Census Data Shows Steady Influx Of Immigrants Despite Mass Job LossesNew data compiled by the Census Bureau reports that 13.1 million immigrants, both legal and illegal, arrived in the United States in the past decade. During that period, there was an overall net decline of 1 million jobs in the nation.

According to the report Immigration and Economic Stagnation: An Examination of Trends 2000 to 2010, approximately 2.4 million new immigrants settled in the U.S. in 2008 and 2009, while 8.2 million jobs were lost during that same period. The Census Bureau concluded that without a change in immigration policy the level of immigration can remain high even in the face of massive job losses.

The agency reports that 12.1 million immigrants came to the United States during the 1990s, but net job growth was around 21 million during that decade.

According to FOX News, proponents of tougher immigration laws are attempting to rally support for ballot initiatives in California and Iowa. Many individuals in those states would like to see a law similar to Arizona's, which allows authorities to check the immigration status of anyone they suspect may be in the country illegally.

"We have illegal aliens working here and they are taking the jobs of American citizens," Craig Halverson, director of the group Minuteman Patriots, told the news provider.

Michael Erickson, a Tea Party activist, has drafted the Support Federal Immigration Law Act. Supporters of the initiative must collect approximately 433,000 signatures of registered California voters by April 21, 2011 in order to get the proposal on the 2012 election ballot.

    Every Non-representative including obama and holder need to be IMPEACHED! for not upholding the oath of office they swore to defend the Constitution! If these clowns were to do their job, this would all be a Moot point!
    Deport all illegal’s, now, all 12 to 20 million of them. Anchor babies and their criminal parents go, period, and cut the phony tears, you knew you were breaking the law when you crossed the border.

    Next shut down any business hiring illegal labor and confiscate all property belonging to the owner. Property will be sold at auction and the proceeds to pay for the massive deportation. Oh and owners go to jail.

    In the vast majority of cases, these invaders aren’t taking jobs that Americans won’t do. They’re getting paid under the table and thus aren’t even paying taxes, even when self-sustaining. When a Swift’s processing plant was raided a year or two ago and several hundred illegals were carted off, 8,000 Americans lined up the next day to take those jobs. Swift should have been heavily fined and told that if caught again, they’d be seized and auctioned off. Swift dishonestly claimed ignorance even though there were several series of sequential Social Security numbers held by the invaders.

    We want our country back and can’t afford to allow these people to come in and take what we’ve built just because they don’t have the gumption to change their own countries. If they’re so hard working and ambitious, let them do it at home. As for the majority of them who steal our wealth by using our welfare nets, schools, and abuse our laws to stymie us, a pox on them. Never once have I heard a protesting illegal say he or she wanted to be an American. They all want a higher standard of living. Tough. Create one at home.

        Another thing worth consdering is…the federal government has been providing (for years) a way for foreigners to come into this country on work visas when there is a shortage of qualified workers in our own country….so…wonder why not consider the same (or similar) avenue…”if” it ends up being true…especially in this down economy…that our own citizens won’t take the jobs the illegals are doing now. Seems to me that it would be fair to everyone; if our citizens didn’t apply for those jobs…then it would make sense to bring foks in that will work at those jobs…as long as they are screened…and no criminals allowed in…and they must pay taxes (hmmmm…www.fairtax.org….just a thought).

          I was a high tech worker during the 90′s. I was employed as a contractor for AT&T Wireless. They hired a lot of H1S visa workers because there were not enough high tech workers (supposedly) to go around. When the bubble burst came, all the US workers were out jobs but the H1S visa workers were still working. Why? Because they were getting less money.. the law stated they were to be paid the same as a US citizen for the same job but that didn’t happen. So while all my fellow high tech workers collected unemployment, they foreigners were still working and sending their children to our schools, etc.

          I do not believe there is a shortage of workers in this country at all. There is just a shortage of companies willing to pay citizens to do a job for a decent wage.

            I was just saying…”if” (for the bleeding heart far left libs) there is a shortage of our own citizens “willing” to take some jobs, then it would be reasonable to consider doing what they already do.

            You’re point is well taken and I tend to agree for the most part…however, I have met people who have said…”I’ll just stay on unemployment until it runs out, since they’ll probably extend it anyway…when it runs out..then I’ll get a job”. For those select ones, then I have little patience or empathy…nor do I have much of that left for anyone that expects to be here “illegally” for work or otherwise.

            So I doubt if people are avoiding gainful employment due to unemployment incentives.

            $280.00 dollars is a August electric bill here in Texas.

            $280.00 dollars is doctor’s office visit, prescription filled and a tank of gas.

            $280.00 dollars is a seat belt citation.

