Dianne Feinstein And The NSA Versus James Madison

A few weeks ago, Dianne Feinstein claimed that mass spying by the National Security Agency is “lawful, effective and Constitutional.”

Seriously.

I won’t waste my time refuting that nonsense. But I will give you some tools to resist these criminals, without relying on people like Dianne Feinstein to do the right thing — which, by the way, is unlikely to happen.

Ever.

More on that and some action items you can take today in a bit.

But first, a little more from Feinstein.

Up Is Down

Calling billions of 4th Amendment violations “Constitutional” wasn’t enough for Feinstein. She then  introduced a new NSA “reform bill” that does absolutely nothing to stop the NSA.

A few days later, she took to the pages of The Wall Street Journal for some nasty fearmongering. She wants you to believe that either the NSA must be allowed to continue the spying, or you could get hurt in a terrorist attack.

Her message was basically this: We spy, or you die.

George Orwell knew what this was all about when he wrote: “Politics itself is a mass of lies, evasions, folly, hatred and schizophrenia.”

The Truth — From James Madison

The truth, though, is that you don’t have to keep taking it from people like Feinstein. And you don’t have to sit around waiting for her or her friends to stop the NSA.

James Madison, known as the “Father of the Constitution,” had some advice for what to do; and it doesn’t include relying on the Federal government to stop the Federal government.

In Federalist No. 46, he gave us a four-step plan to successfully resist — in our States — Federal actions we consider either unConstitutional or “unpopular.”

  1. Disquietude of the people: Madison expected the people would throw a fit when the feds usurped power — even using the word “repugnance” to describe their displeasure.
  2. Refusal to co-operate with the officers of the Union: Noncompliance. The Feds rely on cooperation from State and local governments. When enough people refuse to comply, they simply can’t enforce their so-called laws, regulations or mandates.
  3. The frowns of the executive magistracy of the State: Here, Madison envisioned governors formally protesting Federal actions. This raises public awareness, and executive leadership will move things to the next step.
  4. Legislative devices, which would often be added on such occasions: An example of this is the use of State and local legislation — laws and resolutions — either protesting or resisting the Federal acts.

Impact

This is effective stuff.

Madison said that if a number of States followed this path, it would “present obstructions which the Federal government would hardly be willing to encounter.”

Judge Andrew Napolitano agreed recently. He said if an entire State refused to comply with a Federal law, this would make it “nearly impossible to enforce.”

Putting It In Practice Against NSA

Using this advice, the Tenth Amendment Center has put together a multi-phase plan to resist the NSA.

Phase 1 starts with passage of the 4th Amendment Protection Act in your State.

This is a “legislative device” that requires a “refusal to cooperate” with Federal spying programs in your State.

No matter what they tell you, the NSA absolutely does rely on help in virtually every State.

Here are just a few prominent examples, all of which would be banned with the passage of the 4th Amendment Protection Act in your State.

Providing vital resources: The NSA is resource-hungry. Back in 2006, they maxed out the Baltimore-area power grid. They were concerned that additional power needs could “cripple” their “mission.” The hunt for new data centers was on.

The one in Utah, for example, requires 1.7 million gallons of water every single day to operate. That water is being supplied by a political subdivision of the State of Utah.

Utah should turn the water off.

No water equals no NSA data center.

In Texas, the new data center being built in San Antonio gets all its electricity from a State-owned power company.

They should turn it off and make the NSA fend for itself.

There are NSA locations in Colorado, Washington, Hawaii, Tennessee, West Virginia and Georgia, too.

Universities as research centers: There are currently 166 colleges around the country that the NSA has partnered with as “Centers of Academic Excellence.”

These are major research centers, advancing NSA spying capabilities. And they act as fertile recruiting grounds for future NSA “analysts.”

Many of these universities are State-run, and future partnership would be banned with passage of the 4th Amendment Protection Act.

It’s bad enough they’re spying on all of us, but recruiting our kids to do it? Shameless.

Big Brother in your local police: The NSA’s culture of suspicion is trickling down to local law enforcement. Information collected without a warrant is shared locally through two channels (that we’re already aware of). They share through the Special Operations Division (SOD) and fusion centers.

