California Law Permits Gun Confiscation

SACRAMENTO, (UPI) — California’s attorney general said it could cost up to $50 million to confiscate guns from people on the state’s Armed Prohibited Persons list.

California is the only state in the union with a program to confiscate guns from people who bought them legally but were later disqualified, the Los Angeles Times reported Tuesday.

Attorney General Kamala Harris said California has more than 19,700 gun owners who are no longer qualified to possess firearms.

They are identified by analysts who track gun sales back to 1996 and match them against databases listing criminal convictions, restraining orders and mental health detentions.

For the past five years, California’s gun apprehension teams have been sweeping through neighborhoods in unmarked trucks to retrieve guns from owners no longer permitted to have firearms.

To date more than 10,000 guns have been collected.

“This is about prevention,” Harris said.

California’s program is being studied as a potential model for the nation.

Californians will gather at the steps of City Hall in Ventura and commence a March at 11:30 a.m. down California Street and Main Street towards Mission Park, across the street from the San Buenaventura Mission, where we will assemble for a Public Meeting at NOON to Rally and Protest the efforts of the California State Legislature to impose a de facto repeal of the 2nd Amendment. Speakers will inform the activists attending the Rally on what they can do individually and collectively to combat these proposals and what we can do if the ban goes into effect. Potential confiscation: California Democrats propose draconian gun control laws
      - Feb 8, 2013

On Thursday, California Democrats proposed a series of strict gun control laws that could lead to the confiscation of as many as 166,000 legally registered weapons.

Under the new laws being proposed, all semi-automatic rifles with detachable magazines would be banned, the Mercury News said. Additionally, all guns would be registered and “no ammunition could be bought” without a special permit.

“It joins equally controversial proposals from Assembly Democrats that would regulate and tax ammunition sales and consider taking the state’s 166,000 registered assault weapons from their owners,” the Mercury News added.

“[A]lmost every item in the proposal is wildly unconstitutional,” said Gene Hoffman, co-founder and chairman of the Calguns Foundation, a pro-gun rights group. Hoffman also said the proposals may “accelerate the speed at which the Supreme Court takes these ideas off the table.”

“The violent criminals are simply not going to be affected by any of these proposals,” added Yih-Chau Chang, spokesman for the gun rights group Responsible Citizens of California. “Following the law is the last thing they’re going to do, so it’s only going to affect law-abiding citizens.”

CBS Sacramento said the laws have a good chance of passing, since only a simple majority is needed and Democrats control the House and the Senate. Gov. Brown has not commented on the
      proposals.

On Gun Violence– It is tragic that many people are killed by guns yearly. What are the statistics, cause, remedy, perspective? Some things to think about:

2nd Amendment: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

It is quite clear from study of history and law that private possession of weapons is legal and a foundation of our Constitution. Yes, there is a downside, offset by keeping us free and safer.

U.S. Population 315,000,000; deaths 2,500,000, using guns 11,493 (FBI average)= .045%. So why is this the top priority? Because it’s about control more than saving lives.

    Gun deaths:

    - Down by half since 1992, now average 11,493 murders, 3.5% use rifles. More people killed by hammers and clubs than rifles.

    - 60% suicides, 49% by blacks, most gang/drug-related, illegal immigrants disproportionate perpetrators

    - IN UK? Gun deaths are much lower, but they were even lower before gun restrictions. UK violent crime rose dramatically, now 4X U.S. rate.

    - Worldwide? Far more govt.-related gun deaths, than private citizens. Second Amendment was mainly written for THAT. Many nations with tough gun laws have higher gun death rates. Causal factors are not guns.

    – Toughest gun laws in U.S. and highest gun murders in D.C. and Chicago – Mass shootings have not skyrocketed, but media reports have. The few mass shootings are overwhelmingly committed by young, white, Liberal, crazy, drug-addled males, in “gun-free” zones.