            We do need to lock down our borders ~ visa visits only

            But let’s not get foolish here, ~ We’ve became a nation that lives on Credit ~ sadly so, and too many people are maxed out today.

            While creditor agents are not lending. Too many Americans have learned how to live off other people money.

            I need a bucket truck badly, I can put one to work tomorrow and employ more people. I hoped to get one last year, but it’s looking like next year before I can buy one. I will pay cash for a used one.

            That’s the way it’s suppose to work! I’m not saying everyone needs to be like me because my band of skill and knowledge is very narrow, but I’ve learned it best I know my place and know what I can and can’t do and not wander off course or depend on others to make my life easier.

            Now if more people was the same way ~ you could count fewer people in your life to do the “right thing”

            Illegal immigration is only part of the problem. As they are easy to kick around since they have no defense,no ground to stand on and can’t kick back. ~ this Cracker mentality of, kill them , hang them is very sick. ~ It’s not necessary to be a bleeding heart to understand the scope of the problems we face with immigration.

            Well Bob, not sure about Texas…but I was talking about some folks in NM (and they were not Mexican)…one in particular thought it was better to draw unemployment ($1200/mo) rather than take a job (if offered) that she applied for. The job did not pay enough (paid more than unemployment, but not enough more)…she wasn’t offered the job anyway, so she did not have to make that decision. My point is, I know it’s painful to take less pay and it’s painful to work at a job one may feel is beneath them…but these are tough times and one cannot continue to expect taxpayers to foot these bills forever. I mean really, when is it ever enough? Families usually have to make cuts in their own budgets when times are tough…why is it so many think it’s okay to keep soaking taxpayers?

      It has been suggested that replacing the income tax with a sales tax
      on just about everything would force all consumers to at least pay
      something. How difficult to implement?

            You may be right about that; I guess there’s nothing in there that guarantees states would not do that. They can do that now, so at least it’s an improvement on making the Federal Taxes more fair for all.

            When I drilled down further, the website does have some info that suggest “On average, states could cut their sales tax rates by more than half, or 3.2 percentage points from 5.4 to 2.2 percent, if they conformed their state sales tax bases to the FairTax base.”

            I’ve included the drilled-down link to get to the section I found this under. Look at the tab, About the FairTax, then at “FairTax Bill Info” and “More FairTax Basics”…that’s where I found it :-).

          Hope this posts in the right order (replying to your comment regarding Ohio’s 6.5% sales tax).

          You’re preachin’ to the choir, Joe. NM does not call it a “sales” tax, but a “gross receipts” tax, and the tax rate is different depending on location in the state.

          Here’s the donkey load I found on our state’s .gov site: “It has a gross receipts tax instead. This tax is imposed on persons engaged in business in New Mexico. In almost every case, the person engaged in business passes the tax to the consumer either separately stated or as part of the selling price. Only in its effect on the buyer does the gross receipts tax resemble a sales tax. The gross receipts tax rate varies throughout the state from 5.125% to 8.8675% depending on the location of the business.”

          I live in ABQ and it’s 7.0% currently.

            In Cleveland they built a new stadium for the Indians on the back of the smokers and the drinkers. It was what they called a “sin” tax!! Well after they built it you could drink in it but they were gonna ban all smoking in it! The smokers raised such a stink about it that they reconsidered and made designated areas for smoking!! the government is a bunch of hipocrites!!! All of them from the top to the bottom!!!

        Track them down and convict them to the full extent of the law. THAT is a crime and deserves punishment. There are real victims and must not be tolerated.

        But are you suggesting that such behavior is commonplace or limited only to new arrivals? This is a question of law enforcement of major crime. It’s not a question of immigration per se.

    I initially was going to comment in the same fashion as Stevo 1, but he has saved me the effort and the chagrin generated by finding it necessary to do so, as he has in an articulate and convincing manner. I could NOT agree with him more and it is far beyond the time we, as a free people, DEMAND that our borders be enforced and any and all not here legally be deported PERIOD! We need rigid ENFORCEMENT of all
    currently unenforced immigration laws, a dropping of the suits by the federal government against Arizon for trying to protect itself from criminaliens and Islamic suits against Oklahoma for declaring international and/or Sharia law null and void in Oklahoma as both violate our Constituion. If they don’t like it, they can leave the Country., They should NOT be allowed here anyway as their theocratic
    political entity is totally inimical to all of us NOT Muslim and they are pretty open about taking this country by Conquest and have made the comment that the Islamic flag WILL eventaully fly over the White House. They have publicly said the same of Great Britain and made public statement that Buckingham Palace WILL be a Mosque and that the Queen will be forced to either convert to Islam or leave the
    country. ALL immigration must be Stopped, and the domestic situation dealt with; even if it has to be done by our military, at least it will be OUR military. America has been asleep for far too long it is past the time to WAKE UP and FIGHT to keep what is OURS!