On top of it, local law enforcement is encouraged to share Suspicious Activity Reports (SAR) upstream with NSA and other Federal agencies. (Learn more about SAR here.)

It’s a very symbiotic relationship.

In short, your local police is being co-opted by Big Brother.

Turn It Off!

Every single State needs to turn it off.

Whether it’s resources like water, electricity or sewage treatment, or research partnerships and information “sharing,” there’s nothing in the Constitution, or any case law, that requires your State to help the Feds violate your rights.

Even the Supreme Court has repeatedly agreed with this “anti-commandeering doctrine.” Relevant court cases are 1842 Prigg, 1992 New York, 1997 Printz and 2012 Sebelius.

Working together, we will send a message to people like Feinstein and her creepy friends at the NSA.

“You don’t get to scare us into giving up the 4th Amendment.”

And how do we do that?

Deliver the message with resistance. They’ll hear us loud and clear.

It’s not going to be easy. And it’s not something that can be done with one bill, one lawsuit or one anything for that matter.

But if we want to live free, we have to take it, as Thomas Jefferson so wisely said: “A free people claim their rights, as derived from the laws of nature, and not as the gift of their chief magistrate”

Refuse to comply, and nullify.

Action items:

  • Learn more about the 4th Amendment Protection Act here.
  • Contact your State Representative and Senator by phone. Strongly, but respectfully, encourage them to introduce the act in your State. Contact info here.
  • Contact them again every two weeks until you get an answer. Report back whatever you learn here.
  • Contact your local politicians — county and city or town — and ask them to introduce a resolution in support of this action here.
  • Join the coalition to stop NSA spying here.
  • Sign the petition to turn the water off in Utah here.
  • Get updates on the effort nationally and in your State.

So when that item fails those bargain hunters again buy another knockoff item thus supporting the economy of a foreign company.

            OK a Chinese produced knock off might look the same as one made in the USA however not only did they (Chinese Manufacturer) not pay royalties to the patent holder they use inferior materials and workmanship hardly up to the standards of domestic produced items.

          Being a former manufacture I can attest to this almost all is true HOWEVER it started with TAXATION overtaxing commerce has led to the start of out sourcing but over regulation took its toll as well Being a manufacturer I could cope with rising costs as these could be absorbed HOWEVER State Local and Federal taxes as well as regulations fees licenses and other government add ons can not be absorbed. No one wants to work for free and to stay solvent we do what is necessary to survive.

          It would be more cost effective to produce products domestically even pay higher wages but the robbery from the government makes it impossible to survive.

          I relocated my firm (at great cost ) from the PRCM (People’s Republic of Commie/Mexico to a more business friendly environment. The PRCM not only lost taxes from my firm but those of nearly 100 employees. FYI I had offered assistance to anyone who was willing to relocate so no I was/am not cold hearted.

          You want business then find a way to keep government’s hands out of our pockets.

The framers had a hard decision in which was to be the first amendment and which was to be the second.At the time they felt it was important to speak freely about government. So freedom of speech was first. the framers also knew it was important to be able to preserve these rights and evoked the second amendment.     This is great and what this man is doing is fantastic and, I believe, effective in its way. What “the resistance” (which is what we are starting to become, and the association is intentional and appropriate) needs is a charismatic and “spiritually” powerful leader and probably some non-violent protest (to start). There have been many in American history- Patrick Henry (“give me liberty or give me death”) and Martin Luther King, Jr come to mind. The Tea Party has been effective, in part, simply because of how engaging its’ name is. We can only pray God will send us a Prophet.

    NSA is trying to find Alkaida so they can supply them with weapons and any other type of assistance they might need like they do in Syria. The NSa knew about Osama bin Laden(not to be confused with Obama bin Laden). The NSA knew that Osama had sold its interest in the WTC, but decided to play pocket pool instead of doing anything constructive.

            “will” is the operative word here. Your prediction may or may not occur. (billions is plural; there are currently 7 billion people on earth so you are saying that at least 2 billion or 28% of the world population will die from hunger when Obamacare is enacted in 2014, quite a doosy of a prediction). But the dead, wounded, and amputees that I have listed in my post above are real: they actually died and/or lost limbs. Equating someone for what they might do with someone for what he actually has already done is irrational. It’s like saying Putin is worse than Stalin because he might kill 20% of his own nation’s population (Stalin killed around 17% of his). This kind of speculation would be rightfully laughed out of any court of law or any court of logic.

