally. I worked in Portland, Oregon near Portland State University as a teenage and through I don’t speak Arabic, I do know those languages when I heard them from my extensive exposure to the foreign students I dealt with daily in my job. The Middle Eastern cultures are moving through this area too. Do you really think they are sneaking in here with good will in their hearts?

      I use to feel the same about illegal immigration, until we moved to Arizona. I live 10 miles from the border. My husband had to quit his $32,000 a year job because of death threats, by illegals who are allow in Santa Cruz County Arizona to run “Rabid”. Why the threats you ask “for being white and English speak”. In addition to the death threats against himself, they saw me leave his place of business after delivering his lunch one day, and tried to force me off the road while screaming threats of rape and death at me. Plus there has been 8 murders within 4 miles of us from shoot-outs between drug smugglers. Our 87 year old female neighbor had and illegal beating on her door at 10:30PM with 2 bullet wounds after one such shoot-out. “DEPORT THESE CRIMINALS” and they “ARE” criminals.

    The question, posed during a news conference that was broadcast live on TV, seemed to catch Brewer off guard. After a long pause, she said, “I DON’T KNOW WHAT A ILLEGAL IMMIGRANT LOOKS LIKE. I can tell you that there are people in Arizona that ASS-U-ME they know what an illegal immigrant looks like. I DON’T KNOW IF THEY KNOW THAT FOR A FACT OR NOT.”

    Her answer cut to the very heart of the controversy surrounding the law, which takes effect July 29. Although there are many people who assume they know what an illegal immigrant looks like, the fact is, IT IS IMPOSSIBLE to tell a person’s immigration status by appearance, experts say.

    So despite assurances to the contrary, some civil-rights groups and others fear that enforcement of the law will lead to racial profiling. Several lawsuits already raise worries of civil-rights violations, and a group of Arizona law professors concluded the law authorizes enforcement based on ethnicity. That, they allege, would mean officers would end up harassing and possibly detaining people who aren’t illegal immigrants.

    The vast majority of illegal immigrants are Hispanic. But most Hispanics in Arizona are not illegal immigrants – they are legal residents or U.S. citizens, many with roots dating back generations.

      if you are legal how hard is it to show you are legal. I was stopped for a headlight out and the first thing was produce my drivers license. Why do we have to have licenses, proof of insurance, tags, etc. while they steal cars, wreck, and run away. Or like what happened here in Orlando, sue even though they are here illegally. Thank God there are people, like those in Arizona, fighting for our country.

        It doesn’t help when some states issue liscences to illegals. If people are here on visas that should be added as part of the liscence. I’m sure they could make room to add immigrant visa expiration dates to the liscence even if it’s just a stamp like DONOR.

        Showing proof of status is not a problem, if you are legal. I have a couple of points on the matter of showing proof: 1) If you have contact with the police you have to show your driver’s license or some form of ID, period. The problem is the if you are illegal you can’t get a license in Arizona, so it is harder to lie your way out. 2) My wonderful daughter in law is here from Russian legally and the law said she must have her papers with her at all time. She thinks that all the fuss is for not, if you are indeed legal. If you are a citizen just show your ID. If you are a legal immigrant show your papers as required by law. So: 3) You only have a problem if you are an illegal or criminal even homegrown on the run. 4) In many areas of the country, if you don’t have ID on you, you can be arrested for vagrancy anyway.

      this: Hispanic is not a “race”. I see no difference in my being asked
      to provide I.D. if I am stopped, and their being asked for I.D. while being stopped. They can’t. Only trouble
      with your logic is that they should never be stopped…..only “legal”
      citizens. Do you have to provide I.D. when you cash check? Get on a
      plane? Rent a car? Check into a motel? or any of the myriad activities
      that we all do daily? This law isn’t about “targeting” anyone…’s
      about checking immigration status WHEN you’re stopped for any infraction that gets you noticed by the police.