      I agree with the posters on this site. My state has 240,000 illegals. Our schools are crammed full of non-english speaking students. Our state’s deficit is 2 billion dollars. Our unemployment rate is over 14%….189,000 citizens unemployed while 140,000 illegals have jobs.

      2 assemblymen are currently in the process of drafting similar legislation to SB1070, only a very watered down version. They do not want to step on the toes of the big gaming moguls and contractors.

      What this country needs is a well organized movement to put an immediate stop to this insanity. The illegals are already well organized and have the audacity to march through our streets waving the mexican flag and demand THEIR rights. We, as citizens, should also get off out butts, get away from the computers and form a nationwide protest against the current conditions. We have an absolute right to refuse our tax dollars being used to provide illegals with welfare, free education and health care. We have the right to DEMAND OUR rights.

          GOP midterm gains was a whopping 63 seats ! Giving them a 49 seat majority. Significant gains for sure but suggest it a voice from the burning bush, I think you are getting carried away with your victory.

            I considered my post a direct, clear, accurate response to “disinformation”

            actually I love not being disappointed and a liar never disappoints,

            as far as ~ Am I lying ? I might be, why not check my dates, figures, facts and see?

            The only thing I am not completely certain of(I used recall)is the month MC Cain offered to the American people that the economy was fundamentally sound , I say September but it could have been August of 08, I didn’t think it overly relevant to the point I was establishing and that being, Far too many Americans and members of Capital Hill were blind to the true condition and status of the US economy as recent as September of 2008. And that Bush was compelled to sign a 700 million dollar Financial Recovery Act in October of 2008.

            An “awakening occurred” almost over night, but it took some 30 to 40 days to grasp. And in truth, the full extend of our pathetic situation continued to unfold for a good 12 months, well into Obama’s 1st & 2nd quarter of 2009 tenure while taking oath of office February 20th 2009, 2/3rd of the 1st quarter belonging to “W”

            I truly don’t know how it could be viewed any other way with an objective mind. Whatever guilt “O” might be assigned regarding the economy, had to occur in the Senate.

            I just received good news just a few minutes ago that’s germane.

            Much of this original 700 million has been recovered and as of today only 28 million remains outstanding ! Good news is always pleasant to hear, even if it might seem to diminish my argument.

            Thing are improving they really are, but I’ll be the first to tell you, I don’t any signs of it on my end of the food chain.

            Next, I’ll just say that while I believe it is wrong…I can certainly live with the fact that many will have abortions…for reasons I cannot personally control…it may be their “political” right, but if they choose to do so…they should do so using their own money…do not use taxpayer money to pay for essentially birth control.

            I am that unwanted child, as I wasn’t planned per se and my so-called biological sperm donor did not want any part of me or my mother at that point. Yes, I was unwanted by one parent…and possibly by the other (my mother)…but I only say that because though I’m sure my mother did not want to go through that hell in 1956…a time that was not kind to women who ended up in such a way (hmmmm…see…they didn’t even call it being pregnant). I’ve never asked if she “wanted” me, because it doesn’t matter…even if she did not…she made a very courageous decision and gave me a chance at life, a chance to become a remarkable human being…if I must say so myself. I’ve never thought of hurting myself or others…well…only occasionally have I fantasized about slapping the heck out of a few far left liberals…lol…(just kidding now). The point is, one should never assume an “unwanted” child will turn out to be damaged by default.

            In summary, I noticed in your reply to Sook and Samaurai…that you are very proud of your accomplishments…as you should be. Well, Bob…I’m quite proud of mine…and though my mother is not perfect…I could not be prouder of her than I am at this moment!

    Regardless of what the people have been saying for the last 10 years, these arrogant idiots have the audacity to think they have the power to override the will of the people. Somehow, this lie has been passed on down to those under the Mayor for they all seem to cower behind the Mayors chair fearing they will lose their position in office.

    A bunch of spineless, self-indulgent, usurpers that need to be tarred and feathered and placed up high to see as an example for all to see what will happen to those who dare take these kinds of actions…public humiliation! And I couldn’t care less how doing these actions against these usurpers reflects on us as the people. Perhaps the country will stand up and support this kind of action.

      I’ve been an advocate of a national ID for a very long time. We have the technology to have a picture and fingerprint on it, and we have the ability to scan it (electronicaly or bar code) and immediately see if there are any wants or warrants on it.

      They aren’t proud of America to proclaim that they are part of it with a simple card. Maybe they are cowards who have something in their past that will get them arrested.

    of $901.3 million, and reductions in other income of $273.0 million. The lost direct state
    tax revenue would be approximately $156.9 million.
    I hope Governor Napolitano is realizing what a mistake she made pandering to the bigots.

