Eric Holder Has To Go
On Thursday, the House voted to hold Attorney General Eric Holder in contempt of Congress.

The House of Representatives is about to vote on whether to declare Eric Holder, our Attorney General, in contempt of Congress. And by the time you read this, the Supreme Court will have issued its long-awaited ruling on the Constitutionality of Obamacare.

Unfortunately, I’ll have to wait until next week to comment on both events. Thanks to publishing deadlines, I have to finish this column before the House takes its vote and the Court renders its verdict.

But I don’t have to wait another minute to predict that it’s just a matter of time before Holder is no longer our Nation’s top law-enforcement officer. While the list of unConstitutional excesses by this Administration is longer than both of my arms, Holder’s bungling mismanagement of the Fast and Furious crisis, followed by his outright defiance of Congress, is reason enough to color him gone.

What’s gotten lost in the whole contrived controversy over Holder’s claim of executive privilege is how this uproar began. In 2009, someone in the Bureau of Alcohol, Tobacco, Firearms and Explosives approved plans to let some 2,000 illegal weapons in the United States get into the hands of a Mexican drug cartel. The idea was to track where the guns went, so they could nail some drug kingpins.

A bad idea went terribly awry in 2010, when Border Patrol Agent Brian Terry was killed in a shoot-out with drug traffickers. A firearm found out at the scene was traced to the botched Federal program.

Congress decided to investigate how this whole mess happened. And that’s when Holder’s Justice Department made a huge mistake. It sent a letter to Congress in February 2011 flatly denying that any such program ever existed.

The House Oversight Committee didn’t buy it and demanded to see various reports and communications. One of the items that subsequently came to light was an email in March of last year from then-acting ATF Director Kenneth Melson urging the Justice Department to “back off the letter.” But it took another seven months before Holder’s agency acknowledged the existence of the Fast and Furious program and admitted its previous claims weren’t true.

That would have been a very good time for Holder to abide by the old maxim, “If you mess up, ’fess up.” Instead, he took the opposite tack and dug in his heels. So far, Justice has given Congress only a tiny fraction of the documents it has requested, insisting that all of the others are somehow protected by executive privilege.

Claims of executive privilege can apply when you’re talking about communications between the President and the people who work for him, such as the Attorney General. But not when you’re trying to keep a duly constituted Congressional committee from learning about communications within a Federal department.

In a lead editorial last week, The Wall Street Journal noted the curious contradictions and dangerous implications of what’s happening here:

Did White House officials know and approve Fast and Furious before it went awry, and did they advise the Justice Department on how to respond to Congress’s investigation into the operation’s failure?

How can the President invoke a privilege to protect documents he and the White House are supposed to have had nothing to do with?

And what is so damaging or embarrassing in those documents that Mr. Obama is now willing to invest his own political capital to protect it from disclosure—at least until after the election?

The last three words contain the key to the current unpleasantness. Obama would like nothing better than to put off any resolution until after Nov. 6. And I think it’s safe to assume that Holder would like to keep his cushy job for as long as possible. Who could blame him?

If a majority of House members do vote to hold the Attorney General in contempt, then what happens? It would be up to a U.S. Attorney to prosecute the case — which means he would be prosecuting his own boss. Does anyone see a potential conflict of interest there?

On the other hand, Holder could order the U.S. Attorney not to prosecute. Wouldn’t Republicans have a field day with that one?

Unless Republicans in the House agree to meekly back down (something I don’t see happening), it won’t be long before Holder is gone. Some 115 Republican members of Congress have signed a no confidence resolution against Holder. Dozens already called for his resignation. Several members of the Senate, including two members of the Senate Judiciary Committee, echoed that demand.

Holder has been very obliging in the past about doing whatever his boss in the White House wanted. This included refusing to enforce the Defense of Marriage Act and declining to prosecute New Black Panther Party members who were caught on tape in November 2008 trying to intimidate voters.

So I have no doubt that when Barack Obama wants to shove him out the door of Justice, Holder will quickly oblige. As I said before, you can color him gone. But don’t get me wrong. This doesn’t mean that justice has been done at Justice. We’ve got a long way to go — at least until January — before that happens.

They are in attack mode, in total defiance to protect Holder. And so Holder is now far more important than murder and justice? Why this sudden shift from righteous whiners to defenders of murderers?         Exactly. It is Holder’s job as Attorney General to enforce the laws that are on the books. The wishes of the President are secondary to the law. If he cannot perform his duties and defend the laws as they currently exist, then he should resign.
        Furthermore, if the President expects the Attorney General to follow his orders instead of enforcing the law, then the President should resign as well.

        “Everything” revealed? Not quite, son. The subpoenas are for intra- and inter-office communications for a specific period of time related to a suspected coverup. That’s very far from “everything.”