Jan Brewer, due to the high level of this situation was being very cautious with her answer is all.       It’s not hard to spot illegal aliens at all. If you had as many of them living in your neighborhood as I do, you’d know! One of the houses very close to mine had 12-15 people living in it, several of them sleep on cots in an un-airconditioned garage in 100+ weather. Every night, they had 7-10 old junk cars piled up on the lawn and some parked in front of my house unmoved for weeks at a time (I’ve had to call the cops 6 times so far). In addition, they do no maintenance of the properties whatsoever, with trash strewn about all over the front and weeds growing 3 feet high. Oh, did I mention the graffitti on the garage doors?

          Next time that happens, try calling city hall building department and inform them that the house at such and such an address is violating city code by having too many people occupy a single family zoned structure! If they don’t enforce the codes call the state and report your city!!! It does work, we did it here!

        My wife inherited a house in another state. We tried to sell it without going there for less than the appraised amount. The only bids were for FAR less!

        Finally the realtor admitted that there were about 24 illegals living in it. I asked that they be run off or arrested. She told me that if they tried, they could simply come back and total the house. She also told me that any empty house was left unlocked to prevent them from breaking down the door to stay there.

        We ended up selling at half the value just to get rid of the place.

    This week, the Federation for American Immigration Reform (FAIR) came out with a report entitled, The Fiscal Burden of Illegal Immigration on U.S. Taxpayers, which discusses the costs of unauthorized immigration to the United States. As usual, FAIR has put out a highly misleading fiscal snapshot of the costs allegedly imposed on U.S. taxpayers by unauthorized immigrants and completely discounts the economic contributions of unauthorized workers and consumers. Moreover, FAIR inflates their costs in a variety of ways and conveniently ignores any contributions that would offset these costs.

    While the publication is long and deals with a wide range of issues that warrant more dissection by credible economic experts, the trade publication Education Week has already begun the deconstruction with an item that sheds light on their misleading claims about providing English language services in schools.

    Another argument FAIR makes, which makes it hard to glean what their solution would be is the high cost of deporting undocumented workers which FAIR blames on the immigrants themselves. It’s a somewhat circular argument to say that the cost of undocumented immigrants includes the cost of failing law enforcement efforts. So, in essence, FAIR is saying that the deport-them-all approach costs too much money and doesn’t work. Yet their “solution” is to spend even more money on enforcement.

    FAIR’s data is meant only to reinforce their vision of “attrition through enforcement.” It is not rooted in an effort to move the immigration debate forward. Therefore, passing comprehensive immigration reform – which would yield a cumulative $1.5 trillion in added U.S. gross domestic product over 10 years – is the only sound economic decision the United States can make.

      Excuse me “FACTS”, the illegals in the country irregardless, of race, color or country of origin make little or not contribution, they pay no taxes, they live 15 – 40 to a house, they send most of the money they make out of the country. In addition, they are a hugh part of the identity theft in this country, I spoke with a local woman here in Arizona just a week ago, who is going through hell to regain her identity after it was stolen by a group of hispanics in California who had two apartments rented in her name that where destroyed by the 20+ illegals living in each apartment. She found out about it when the landlords came after her for the damages. In our area just two weeks ago they caught an illegal with 5 stolen indentities, who was collection welfare and food stamps under each of the stolen indentities.

He may even not be an American citizen as he hasn’t provided documentation to prove this…its just assumed. When he went to Indonesia and went to school as a child, I believe he gave up his american citizen ship (if he actually ever had it to begin with) and was declared a citizen & a muslim so he could go to school.

      One of the real problems here is that we have one of the softest prison systems in the world. We do still have the death penalty but it certainly isn’t hard labor!! Probably only England’s system is easier.

      In any case, this is known all over the world. Criminals in many countries, including Mexico, knows this. Their view is that it is better to rob a rich American than a poor person in their own country. (Rich is a word that varies with your background. To them, even those on Welfare here are rich.) And if they do get caught, they expect that they will have to serve less time at a much better place than they would at home. And they have their own government to intercede (they think) if they do get caught. So why not come here to commit crimes? Particularly since in most cases, if they are caught, they are simply given a plane ticket back home.

      So we not only get the poor who want jobs but also all their criminals as well.