    The study concluded that the state of Arizona took in tax revenue of $1.64 billion from
    immigrant workers while the amount the state spent on immigrants was approximately $1.41
    billion leaving a net benefit of $222.6 million to the state coffers. But that is only
    what they contribute to Arizona’s revenue. They also pay national income taxes and social
    security taxes.

            With all due respect, I do not need to read the Census Bureau report because I have no interest in the economic impact or demographics of illegal immigration.     knows, the cost of producing an 18-year-old is significant (clothing, shelter and
    rudimentary education). Based on my research, the cost is approximately $150,000 to produce
    even a menial laborer in the United States. Obviously, the more skilled the worker, the
    greater the cost and value. An Indian with a degree from the prestigious Indian Institute
    of Technology is probably worth closer to $1 million. Given this data and immigration patterns,
    the total transfer of wealth from the rest of the world to the U.S. is approximately $300 billion
    per annum.
    Our lack of understanding is borne out by the fact that America’s current account calculation
    does not add the net benefits from immigration. In its simplest terms, America’s current account
    is equal to our trade balance (currently a deficit) plus inflows and outflows of capital. But,
    this calculation only recognizes a flow of financial capital. The constant flow of semiskilled
    and skilled workers into the U.S. is a tremendous inflow of human capital. If taken into account,
    America’s current account deficit would decline from about $600 billion per annum to $300 billion -
    a significant improvement.
    The value of immigration is accentuated when comparing America’s demographics with those of
    the rest of the developed world. Largely due to healthy immigration, America will have a
    population for the remainder of this century, standing alone among major developed nations.
    Japan and Europe will see their populations decline over the decades to come. More ominously,
    China – due to its one-child policy – will see its population age and decline by the middle
    part of this century, calling into question whether China will modernize before it ages. It
    remains to be seen whether a nation can remain a world leader with a declining population.
    Recent history has no precedent. The precedent set during the late Middle Ages – when Europe’s
    population declined – provides a dismal omen.

          Your argument would be much more convincing if you were able to show that requirements in the past for immigration were as tough as they are now. A Mexican – the same as a Swede, or a Pole, or an Irishman in their day – risks everything by coming to a new land, hoping to leave poverty and limited opportunity behind, and usually lands here with little more than the shirt of his back. The biggest difference between them is that the Mexican – at minimum wage that’s currently $5 a day – has no hope in hell of ever meeting the present U.S. Immigration Service requirements.

          The other difference, of course, is that European immigrants were tolerated if not always welcomed… whereas the Latino families treking for five days through the desert of Arizona is under risk of dying of exposure and dehydration or even getting a bullet in the head by the “Patriot” Minutemen, only to face – to judge from comments on this forum – a general hatred from later generations of those same poor European immigrants.

          People claim that they’re only here to take advantage of the system and then they’ll go home again. Truth is, no matter what their original nationality, almost none of them ever go back, except for a visit when they can.

      Give it up! I have seen the direct results of immigration both legal and illegal. I live in a small community and we are getting over run with them. They are standing in line at the food bank and wanting free services. They are over running our hospital emergency room and committing crimes (both drugs and weapons).

      In Seattle where my mother lives the immigrants, both legal and illegal, hit the welfare office at first opportunity. They live in subsidized housing, they get free medical, their children get free breakfast and lunch at the local schools, plus food is sent home on weekend for them, food stamps, etc.

      There is an entire subsidized housing complex that is filled with Somalians and they have food stamps, medicaid, and all the benefits they can get. This is all while working for cash and they keep their money among themselves by using someone in their community as a banker.

    of the debate over the economics of immigration. Yet the role that Latino-owned
    businesses play in growing the economy and creating jobs is often overlooked. As the
    new census data illustrates, however, the entrepreneurship of the Latino community is
    a powerful economic force which can not be ignored. Even though the recent recession
    has undoubtedly hit the Latino business community hard, the fact remains that, without
    Latino businesses, the United States would have a smaller economy and fewer jobs.
    This is a basic economic truth which many nativist groups seem unable to grasp.

    How illegal immigrants are helping Social Security

    The contributions by unauthorized immigrants to Social Security — essentially, to the retirement income of everyday Americans — are much larger than previously known, raising questions about the efforts in many states and among Republicans in Congress to force these workers out.

    In response to a research inquiry for a book I am writing on the economics of immigration, Stephen C. Goss, the chief actuary of the Social Security Administration and someone who enjoys bipartisan support for his straightforwardness, said that by 2007, the Social Security trust fund had received a net benefit of somewhere between $120 billion and $240 billion from unauthorized immigrants.