        Yes, we have laws to protect flow of national security information. and executive privilege is valid when such protection is warranted. Since the documents have already allegedly been provided by DOJ to Congress related to the OPERATIONAL nature of F&F, what’s left are the nonsecurity related communications that in NO WAY impact national security.

        In case you have any doubts, please refer to AG John Mitchell’s prison time spent for EXACTLY the same actions Holder and Obama are taking now. Once again, executive privilege does not, and never has, extended to information involving a coverup of illegal activity.

        Vig. First, I admit i am somewhat confused as to just what exactly Holder refused to turn over. From what i understand, no documents as to any BshII operations under the program have been asked for. In fact, such offerings have been refused. Holder and the AGs office did turn over everything up through Oct. 2011. What remains are those communications from Oct through today. Is this correct? line votes on the subpoena for the most part. Suspiciously looking like partisan politics witch hunt doesn’t it?

        And….unlike past investigations..there isn’t a “smoking gun” memo or document (leaked or turned over) which gives a direct line to something seriously awry in evading the law. When Reagan was embroiled in Iran Contra for dealing with the enemy and violating directly the laws. Even with the smoking guns circling about indicating North was a treasonous criminal SOB, that administration stonewalled and fought every request until Reagan was forced to ‘fess up or face a showdown with Congress.

        So my questions center around…why only the documents for F&F and not the entire program from beginning? Why concentrate on documents known to be after the operation was found out and the internal investigations of the AGs office?Where is the “smoking gun” or are we to be treated to another Inquisition as Herr Starr conducted with Clinton…only to waste tens of millions of dollars for nothing?

        Flashy, you say you would like to know which documents they are demanding Holder to turn over. Let me help you out. They want the documents and e-mails that prove that the real reason for “fast and furious” is to promote the liberal quest for gun control laws in the U.S. And what appears to be an even more likely enlightenment (based upon the complete stonewalling by the administration) that the great Ozbama in right in the middle of all this. Any questions?

        Flashy, I believe the subpoenas cover the inernal memos and e-mails within the DOJ subsequent to the February 2011 letter. To quote Mr. Wood, “…Holder’s Justice Department made a huge mistake. It sent a letter to Congress in February 2011 flatly denying that any such program ever existed.”

        That, combined with insider tips and Holder’s nine appearances before the House/Senate in which he was caught in lies about when he first knew about F&F, are not smoking guns but present a reasonable doubt about the forthrightness of the DOJ. Add to that the exertion of executive privilege, which is tantamount to a coverup of either Holder’s actions, Obama’s involvement, or both, and you have a basis for investigation.

        Although Committee vote was purely along partisan lines, 17 Democrats in the House crossed party lines on the contempt vote.

        Iran Contra proceeded to appointment of a special prosecutor, Judge Lawrence E. Walsh, in the absence of any “smoking guns.” The prosecution was largely unsuccessful, in part due to immunities and divulgence of damaging information during the pretrial Congressional hearings.

        You may decry the “witch hunt” aspect or playing of politics during an election year. But you then must also remember the impeachment of Bill Clinton, in which conviction in the Senate was roadblocked by a purely partisan Democrat vote after perjury was proven. It was not Ken Starr, it was the Democrats who wasted “tens of millions of dollars for nothing.”

The operational portions of both Wide Receiver and F&F are already known, and as Jay Carney said, those pertinent documents have been provided. Once again, it’s not about the operations, it’s not about national security, it’s about stonewalling the release of information that may be germane to a coverup. Sufficient legal doubt is present, and the executive privilege throws gas on the fire, ot doesn’t douse it.

        Unfortunately for this country, this may very well be of national security as the entire operation was conducted without the Mexican government being informed. Now that more than 2,000 weapons have crossed the border into the hands of suspected drug cartels without permission or involvement from the Mexican government and resulted in hundreds of Mexican civilian deaths, this could very well be considered an act of aggression against a sovereign nation.

        Obummer knows this and that is undoubtedly why he has protected them from going public. Don’t get me wrong, I in no way agree with this Imposter-in-Chief or his race baiting AG Holder.

        Just food for thought!

        Operation Fast and Furious was pure and simple a sneaky attempt by a bunch of arrogant bastards to manufacture a crisis in an attempt to weaken the Second Amendment. Only they handled it like the Three Stooges and it blew up in their faces. And no, I don’t have solid proof, but most reasonable, honest people with a modicum of common sense can connect the dots. It’s time those people on the opposite side of the political isle admitted this scam. Then, like the Democrats said in the 1990s, we can all “Move On”.

    Actually that is not what Fast and Furious was about at all; the whole obongo/holder scheme was to send guns to Mexico traceable to the U.S. so that the swine liberals(aka democrats) could push for more gun control laws. It backfired on them like so many of their sick twisted agenda is and will.

