Congressional Irrelevance

March 14, 2012 by

Congressional Irrelevance

Senator Jeff Sessions (R-Ala.) appeared stunned during a March 7 Senate Armed Services Committee hearing when first Joint Chiefs of Staff Chairman General Martin Dempsey and then Secretary of Defense Leon Panetta said the Administration of President Barack Obama needed only an international legal basis to go to war, and Congress would be an afterthought.

What’s truly stunning is that Sessions would be surprised. Congress has been derelict in its duty for some time and has essentially allowed the President to function as an emperor. It ceded its authority after 9/11 when it allowed President George W. Bush to engage in the vaguely defined War on Terror and send American troops around the globe. Obama upped the ante in Pakistan and Libya and may be on the verge of doing so in Syria and Iran.

Congress has become a ceremonial body. Its 535 members are more interested in lining their own pockets and passing legislation to benefit the banksters and large corporations than in Constitutional governance.

Sessions took these boobs behind the woodshed. Constitution? We don’t need no stinking Constitution! We got coalitions. Progressives pervade all segments of the gubmint. Vote these sob’s out.

        I heard somebody say this:

Unfortunately for many reading and writing on this site, they do not understand the issues being raised by this article and the Sessions video. I am not bothered one bit by the “concern” being raised by Sessions. I am, though, very concerned about his ignorance. As an elected representative of our country, he sure as heck should know better. Here is what he does not understand or, for self-serving political reasons, is pretending not to understand.

        1. Except in the case of an actual or imminent attack, no nation can start or threaten to start, a war. Why? Because under the United Nations Charter war is illegal. The UN is a ratified treaty of the US and included in our fundamental (Constitutional) law under Article VI entitled The Supremacy Cause. We have a legal and moral obligation to comply, in letter and spirit, with our legal commitments and obligations.

        2. When can a nation resort to war other than in self-defense? Only if it has legal authority under international law to do so. In most cases, that authority will come from the UN Security Council of which the US is a voting member and possess the power to veto any action by the Security Council. We do not lose any power or sovereignty as Sessions is attempting to scare people about here.

        3. Article 51 of the UN Charter recognizes, as inherent, the right of a people, a nation, to resort to war in self-defense. It parallels domestic law where an individual may resort to deadly force if that individual believes his or her life is in imminent danger.

        4. If we are about to be attacked by a nuclear weapon, does the President have the time to first get permission from a Congressional declaration of war to respond? Enter the rationale for the regulated President’s War Powers. The answer, especially in our nuclear age, is that the President may not have the time to ask Congress before he or she needs to defend our nation with a response.

        5. I repeat. Unless in self-defense, no nation can go to war without authority under international law. That is the point that the Secretary of Defense is, unsuccessfully, attempting to explain to a lawyer and elected member of Congress in the video. Senator Sessions is an embarrassment to himself and to our country.

i agree with everything you said. I was trying to make the same point without having the facts that you laid out to back it up.

      • Jerome

Sessions should look stunned. He’s beginning to realize that Obama is making Congress irrelevent.

      • Nancy in Nebraska

David L, I say we break the treaty and tell the UN to shove it! This is The United States of America and we have our own Constitution!!!

      • FreedomFighter

DavidL would turn America over the the UN, based on communism, the most corrupt body ever known to exist, run by satanists responsible for millions upon millions of deaths around the world.

No thanks DaveL the commi, the UN is not my choice for government.

The United Nations is an organization that was set up by the Leaders for the Leaders. They do not represent the people of America.
What amazes me is that Liberals, like DavidL, who quite often argue that we are a Democracy (really we’re a Republic) and how important it is for the people to have a vote, can turn around and relinquish our Sovereignty to an organization set up to serve self-interested Leaders and whose representatives aren’t even elected by the people.
Remember that our own Federal Government has greatly trampled the Constitution in their quest for Absolute Power, so why would anybody think the UN won’t do the same if we don’t stop them? The further that Government gets from the people they supposedly represent, the harder it is to stop them from usurping their Power.

Read this and help to get us out of the UN!

      • James

DavidL you are the one that is clueless. SECDEF was saying he did not need permission to go to war only UN permission. Our constitution says only congress can authorize war except in defense of the country. Attacking Syria is not self defense of the coutry so requires congress to approve NOT the UN. DAVIDL you are an obvious troll for the globalist and are a traitor to this country.

      • Nancy in Nebraska

DaveH, the federal government is just an illusion. It’s a shill for the UN.

      • Ted Bayer

        In response to DavidL:
It should be noted that treaties may not preempt the Constitution. Article VI specifically says, “This Constitution, …and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; … anything in the constitution … notwithstanding”. Thus a NATO directive to go to war in Libya does not obviate the Constitution’s requirement for Congressional approval to do so, nor can a UN requirement to not go into a war prevent the US Congress from approving a US Presidents request to declare a war.
This interpretation is supported by judicial precedent. From Wikipedia: “There has been some debate as to whether or not some of the basic principles of the United States Constitution, such as the country’s system of government or Bill of Rights, could be affected by an ambitious treaty. In the 1950s, a Constitutional Amendment known as the Bricker Amendment was proposed in response to such fears. This proposed amendment would have mandated that all American treaties shall not conflict with the manifest powers granted to the Federal Government. Subsequent Federal court cases such as Seery v. United States, 127 F. Supp. 601 (Court of Claims, 1955), Diggs v. Schultz, 470 F.2d 461 (1972), and Reid v. Covert, 354 U.S. 1 (1957) have, over the course of time, established in legal decisions most of the limitations that had been proposed by the Bricker Amendment.[6][7][8]

      • Wyatt

So now we need only the ok from the UN to go to war ? What a total load of horse hockey! Since the death of Dag Hammershold in the late 1950′s the UN has been a worthless organization incapable of preventing wars and conflicts anywhere they set foot and or decided to meddle . Basicly , in the past 60 years the UN has become a sounding board for the Communist and repressive Dictators of the world and Third World Countries who wish to hold the rest of the world hostage . And now they allow terrorist organizations to have a voice dispite their continued terror activities .

And just think , we the taxpayers of the United States get to pay for their deluxe offices in New York City . If the United States was smart , if the current White House had any guts and or brains , they would either start collecting rent or kick the UN out of the country . I would like to see just how long it lasts without our subsidies !

      • Rick

@ DavidL First, Nobody realy cares what the UN says. Without us the UN has no teeth. Second, this article is not about the UN it is about our constitution which in this country is supreme over UN and any other laws. It says that The power to authorize war lies with congress NOT the President. This Jerk in the White House has no clue what the constitution says nor does he care if he does not like it he simply ignores it or over rides it at will.If he was half the leader he should be he would be putting the constitution before anything else. If the UN does not like it then We shold keep the money we spend on them and send them packing let the 3rd world fund them since they run it anyway. I can find much better use for that money right here in the US same with all the aid we send to these foriegn countries that are looking to stab us in the back at every oppotunity. that would almost solve our debit in a few short years.

      • wendy dipietro

        DavidL,
Yes we have a right to defend ourselves in the event we are being attacked and no, the President does not have to seek congressional permission in that case. However, we are not under attack here. We are seeking to go into another country and assist. And before we do that, our President has a responsibility to seek congressional approval prior to seeking international approval which is the point Sessions is trying to make. Congress was set up to prevent any one person (the President) from running amok and ruling like a king. This is a Democracy and therefore set up so as to function by seeking the wisdom of many before such a major decision is made. You know, like offering up the lives of our children for another country. And what I hear from the Obama administration is, ‘I’ll do whatever I want’. His authority is limited just like the Supreme courts powers are limited in such that congress has just as much authority as the Supreme court to make a decision. But this administration has handed over all authority to the Supreme court as if they were god. This administration is way out of balance and leading this country down the wrong road.

      • kkflash

DavidL: It is you who does not understand the issues raised by the discussion in this video. There is a little matter of Article I, Section 8 of the Constitution that is being ignored by Obama, Panetta, and the Joint Chiefs.”The Congress shall have Power…To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;” There is no similar power granted to the President, as even his role as Commander in Chief of the military is limited to “when called into the actual Service of the United States;” The very idea that Obama and his staff think they may take war-like actions without specific Congressional approval is an abomination (or should I say Obamanation) to the Constitution.

      • TML

“1. ….The UN is a ratified treaty of the US and included in our fundamental (Constitutional) law under Article VI entitled The Supremacy Cause. We have a legal and moral obligation to comply, in letter and spirit, with our legal commitments and obligations.”

Except where that commitment or obligation conflicts with the Constitution itself.

“2. When can a nation resort to war other than in self-defense? Only if it has legal authority under international law to do so.”

Yet, as you just said, “1. Except in the case of an actual or imminent attack, no nation can start or threaten to start, a war. Because under the United Nations Charter war is illegal.”

“2…. In most cases, that authority will come from the UN Security Council of which the US is a voting member and possess the power to veto any action by the Security Council. We do not lose any power or sovereignty as Sessions is attempting to scare people about here.”