    That represented an astounding 5.4 percent to 10.7 percent of the trust fund’s total assets of $2.24 trillion that year. The cumulative contribution is surely higher now. Unauthorized immigrants paid a net contribution of $12 billion in 2007 alone, Goss said.

    Previous estimates circulating publicly and in Congress had placed the annual contributions at roughly half of Goss’s 2007 figure and listed the cumulative benefit on the order of $50 billion.

    The Social Security trust fund faces a solvency crisis that would be even more pressing were it not for these payments.

    “If for example we had not had other-than-legal immigrants in the country over the past,” Goss e-mailed me, “then these numbers suggest that we would have entered persistent shortfall of tax revenue to cover starting 2009, or six years earlier than estimated under the 2010 Trustees Report.”

    Americans are faced with the difficult choice of cutting pensions, delaying the retirement age or raising taxes if we want to maintain the solvency of what has been the centerpiece of social welfare for ordinary Americans since the 1930s.

          My sister-in-law had a heck of a time with the IRS, because an illegal had been using her SS#. They said she earned way more than she did, and wanted her to pay up!

          Using other people’s SS# creates serious indentity problems for people, yet no one seems to care. It should be a serious crime, and people should be nailed to the wall for it.

            Apart from that, we all know about the corporate welfare bums: the defence contractors, bankers, and other insiders sucking off the BIG government tit. They make the millions “lost” in education and health services pale by comparison. For them it’s not millions, not even billions: it’s TRILLIONS ($X,OOO,OOO,OOO,OOO)… and that, my friends, was part of the original protest of the founders of the Tea Party before it got taken over by the kneejerk reactionaries.

            If we want real solutions, how about coming up with some serious, well-researched alternatives to deal with these many other questions of unfairness in society? I salute Max901 for painting a fairer picture of the situation, one that most of you simply don’t want to hear.

            Indeed, the solution that I AM hearing in forums on the immigration issue basically boils down to sending out the Brown Shirts to round up identifiable immigrants, in the stupid belief that this will make all the other problems just go away.             There’s a big difference between working poor and “poor white trash”. The latter term only came into common use in the 1980′s and 1990′s to refer to the slothful sub class who have no intention of ever improving their lot, despite taking lots of money from the community/government.

            I’d not sure where you get the idea that I consider immigrants as “victims”.

            My reference to this term was simply that, if they are criminals as so many claim, then what exactly is their crime and who is their victim? (And I assume you are more reasonable than those throwing around the accusations that they’re all Rapists, Murderers, etc., etc.)

      Who the hell are they trying to kid? This is a classic case of lying with statistics. “Cumulative” contributions may be 10.7 percent of total assets, but the figure means nothing. Do you know what “cumulative” means? It means they took ALL contributions from the time SS started in the 1930s and divided it by the CURRENT asset position.

      Using cumulative figures means that “the cumulative contribution is surely higher now.” Duh..of course it is! It will get higher every year! It’s MATHEMATICALLY guaranteed to increase!

      The more meaningful figure, the apples and apples comparison, is $12 billion per year contribution, divided by total assets of 2.24 trillion. You know what that yields? Slightly over 1/2 of one percent per year!. THAT’S the correct calculation.

      It doesn’t surprise me that the Washington Post would try to fob off faulty statistics to further their leftist agenda.

And while we’re at it, the use of “total assets” is a bogus comparison as well, apples and oranges. Total assets is a current figure, a snapshot in time. A VALID apples and apples comparison would have been “cumulative contributions from illegals divided by CUMULATIVE TOTAL contributions over the years.” That, for sure, would be a much smaller fraction of 1%.

      “Steven A. Camarota is Director of Research at the Center for Immigration Studies in Washington, D.C. He holds a master’s degree in political science from the University of Pennsylvania and a Ph.D. in public policy analysis from the University of Virginia.

      This study is one of the first to estimate the total impact of illegal immigration on the federal budget. Most previous studies have focused on the state and local level and have examined only costs or tax payments, but not both. Based on Census Bureau data, this study finds that, when all taxes paid (direct and indirect) and all costs are considered, illegal households created a net fiscal deficit at the federal level of more than $10 billion in 2002. We also estimate that, if there was an amnesty for illegal aliens, the net fiscal deficit would grow to nearly $29 billion.

      Among the findings:

      Households headed by illegal aliens imposed more than $26.3 billion in costs on the federal government in 2002 and paid only $16 billion in taxes, creating a net fiscal deficit of almost $10.4 billion, or $2,700 per illegal household.

      Among the largest costs are Medicaid ($2.5 billion); treatment for the uninsured ($2.2 billion); food assistance programs such as food stamps, WIC, and free school lunches ($1.9 billion); the federal prison and court systems ($1.6 billion); and federal aid to schools ($1.4 billion).

