Big Brother Can Access Email Without Warrant

Government officials investigating the WikiLeaks controversy have made one thing evident with the investigation: They do not believe it violates the 4th Amendment to search information on cellphones and in emails without a warrant or even notification of the person being searched.

According to The Wall Street Journal, the government has obtained a secret court order to force Google Inc. and small Internet provider Inc. to turn over information from the email accounts of WikiLeaks volunteer Jacob Appelbaum. The smaller company fought the order but lost, and both were required to release partial emails and addresses of those with whom Appelbaum had corresponded with over the past two years.

The article said the order vindicates suspicions many people have about the government’s ability to peek into individuals’ email accounts and observe online tendencies without their ever knowing they were investigated. The law that is supposed to protect Internet users from Big Brother’s spying eyes, the Electronic Communications Privacy Act, was passed in 1986, before the World Wide Web existed.

The government has also considered using cellphone GPS to pinpoint the location of individuals without their knowledge, a process that a Federal court called “Orwellian” when it overruled a government request to obtain cellphone location records without a warrant.

Voting will not accomplish your request…there is only one way to do this…the chances of them just ‘going away and leaving us alone’ are less than slim.

I am afraid that the resulting anarchy would be worse and lead to tyranny even worse than you fear now.

Personally, I chose that if necessary we follow the lesson from our Founding Fathers. We remain a people of “natural laws” even if our rulers reject natural law in favor of tyranny. I believe we still have a chance to save America, but the window of opportunity is closing. It may become necessary to have a revolution of words, to stand up in word and action, humbly, boldly, and courageously stand up for limited government until the federal government can be… trimmed… to its original, very limited, Constitutional size.

Well, they know my email address. I suppose I should expect the FBI soon or maybe just a hit. Cheers!

It isn’t just your email. It could be your cell, Nook, any kind of the new tablets. We are watched more than you think.

I think the time for using the ballot box has long passed…you know, that saying about the Tree of Liberty needing watering…

  • Houizi

The libtards jumped through their corn-holes when Bush did a version of this after 9-11. This is MUCH more extreme … where are they now?

  • Altaica

While we’re watering that tree we need to pull up a lot of weeds that are stealing it’s nutrients.

Your watching your world change very quickley, it is almost down the slippery slope…..the new genteration want a socialist goverment and will show up to vote for one unless the old folks get off there kesters and go vote in 2012….this has always happened when the people let the goverment grow to big, its agencies run the people….

  • Raggs

Very soon the gestapo will be coming into your home and taking your guns because you are deemed as a threat if you do not agree with oblama…

    • s c

Raggs, it should be clear that America is infested with a new generation of Nazis in Washington. Sadly, that fact is being ignored by many Americans, and some of them are elected.
Because of their constant use of gradualism techniques, don’t be surprised when Opraiseme demands that a law is passed so Americans will be FORCED to have cell phones. If nothing else, Washington’s neoNazis will know where we are 24/7.
It is logical, Raggs. If you can FORCE Americans to buy health insurance, you can FORCE them to do anything. And, as Osalutemenow
has done so many times, ignoring the Constitution is no big deal to him.
Remember, our W H stormtrooper is ‘special.’ Of course, that will create future ‘problems,’ as some Nazis are very particular about membership quirks, and even Hitler would not approve of America’s lowered standards.
Hitler and his herd didn’t worship eugenics because they were bored, Raggs. Some utopian Nazis will have a hard time understanding all the implications, but that’s THEIR problem. It even has an unusual, humorous tint to it, too.

I for one am of the opinion that this court decision is “Orwellion” in nature and as such most unfortunate. Legislation seems now to be the only answer of fix for this problem, however perhaps if this decision is heard by the Supreme Court this lower courts decision will be overturned, but I doubt it.

The Bush Administration’s Patriot Act made such warrantless searches constitutional if there was reasonable cause to believe that such searches were vital to our National Security. That was back just after 9-11 and only a few Aamericans took exception to it. Obama’s administration extended the Patriot Act, though, and that looks like the gradual abandonment of the Bill of Rights restrictions on the federal government.

    • s c

James, please do all of PLD’s readers a big favor. Every time Obummer’s worshipful apologists line up to try and distance themselves (and their fearless, wannabe ‘god’) from the Patriot Act, please REMIND them their fearless leader extended the damned thing. We can only hope that they will howl at the moon when this is stuck in their faces. They do have this SEVERE memory problem.

    • eddie47d

Tell me SC if someone asked you to do your patriotic duty and wiretap a Liberals house for “pertinent” information would you be willing to do it to “save the nation”? Would you stand firm in you beliefs and refuse to do it or find more joy in nailing a Liberal?

Wasn’t the “Electronic Communications Privacy Act” the one that Clinton had passed that included the requirement that every communication device had a chip installed that allowed the government to log onto that device (via telephone lines) and copy all transmissions? I know they have one that did. In other words, all telephones, fax machines, computers, etc. have such a chip. It records all transmissions which can then be downloaded by government computers.

Remember the single short ding your telephone USED to do back then? That was the government computer calling. Now they don’t ding.

I checked with our company IT about this and the person laughed and agreed that this was there. He said that when they don’t have anything else to do they send messages to each other with titles like “THIS IS NOT A BOMB THREAT” just to insure that some oaf in Washington has to read it.

    • s c

45caliber, does that go back to the time when Bubba Clinton wanted to “bless” America with something known as ECHELON? You could call it an extension of “the ends justify the means.”
Apparently (up to a certain point), Clinton and Opraiseme have more in common than I would have guessed. If it wasn’t for the fact that Clinton once said that at one time Obummer would have served Clinton his coffee, they might have reasons to consider each other ‘equals.’

Gee and just to think that they have had the ability to screen and monitor land lines for years. Fiber optics are wonderful. What is the news here. Do you really think that after all of these years that they have been waiting for permission?

  • Louis

    Why is anyone suprised?

    • libertytrain

things were televised pretty darn quickly with all the news centers in New York. It was almost instantaneous.

      • James

The plane President Bush says he saw hit one of the twin towers, wasn’t televised until 12 hours after he said that. This timing is documented in “The New Pearl Harbor, revisited” by David Ray Griffin.

        • libertytrain

Well, than someone ought to explain to them that I and millions of others watching the morning news saw it just after it occurred, the first tower that is, then the 2nd tower was live when it was hit.

How nice; Eric Holder doesn’t feel that snooping on your e=mail doesn’t violate your Constitutional privacy. How nice. Now lets snoop on his about Fast and Furious and his alliance to the black panthers. Turn-about is fair play.

  • Take Aim

You can thank W and Don’t go hunting with me, Dick Cheyney for this occurring.

Man! THIS is just the beginning.. The ‘spark’ before the fire and had it not been for some level headed individuals, this fire would have ignited sooner.. Keep bringing the water!!