So even though you conclude that the UN Charter makes war illegal for any country other than as defense against direct attack, you go on to say that this same UN can say it’s ok to go against its own ‘rules’.

“5. …..That is the point that the Secretary of Defense is, unsuccessfully, attempting to explain to a lawyer and elected member of Congress in the video.”

And then you assume to know what the Secretary of Defense is “unsuccessfully” attempting to tell ‘us’, when it is quite clear from the video the Secretary of Defense is saying that UN approval would be sought for FIRST before congress. Since we are not actually being attacked, would it not be pertinent to FIRST get approval from Congress (the representatives of the people) in accordance with the Constitution BEFORE seeking UN approval? The Secretary of Defense is clearly saying the President has the ability to unilaterally take engage our military in an OFFENSIVE war with international approval over Congressional approval.

DavidL, you are an embarrassment to yourself.

      things are certainly getting scary.

      • DavidL

        To Ted Bayer,

I absolutely agree that the President should consult Congress either just before or immediately after the start of hostilities as provided under the War Powers Act. I never argued otherwise.

    • Art

You said it perfectly. Screw these third world sh*t hole countries, If we had our own oil we not be any where near these places.

      • bp

We have more oil & natural resources than any other country in the WORLD, but our communist government prevents us from developing them! We need a serious awakening of our independent & sovereign spirit! For love of country…..

        • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

If we had a socialist government they would nationalize the oil and all natural resources. Right now we produce more oil than we did at anytime in our history, our usage is 1/2 what it was eight years ago. Guess what the oil is owned by multinational who sell it to China , where they get the most for it. Oil price is set by OPEC and the world market , so even though we produce oil we are not allowed to buy it , but are forced to go on the world market. Produce 10 times more oil and it would be the same because big oil go where they get the most money. Its the Fee Market at work, remember. Just like the free market is at work when company move our jobs over seas where they get slave labor, ppay no benefits and have no environmental constraints. To top it off they park they money in offshore accounts and the republicans vote them a tax cut.

          • 4loveofcountry2

You have no understanding or wisdom, whatsoever Delroy Brown. If we were able to drill & develop our own natural resources, we could be energy & financially independent. THINK about it.

          • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

It does not work like that. The oil is owned by multinationals like Bp, Shell etc. They put the oil produced on the world market or where they can get the most for it. Its the Free Market at work. Most of the oil conglomerates are multinationals. We cant force them to sell here. Therefore we import while they export. Goy it.

Congress irrelevant? Good grief Mr. Livingston, Glenn Beck was saying this while he was still on CNN. This President should have been impeached early in his presidency, but congress did nothing but complain and cry about his transgressions. Now Congress is pretty much irrelevant, and they still bluster up and complain. I hope that this November, we take those RINOS out of their cushy chairs, while the Democrats in both chambers go down the tube. This is the people’s last chance to remain a Republic.

    • http://msn.com mr.freedom

AMEN. we have a two party one party Both are the same…

      • DavidL

        This is for Freedom Fighter:

You are being animated by a non-issue. The UN Charter and our Constitution are not mutually exclusive. The UN Charter is part of our Constitution. Our Constitution controls, and supporting the UN does not in any way change or weaken this fact.

May I suggest you do some homework:

        Read……… the UN Charter
Read……… the Constitution, and pay particular attention to Article VI.
Read……… Act of Creation, The Founding of The United Nations by Stephen
        Schlesinger (No liberal that)

To call for the abolition of the UN because “it doesn’t work”, makes as much sense as calling for the abolition of criminal law because there is still crime.

      • Dale on the left coast

        DavidL . . . UN charter part of the Constitution . . . NUTS Dave . . . . just NUTS . . .
The UN is a group of 190 odd countries . . . the vast majority of them are despots and dictators . . . is a worthless organization, and must be abandoned by Freedom Loving Democracies around the world.

      • Ted Bayer

        In response to DavedL:
Treaties agreed to by the US, including the UN Charter, do NOT become part of the Constitution. While I agree that Article VI of the Constitution asserts the supremacy of US Treaties over State law, it does not give the Treaty equal status to the Constitution itself. If you read Article VI more carefully you will see that it specifically states, “…anything in the constitution … notwithstanding”. In addition, numerous Federal cases have established judicial precedence in support of an interpretation of Article VI that gives the Constitution itself supremacy over any treaty.

      • eyes wide open

Wait, don’t tell me DavidL, you’re jewish, it explains much regarding your views. Israel is ready to fight right down to the last American. My only wish is that we make them go it alone. Lets see how brave those little sissys are then. In the mean time, go ahead and keep killing unarmed palestinians with F16s you miserable cowards. The only fight you could win is against an unarmed opponent.

      • texastwin827

DavidL and your point would be? Article One, Section 8 of the constitution also says Congress shall have the power “To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water;”

The War Powers Resolution was not only passed by Congress but 2/3 of Congress voted to override Nixon’s veto of the resolution. At what point to be decide that we no longer need the “Checks & Balances” that our founding fathers provided for us?

    • Sirian

No, the Senate conducts the trial. The House has to make the charge. And if I’m not mistaken, we have a Republican House right now.

      • Ted Crawford

Exactly right Alex. While it’s nearly certain that he, like Clinton, would be Impeached, the end result would be the same as with Clinton. Impeachment, espesially at this point, would take far too long and accomplish nothing substantive!

      • JUKEBOX

In the interest of time, the quickest way to impeach Obama with our vote in November. As for David, if Iran had a missle aimed at Obama’s bedroom, he would probably want to sit down and have a beer, and ask Ahjmadenijad if they couldn’t “Just get along”.

  • Bruce Belligan

Congress gets what they deserve. Emperor Obama isn’t through with them yet, not by a long shot. This is the price you pay for betraying the constitution.

    • Joe

Congress gets what it deserves!!! Congress deserves NOTHING!!!,but to be replaced!!
People seem to forget or do not know, that Congress is responsible for what comes out of Wsahington. As much as I dislike Obama and his tactics ,Congress has the say on it ALL.
But Congress is gutless. They are too busy looking out for their welfare.
They know nothing of Constitutional governace.
There are a few who are trying to make a difference, but ,with 70 known socialist democ rats in Congress,it makes it difficult .
Vote these career parasites out of office.See if they can get a real job!!!!

      • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

It sounds that you want a one party state with no congress no debate , just totalitarian government representing your point of view. Most of the middle east, Russia and China fits right in with your thinking. You seem to want to impeach the president every time you disagree with him. Remember 1/3 the country vote democrat, 1/3 republican, and 1/3 is independent minded and analyse their choice each go around.. You say forget the vote impeach every time my man lose.Just like like the bible, there are those who can trod out and quote scriptures that support their point of view. Reading the comments I see those who can point to articles of the constitution whenever it advances their point of view while at the same time ignoring every thing else that it says. Real life and the issues we face as a country and worldwide is complex and is not solved by emotional and closed minded way of thinking.

i saw ron paul in topeka last friday. in his speech he said the people should decide if we go to war and congress should act on their wishes. thing of the past, huh. the people were brought up many times in the speech he made. does romney, santorum or gindrich mention the people much. hell no. all backed by the elitists. please voters. ron paul 2012. he’s about all we have left.

Your Right on Ron Paul and may I also say that HE is the only one in all of both the House and the Senate that’s both party’s. win Ron Paul put his Hand on the BIBLE and Swore to up hold the Constitution and the Rule of Law that is Exactly what he has done.
he has NEVER at any time not stood by the Constitution or the Rule of the Law NOT once.
there is NOBODY ELSE THAT CAN SAY THAT NOBODY…

VOTE Ron Paul to save America

      • Hey You

Although I agree with the sentiments which you express, there does not seem any voting effectiveness left. We, collectively, have left the republic and now are circling the drain as prosperity and morality go down.

    • Danette

He’s the only one running who understands that our overlords are the international banksters/globalist elitists and that we must get rid of the central bank, the Fed, in order to take back control of our nation. Of course if he does get elected the banksters will attempt to assassinate him as they successfully did JFK, McKinley, Lincoln, et al.. So, are we just going to sit here and let the country go down the drain it’s already circling? The hour is late. It’s high time those few of us who are Americans in more than just name begin making a principled stand against our would-be masters regardless of consequences. We must refuse to obey unconstitutional edicts of the federal government, perhaps a good start would be by refusing to participate in the elite’s religious initiation rite of Abortioncare…er…I mean Obamacare.

Ron Paul in 2012 or America is Busted!!!

  • J Evans

Our current President has made his disdain for our Constitution abundantly clear in the short time he has been in office. Lets’ pray there are still enough Patriots in this country, and that our election process has not been compromised to the point that he’ll get a second term, so as to finish us off. BTW, I’m not hearing anything in liberal media about the 6 African countries to which he has sent American troops. He surely bypassed Congress to do that, because there hasn’t been anything public about it. (I know soldiers who are there, that is how I know about it.)