And when someone ran an ad in local newspapers stating that they would buy any and all guns…… and he did buy 67 weapons one afternoon at a public meeting place… at seller asking prices….. nobody but a few of us noted the situation. Of course, no laws were broken by this purchase episode, but where did those guns go? Who was the non-identified hispanic looking buyer, really? Was it just a gun store sham or an individual seeking to make a few bucks legally turning guns? Nobody knows, since nothing could legally be done at that time. Still makes me wonder, how about you?

      A presidential pardon “extends to every offence known to the law, and may be exercised at any time after its commission, either before legal proceedings are taken, or during their pendency, or after conviction and judgment.” (SCOTUS)

      “Unless the pardon expressly states that it is issued because of a determination that the recipient was innocent, a pardon does not imply innocence. It is merely a forgiveness of the offense. It is generally assumed that acceptance of a pardon is an implicit Acknowledgment of guilt, for one cannot be pardoned unless one has committed an offense.”

      If Obama is not re-elected, he would most likely issue a pardon before inauguration of the new president. If he is re-elected, he has the luxury of time in that he could let the investigation, Grand Jury deliberations and indictment play out before he either throws Holder under the bus, or ultimately pardons him.

      Given the disrespect for the rule of law that Obama cherishes, he could even pardon Holder the day after he is re-elected, thereby nullifying any subsequent legal action during a second term.

Do you really believe, I mean really believe that anything is going to become of this ” Contempt of Congress ” charge? No I’m not for the communist democrats nor Eric Holder. I agree that the man must be impeached/fired and charged in a criminal court. With that said, do you think after having our @$$ handed to us yesterday by the supreme court ruling on Obamacare, that Eric Holder will even see the inside of a jail, much less a court room? If Obama can control the outcome of a supreme court ruling how far do you think we are going to get with convicting Eric Holder or getting the ” executive privilage ” documents on Fast and Furious?
    This is only a dog and pony show the republicans are putting on because they can’t do anything else. Only way to nail Obama or Holder is to vote in another president with some testicalar fortitude. Then bring them both up on charges of treason.

    Holder has already tried to leave office over the Fast and Furious debacle. Valerie Jarrett (who pretty much is a Muslim and responsible for much of the leftist policy from this White House) said no, he can’t quit, it’d look bad for the Obamation. Frankly, Holder’s inevitable contempt citation from Congress I predict, will fare much worse for King Obama come November, when voters rightfully kick the trash to the curb! So, despite the fact that a border agent lost his life tragically in this bungled fiasco of incredible proportion, there is one small silver lining to the whole deal.

        Economists are generally agreed that the Depression was lengthened and deepened by FDR’s socialist policies. Just as Obama is doing with the recession they say no longer exists.

        As for those without work, ask them whether or not we’re in a recession.

      Many people voted for Obama because they were encouraged by his energy and his promises and also disillusioned by President Bush. It had nothing to do with the fact he was half black. Has nothing to do with his being half black. He has no substance. When minorities groups get over whining about race, they will move ahead. Women did just that with affirmative action.         The National Debt has now increased more during President Obama’s three
        years and two months in office than it did during 8 years of the George W. Bush

        The Debt rose $4.899 trillion during the two terms of the Bush presidency. It
        has now gone up $4.939 trillion since President Obama took office.

        The latest posting from the Bureau of Public Debt at the Treasury Department
        shows the National Debt now stands at $15.566 trillion. It was $10.626 trillion
        on President Bush’s last day in office, which coincided with President Obama’s
        first day.

        The National Debt also now exceeds 100% of the nation’s Gross Domestic
        Product, the total value of goods and services.

        Mr. Obama has been quick to blame his predecessor for the soaring Debt,
        saying Mr. Bush paid for two wars and a Medicare prescription drug program with
        borrowed funds.

        The federal budget sent to Congress last month by Mr. Obama, projects the
        National Debt will continue to rise as far as the eye can see. The budget shows
        the Debt hitting $16.3 trillion in 2012, $17.5 trillion in 2013 and $25.9
        trillion in 2022.

        Federal budget records show the National Debt once topped 121% of GDP at the
        end of World War II. The Debt that year, 1946, was, by today’s standards, a mere
        $270 billion dollars.

        Mr. Obama doesn’t mention the National Debt much, though he does want to be
        seen trying to reduce the annual budget deficit, though it’s topped a trillion
        dollars for four years now.

        As part of his “Win the Future” program, Mr. Obama called for “taking
        responsibility for our deficits, by cutting wasteful, excessive spending
        wherever we find it.”

        His latest budget projects a $1.3 trillion deficit this year declining to
        $901 billion in 2012, and then annual deficits in the range of $500 billion to
        $700 billion in the 10 years to come.

        If Mr. Obama wins re-election, and his budget projections prove accurate, the
        National Debt will top $20 trillion in 2016, the final year of his second term.