            President Obama removed all troops from Iraq as promised. He will remove the last of the U.S. troops from Afghanistan in 2014 as promised. Mitt Romney opposed Obama on this and said you should never tell the enemy when you are withdrawing, well Obama said we are out of Iraq in 2011 and he pulled all the troops out of there in 2011. He said we are out of Afghanistan in 2014 and we will be out of there 2014. The President didn’t start either of these wars. HIs predecessor in the White House did.

            Barak Obama was elected to the U.S. Senate in November of 2004 and was sworn in on January 2, 2005 nearly 2 years AFTER the Iraq War was launched by the Bush Administration and 4 years and 4 months AFTER the 9/11 attacks of 2001. While serving in the Illinois Senate as a state Senator in 2002, Barak Obama voted for a resolution that opposed any U.S. invasion of Iraq. Obama’s vote against that disastrous and monstrously expensive war was used with great effect in his 2008 presidential campaign.

        The Military knew where he was long before your president gave the order. And make no mistake about this, Obama did not kill Bin Laden, it was the brave and heroic Navy Seal Team 6 that killed the POS.             Again you show the inanity of the typical liberal. Reagan used Iran to provide financial aid to Nicaragua to fight and Cuban-backed Communist Sandinistas. The arms sales supposedly softened relations between Iran and the US. Although this action was not above board this was done to fight communism and the sale of arms could improve U.S. relations with Iran, but might lead to improved relations with Lebanon, increasing U.S. influence in the Middle East.

            In 1982, the US was leading the peace keeping mission in Lebanon October 23, 1983 – At 6:22 am, a truck carrying 2000 pounds of explosives driven by Hezbollah operatives into the Marine compound in Beirut and crashes into the 1st Battalion, 8th Marine Regimental Battalion Landing Team barracks. Since Lebanon and the Middle East didn’t want peace and Reagan didn’t want any more American lives lost so in February 1984 he pulled the troops out to let Lebanon fend for themselves. Something all the ensuing
            presidents refused to do. The Middle East will always be at war for this is their culture Reagan knew it no one else will admit to it

            I’d be willing to wager a tidy sum you never served yourself if you did it was in the rear somewhere far disconnected from any danger. If you are going to point fingers best make sure YOUR hands are clean !!! And when you begin do assign blame on others it is at that time you lose all credibility and you have lost.

            A little advise if you are going to argue issues of Marine Corps history with a Marine you had best make sure you’re right and know what you’re talking about.

    Can we see that it is imperative that we get rid of the second graders and criminals in senate and congress? We also must drive out the criminals in the executive!     The problem is that large segments of the American people and the representatives that they send to the House and Senate support a very aggressive intelligence and surveillance program against the threat of Islamic terrorism. From polls that I have read, these views constitute a majority. Huge numbers of Americans either don’t know or don’t care about the abuses of these programs. This is why executive branches going back to Woodrow Wilson have been able to consistently get away with this and increase their surveillance and intelligence powers. They have considerable domestic support when Americans feel that stopping an outside threat is more important than the loss of Constitutional rights. Political leaders in both parties have noticed – unfortunately in my view – that there are no mass demonstrations in the street by Americans demanding an end to these surveillance programs. And even if there were – did the massive demonstrations against the Vietnam and Iraq Wars have any effect in stopping or shortening either of those immoral, ineffectual, and unConstitutional wars?

      Apparently you missed the SCOTUS rulings that Mr. Boldin points out – 1842 Prigg, 1992 New York, 1997 Printz and 2012 Sebelius … not to mention the precedent laid down for nullification and interposition by the two most prominent founders; Jefferson and Madison. This method is essential in returning to constitutional governance.

      We use ‘federal’ because we are a federation. A federation divides SUPREME powers between our central (federal) government and our state governments. We are NOT a nation, with a national government that has supreme power over everything. Just because our CENTRAL government is ACTING that way and our state governments and the People have ALLOWED them to get away with it, DOESN’T mean we have to KEEP allowing it.