    • Leon

The president knows more about the constitution than you do since he is a constitutional lawyer. You sound like a individual who just don’t like his policies which is fine you can vote him out next time.,If anything is true about Obama he is reluctant to commit US troops abroad and believe in talking it over. Like president bush before him said we will pursue the terrorist wherever they go so we do not have to deal with them here. I am sure if you look at where we have dispatch military personnel in Africa its usually to disrupt terrorist setting up new base of operation.

Oh joy, the spelling Police are here! Everyone, quick grab your Thesaurus and Dictionary! Let’s, by all means, focus on the spelling, punctuation, and sentence structure, after all the substance is only a secondary issue, at best!

What is the matter bp you have no response to Kathy so you are resorting to subdifuse to comment on grammar and sentence structure. Because you can not dispute the substance of her comment. Or, did her logic go beyond your ability to comrehend?

        • bp

Rick:Find no logic or substance or punctuation in the comment. What is “subdifuse”?

      • Wyatt

Wow BP , thats a typical leftist statement . Not all people are articulate or have the ability to calmly form a response to posts . Kathy has every right to post and comment on here and share her opinion . Grammer and punctuation aside . I am sure people get the gist of her message . As for valuable blog space ? What a load of horse hockey . I am fairly certain you mean , lets silence a dissenting voice .

As for the topic of the article , I am not quite certain just how many have served in the military , but be quite sure of the fact that Congress and only Congress has the power to send us off to war . Look at WWII , FDR’s “Day of Infamy” speech to Congress in which he asked Congress to authorize a state of war . And as much maligned as George Bush was for his post 9/11 actions even he went before Congress to as permission to sent troops off to war . And dispite the denials and later recantations and excuses , the vast majority of the house voted to send and commit our troops .

Barry O and his henchmen are simply trying to apply dictatorial powers and set us up for a total take over of power . He has made no bones about what he thinks of the Constitution and its rules over the presidency and has spit on and trampled it at every chance in his march to creating his own dictatorship . Having got over on us by getting elected when he was not legally entitled to be a candidate , he feels he can do pretty much what ever he feels like . If you doubt , just look at all the things he has crammed through without approval of anyone as he sticks it to America .

Interesting comments. I can see BP’s point because there are no periods, words misspelled, etc so I couldn’t really understand what she was trying to say. But what is interesting is the very thing that you all are criticizing bp for is exactly what you are doing to him. He has a right to speak his mind and it sounds like he was frustrated with the post. Perhaps bp could have expressed it differently. However, he/she gets to express regardless of what the rest of you think just as Kathy does.

I wanted to say that, but could not.

      • DaveH

Can you read, Wendy? Our comments were not an effort to censor BP. His WERE an effort to censor Kathy.
To wit from BP — “Go back to school; at least get your GED before talking to adults. You’re taking up valuable blogging/editorial space. Or maybe you are just a progressive mole”.
Show me any response to BP that was equally vitriolic.

      • texastwin827

bp, if you had a shred of common sense, you would probably have realized that she doesn’t type by touch (no periods, no capitalization, etc) and that usually creates lots of errors. Errors, I might add, that may appear to be spelling or grammar errors when, in fact, they aren’t.

Perhaps if you spent as much time actually reading her comments, instead of belittling them and her, you might have understood. Perhaps it is you who actually “needs an education”.

      • texastwin827

Translation of Kathy’s comments for BP:

“We need a President to get things done. Everyone know Obama has no experience and that’s what got us in this place. Like all young (people) it’s spend, spend, spend which puts us deep into debt. I’s time we put someone who can do America right. Stop the flow of illegals, no more debt. It’s time we put someone who can do America right. Stop the flow of illegals, no more dream for foreigner’s education that we are paying for, giving jobs away to China. We’ve got to stop feeling sorry for other countries and stop paying countries for war. Play time is over. We’ve got to bring America back, not put it under. Reverse all of Obama’s laws. He had no right passing them on to us.”

Apparently, Kathy wasn’t too hard to understand, if I can easily translate her comment. Again, perhaps it’s your education, bp, that is lacking.

      • texastwin827

aww shucks…I made a boo boo. I have a typo and I’m sure bp will focus on it instead of the translation of Kathy’s post…you know how his small mind is!

    Brain dead repukes are inept……….

    • Fredo

What’s a “repuke”? Puking twice? Anyway, I firmly believe that today’s wanna-be-politicians running for office for their first time, are doing so in hopes that they may also become Rich while “serving”. The idea of serving because you want to serve your Country and help run the country FOR the people, is long gone. Political office is now seen as a room with the potential for becoming rich. There is NO group of people in America that is more abused and taken advantage of AND discriminated against, then the American Federal Income Taxpayer. Not one. We are trampled for our money everyday, and all it seem the feds do is look for more ways to take our money. They use our money to make money for themselves and their families and their friends and their contributors. We should have our own “Preferred” status of those who support the entire f*&%ing nation of deadbeats and do-nothings….and of course, ALL the wars, ALL the infrastructure, ALL the economy and everything else that we fund in this country. I am sick of being “governed” by rich people. Why is it that some politicians are not rich when they take office, but ARE rich by the time they leave office? I also believe there should be an open hunting season on lobbyists. It should not be legal for them to bribe our “on-the-take” politicians. Obeyme is incompetent as our President and seems to want to “rule” instead of lead. He certainly needs to go in November, or this republic will sink into the hole that is full of thieves in congress and liberal “Royalty” in charge of the new, socialist Amerika. This administration is full of thieves and liberal tampons who only want to rule America. Please help to vote them gone.

      • Bob Johnson

It makes no difference to me if one we elect is rich or poor, as long as they lead. A leader is concerned about all of the people, and the affairs of the country and state, he is not concerned with making money or consolidating power, those items are for despots and tyrants and dictators. If we do not remove obama from office, we will ultimately put one of the three in place of a freely elected president. One should not seek office to simply reap rewards, there is an assumed fiduciary responsibility that comes with election to office, and if you cannot honor that you should be removed, as quickly as possible. Career politicians are as bad as a plague, and lead to the same place

You’re crazy! The Congress of the United States is doing a remarkable job in representing such a broad spectrum of people at a time when it gets absolutely no cooperation from the Executive branch. The Congress of the United States did everything in its power to help President Geroge W. Bush build a wartime coalition to combat the War on Terror short of an out right declaration of war, which probably wasn’t warranted under the circumstances. i only ask that you please give the Congress a little credit because they are our representatives, and this is a representative democratic government. The Congress in general is doing a remarkable job in representing such a diverse set of people who, on their very face, is practically ungovernable.

    • Neil Breckenridge

Unfortunately, we now know Congress is just a bunch of “insider trading”, self-serving miscreants who talk, talk and talk. They get full retirement for serving one term, with health care for life. They no longer represent anyone but themselves. Sadly, the Republicans are as corrupt as the Dems. The Republicans cannot get a moderate elected! And still we get Dole, McCain and now Romney. They ask consideration to replace a Communist in Chief with the person who led the Socialist Republic of Mass. What a farce. The American people have not been served well by the Congress for 40 to 50 years. There must be a leader to totally reverse the trend or there will be dire consequences.

      • bp

Neil Breckenridge: Totally agreed. WE THE PEOPLE have the last word & our constitution will stand this test. America is waking up, perhaps for the first time in a century! That can only be a good thing. Time to hit that “restart” button!

    • Patriot

Congress is supposed to support the Will of the people, the last I checked (over 30 years or longer, since 1913 perhaps) they have done anything but! Their Will is for their own benefit.

Our founding fathers warned that the fall of the Republic will be near when these 2 things happen:
      1. Elected officials are not constrained by the same laws as they make
      2. When laws are implemented by unelected bureaucracies or departments

Can anyone say this is not happening? We need to reverse the flow of energy to the Will of the People!

      • Ted Crawford

I think that it really began somewhat eariler Patriot, with Lincoln! His administration replaced our Constitutional Republic with a Representative Democracy, largely nullifying the 9th & 10 th. amendments.
Wilson further degraded our Government into a simple Democracy. With his administrations passage of the 16th. & 17th. ammendments. The former granted them a hugh pool of money to misapproiate, and the latter insuring the best Congress that money could buy!

The congress vote along party line, not what is good for the country. If voters let every one justifies his vote at election time congress would change.. This does not happen since most people are uneducated on the issue and vote for a candidate based on election year sound bites paid for by billionaires and special interest. The will of the people are not represented since politician vote the interest of those they can count on for campaign contributions and we all vote party line. Everything stays the same and we complain but refuse to educate our self and vote our self interest.

