City Tells Man It’s Illegal To Clean Sidewalk

A business owner in Corpus Christi, Texas, is at a loss for what to do after the city informed him: He cannot wash bird poop off the sidewalk in front of his restaurant. The city claims the droppings go into the storm drain and then into the bay, polluting the water.

John Webb, manager of Crawdaddy’s, has been washing the sidewalk for 18 years, but recently he was told it was against the law.

“If I can’t wash my sidewalk off, what am I supposed to do? I’m at a loss at how to clean this up,” he said. “Now I’m stuck with having dirty sidewalks and this bird poop. It’s nasty,”

Officials say that Webb is violating the city storm water ordinance. Hosing off the sidewalk could result in a $2,000 fine.

City officials believe that it’s OK for rainwater to wash away the bird poop because that is a natural occurrence.

“It just seems kinda foolish that rain washing it off is a natural occurrence, but a water hose washing it off is a pollutant. It just really doesn’t make much sense to me,” said Webb.

        Now if only the County Health Department would fine the city over their chicken sheite ordinance. It takes a twisted mind to think there’s a difference between bird poop being washed into the storm drain by a water hose or rain water, it is still ending up in the same place.       What does the ‘City’ think is going to happen when it rains? I wonder if the ‘City’ will allow this business owner to put on a raincoat when it rains, and scrub the sidewalk while it rains, to ensure not just some of the bird droppings gets washed away with the rain, but all of them?

    This sounds a bit suspicious to me. Does the city have some ulterior motive for this? Do they want to shut down his restaurant for some reason? Will health inspectors go to his restaurant and inform him that the bird droppings are a violation of the health codes and if they are not cleaned up they will shut him down? Store and restaurant owners all over the country sweep and hose down the sidewalks in front of their establishments all the time. Since the city is telling him he can’t clean the sidewalks then why doesn’t the city do it. After all, the sidewalks belong to the city and so they should be maintaining them.

Get creative, people of Corpus Christi…. There is more than one way to shovel horse poo. Protect your private businesses. Take care of your neighbor. Line up at Craw Daddies an give him a million dollars worth of business. Track bird poo every where. Feed the birds so they will poo more. What you need is a giant pigeon statue.

      Wet vac won’t work. Pigeon poop would stick into the crevices in walks so a pressure washer or hose and a good brush would be needed plus elbow grease.

        BINGO! It’s amazing what a 2500 psi Pressure Washer will do. Check Yellow Pages under Pressure Washing. Bring the Vac. Hot water will even remove old bubble gum. I was in the business.

        Carey, pressure washer has the same problems as a garden hose, the water still flows into the storm drains and into the bay. There are a few tools out there than might do what is needed, but would probably be easier to manufacture something on site, like a big vacuum cleaner tank with a regular wet vac hose and a high pressure water nozzle attached to a intake fitting on the end of the hose, Spray water out and vacuum it up in the same operation, almost like a street sweeper does.

      Cary that is a good idea, however, doesn’t get rid of the problem. Pigeons are rats with wings and cause all kinds of problems, buy bird seed and soak it in rat poison and feed it to the pigeons, they fly off… end of problem.

    All it will take to get the city back in line is one person claiming the city is responsible for making them ill by allowing the bird feces to pile up in front of the dining establishment. Of course, a nice, big public outcry would help, too, since those officials are elected by the people. Unfortunately, most people will not care because it isn’t “their problem”. What they don’t realize is that it is this kind of ridiculous government intrusion that has eroded any semblance of government by “we the people”. As long as the sheep are willing to be led to the slaughter, the government is more than willing to slaughter!

    My son had an excellent idea…grab the pigeons, wring their little necks and serve them as “squab” to your patrons! Problem solved…unless another intrusive gov’t agency or animal rights activist protests. I’m sure the pigeons have more rights than that business owner. It is a little short-sighted for the city to not realize the business owner pays taxes which supports the local economy, attracts patrons and perhaps tourists which support the local economy and is even willing to do part of the city’s job of maintaining a public place…for free. And…we all know the emperor is NOT wearing clothes and there is no difference between rainwater washing poo away or water from a hose!!!

    Sounds like someone is following the code a little tightly. Sometimes the “letter of the law” is all there is to certain city employees. A carryover from maybe military indoctrination? Not that that’s all bad but sometimes a little bending to work a solution is better. No, washing it out on the street should be avoided. If it rains it’s what happens but if you wash everything down the street drains including leaves and cigarette butts and all the litter people tend to dispose of in the wrong way it does effect the fish and wildlife downstream.
    We need the fisheries to survive in the future.

Where the HE#% do these people think all the bird poop goes when it rains? Are they going to ban birds now? This man should just keep cleaning in the name of hygiene and let the crazies take him to court. Let them explain to a judge how it is better for him to let customers track bird poop into his EATING establishment and not let it go where it naturally needs to go.