        Actually, the best justice I’ve ever got was from a shop steward. On midnight, July 4th 1998 I was assigned to do an overnight maintenance run at a studio in Hollywood. When we got our checks the next week, we were expecting to be paid holiday time – basically double time with overnight hours (work 7 but get paid for 8) We actually worked 9 hours straight, so we were expecting 18 hours of overtime. The shop only paid us straight time even though we started on a Holiday. It took about three weeks, but we all got our overtime pay. Thanks to the shop steward. And thanks to the brothers and sisters who sacrificed in the past to give a future to their beloved Union.

          A shop steward does not hand out justice KG. They argue the unions position according to a labor-management agreement. Either management, or an arbitrator, makes the final decision in a disagreement. In your case, it appears that management decided that you were due the overtime pay according to the agreement.

    In the states the Federal Government also co-opts police leaders nationwide through the “FBI Academy” in Quantico, VA. You’ll see this “accomplishment” on literally every police chief’s resume. In reality, they inculcate leaders of local police departments to fully cooperate with the Feds on any issue or conflict. It’s an old but effective tactic that’s been used by salesmen for decades called the “norm of reciprocity.” They provide something for “free” and naturally you want to reciprocate. The Fuller brush man handed out a free brush just like the Hari Krishnas used to hand out free flowers at the airport and numerous other examples you can probably recognize yourself. Is your police chief a graduate of the FBI Academy? You can bet if he or she is that their loyalty to their own city has been compromised.

The personality traits that law enforcement attracts is somewhere between the devil and a control freak They are not their to serve and protect but there to boost their fragile egos by “busting heads and inflicting pain most are would be mercs who cannot face adversity or danger so they become cops.

      I’ve posted this before and it is always apropos:

      The point of this isn’t to judge whether cops are justified in doing what they do. This article has nothing to do with police training. And this isn’t just about American cops. This is about the perception that we, the public, have of you when you perform the following actions. It doesn’t matter if you disagree with these perceptions, because right or wrong, they exist. The point of this posting is to simply let you know that we’re watching, and this is how we see things.

      1. When ten of you show up to make one arrest, it makes you look like cowards. On my way home from a bike ride, I saw three arrests being made in under an hour in a relatively safe part of the city. At one of the incidents, eight police cruisers responded to make one arrest. The guy who was arrested was ejected for being too drunk in a bar. Just one guy and he was drunk. He had a stupid moustache, hadn’t hurt anyone and was drunkenly walking home when he was tased and tackled by 3 cops before 6 police cruisers showed up in addition to the two that were there, for a total of 8 cruisers and 10 cops. The man was unarmed.

      How much backup do you need? It’s one guy. If you can’t handle one drunk guy by yourself, you shouldn’t be a cop. Training tells you otherwise? Well stop being trained by sissies.

      2. When you tase somebody who IS NOT trying to escape, it makes you look like lazy cowards. A taser IS NOT a remote-control for people. Want to talk to someone? Then walk over to them and talk. Don’t tase them and expect them to cooperate. Also, when someone is being tased and is writhing in cardiac arrest on the ground, they aren’t “resisting arrest” by not getting on their knees and neatly kowtowing to your demands. They’re incapacitated. You look like idiots barking orders at them when they can’t move.

      Being a cop has certain risks associated with it. If you aren’t comfortable with those risks, don’t take the job. Always trying to minimize your risk of injury at the expense of others by being a taser-happy lunatic makes you look like lazy sissies.

      Tasing everyone you see because they might pose a risk to you is like spraying everything with a fire extinguisher so it doesn’t catch fire. Part of the problem might be that many cops are overweight and out of shape. If you fatsos can’t chase someone down, then you shouldn’t be cops. Studies have shown that not being a lardo is just as effective as using a taser.

      3. When you set up speed traps, it makes you look like you don’t have anything better to do. I get happy every time I see a speed trap, because I assume it means all criminals have been locked up, you’ve caught the guys who broke into my car on three separate occasions and my stolen property will be returned shortly, right idiots? Good job guys, take a break and make some scratch for the city. Because why the hell else would you be sitting on your butt in a ditch if that wasn’t the case?