WHO are they representing when the healthcare bill says we will all have to be “chipped” to receive healthcare? The congress doesn’t represent me and it doesn’t represent you! They represent their own interests which include getting rich and staying in office! NO ONE represents us! They don’t care what we want! They LIE to us to get elected then, we’re screwed! We need to throw them ALL out! They are turning The United States of America into a communist nation! They are following the wishes of the UN instead os their own people! It seemed to me that the Sec. Was simply saying that as far as a military action that was not simply dealing with an immediate threat to the USA, but was instead a result of worldwide, or widespread need to control a situation – like Bosnia, that first we would go to the international bodies that govern the treaties that deal with those international relations, the relationships between nations, and once a consensus was arrived at that action was needed, that international laws had been violated, that action against the offending nation was approved of, and within the jurisdiction of the international laws that govern the treaties between nations… that then he would seek the approval of congress to follow the proposed course of action.

This is as it should be. It has absolutely nothing to do with the sovereignty of our Nation. We are still free to declare war on, or take military action against, any nation or persons who pose an imminent threat to the USA. However justified we may feel, we do not have the right, either morally, ethically, or legally, (nor was it a part of our foreign policy in the early days of our democracy), to interfere with another nation’s internal development. We do not have the right to engage in the nation building which President Bush led us into in Iraq.

However, we do have an obligation as the world’s only existing Superpower (and as defined by the legally binding treaties our congress has committed us to over the years), to assist in dealing with rogue elements and rogue nations when called upon by the nations we are in treaty with.

    • Patriot

Our military was never intended to be the police or peace keeper to the rest of the world, the entire notion needs to extinguished now! Our armed forces should only be used in defense or when our own interests are at risk. Congress has the power of the purse when our military is needed, per the Constitution the executive branch needs to gain their approval before deployment, END OF DISCUSSION!

    • angel

The point is there is no legal ground to move forward and deploy military outside of our nation defense. The point is american men, and women are dying for unconsintutional reason, these people give their lives for someone else cause when they signed up to defend america. I don’t see their kids on the battle feild dying, for bascly b.s. causes and corp. Profitering. How many children have been left without a dad, or a mom, or both even. The point is his and have been a misuse of u.s. military by our gov. Chasng a boogie man and shaodows with nothing to show but a big price tag rising oil prices and corp america doing the best its ever done off the middle class with price fixing. When ever the military is deployed there is suppose to be a clear reason, way in and way out with perjected tim line, planing. We maybe a world power, but the dosent make us the un and nato clean up crew and arron boys and girls. We caused enough damage around the world and hav a bloody nose to prove it. They don’t want us there ,we don’t want ou troops there, the only ppl who don’t seem to agree is the gov. This ain’t about peace its about power grabbing and fear mongering as the expand the police state and dhs/tsa. And congress is just as guilty, every single person who voted yes on the NDAA is treasonous by declaring war on the u.s. in the NDAA it declares america a warzone, who lives in america we all do, and arugably they lost their power by doing so, giving the military the run of it hence the statement. That’s why there is no or an extremely vague defination as to what is a terrorist in the document.

WE ARE NOT A DEMOCRACY!!!! WE ARE A REPRESENTATIVE REPUBLIC! I AM SO SICK OF THIS WHOLE IDEA THAT WE ARE A DEMOCRACY. We are not, the education system has done one hell of a job drumming that into us! We, all of us that are patriots on this site need to get our wording right and we need to understand what the differences are between a democracy and a republic! Just sayin!!!!!

      • Ted Crawford

You are suffering from a false assumption here Car! I, and from reading these posts, many others DO, very clearly understand the difference between a Republic and a Democracy! The fact is that we haven’t be praticing Republicanism as a form of government since 1861!
If we were still a Republic PPACA, Dodd-Frank, NDAA, the Department of Education , the Department of Energy, The EPA, ETC., ETC. could not exist as Federal Laws or Institutions. Artical 1, Section 8 and the Tenth Amendment would prohibit it!
If you are upset with our Democracy, as I and many others are, please don’t look at what is now happening and what will surly happen if we don’t vote Obama out of office! If Obama wins another term, without Conservative gains in the House and especially the Senate, by the end of 2013 we will have further degenerated into a Social Democracy!

The lie can be maintained only for such time as the State can shield the people from the political, economic and/or military consequences of the lie. did the u.s. not set the Nuremburg mandate, after ww 2, about not invading another country ? if true the politicians & every president, along with the cooperating nations that were directly or indirectly involed are guilty of war crimes. i do not condone what the nazis did, but i surely question the rationality of all sides when we label those who are in “POWER” as rational & the populace as irrational. they have spent generations convincing us so. this country justifies what it does in the name of national security & sends the troops to enforece it’s will. i’m aure many of those who write their comments here don’t believe we had nothing to do with war crimes. we have become the attackers & try to be free of the sin of acceptance to what we have done. is it time we pay for our obvious denial of what we have allowed. i think so. we have become what rome became: A NATION OF BREAD & CIRCUSES !! MILLONS DIED IN THE “FINAL SOLUTION” WITH THE POPULACE’S DENIAL OF THEIR INVOLVEMENT. DO YOU DENY WE HAVE PLAYED THE ROLE OF FOOLS ? we look & do not see, listen but do not hear, & saddest of all, continue deninal of our responsibility. we have become less that the wild beasts that only live to survive. is that the best we are ?

    • bp

Terry: In part because the man (using this term loosely!) was never vetted in the media. NO ONE bothered to define the meaning of “fundamentally transform”! • Patriot

To add to this point, has anyone noticed that when Obama is campaigning (which basically started when he was elected) the rhetoric these past few months no matter how ridiculous or untrue his statements are, there have been very few, if any, mainstream media types challenging or disputing his claims? When the constructive criticism or debate has stopped, it’s as if all the statements are true and to the untrained or ignorant folks, these are viewed as the truth, this to me is the scariest part of this agenda. When it is hard to tell the media from Big Government, is this close to the collapse of our nation or will “the rest of the people wake up to this fact”? Is it possible that the masses are mind controlled?

        • bp

    • Ted Crawford

This shoul come as no surprize to anyone! A cursory look at his background explains it all very easily. He was born to an American, self avowed, Communist, mother and a foreign, also Communist father. Raised and educated, in his formative years in an Islamic, Socialist country.
His close associations from youth through adulthood further displayed his direction. Frank Marshall Davis, Jeremiah Wright, Bill Ayers, Bernadine Dorn.
His books tell the story. These books, one would at least assume, are his thoughts, in his own words. No reporters asking any leading questions, no position in Government to protect. In Audacity of Hope he explained that as soon as he arrived at school, Occidental, ” I emmediately sought out the Radicale, the foreign exchange students and the Marxist Professors”. In Dreams From My Father he explained that “…Should things turn ugly I will always side with the Muslims”
When he said “Fundamentally Change” it should have been obvious what he ment!

I believe that when obama is out of office the first thing the new president should do is fire every one of the people who obama hired. And if during their employment they have broken the law or did not operate under the constitution of the United States they should be prossecuted as traitors.
I also believe that every thing obama has done with few exceptions and if lawfully possible should be undone immediatly. Congress has sat on it’s rear end and allowed obama and his cohorts to almost destroy America. I personly believe that the republicans are not the answer either as I believe most of them are bought and paid for (and I also believe this of the democrats). That being said at this point I do not have a lot of faith that America can overcome what has been done by the bush and the obama administration.

  • trashman

I think that a lot of people miss the point. Being elected to Congress results in a high prestige, highly compensated job with fantastic benefits, long vacations, lifetime perks and salary and laws made just for themselves. Who wouldn’t want this?

In order to get elected most politicians sell their souls to corporations and lobbies because that is where the money comes from. To stay elected the percentage is almost 100%. I exclude Ron Paul in particular. The Founding Fathers looked at Congress like we look at jury duty – something that you would prefer not to do but do it anyway because it is ”civic duty.”

We need to return to that and it is simple; TERM LIMITS.

McCain, another elephant headed to the graveyard, a couple of weeks ago used his office to proclaim, “Bomb Iran!” Now I don’t know about you folks, but my empathy is with the troops, who after multiple deployments in the “war on terror” are being pulled out of Iraq and Afghanistan, while at the same time being inserted into other god-forsaken places on the sly. ENOUGH!!! this country’s armed forces have and are being used as a political tool and slowly being bled by frequent deployments, lack of firm objectives, budget cuts and leaders without experience….I remind you, everytime someone is killed or wounded, he or she is an American family’s son or daughter. Before we commit any more of our GNP or blood to policing the world,, let’s ask the people AND the troops.. When we pulled out of Viet-Nam the people were told “Never again, without clear objectives….Do any of you know the clear objectives in everything going on today or understand why we keep expanding the reach of our committments. Could it be that just as the Roman Emperor used the circus and gladiators to calm the masses, we are being calmed and diverted from the true picture and reality?