      With nearly two-thirds of illegal aliens lacking a high school degree, the primary reason they create a fiscal deficit is their low education levels and resulting low incomes and tax payments, not their legal status or heavy use of most social services.

      Many of the costs associated with illegals are due to their American-born children, who are awarded U.S. citizenship at birth. Thus, greater efforts at barring illegals from federal programs will not reduce costs because their citizen children can continue to access them.

      If illegal aliens were given amnesty and began to pay taxes and use services like households headed by legal immigrants with the same education levels, the estimated annual net fiscal deficit would increase from $2,700 per household to nearly $7,700, for a total net cost of $29 billion.

      Costs increase dramatically because unskilled immigrants with legal status — what most illegal aliens would become — can access government programs, but still tend to make very modest tax payments.

      Although legalization would increase average tax payments by 77 percent, average costs would rise by 118 percent.

      The fact that legal immigrants with few years of schooling are a large fiscal drain does not mean that legal immigrants overall are a net drain — many legal immigrants are highly skilled.

      The vast majority of illegals hold jobs. Thus the fiscal deficit they create for the federal government is not the result of an unwillingness to work.

      The results of this study are consistent with a 1997 study by the National Research Council, which also found that immigrants’ education level is a key determinant of their fiscal impact.”

Lost spending on food, beverages, entertainment, local transportation and retail goods brought the total cost to $141 million, the report said.

    The boycott is aimed at an Arizona law requiring police officers to determine the immigration status of people stopped for questioning. The state’s credit may be affected if the boycott harms tourism, Moody’s Investors Service said in May. In July, Moody’s cut the state one level to Aa3, its fourth-highest credit rank, citing “economic and financial weakness.”

    “This significant hit to direct visitor spending could not come at a worse economic time for Arizona,” said the report by the policy group founded by former Clinton administration chief of staff John Podesta in 2003. The center describes itself as a critic of conservative values and a supporter of the progressive movement.

    Tourists spent $16.6 billion last year in Arizona, where the travel industry supports 157,000 jobs, the state Office of Tourism said July 15.

    “Gov. Arnold Schwarzenegger said Wednesday that the claim by some conservative activists that illegal immigration is to blame for all of the state’s fiscal problems is ignorant and bigoted.”

    Arturo E. Ocampo of Tracy has been a practicing attorney since 1985, In the 20-plus years I have spent studying, lecturing and litigating immigration issues, two things have always amazed me. The first is the amount and intensity of hate spewed against undocumented workers. The second is the amount of misinformation that is published about them.

    On this second point, the quote from Mark Twain is illustrative. “A lie can travel halfway around the world while the truth is putting on its shoes.” I suppose this may be true in part because misinformation, like a lie, requires no accuracy, validation or research; all of which are time-consuming practices.

    The recent letters alleging that all undocumented workers are “criminals,” and specifically Veronica Suarez, whose plight was written about in the Tracy Press recently, is a criminal are factually incorrect.

    According to the facts (as stated in Sharon Franceschi’s Sept. 7 commentary) Saurez entered the U.S. on a valid visa, overstayed her visa when it expired, resulting in her unlawful immigration status. None of these acts, as stated by Franceschi, constitute a crime under federal or state law. Overstaying a valid visa under the Immigration and Naturalization Act is a civil violation of the law, not a criminal violation. Being in the U.S. in under undocumented status is not a criminal violation, but a civil violation of the INA.

    The facts, as stated by Franceschi, do not indicate that Suarez has committed any crime. To call her a criminal is erroneous at best, and libelous at worst.

    Furthermore, it is an Americanism that a person is innocent until proven guilty. So until Suarez (or any other undocumented person) is charged and found guilty of a crime, it would be inappropriate to call them “criminals.”

    It is important to note that there is a very large difference between civil and criminal violations of law. The distinction is so important that the law makes the erroneous allegation that one has committed a crime of slander or libel, (which means liability is automatic even without proof of damages). One who violates the civil law is no more a criminal than someone who has breached a contract or accidentally damaged another’s property.

    It is true that entering the United States without inspection is a misdemeanor under the INA. The misdemeanor is completed once an individual’s entry is complete. Suarez, according to Franceschi, did not enter without inspection; she entered with a valid visa. According to U.S. Immigration and Citizenship Services statistics, about 40 percent of undocumented persons enter legally and overstay their visas (which, as stated above, is not a crime). Consequently, at least 40 percent of the undocumented population has committed no crime in regards to their immigration status.

    Therefore, one cannot assume that a person has committed a crime simply because they are undocumented.

    Franceschi is also in error in her allegation that getting married and having children while being undocumented in the U.S. is a violation of the law. It is not. Franceschi goes on to say that Suarez “apparently bought a house illegally.” It is unlikely that Franceschi knows exactly how Suarez purchased her home. Consequently, any allegation of illegality is, at a minimum, irresponsible.

