2013 NDAA Still A Threat To Americans

Earlier this week, President Barack Obama signed the 2013 National Defense Authorization Act, a bill that keeps Guantanamo Bay open and indefinite detention of American citizens a prospect.

This year’s NDAA also authorizes funding for the war in Afghanistan, tightens sanctions against Iran, funds Special Forces and boosts security at diplomatic posts abroad in response to the attack on the consulate in Benghazi, Libya, in September.

The President, in a signing statement, expressed regret for provisions keeping Guantanamo open.

“I continue to oppose this provision, which substitutes the Congress’s blanket political determination for careful and fact-based determinations, made by counterterrorism and law enforcement professionals, of when and where to prosecute Guantanamo detainees,” Obama wrote.

“This provision would, under certain circumstances, violate constitutional separation of powers principles. In the event that these statutory restrictions operate in a manner that violates constitutional separation of powers principles, my administration will implement them in a manner that avoids the constitutional conflict,” he added.

While Congress added a provision, Sec. 1029, asserting that “any person inside the United States” is allowed his Constitutional rights, including habeas corpus as a fix for the indefinite detention provision, critics are less than impressed.

“Saying that new language somehow ensures the right to habeas corpus — the right to be presented before a judge — is both questionable and not enough. Citizens must not only be formally charged but also receive jury trials and the other protections our Constitution guarantees. Habeas corpus is simply the beginning of due process. It is by no means the whole,” Senator Rand Paul (R-Ky.) said.

The American Civil Liberties Union also criticized the Obama-approved bill.

“His signature means indefinite detention without charge or trial, as well as the illegal military commissions, will be extended,” said ACLU Executive Director Anthony Romero. “He also has jeopardized his ability to close Guantanamo during his presidency. Scores of men who have already been held for nearly 11 years without being charged with a crime — including more than 80 who have been cleared for transfer — may very well be imprisoned unfairly for yet another year. The president should use whatever discretion he has in the law to order many of the detainees transferred home, and finally step up next year to close Guantanamo and bring a definite end to indefinite detention.”

    Brilliant. See, we can have wars funded, you just have to have a NDAA Bill to accomplish that sort of thing. Stupid boosh, why didn’t he think of that? What? You still have to borrow money to pay this Bill? Ben?, Ben?, what’s the balance remaining on our card?

      Krizma99: Are those new code words for you “self-proclaimed fascist” because the old ones aren’t working? I definitely wouldn’t take you word for anything since Obama has been adamantly against keeping Guantanamo Bay open. He does have Congress to work with so you should be more concerned with their “shenanigans” and pulling the wool over your eyes. Now if Guantanamo Bay is closed it would save the US over $365 million in rent to Cuba and millions more in security with the prisoners. Although there would still be prison costs if they are transferred to US prisons maybe the trials would move along quicker so guilt or innocence can be delivered. Congress is also the one who has control over NDAA and funding Afghanistan. Since our war commitment to Afghanistan continues until late 2014 then obviously it has to be funded. Now maybe Congress can declare peace tomorrow and get the heck out of there but fat chance of that happening either.

        90% of what’s taking place in Washington today is illegal, unconstitutional or both. Our President is not qualified for the office because he’s not (can’t possibly be) a “Natural Born Citizen” as required by our constitution. That makes every order he gives and paper he signs illegal. I seriously doubt there is a SINGLE politician in Washington who’s not guilty of “TREASON” for violating his oath of office to “Protect and Defend the Constitution Against All Enemies, Foreign and Domestic.” Each and every Judge on the Supreme Court can easily be impeached for violating their oath, and “assuming” power nowhere granted by that constitution to “interpret” the constitution as they see fit!

        Who is to blame for all this? WE ARE! The federal government was not created by “The People” but by THE STATES, and it’s the States which allow this abomination to continue to exist. Who controls State government? WE DO! All we need to do is elect people to our State government who will demand that THEIR AGENT, the federal government, abide by the constitution which caused it to exist in the first place!

        If we do nothing except enforce the 10th Amendment, 90% of our current federal government would simply vanish from the face of the earth, as an unconstitutional usurpation of authority which is nowhere granted, and in many cases specifically denied by the Bill of Rights.

        Wake up people! We’re doing all of this to ourselves…

        eddie likes to blame congress but Obama had a Democrat house and senate his first 2 years in office and did nothing to close gitmo or implement an immigration policy.

        MOMO: I sure did (pull it out) since I can’t find where I originally found that information. Yours was far more accurate. We have paid in the last 11 years $9 million to house the detention center there.

    Of course it’s s threat to Americans. Anything that in any way encroachs on our freedom of speech, freedom to have arms to defend ourselves with, says the we are guilty until we prove our innocence, in short, in anyway that could be considered an encroachment on our Bill of Rights and Constitution is a step toward tyranny on the part of “the” government. I could care less what politicians dressed in robes say. The people can interpret THEIR OWN Constitution the right way