          Personally, I think that every illegal caught should spend at least six months building on the border fence before being sent home. It would get the fence built and it would discourage them from coming back.

    Gov. Brewer is in the fight for her state and our country. McCollum needs to be defeated and Scott deserves a shot at getting things done for our state and country. Every time I see Gov.     Change the 14TH ammendment to the Constitution.Then it will no longer be an incentive for the illegals to come here to have their kids.There are travel agencies that do this as a business.They have package deals,tickets, hotels,doctors,hospitals,etc.By changing the 14th it will put them out of business and the bleeding hearts cant say we shouldnt deport US citizens,because parents and KIDS will not be anything but illegal.They repealed Prohibition when they saw that wasnt working.

      Do you people limit your “fact finding” to sites like this? Have you heard nothing about the reality of so called “anchor babies”? You make it sound as if the family is home free and citizen ship bound just as soon as their baby is born. Truth is, the parents and family can’t even begin to move towards immigration until the child is 21. 21 years of hiding from the law just to BEGIN the process. And let me tell you, it’s a LOOONG process. Even if you go for the easiest route and marry a U.S. Citizen, it can take years to get your citizenship. This is just another scare tactic by those who want you give them power and control over your lives. The same people who warn us that whites will soon be the minority, but fail to mention that the new “majority” will be a collective of ALL the current minorities. So what is the point?         The reality of anchor babies according to F.A.I.R.

        An anchor baby is defined as an offspring of an illegal immigrant or other non-citizen, who under current legal interpretation becomes a United States citizen at birth. These children may instantly qualify for welfare and other state and local benefit programs. Additionally with the passage of the 1965 Immigration and Nationality Act, the child may sponsor other family members for entry into the United States when he or she reaches the age of twenty-one (See also Chain Migration). The sheer numbers are staggering. In Stockton, California (2003), 70 percent of the 2,300 babies, born in San Joaquin General Hospital’s maternity ward were anchor babies. 1

        Interpreting the 14th Amendment
        In Parkland Memorial Hospital Dallas, the second busiest maternity ward in the United States, 70% of the women giving birth were illegal aliens. That added up to 11,200 babies for which Medicaid kicked in 34.5 million dollars to deliver these babies, the feds another 9.5 million and Dallas taxpayers tossed in 31.3 million. The average illegal patient is 25 years and giving birth to her second anchor baby.

        According to the Constitution’s 14th Amendment, ratified in 1868 to ensure citizenship for the newly emancipated African Americans, “all persons, born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.” The phrase “subject to the jurisdiction thereof” was intended to exclude from automatic citizenship American-born persons whose allegiance to the United States was incomplete. For example, Native Americans were excluded from American citizenship because of their tribal jurisdiction. Also not subject to American jurisdiction were foreign visitors, ambassadors, consuls, and their babies born here. In the case of illegal aliens, their native country has a claim of allegiance on the child. Therefore, some Constitutional scholars argue that the completeness of the allegiance to the United States is impaired and logically precludes automatic citizenship. However, this issue has never been directly decided by the U.S. Supreme Court.

The estimates provided ranged from 50 million dollars to 87.5 million in Pennsylvania and 932 million to 1.04 billion dollars in Texas.1

        FAIR estimates there are about 363,000 children born to illegal aliens each year. This figure is based on the crude birth rate of the total foreign-born population (33 births per 1000) and the size of the illegal alien population (13 million in 2008) adjusted downward to account for the estimate that females are a smaller share of the illegal alien population than the foreign-born population.2

        What Does This Mean?
        Higher Taxes: The federal government has control over immigration law for the United States. By not correcting this mis-application of the 14th Amendment, the funds that state and local governments must provide to anchor babies amounts to a virtual tax on U.S. citizens to subsidize illegal aliens.

        Disrespect for the rule of law: Congress, by failing to act on legislation aimed at correcting the interpretation of citizenship by birth, in effect rewards law-breakers and punishes those who have chosen to follow the rules and immigrate legally.