  • Jimof CT

I agree Congress has been less than diligent in exercising their 1/3 power of government to prevent this most radical executive administration’s blatant disregard of our Constitutional limitations on Government in general and the Executive branch in particular.
Starting immediately this President avoided Senate approval and established a shadow authority of “CZARS” that supercedes the authority of approved cabinet positions.
Subsequently’ this Executive and his Democratic legislative leadership took actions to bribe Congressinal members to obtain approval of Obamacare and loaded an immense piece of legislation that would not even be read to increase Government control of the nations health industry and policies.
This latest example merely continues the Lybian action which was a congressionally unauthorized military commitment, the recess appointments made by this President when the SENATE HAD NOT DECLARED ITSELF IN RECESS, Attorney General actions galore that ignore or override Congressional or State authority.
What is and should be more shocking is the lack of attention to Obama’s eligibility issue and the abundance of impeachable issues. An impeachment process has finally been initiated by a Congressman to almost no media notice.
I will watch to see how little attention this concern about testimony of Secretary of Defense generates.
The media was all over Bush for everything they felt was an abuse of his Presidential authority. I can’t think of any significant media attention to the Obama administrations disgraceful record of abuse of power.

Senator Jeff Session is playing lawyer and using semantics. The general did say they seek congressional approval, but by virtue of the fact that we are a part of NATO we would want to get get their approval before we drag them into a war. The get the UK to fight alongside us in Iraq Tony Blair needed legal justification to present to his parliament . He and other member government just don’t wanna commit troop without legal justification because the US congress says so. If congress want to go go to war unilaterally then we should remove our self from NATO and the UN. This way we don’t have to have troop all over the world protecting member country and spend the money on education and infrastructure. Congress does not want this of course since they are elected by war profiteering companies who invest heavily to their campaign coffer. This is all about their hatred of Obama. Some want him to commit US troop to help in Syria without international support meaning we shoulder the entire cost. However as soon as he commit they cry about they deficit and the violation of the constitution. Congress has the power to declare war but does nothing. They allow the president to act without voting and then grandstand by holding hearings dishing out condemnation along party line. Democrat did it to Bush, now republican are trying to do it ti Obama.

    • Ted Crawford

That’s not what I heard Delroy! I heard him state that they would seek” APPROVAL” from NATO and the UN, then “INFORM” the Congress, no mention of Congressional approval at all!

      • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

I would agree with you, but I don’t think that’s what he meant. he did poor job explaining himself. I understood him to mean consult with NATO, the UN and our allies to see if international law or human rights law were violated. If they found justifiable reason they present it to congress. Congress still has to vote they can say no. We still retain the right to defend our self if an imminent attack or violation of violation of the US occur without seeking NATO or UN approval. But going into Libya, Syria does not fit those criterion. Going to war with Iran or committing our troops to preemptive strike on that country definitely requires congressional approval first.

I suggest small group tactics training — use paint ball guns.

About as real as it gets without wounds, you will find out how easy it is to die, esp from snipers and some moron spraying the woods with a machine gun.

Practice night, day, if you can afford it night goggles, and heat sensing devices should be employed — it will show you how you glow in the dark for snipers.

To own the night, and become invisible during the day = survival.

Hey, dude you are so delusional and filled with hatred. Get some help. If you don’t have anything positive or constructive to contribute keep out of the conversation. We don’t need people arming , who are we going to fight each other. What do you want . America to be like the middle east.. We are the United States , the president is not elected for life. You don’t like him vote him out. Don’t use your freedom of speech to incite violence and pit Americans against each other. Politicians spend the amount of money they do to get elected because most are truly want to serve the country and give a voice to those who are powerless and disenfranchised. We need election reform , and we need to keep corporation and multinational out of politics. You need to educate your self on the constitution and the issues. Don’t be so blinded by party politics, be of an independent mind and don;t allow you thoughts to be shaped by hatred and misinformation. Open up you mind and find jesus.

It won’t long now and we will be hearing the cry ” Give me Liberty or give me Death”

There are a lot of articles about voter fraud concerning Ron Paul, 4000 people showed for him and only 2000 votes were counted or there were 50 people at the caucus but 79 votes were counted. When our voting no longer counts it will be time for heads to roll.

We may not be far away now.

    • 45caliber

      Dave:

A local politician in Arkansas wrote a book about 1970 or so about this. His most interesting comment to me what that the next people to hold office were determines the night of the election – and the people had no say in the matter. And this was due to BOTH parties deciding together who would run and who would be elected. And that was for everyone from dog catcher to President.

    • Ross

I keeping hearing this from people who were actually there voting as well. Now the MSM doesn’t even mention Ron Paul. The electronic voting machines are a scam, and even those that had written ballots were shocked at what they counted compared to what was being reported. The GOP hierarchy has corrupted itself and the MSM is obeying. I don’t know if their is enough time, but the electronic voting should be ruled out in every state. The ballot counters of written votes should be monitored, videoed and made public. From a very independent point of view, something needs to be done very quickly.

  • R Hill

It appears more and more that the House is trying to do its job, but the Senate isn’t. And Harry Reid is the leader of the Senate and the main reason the Senate is so terrible. Reid is another frustrated super liberal who does exactly what Obama wants him to do.

We must get rid of Obama and the democrats or we have no hope of restoring America!

We can blame the 17th Amendment for that.

Reid got re-elected through voter fraud in Nevada because of the electronic voting machines. The union cam in late to fix an apparent problem. Hence, all votes for anyone else besides Reid came up as a Reid vote. The elites had to keep Reid at all costs, even the cost of being exposed, which obviously, they no longer fear.

It would be interesting to see some legal scholars lay out a case for impeachment. War crimes comes to mind. As commander and chief Obama has ordered solders ” People” to go to war but has not asked congress for a declaration of war. When a solder go off and kills 16 Afghans including 9 kids, as the buck stops here boss, does that not make Obama just as responsible as the solder who committed the crime? If someone gets killed why committing a crime and your somehow involved, you fact the same penalty here in the US. If any other leader from any other country was doing what Obama is doing the US would want to hang them just like they did to Suddam Hussein. I don’t see much difference between Suddam Hussein and Barack Hussein Obama.

Get your facts straight, you are losing credibility. Bush got got congressional and UN authorization for the war in Afghanistan. The entire world was behind us because the crime of 9/11 had its base of operation there. The Taliban hosted and supported Bin Laden and refused to hand him over The war there was never ended, we just diverted our attention and resources to Iraq to settle old scores. Obama ran on a platform to bring the illegal war in Iraq to a close and redeploy the troop to Afghanistan to hunt down and eliminate Bin Laden as well as stem the tide of a resurgence Alqaeda and Taliban in that country. Mission accomplished. Its just a matter of withdrawing the troops and 2014 is the projected exit. There was no illegal war spread your propaganda elsewhere or find a less inforrmed audience.

Whats your point, someone said Obama went to war in Afghanistan with out getting congressional approval. President Obama did not start the war in Afghanistan he inherited it. As far as I am aware, he has not declared any new war and do not plan to. As far as Libya is concerned we were there in a limited support role as part of the UN and NATO Republicans like John McCain were clamoring for intervention like they now do pertaining to Syria. Once we got involved they stared to criticize and play politics just to make the president look bad. Finally congress did agree to limited intervention as the president met with them. Stop looking for an issue where there is none.

Demonrats are nothing but shills for the New world Order of Communism . Unfortunately our so-called educators have been preparing our youth and many that are now adults for communism ( progressivism ) for over forty years now . This is all part of ” agenda 21 ” and ” international law ” overriding our own declaration of independence and constitution to enslave us to the United Nations control . If we don’t VERY soon take control of the constitutional reins of government it will be too late . That is precisely why the lamestream media , the republicrats and the demonrats are so afraid of RON PAUL . He is the only candidate with enough vision to see this and enough guts and chutspah to do anything about it . Barack Romney will certainly not do it because he IS a progressive , as is Gingrich . I don’t believe Santorum is a progressive but I could be wrong , either way , I don’t think he can get the job done as well as RON PAUL would . The only REASON RON PAUL is not leading in the polls is because of the duplicity of the lamestream media , said duplicity is a fact as the election of Obamass has proven . All the stuff STILL hidden from the public was and is known by hte traitorous national media . They are ALL scumsuckers .

Ron Paul has a lot of good ideas , small government , non intervention in other countries affair. However he is too far out on some of the more important issues in regards to domestic affairs, but he at least has conviction and does not pander to special interest. Cant say the same to all the other candidate including the president. Nobody is perfect and politics is a compromise of ideas. We have over 300 million people and no two thinks alike, although politicians would like you to think so. They always say ‘the american people want, believe” . What are they mind reader. They go against the poll of what the american people says and want on almost every vote in congress. At the end of the day we elect the one who lies to us best.

  • 45caliber

I disagree with one comment here in the article. ” It ceded its authority after 9/11 when it allowed President George W. Bush to engage in the vaguely defined War on Terror and send American troops around the globe.”

Once a war has been declared (by Congressional vote and approval) CONGRESS HAS NO MORE SAY IN THE WAY THE WAR IS RUN. The main reason that Congress prefers “police actions” is that it gives them micromanagement abilities over what the soldiers do and how the war is run. You can’t run a war by committee. They have screwed over the military ever since Korea by second-guessing the generals and changing the rules in the middle of things.