      Most bird poop get washed out under the trees and through the filter of the soil and actually is good. Not running it out the storm water system.

        But we are not talking about most bird poop we are talking about the poop immediately in front of a resturant on a city sidewalk that is basicly impervious to moisture and therefore the poop has to wash into the gutter then the drain.

        Daveh234, this is true, in fact I wash the poo on my sidewalk into my yard rather than into the street so the nutrients in the poo can fertilize my yard.

        Daveh234 makes a really good point. The problem is the storm drains. They are the environmental hazard enabling human device. Put there by GOVERNMENT.

        Thus you see the problems all go back to one source. Government. Save the bay. Outlaw government.

    Maybe the city water is the real pollutant. I suggest getting the Health Department involved as bird residue could be a health hazzard not just for his business, but other businesses, homes, and government buildings as well. The other potential is that the inspector wants this guys business to go elsewhere like to a buddy of his.

    As to the suggestion of a pee-off, Texas now has a law which flatly forbids the discharge of human waste onto the ground anywhere in the state.

    Dogs have hydrants and trees, birds have walkways, cows have flat rocks, fish have reservoirs; but, Texans have to hold it.

    Mr Webb, et al, needs to fight fire with a bigger burner: Make the act political speech!

    Aside from that, he might place a couple of tables out front, and invite the Mayor over for coffee.

    Recondition the pigeons to feed in a different area. Maybe one the city wouldn’t like if it is near by. Gradually place bird seed further and further from establishment to a more desired place for the birds to feed and defecate.

    Here is an idea. If you could provide a reservoir at the street edge that would colect the wash off water containing the poop, then suck it up with a wetvac, it could be discharged into the city sewer system where it would be treated like human waste. The first time you do this procedure make sure to get a local TV station to film it and run it on the local news with the irate business owner explaining why he is forced to clean this way. It will ridicule the stupid law and maybe get public sympathy and ultimately changed.
    It’s worth at least a one time try to bring attention to some of the stupid laws on the books. Reed

      That’s how we used to change the oil in our cars back in jersey , you park over a sewer drain and let the oil go down the storm drain and then you would chuck the old filter in , let down the bumper jack and your oil was changed ,

    Help me out here. It is bad to wash away a small amount of bird poop every day with water that is treated to kill germs but it is good to wash it away with untreated rain water in one big dump to the storm sewer system?

    There are companies here in Corpus that will capture and remove pigeons. The pigeons are then sold to be used for targets a pigeon shoots. Everybody wins (except the pigeons).

    Time for the city to clean the sidewalks for free since it is they who are standing in the way of the health issues involved and make sure the city is accountable to the taxpayers for their ill advised thoughtlessness……I would be leading the charge to rid my city of poor leadership.

    Is this a mountain or molehill? The business owner wants clean sidewalk and the city has created an obstruction that may hurt business. there appear to be two considerations that come into play.

    First, how do you keep bird crap off the storefront and sidewalk.

    Second, what can be done economically and legally?

    The answers to consideration one ranges from kill all the pigeons to close the store or move.

    Consideration two is more complex as local codes and practices come into play; but washing the bird crap away is not an answer.

    How about an awning that extends out to edge of the sidewalk, then the storefront stay clean and the rain washes the bird crap away with no negative impact on the environment.

    Really people are you serious!!

    the store owner should personally sue every person involved in enacting this law for loss of income/time, and traumatic injury. get government out of our way and let us get on with life. if politicians want to control other people, bully their spouses or life partners.

    Hire people to do a job, don’t allow them to exercise discression in how they do it — as is usually the case with municipal code enforcement — and you get redicious incidents such as this. If the municipal officials who wrote the code had thought a bit, they would have remembered what fish do in the bay waters — a bit of pigeon poop added is no great matter.

    OK first I feel a Country & Western song coming on: “Everybody’s pissing on my pigeon poop. in Texas”, We’ll get Willie to sing it. There is probably some law against feeding rat poison to pigeons so instead we’ll get Monsanto to make a special GMO grain to feed the pigeons and a special pigeon perfume to spray on the sidewalk. When the birds eat the grain they can’t stand the smell of the perfume so they fly off. Additionally the GMO caused pigeons to get constipated so they can’t poop…ever then their stomaches explode, Is there a law against washing dead pigeons down the sewer?.

    Just a modest proposal, thank you for your time.

    The obvious answer is for the restaurant owner to collect rainwater in barrels and then run that water through a power washer to remove the bird poop.

    Have you ever been to Corpus Christi? The place is a dump, and you would have to be an idiot to live there in the first place. Which is why idiotic regulations and city ordinances are in place there. Cannot fix stupid, and all the people in southern Texas are redneck idiots. I am glad I did not take the job offer there.     The day after this came out on Jim Lago’s talk radio program here in Corpus Christi, the city manager rescinded this bird brained policy. We are free to clean our sidewalks, subject to impending drought related water use restrictions.