        The original intent of the 14th Amendment was clearly not to facilitate illegal aliens defying U.S. law and obtaining citizenship for their offspring, nor obtaining benefits at taxpayer expense. The United States is unusual in its offer to extend citizenship to anyone born on its soil. Other developed countries have changed their citizenship practice to eliminate the problems caused by the practice of birthright citizenship.1 The anchor baby problem has grown to such large proportions that the United States can no longer afford to ignore it. The logical first step for correcting the problem is for Congress to adopt legislation clarifying the meaning of the 14th amendment.

          You missed my point. I was speaking of all these groups working TOGETHER. When was the last time you heard La Raza talking about joining forces with the New Black Panthers? (Now that I’ve said it, I’m sure you’ll see all sorts of warnings about the collective threat to come.) Also, these groups don’t represent every member of each ethnic race, so the suggestion that they will mobilize and take over is akin to suggesting that White Americans will all don white hoods and join the KKK.

    Every state should begin changing their laws on illegal immigrants. This will have a positive effect in that it will force Holder and the Obammy admin. to concentrate their efforts and all the law suits they will bring onto each state! Benefit: we will enjoy peace and quiet times watching the news because we won’t have to listen to their daily flooding of the Bullshit, lies, and racism.

    Florida and Arizona along with any and every other state that wants to enforce immigration laws…must be ready to nullify any Federal ruling that tries to stop them from doing so.
    The United states was NOT founded on the principle of absolute submission to the Federal Government…in fact the truth is very much the opposite.

          Joe H–Bob and I are positively sick about this entire sham. Of course the trial was held in Chicago. It should have been here in Springfield. The jury certainly wasn’t doing their job. Neither was the prosecution. Rahm Emmanuel should have been called in and put on the witness stand right along with Obama. They didn’t put Blago on the stand probably because of his mouth. His mouth would have done him in–he doesn’t know when to shut up. One count–unbelievable. The next trial will be on the taxpayer’s dime and according to the news there will be another trial. Meanwhile Blago is running around loose. Blago is absolutely crazy, the little weasel. He really has some loose screws. I find it very interesting that he kept sayng he would not be convicted. He went around tooting his own horn and literally slapped the decent citizens of Illinois in the face. Blago is as guilty as sin, along with the rest of them.
          But Illinois politics–what can I say? Pathetic situation.
          I have arrived at one conclusion–the “fix” was in, especially since November is coming up. Sure don’t want any Democrat to get in big trouble now.

I work in a hospital setting and see it EVERYDAY! They do not pay a thing and more often than not, they are not sick! They try and get narcotic pain meds so they can sell them. Obviously not all of them are bad people but most are taking advantage of our idiocy! Obama should be drawn and quartered. He is a Muslim extremest that acts very well!         I am not a hospital staffer, but when I went to the Nogales, AZ hospital I had to wait endlessly through the doctor thought I was having a heart attack, because the ER was filled with illegals and the parking lot was full on Sonoran, Mexico license plates. In addition, probably half or more of the people receiving welfare and food stamps in this county are illegal or actually live in Nogales, Sonora, Mexico. You heard them complain regularly in the grocery lines that the US won’t make the Mexico stores take their EBT cards. I was behind two women from Mexico, two week ago that where whining about that very thing. The one said “It makes me mad that the US won’t make the Mexico stores take my EBT card and I have to drive all the way over here to shop” then she said “So I decided to come to Rio Rico to shop and not shop in Nogales, so I could go to my friend’s house and check my mail for my kids WIC cards.” I then watched her load $350. in groceries into a brand new Mecedes SUV. I took down the license number, but the welfare department and the police both refused to even take a report.

    We live in a canyon near the Mexico border and have for over a week now been hearing Arabic voices and the Arabic languages spoken by people traveling through our area on the same paths the Mexican illegals use. It is not just about Mexican, Central and South American people coming here illegally. I worked in Portland, Oregon near Portland State University as a teenage and through I don’t speak Arabic, I do know those languages when I heard them from my extensive exposure to the foreign students I dealt with daily in my job. The Middle Eastern cultures are moving through this area too. Do you really think they are sneaking in here with good will in their hearts?