    • Realist

Our current military is worn out and tired. Many troops have passed their 5th tour to the desert regions and this would be unheard of in the jungles of SE Asia. Troops have suffered severe brain trauma from IEDs and amputees are redeploying to the same battle grounds. Recruiting efforts have been hampered by poor morale and suicide events.
If a draft is re instituted, this would place a lot of autistic and other unqualified people on notice for screening. The best way to keep our forces on a voluntary basis is to keep a better environment for our troops to sustain. That means staying out of world policing,
securing our borders and keeping open gays out or in the closet. Our troops have been
tossed around to hotbeds that was never in the best interest of national defense and this keeps working on the morale and loyalty that our troops have to endure.

    • http://boblivingstonpl.wordpress.com Bob Livingston

      Dear James,

You write: “There is a bill in congress to impeach the President too. How long before you comment on that?” A bill of impeachment is irrelevant political theater. Congress is a criminal enterprise and a good ole boys club and no bill of impeachment will go anywhere because the fox is guarding the henhouse. Congress members have no fealty to the Constitution. Their fealty is to the banksters and big business and the New World Order: In other words fascism. Until the fascist system collapses an impeachment trial would only serve to gin up the right and left and reinforce the false left/right paradigm. If you hold your breath until a Congress–that won’t even discuss the poser President’s ineligibility to hold office—decides to move with impeachment, you will be dead and buried many times over.

      Best wishes,
      Bob

Now I understand why guns are not allowed into the city of New York. That is the seat of the UN. If law abiding citizens feel it necessary to target the UN then the City of New York is the first line of defense of the UN. Unfortunately civil minded people would not intentionally attack the UN. Criminals will not attack the UN. Liberals must keep law abiding citizens from attacking the UN. What does that saying mean, “Protect our constitution from all enemies both foreign and domestic.”

Getting us into a war for the economic gain of the devilish global elite, who play both sides of all conflicts against each other for profit, is not the exclusive preserve of either party. Set aside the government school/media instilled preconceptions and do some open-minded research. You will find it fascinating. Both parties secretly serve the interests of the globalist elite. Party labels are just window dressing. Some good places to start are the JFK assassination, Illuminati, the Bush’s Nazi connections through Brown Brothers Harriman, Skull and Bones, Lincoln’s assassination, Federal Reserve, JP Morgan, Rockefellers, Rothschilds, Masonry (Obama is a mason as are the Bushes and almost anybody who is anybody in governments worldwide), Operation Paper Clip, Bohemian Grove, the Bible book of The Revelation predicts a global religious/economic system under a charismatic world leader, the antichrist, that is able to control all buying and selling by implanting a 666 related number in the hand or forehead. Dissenters will have their heads cut off! Sounds pretty Islamic doesn’t it? Check out Alex Jones’ radio program and archives at Infowars.com. Don’t just have a kneejerk reaction against what you find out, try listening for awhile and see if what you’re hearing/reading doesn’t answer a lot of questions, take some time and check it out. If you are truly willing to know the truth no matter how uncomfortable it may make you, you can come to know it.

Oblama has stated basically that Congress doesn’t decide war for the US. The UN does. Therefore he accepts orders ONLY from the UN – a one-world government. DAVIDL – Here’s a great solution for you: LET’S GET OUT OF THE UN. NO treaty should be passed that violates the authority of THE PEOPLE as stated in the Constitution. To allow the UN to be able to say that our country can or cannot go to war violates the supremacy of the people. Congress, whom the people elect to REPRESENT THEM, should always have to approve any war. Check this website. I had to copy and paste it into a word file to get it to work (with CONTROL/CLICK). HOW DO WE DO THIS? All you legal authorities out there, tell us HOW so we can start.

It is by Ron Paul, who makes such sense, but is not electable because we, the people, don’t have enough courage to “bite the bullet” and endure the fallout to re-establish our country on the right path.

Here is one quote from this site: Mr. Speaker, over a half a century has transpired since the United States of America became a member of the United Nations. Purporting to act pursuant to the treaty powers of the Constitution, the President of the United States signed, and the United States Senate ratified, the charter of the United Nations. Yet, the debate in government circles over the United Nations’ charter scarcely has touched on the question of the constitutional power of the United States to enter such an agreement. ………..Since the passage of the United Nations Participation Act, however, congressional control of presidential foreign policy initiatives, in cooperation with the United Nations, has been more theoretical than real.

Qui Bono? Whenever I read, or am informed, by such as in this article/video, I reflect upon the parties involved – (the subjects) in the video, and I ask, Qui Bono? Who benefits? It is easy to discern Panetta’s and the General’s, versus the Senator’s territorial tug of war and how they struggle so mightily to inform one another that one of them is the boss/or not the boss of the other. The Senator has lost, demonstrated by the mere fact that he is being informed that there IS A HIGHER power other than the constitution. Coup d’état complete. Senator Session will not pursue this any further. He nor any current member of Congress have the intestinal fortitude to do what they swore to do when they took office. Therefore, so we also don’t become/feel irrelevant, let’s pretend that we are in control, by discussing such germane issues such as birth control, gay rights, or DOMA. It will at least keep us occupied (distracted) as the liberals have the TV informing them of the latest on the Kardasians and Lindsey Lohan.

DavidL, you would do well to go back and read what the Supremacy Clause is all about. First of all, that clause was written long before there was a UN charter, and has nothing to do with what you are saying.

Article VI, Clause 2 of the United States Constitution, known as the Supremacy Clause, establishes the U.S. Constitution, U.S. Treaties, made pursuant to the U.S. Constitution, shall be “the supreme law of the land.” The text decrees these to be the highest form of law in the U.S. legal system, and mandates that all state judges must follow federal law when a conflict arises between federal law and either the state constitution or state law of any state. (Note that the word “shall” is used, which makes it a necessity, a compulsion.) However, the Supremacy Clause only applies if the federal government is acting in pursuit of its constitutionally authorized powers, as noted by the phrase “in pursuance thereof” in the actual text of the Supremacy Clause itself.

The “supremacy clause” is the most important guarantor of national union. It assures that the Constitution and federal laws and treaties take precedence over state law and binds all judges to adhere to that principle in their courts. – United States Senate

When I first read this article and watched the video, I have to admit that I was left speechless. But as I thought about it throughout the day, it occurred to me that this sort of turn of events might have positive repercussions.

To hear Madison and Hamilton argue the case for a federal government versus a divided collection of states, the Constitution would create three branches of power, each designed to check the other. And it was deliberately designed so that each would act according to its own self interest. The more the president tries to usurp power he has no right to, the more incensed the congress will become, until eventually they impeach him, which no executive order will be able to get him out of.

Again, the more I thought about it, the more it put a smile on my face. It was nice for a change to see congress get offended by the flagrant disregard for the Constitution and the usurpation of their authority, when typically it’s congress ignoring the Constitution while usurping our authority. I guess we all really do reap what we sow.

Maybe this will be one of many “abuses and usurpations” that will finally convince congress to do something about the abuses of power going on in Washington, and particularly in the White House.

Friend of mine used to say, “Nothing is going to change until we (literally), take tar and feathers to our public servants in Washington. ” He’s probably right.

  • chuckb

the u.n. charter does not supersede the constitution, the bolsheviks would love it, however, it “ain’t” going to happen.
Our Senate and President lack lawful authority to enter into a treaty that conflicts with The Constitution so even signed and ratified it would not be a valid treaty.
Read The Constitution. Where it includes treaties as part of our supreme law the clear grammar qualifies the clause as referring to treaties that are consistent with The Constitution.

I’m pretty sure we closely resemble 1934 Germany. When they render the dollar totally worthless and people are hungry they will gladly give up the few rights they have left to the government for the promise of salvation. Nothing has happened by chance the destruction of this republic has been planned and carried out to perfection. God help us all.

What, is your point comparing president Obama to Hitler who murdered 6 mil Jews and hate monger and race supremacist. You sound a lot more like Hitler than our president as you espoused hatred without facts to support it. Hitler hated Jews for his own shortcomings and projected his own failure and inadequacies on them. Come back with some facts to support allegations. President Bush did the right thing by asking congress to bail out the banks to prevent a total collapse of the US and the world’s economy. President Obama followed through on it . The banks recovered wall street is back , Gm is number one again and we are no longer losing 750,000 jibs a month. The government had to spend money to stimulate the economy as business was not investing and nobody was buying anything. Go take a class in economics. The government made money on the loan by the way and most of it if not all has been paid back. Citibank struggles has nothing to do with the bailout do not attempt to link the two. Congress never listen to Obama as they say no to almost everything he proposes , so your augment goes out the window on disrespect. The US need allies we are not an island. You are acting selfish person by suggesting we withdraw from the UN. I bet you do not know why the UN was form and why we need it even if every member nation has independent belief. How do you know how the military feel did you interview or poll each of them. Don’t presume to know , most military people are patriotic , they serve flag and country not a party or president. Finally by comparing president Obama to Hitler you make light of those who were murdered and placed in concentration camp by Hitler. How many people did our president put in concentration camp. If Obama was Hitler you would not have the freedom to dissent and express the offensive point of view you espoused.