    It is also important to note that the Immigration and Citizenship Services doesn’t consider all undocumented persons criminals. When the Immigration and Citizenship Services publishes information about its enforcement activities involving undocumented workers, it are always sure to make a distinction between “criminal” and noncriminal aliens.

    Another myth is that the term “illegal aliens” is a term of art or is legal jargon. This term is not found anywhere in the INA or in Blacks Law Dictionary. The INA refers to undocumented persons as either an EWI (entered without inspection) or as someone who has overstayed their visa. “Illegal aliens” is a term invented by anti-immigrant groups designed to put undocumented persons in the worst possible light and to instill fear in Americans. It is intentionally designed to associate undocumented persons with criminality.

    This xenophobic view that undocumented persons are “simply criminals” comes from the historical stereotype that the foreign-born, especially undocumented immigrants, are responsible for higher crime rates. This misconception has deep roots in American public opinion and popular myth. This myth, however, is not supported empirically and has repeatedly been refuted by scientific studies. Both contemporary and historical data, (including U.S. governmental studies) have shown that immigration is associated with lower crime rates.

    The studies have uniformly shown that recent immigrants (including the undocumented) are less likely to be involved in violent crime, and that when there is an increase in immigration patterns, violent crime decreases. This has been shown to be true in large cities with heavy immigrant populations.

    In the most recent of these studies, The Myth of Immigrant Criminality and the Paradox of Assimilation (2007), from the Immigrant Policy Institute, it was found that among men age 18 to 39 (who are the vast majority of inmates in federal and state prisons and local jails), immigrants were five times less likely to be incarcerated than the native-born in 2000.

    During the Proposition 187 debate, then-Gov. Pete Wilson published statistics that stated that
    12 percent to 15 percent of the state prison population had Immigration and Citizenship Services holds or potential holds. The Department of Corrections analyst who compiled these numbers said Immigration and Citizenship Services holds are placed on inmates who were born outside of the U.S. (therefore 12 percent to 15 percent of the prison population was immigrants). The immigrant population at the time in California hovered at about 25 percent, showing immigrants were much less likely to be incarcerated than the native born in California.

    In short, the data shows you are much safer if your neighbor is an immigrant.

    Franceschi owes Suarez an apology. I am also surprised that the Tracy Press allowed a commentary to run without checking the facts. Although commentaries are designed to allow for the expression of differing opinions, the First Amendment is not as generous with misstatements of facts — especially when the facts can be libelous.

    For the immigration debate to be a healthy one, we should strive for a debate based on facts, not myth or tired stereotypes. We should also not let our position on this topic strip us of one of the great qualities we possess as people — the ability to be compassionate.

            As for Sook Young commentary about which side I’m on, I’ll just simply say that I’m on the side of reason. I encourage and will continue to encourage fellow conservatives here to re-think their basic stance on the immigration question, ’cause a lot of good people who’ve committed no crime are going to get badly hurt.

            Conservative philosophy by its nature and throughout history has always been to take a sober second look at what the mob is saying. Commentaries in forums like this one where people feed off each others’ prejudices have nothing at all to do with real conservatism. You’d do well to read the writing of Edmund Burke. You’d also do well to learn from the lessons of WWII Germany and its treatment of minorities.

            BTW, where are you getting this idea that I think that immigrants are “victims”? I’ve never said or even thought that: on the contrary, I’ve always stated that they are, in general, a positive presence.

            Of course, there are always a few bad apples in any group. But I get more than a little ticked at people who say that the whole barrel is rotten and throw around statistics irresponsibly without ever giving any solid references to support these judgemental opinions.

            If there is a problem with people falling back on government support systems temporarily when they’re no longer able to support their families on their own – the plight of many hard-working people from the construction trades ever since the collapse of the housing sector – well, that’s another debate for society, and one that extends to ALL races, not just Latinos. Obviously people shouldn’t get in over their depth in debt and then not be able to finance it.

They were the salt of the earth, dam good people and they would tell you the same thing I did. They were legal and hated every illegal, as they called them, wet back that entered the states! I picked tomatoes, asparagus, and apples along side them and learned from them in the process. I learned there are mostly two types of Mexicans. One is fiercly proud and are proud of every thing they earn or build. the other is the moocher type that will take anything you give them and have NO pride what so ever!!

            I do agree with you on the moochers… but that’s not really their problem, it’s OUR problem and it’s about how the community (government) handles such abuse. Immigrants – who, after all, are looking out for their own survival interests in a new land, without a lot of family ties or any real wealth to back them up under duress – will naturally take advantage of any financial incentives offered. (The key here is the word “offered”.) That’s just intelligent economic behaviour under the circumstances.