      People who speed are awesome. The last thing this world needs is more slow drivers. Traffic jams occur because of idiots braking prematurely. And when you pull people over, how about doing it in a place that doesn’t obstruct traffic? You know what’s just as “unsafe” as speeding? Having to swerve into another lane because your stupid car is blocking traffic.Every time I pass another cruiser parked in two lanes, backing up traffic for miles, it makes me literally punch myself in the jaw until I pass out.

      4. When you give out imbecilic tickets for rolling through stop-signs at 3 AM, or closing down lemonade stands, it makes us think you’re morons. We know that “the law is the law.” We also know that you’re not instruction-executing robotic automatons. When you harass us with nonsensical fees and fines, it makes us question your judgment. We know that this kind of trash is all about the money.

      Remember that case in Florida where a pair of LEOs closed down a lemonade stand operated by a 6 and 9 year old girl, because they didn’t have a permit? The legal age for entering into contract in the United States is 18. So that effort to charge them fees by making them apply for a permit? Illegal. Law is the law, right? Arrest yourselves. And speaking of nepotism…

      5. We know you guys use the buddy system to get out of speeding tickets. And it infuriates us to no end. Cops have a code that basically amounts to always letting fellow cops go.

      When a cop pulls over an off-duty officer, the officer who was pulled over discreetly flashes his badge to let him know that he’s on the force, and he’s simply let go. You think we don’t know what’s going on, jerk-wads? It’s a courtesy not extended to anyone else, lest the officer is having a particularly good day and isn’t PMS-ing all over the highway.

      Sometimes you write tickets for going 1 Mile over the speed limit, sometimes it’s 10 Miles. Then when you get called on doing something stupid like writing a ticket to someone for a law that shouldn’t be enforced and rarely is (like jay-walking in New York), you hide behind your tired mantra that it’s the law and that you have to be consistent. Except when you aren’t.

      6. When you flash your lights just to get through intersections, you look like scumbags. I’ve followed cops who’ve done this, only to see them park their cruisers for coffee or lunch. And speaking of lunch…

      7. When you park in a red zone to eat, it makes you look like lazy scumbags. The argument can be made that police officers need to be near their cruisers at all times in case of an emergency. Fine, but that doesn’t entitle you to eat at the most popular restaurants. If you want to eat at some trendy restaurant, park at a meter and pay, like everyone else. Can’t find a meter? Tough luck, go someplace else. Doctors, surgeons, rescue workers and security all have important jobs where people’s lives are at stake, and you don’t see their cars popped up on the curb, obstructing traffic and parked illegally so they can fill their fat faces with lunch. We know you’ll never get written a ticket (see #5),
      it infuriates us, and it makes us trust you less, and cooperate less.

      Now this is the part where I say “I know that police officers have a tough job,” but they don’t. Being a cop isn’t hard, it’s dangerous. There’s a difference. Being an engineer, teacher or airline pilot is hard. Being a logger, deep sea crab fisher, coal miner or firefighter is hard and dangerous. Being a cop is dangerous, but usually not hard. Driving around, issuing moronic tickets and filling out paperwork isn’t hard, it’s annoying.

      This is also the part where I say “now I know that most cops are
      good,” but I don’t. I only know two cops in real life, and they’re both awesome, but so is anyone I choose to call my friend. Most cops I see abuse their power every day by parking illegally, talking on their cell phones while driving, drifting in and out of lanes without turn signals, flashing their lights to get out of intersections and power tripping like crazy. If you’re a cop who’s reading this, rather than being butt-hurt by people’s perceptions of you, do something to change it. Write a fellow officer a ticket. Stick your neck out for us, rather than your colleague for a change. Do the right thing. We notice.

      And as for us: record cops. Record them all the time. Record them even if they’re not doing anything. Cops are cracking down on this and they’re trying to change the laws to make it illegal so they can’t be held accountable for breaking the law. They look up your plates every time they’re behind you at a stop, even if you haven’t done anything, just to check up on you. It’s time we started checking up on them. Who watches the watchers, if you will.

            Just referring to the typical beat cop. They are judged by their worst examples. There still are good ones doing the job right and for the right reason. Maybe not for long because the pool of applicants reflect society and the standards have been lowered so far as to be meaningless.

            But in the USA all of this can be changed. Most countries, it can’t be. No country has more laws protecting more kinds of right. No country has the legal remidies the USA has. It’s people: the low information voter. The American dream came true and you’re looking at it.