      • http://www.ifonlyphotos.com Alex Frazier

Delroy, I’ve studied economics. If you have, then your education is incomplete because you espouse an economic strategy that Keynes himself said was not compatible with a free market capitalistic society. It’s best environment is a totalitarian state.

Our government did not need to spend money. The bailouts didn’t save our economy. They just forestalled the inevitable. There’s still going to be a crash. Our money is rapidly deteriorating. Prices are set to triple within the next eight years if we stay on our current path. When that happens, the inflation will spiral out of control and we will find ourselves in a legitimate state of hyperinflation.

For the record, killing Jews isn’t the only thing Hitler did. If you do some research into 1930s Germany, you will find that many of the policies instituted by the Germans under Hitler are being instituted today under Obama, as others were instituted under Bush. We are a gun confiscation, an SS Gestapo, and a racial genocide short of becoming Nazi Germany. While I doubt that another genocide is likely, gun confiscation is definitely in the works, as is martial law and a police state.

So don’t criticize someone because they spoke the truth. You really don’t know what you’re talking about.

the difference between hitler and barry soetoro is, hitler had an intellect, he may have used it the wrong way, however, this current clown in the white house doesn’t come close to having anything between his ears. he’s nothing more than a mouth piece for people hiding behind the iron curtain .he makes programmed speech’s every day, talking from a teleprompter, then every few weeks they pay he and moochella with an all taxpayers expense vacation/. throw in a few sporting events “basketball & golf in between. perhaps we have never in the history of the u.s. have we had a more ignorant man sitting in the white house.

He is one of the most cerebral president in my lifetime. Because you don’t agree with someone;s policy doesn’t make them dumb,

          • http://gmail sancheleezy

Anybody who believes that this inept president is cerebral has got to have mush for brains as Obama is simply a promoter of over sized government and controller of people’s lives (socialism). He gives our hard earned taxpayer money away to crony crooks who want to create overly expensive green technology that no one can afford, which causes them to go bankrupt with all of the people bailing them out in the end. He is merely a simpleton of the worst caliber who uses everyone to his advantage—and we all pay for it!! What a scam artist.

          • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

Every new technology falters before they bear fruit. The computer chip, electricity, the telephone, the internet, the internal combustion engine, the airplane, and pharmaceutical drugs. So will alternative energy and the electric car. We never gave up on the internal combustion engine or the telephone because the first test run failed. If we did we would still be riding the buggy cart of the 16th century, which is where your mindset is fixated. Business or all about making profit so they normally do not invest in new product or technology until its proven. This is where the government comes in since it seeks first and foremost the advancement of the nation as a collective whole rather than to turn a profit. Most if not all of our technological breakthrough comes from government investment. Not just here but most of the developed world. That’s the difference between us and the third world . The government has no money to invest in new technology. I know you will never grasp this because you are of a simple mind who just repeat what you hear from those who are either ignorant or misinformed. Finally if I am not mistaken the president graduated Magna Cum Laude from Harvard with a constitution Law degree. How about you. The electric car by the way will be expensive until they are mass produced.

          • http://gmail sancheleezy

It is so hard to communicate with a dedicated socialist progressive which is exactly what you are as you simply do not understand the difference between the marketplace which is either free enterprise, which has given us all of the aforementioned technological advancements, or crony capitalism such as Spain which has had “green economy” forced upon them by government cronies like those in this White House. Spain, reportedly now enjoys a 20 to 25% unemployment rate, due to government influence over the citizens right to choose. You don’t even mention that to power your electric cars would take hundreds of nuclear or coal-fired power plants necessary to create enough electricity for their use. When new technology becomes applicable and less costly things do change on their own. Demand creates marketable choices not government mandates, intervention, and interference. The only thing Obama Magna cum Laude about this president is community activism.

          • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

You make no sense, The electric car uses gas or battery, so why would you need a nuclear plant to power it. We do need nuclear plants as an alternate source of power supply granted the batteries are rechargable. The point is we use less fossil fuel and reduce pollution. New technology never becomes applicable on their own without seed money from the government for research and development. The reason is greedy corp don;t like to invest in unproven technology. It’s for that reason we don’t have a cure for cancer. Many of today,s new technology comes from NASA which is a government run program which would make it socialist in your narrow way of viewing the world., Medicare, social security, the police department, the fire department, the court system, mass transit, the air line , the library, public school and university, the highways are all government run. Can you imagine America without them, do you think the free market would find them profitable to undertake. Without everything I mentioned we are just another backward third world country. Is this where you want to take us . Back to the 1700s. Everything is not free economy, almost every country has a mixed economy including China. Community activism is a good thing, you should get involve , that’s how you effect positive change. A neighborhood crime watch is community activism, whats wrong with that . Preventing corporation and multinational like Bp from polluting our water and dumping toxic waste in the river and on land where it affects the food chain are positive things. Obama instead of going to work for a big law firm volunteered his service to the poor and disadvantaged. Have you ever volunteer your service to make a difference in someone’s else life. You should try it someday, it can be rewarding .

          • 4loveofcountry2

Delroy Brown must work in the White House! Margaret Thatcher famously said, socialism is great until you run out of “other people’s money” OPiuM, which is addictive! To answer your question, YES, I can imagine America without your list of gub’ment expenses, because without a profit motive there is no efficiency. For example, the US Post Office is billions of dollars in debt, while FedEx & UPS are thriving. “Seed money for research & development”? Looks like flotUS not-so-proud has rewritten your history. If you think China is so great, why don’t you live there? Maybe you would like that regime dictating to you. As for BHO, he was an ungrateful affirmative action student who became a “community organizer” when he realized he would have to actually work for a living!

          • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

Your consuming hatred for Obama prevent you from being rational. First of all Margaret Thatcher was not always right since she supported apartheid and the murder and imprisonment of Blacks in their own country because it profited Britain. The Post Office is very solvent and not heavily subsidized by the government. It was not intended to make a profit but rather serve as a public option to UPS and FED EX where you pay $11 to send the same mail domestic that cost you under $1 with USP. The reason the USP is having difficulty balancing their book is because a Republican control congress passed law that require them to pay pension ten year out based on projection upfront. This was designed to bankrupt the system and turn it over to private company. This way they get rid of the union which support the Democrats even if rural american and the common people suffer. Calling me a socialist is a last resort for people like your self once you cannot rationally support your position. I am not insulted since I know the source of the name calling. Obama. I don’t support China’s regime but how they chose to run their country cannot control. I live hear and therefore I am talking about America not China. I bet your record was comparable to the president’s record in school you would make a more coherent argument rather than , name call. The president went to Harvard on a scholarship which meant he was a good student rather than bloodline or affirmative action. Your hatred is screaming. You know nothing about service to country and others is the only reason for you to reach your conclusion. You made no sense, why would somebody who you deem hate to work for a living volunteer their service. See your logic. Get a grip,

          • http://gmail sancheleezy

You are nothing but a fool who worships an even bigger fool. You make up “facts” which are not facts but opinions of your own making. The post office was never created because of UPS. or Fed-Ex., but early at the inception of this nation all correspondence needed security and guaranteed delivery as the business of communication was at center of all of the nation’s activity. I do not hate Obama, but do not agree with most everything he believes in, and do find his policies totally lacking in fairness for all Americans. It is all about government spending, taxing wealth, and sharing with those who are able bodied but do not want to work or educate themselves for a career. These individuals want things given to them, but don’t believe in earning their way. Please be honest and don’t invent facts.

          • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

You are right about the inception of the post office, that was never in dispute, I was just pointing out the fact that it offer a better rate for the average Joe than UPS and FEDEX. Privatizing everything would affect the poor. This does not bother you, its all about profit and free market in your view. The free market is great but government has a role to play. Every thing left up to the free market without government regulation and we all suffer. Everything takes a back seat to exorbitant profit,, low wages and unsafe condition. This is why we need union. They speak for the working man and demand a fair wage. Most people I meet want to work there just aren’t enough jobs . They move them to where people get no benefits and work 12 hr days for slave labor. I have two degrees in Engineering and could not find a job for a year after my job was outsourced. I am now forced to work outside my field for half of what I use to make. I have friends in the same situation and I don’t blame Obama . I blame the big business and the congress who cut them breaks to move jobs over sea.. President Bush called it the emerging job market. Obama is trying to fix this but the republican congress fights him all the way. I keep up with what is going on. I don’t get fiction from FOX.

          • 4loveofcountry2

You are just a progressive mouthpiece, aren’t you? Everything you say lines up with all of O’s talking points. I don’t believe you have two engineering degrees; they are in high demand. “forced to work outside your field” is the latest lie. A job is a gift & not a hierarchy! You contradict yourself re:unions, which have no place in government where there is no competition! Unions are bankrupting the public. BHO is not trying to “fix” anything; he is anti-American systemically dismantling our economy, an overeducated, socialist buffoon! & what is your real name?

          • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

I am done done now. I don’t need to prove anything to you. I have a Bachelors degree in Manufacturing Engineer and an associate degree in Engineering science. You sound like like an insecure hate monger who has failed in life and look to project and blame your failures on the president. Someone like you no matter how much money you have will always fail as a man and human being your thought are shaped by hate. You are not guided by what you see but by you inherently believe despite evidence to the contrary. You need to relieve yourself of hatred bigotry and prejudice then maybe you will begin to view the world we live in more clearly. Without meeting you , I can tell from your tone you have a hardened heart and never felt the joy of loving humanity. What a shame. I will be praying for you. You question the president of the United States credentials knowing he graduated magna cum Laude from an ivy league school, therefore it comes as no surprise you would question mine. I don’t need to communicate any further with you, have a good life.

          • 4loveofcountry2

Right back at’cha, “Delroy Brown”! Your rabid characterizations give you away!

          • http://gmail sancheleezy

Mr. Delroy Brown you have got to realize and think a lot more deeply about just what you are espousing, as you do not seem to be able to visualize anything past your pro-union and pro-Obama mentality. I will be honest with you because you seem to be a decent person. My wife and I did not vote for McCain/Palin because we felt that they were really not that much of difference from the Democrats and Obama/Biden, as they both seemed to basically be out of touch with the reality of this country’s situation. But George Bush stimulated about $350 billion to Wall Street banks that were financially in trouble due to loans being given to those that could never even possibly pay off their loans due to government intervention in real estate. Yes, Congress figured that everyone should be in on the real estate bubble which Congressman Dr. Ron Paul warned us about 10 to 11 years ago, in 2002. If someone has a part time job or is underemployed, or unemployable, and doesn’t meet the necessary requirements to afford the loans, why were they given loans at all? Because the government with congressional bills made the banks make loans available to those who were never able to buy these homes. Basically, what I am trying to communicate to you is that too much government, not too little regulation or intervention of government into free enterprise has caused nearly every financial crisis we have. Obama took the ball from Bush, tripled and quadrupled the stimulus package to include the Unions who worked at G.M.C. and Chrysler in order to pay back for their support in electing him to the Presidency. Don’t ever say that I do not care about anything but the profit motive, as I care even more deeply for this country than you can imagine. We have got to bring the deficits and debts of this nation under control with spending that is within budget and balanced, as our children and grandchildren are already saddled with outrageous debt. Think Delroy, if business which produces the capital, which creates jobs, which creates wages, which people spend, to buy things, is handicapped and controlled by the government, then businesses cut back lay off workers, people spend less, TAX REVENUES go down, and the government gets even less money in taxes to spend and in most cases waste. And your statement that I hate Obama is b——- as we did vote for him and after this catastrophe that has occurred we guarantee that we never will again. Do you also really believe that a President really needs to surround himself with 23 czars, who are not answerable to anyone belong in our government (UNCONSTITUTIONAL) ? Yes, Bush had a few and I will condemn him for it too as I said it before—I am not a Republican or a Democrat but a patriotic American who believes in the Constitutional Republican form of government that we were given by the Founders of this nation. Give these words some thought please. Dave S.

America, we must remove the vast majority of congressional members this November. They have had over 3 years to bring this president to justice and haven’t. I understand that the Democrats controlled both houses until the 2010 elections. And I understand that they still control the Senate. But what I refuse to accept is the fact that those “representatives of the people” did not do their duty. THEY ARE DEFINITELY IRRELEVANT, because they permitted irrelevance to happen.

I see the 2012 general election as the very last opportunity that WE THE PEOPLE will be able to do anything to stop this communist take over of our nation. We all better get out and vote this time and put these criminals out of office — the President and the cowardly congress who are up for re-election.

Untl November, please, please, please PRAY FOR AMERICA. We cannot prevail with out God’s Providential help. God made this nation strong, and only God can help us now.

Communism die with the passing of the Soviet empire. China is more capitalist than we are. Little old Cuba , well has been under a naval blockade since the 1960s. My question is this , who are you scaring by saying the communists are gonna take us over. We have been hearing that since the 50s, Go Have cold shower and a couple of Xanax. Sleep it off you will feel better when you wake up.

      • http://gmail sancheleezy

If anyone needs an ice cold shower it is you, DB as you haven’t a clue as to what is going on in this country. We need to elect more responsible leaders and Statesmen and women who truly believe in the Constitution as it was written, and shrink the this over sized government down to size and quit bankrupting everything in their path. Right now only Dr. Ron Paul realizes just what needs to be done, “Restore Liberty and the Constitution”, and quit trying to control every aspect of the citizens lives. Think before you make statements that carry no logical weight behind them.

        • John Stanfield

Delroy Brown, if you think communism died with the passing of the Soviet Union, you need to wake up and smell the coffee. Communism is alive and well all over the world As for China being more capitalistic than the US, you need to study on the working conditions in China, how they have to live where they work, and take a look at what the workers make. That is why the Chinese study as hard as they do, to get a job in one of the labor cities. It is not the Chinese people who are following capitalism, but the government.

  • Brenda

DavidL…..I disagree…..ultimately, our legislature has the initial decision to make…..we are bound by our CONSTITUTION….remember that little document that Obama seems to forget? We are a sovereign country under that FIRST…..meaning, we do not “obey” international control…..we are our OWN country and laws and it doesn’t matter what the others want or say…….it is up to our Congress FIRST then see if we get international help or approval but ultimately, Obama made an oath to protect the citizens first and foremost…..and that includes war, which as a sovereign country, our own legislature must approve FIRST

    • http://gmail sancheleezy

Thank you Brenda someone that understands that we are a constitutional republic first and foremost and not a dictatorship.

  • Brenda

Delroy…..you either have blinders on, or you are so partisan, you refuse to see what is happening in this country…….just google “communist meetings in the US” and you will be amazed at how many pages you get……even a Democrat senator from Illinois, recently was given an award by the communist party usa……google it……and then start researching the Progressives, Fabian Society and up through the decades with what has been building for decades……YOU need to do a little reading and research before you speak

  • Brenda

Delroy…….if I were you, I would not be posting as you need to review the FACTS first……actually 20% in this country are liberal, 40% are conservative with the remaining in the libertarian or independent categories……look it up…….and as far as our Constitution is concerned, I am in a study group every other week where we study the founding fathers and our Constitution……you may want to actually read it to find out what it says…..ooh, sounds like Nazi Pelosi, doesn’t it? Go back to mamas basement and study first

  • http://gtec.com Winston Crotchett

Obama truly believes he is a emporer or something: at any rate everything he does is a perversion of the Constitution and a failure to perform his oath of office, HIGH TREASON. Also, on numerous occasions I have urged my congressman and several others to impeach him and remove him from office, with a request of an answer as to what action they have or have not taken – NO ANSWER! I also have emails where he says on video that he was born in Kenya and also that he is not an American citizen. Will the fools never wake up?

    • http://gmail sancheleezy

It is always to good to hear from those that understand the truth of the matter, but we need to make sure that from know on that those that we give our vote to, believe strongly in the Bill of Rights and the U.S. Constitution and ensure B.H.Obama’s defeat this Fall and ensuring also that the Republican’s (true conservatives) overtake the Senate majority. Even if Mr. Obama wins with both Houses of Congress in opposition control he will be nothing but a lame duck President.

      • http://www.facebook.com/profile.php?id=100003537466597 Delroy Brown

If he is a lame duck president it means the people’s work doesn’t get done, which means the country and the economy stagnates. How patriotic, not that you people ever care about the country or people out of work as long as you can lie and blame everything on Obama. He turned the economy around despite 3 years of obstruction and he would find a way again. Hopefully the american people will recognize you guys for who you are and elect Biden or Hilary in 2016.

        • http://gmail sancheleezy

You are nothing but a “worship-and obedient follower”, of Barack Hussein Obama as he has convinced you that he knows what is best for you and everyone else in America. You are nothing but a fool with a dream who is so easily manipulated by this president and the soldiers of control who surround and influence him. Take your blinders off, understand that you need to research and investigate things on your own, and not automatically accept what you are told to think. Don’t ever call me, “you people”, as you assume that I am a neo-con which I am not. I believe in the United States of America, as it was intended to be established as a Constitutional Republic by the Framers and Founders, who sacrificed everything to create this pro freedom for all, non dictatorship, anti-monarchy government. This government has become way too bloated, dictatorial, and way to involved in everyone’s business literally. The powers not delegated to the national government resides in the states and the people (10th Amendment) which means that the federal government is not a dictatorship of control, that each state has the right to determine their own destinies. You do not ever even mention the differences between this country and other nations in the world, but seem to think that we should be like everyone else. If you are unhappy with the idea that we are individuals with the right to think, speak, and as Americans come to our own conclusions to solve our problems. You, Delroy Brown are so rigid in your thinking as a progressive liberal that you can’t even see the forest for the trees. Wake up–there is still time to see the truth.