        That would mean the Debt increased by 87 percent, or $9.34 trillion, during his
        two terms.”

I think he’s being told to cover for the real mastermind of the FF game and that it is someone in the White House who was calling the shots. It’s time to get some of the lower players to roll on the top by offering immunity (etc). At least now with a civil contempt a judge will be able to peruse the documents that Holder’s claim are protected by executive privilege. We will see won’t we; although I know it won’t be today but there is no statute of limitations on murder.

Last I knew of them doing anything to help anyone was helping all of the black folks in New Orleans after Katrina. Here we are in Colorado with fires everywhere, close to 400 homes burned to the ground, people displaced with not much more than the clothes on their backs and what are we hearing from FEMA? nothing! It appears to me that FEMA only responds to an emergency when it suits the government and their agenda. We’ll see what happens today. Obama is on his way here to survey the damage. In reality, there have been very few instances in history where the people’s will was acknowledged by this government. It was acknowledged with Nixon’s resignation subsequent to Watergate but disregarded in Clinton’s escapades in Lewinski-gate. It seems that our wishes and demands have little meaning to politicians. What matters is what the puppetmasters want and what fits into their agendas. When in the course of all of this, the people have truley had enough, they will rise up in arms against the tyranny and defeat it. This is why this botched operation was planned in the first place. A full scale attempt with firearms to overthrow this tyranical government is what THEY fear. THEY want to get rid of our ability to do such a thing and taking away our guns is the only way they can accomplish complete control of the people. Operation “Fast and Furious” was meant to be a stepping stone in that direction.     Operation Wide Receiver and Fast and Furious perhaps have been failures and somewhat hampered by current gun laws. Like the gun buyer who was on food stamps could go out and purchase so many guns at one time. Also the ATF agent so much involved in the gun walking may be the one protected most until more investigation happens and he is the person who should be prosecuted. It is also somewhat of question of where this agent was assigned in Maricopa County and also the DOJ is investigating this county. When the real truth comes out and more learn the real events perhaps the worse thing to have happened is for the House to hold Holder in contempt.

    Well Chip, F&F was not “bungled”. It went exactly as planned. They got thousands of guns illegally / treasonously into the hands of Mexican gangsters. The gangsters would then use the guns to murder and plunder and the guns would then be traced back here. Their hired help in the MSM would then work the public into frenzy. This would then allow the Communist foreign-national Kenyan to rally his fellow Communists in Congress to clamp down on guns, gun sales, gun owners.

    Little Barry Soetoro is up to his eyeballs in F&F and as with Holder he is an accomplice to several hundred murders, not the least of which was one of our border guards. By this point in time they should have both been removed in handcuffs and locked up in Leavenworth awaiting trial, conviction and hanging.

    With a vote or 255 – 67 in favor of the criminal contempt of Congress it looks pretty conclusive. However, it also leaves 113 members of the House who did not vote and are derelict in their duty which once again shows that it is very difficult to hire good help these days.

    And as I told my Congressman last week end the House does not need the Senate to arrest and jail Holder. However, we must remember, we haave The Weeper of the House who is simply a go along to get along political hack. He will do whatever TPTB order him to do.

Presidential Executive Orders become what amounts to an ‘autocrat ruler’s’ ruling that no one in the USA can contest, reject, repeal, etc. once a PEO is published in the Federal Register. PEOs need to be done away with while Congress is filing contempt charges, I think.

    It gets worse by the day. Holder defies congress, Obama exerts executive privilege, justice department will not prosecute. Does this sound like democratic republic? Where are we headed? Will it do any good to go through impeachment proceedings? Will they just ignor that too, and say it’s racist, or that we don’t have the authority?     Now the truth is coming out about Fast and Furious we should hold every House member who vote to hold Holder in contempt of Congress in contempt themselves for making a mockery out of the House. I can’t wait until Nov when you Teabaggers are sent back to your Plantations. Maybe then President Obama and the Democratic Congress can fix the mess GW left and get us back to progress.     IN MY OPINION LOOKING INTO YOUR SYSTEM, believe Eric Holder should keep his job Chip, this is one of your systems main fault when those who hold judicial office fear losing those jobs unless they do what the parliament your Congress demand they do etc whereas in Australia we have a separation of powers between politicians and the parliament. Whats the point in having a Justice system being controled by your members of Congress. Might as well save the money and sack the lot. From my perspective he was discharging his duties as he should or would do in Australia or the UK.

    Your justice system is broken because your politicians are meddling where they should not. I suggest your powers that be go back to the start and admit your Constitution has either failed or mis interptreted by your interpreters of Constitution and law,

    I want the justice department to flat out enforce the laws of the land… not making it up to satisfy his sick communist agenda. It’s up to the legislatures to make the laws & Holder & Obama are oath sworn to uphold the laws, never make them.