            My question is when is the debate going to get away from calling people down because of their heritage or race and instead focus on what we the people are willing to provide as support to our neighbors when they fall on hard times.

            Obviously, it can happen to any of us – indeed, the way things are going, probably will to most of us – but such support has to come with strings attached… like taking sensible measures to improve yourself, get a new trade, learn from the hard times, etc.

            I believe the question “Who is my neighbor?” has already been answered.

    knifins,pregnancy care/delivery,whatever),plus do not forget the prison system is loaded with illegals at a of $40 to $50,000/year each. These very same crooks know that the education system in our

    Their is absolutely no incentive for these lying (promicing to work
    for the betterment of America, all the while selling it),cheating,

We need to start really enforcing employment laws in this country. Instead of what we have now which is a public slap on the wrist and a private slap on the back. Increase penalties for hireing illeagls to bring some jail time and very heavy fines.This would make it no longer cheeper for employers to hire illeagles than the U.S citizen.           rob, if i want to smoke pot, i should be able to. however, i should not be allowed to drive under the influence as that would infringe on others’ rights to life. if i buy a piece of property, i should be able to own it some day which you don’t if the govt can take it in lieu of taxes or to run a road through it. if it infringes on my rights which don’t infringe on anybody else’s, it shoudln’t be a law. we are not for big business – most of us are just workers or small business owners. we want more jobs so we can afford to buy the things that will cost more when americans are doing the work instead of illegal aliens. we want to keep our wages rather than turning so much of them over to the govt so they can run agencies that tell us what to do every minute of every day or give it to illegals on welfare. nobody said we should be in a state of anarchy with no laws at all. but, if it IS a law, it should be enforced.

It also has nothing to do with the laws requireing the employer to provide leagl documentation on Employee. And why do they outsource every customer service job to India and the Phillipines. Why? Because American industies don’t shive a git about America. If they could sell every one of us and get away with it, they’d do it for the buck and their immoral bonuses they give their executives. My idea. Find out what companies use good old American labor and support them by buying their goods and services. Maybe then the Big Boys will get the message and do the right thing.       A huge part of the problem is the loss of the American work ethic. Far too many people have the Union attitude of less work for more pay. We’ve had companies close because they can’t find enough workers. The gvt. makes it relatively easy for people to opt out of work and still survive. If you want to solve the illegal immigrant problem do the following:

      1) take away the carrot. No jobs or social services for illegals. Fine the hell out of any company knowingly hiring them. Repeal the 14th Ammendment; no more anchor babies.

      2) Cut welfare and Americans will take those jobs; hunger is a great.
      motivator.

      3) Give tax incentives to companies who stay in this country and hire Americans. Increase taxes on those who don’t.

      4) Stop all immigration from 3rd World Countries for unskilled workers. Cut student visas to students from Muslim countries.

      5) Round up foreign gang members and take them on a one way ride to the desert.

      I would volunteer to manage these programs. This would be a giant step towards restoring America’s former greatness. Existing policies are a failure so give this plan a try. What do we have to lose, we’re already losing our Country.

    Take over the western states and they are right on schedule. FAIR, For American Immigration Reform, has been telling us about this
    for years! The idea ? “We will take over by having lots of babies and you gringos will pay for them to be born here”. I know, I heard it in every school throughout the County where I did almost ten years of substitute teaching. The latest idea? Bring in the drugs. Kids talk about it with pride as though they were living and writing their history. We have enough chaos and finacial distress to know that things will not get better if we give amnesty to illegals. Enforce our laws as agresssively as TAS has descended upon our liberties.

    Meg Whitman, who ran for Gov. of California, should have filed a law suit against the agengy that produced the false ID and the maid for
    using a false ID. That constitutes two crimes!! What an opportunity was missed to enforce the law. Bet Eric Holder won’t do anything.
    Money flows to Mexico like confetii. Soultion on that? Tax it 40%! when they send it through banks, Western Union and all systems of delivery that they use for transferring funds. Make it illegal to transfer funds in bundles from here to Mexico or any other country when crossing the border.

    On the Dream Act: NO, NO, NO! It is descrimination to charge illegals less tuition and take away the seats that belong to the many men and women who went to war who will soon be coming home. No more grants to La Raza, LULAC, Mecha and and others whose intentions are nothing more than to round up votes for the Democrats. The political power players in the Hispanic Caucus are progressives with miltant constituents who relish maintaing ignorance about our Constitution while they flout their idiology of hatered towards America.I met them when I was doing volunteer work within their communities up and down the state.

    I DEMAND AN ID CARD for the safety of our country. Let’s get stated now. It might help flying easier. It is time for drastic measures.
