City In Kansas Overturns Ban, Allows Open Carry

Five years ago, a city in Kansas decided to ban the open carrying of guns. On Monday, that decision was reversed.

Overland Park’s City Council decided to allow citizens to walk the streets with guns in full view. The ban was overturned with an 11-1 vote.

Citizens can open carry with a few caveats: The weapon has to be holstered, the safety has to be on and citizens cannot carry guns into city-owned buildings.

Some citizens support the ban being overturned, while others think the decision is not wise.

“As a matter of respect to the right of a person to own a gun and carrying, clearly, I do support that,” said Michelle Dunham of Overland Park. “But as a person would be walking next to people carrying guns out, yeah, that’s more concerning to me.”

Business owner Sheila Weiford thinks the new open carry law is outdated.

“We don’t need someone walking around toting a gun. That’s not what we’re all about. It’s not the Dodge City days,” she said.

    Yes I am so familiar with how little Americans know about Canada. My daughter is also married to an American and lives in, South Carolina and since she went to the U.S.,when she was still a child she,too, is more American in her ignorance of Canada, in spite of the fact she is still Canadian. In fact I can recall when I first started commenting here, in Personal Liberty how Ameriicans used to comment and tell me to go back to Canada because I had no right to comment about American issues….believe it or not.I guess they didnt’ notice I am also an Irish citizen!!! Of course my responsese to them were sufficient and correct and so the result, is I no longer get those foolish “redneck” comments…I miss them though :-)

      Any person that goes to Another Country and starts Spouting off about what that country should do is showing how Respectful he is toward anyone , that lets them know who you are ,and most likely what you are because your comments are usually something that is not a real issue for them ,Canada has its socialist problems also ,

    As a Canadian I agree with th “Open Carry” principle. Unfortunately in Canada, Canadians have been conned into believing TWO things:1.) Guns, for the citizenry, are ONLY for hunting animals and 2.) Guns kill, instead of people Kill. This attitude AND con-game has been in existence almost since the forming of Canada and is probably the reason murders in Canada are a lot fewer per capita, than in the U.S., rather than the fact than handguns are virtually illegal ,in Canada. To me, as a Libertarian the RIGHT to own any tool, such as a handgun, in spite of their justification NOT to own same, is GREATER than the quasi security and other rationalizations, gained by “Big Brothers“ violation of my rights

      Roger, statistically speaking Canadians are the third most heavily armed nation on the planet behind Switzerland and the US. By The Canadian governments own estimates there are over 80 million firearms in private hands in Canada, yes that’s right “80″ million.

        Yes I am aware and in fact, I live an area of Canada where I suspect, knowing the towns people, 99% of households have guns of all types, EXCEPT handguns…and guess what – virtually NO CRIME. The last murder was over 5 years ago and it was A HIT concerning drugs….another argument for NO DRUG laws please. House break-ins are non-existent and about one small business ( corner store) robbery per year. NO bank robberies at all.

        Funny how that works eh Roger? I’m married to a beautiful Canuck girl and live in southern Alberta. (home state Arizona) And I was surprised to learn that Canadian law allows for the for pretty much wide open gun ownership. The myth in the US is that Canadians have been disarmed. Nothing could be further from the truth. I was out target shooting yesterday morning (sighting in some rifles) at a public range and standing right next to a group of soccer mom’s who were shooting 300 win mags and 30-06 rifles. They don’t hunt but were enjoying the target shooting for sure.
        I’d hate to be a UN soldier enforcing any sort of police action here…hell the soccer mom’s alone would be some fierce opposition. ;)

    Strongman. NYC does not have the most gun crime and I believe it is somewhere in Mississippi. There are several States that are more “violent” than NY and several cities that are more violent. I posted that months ago so you’ll have to look it yourself. Besides the majority of gun crimes in NYC come from weapons traced to Southern states so deal with the gun runner problem!

      Where do you come from? I’ve been reading your posts here and there is absolutely no substance to any of them. Do you just sit and think of ways to keep things confused and stirred up? Just to make things more understandable, N.Y. DOES have ONE of the highest crime rates in the country. So does Washington, D.C. and so does Chicago, Illinois. There is absolutely no truth to your accuisation that guns in the North are run there from Southern States. In fact, some of the Nation’s oldest firearms manufacturers are in Connecticut. Can you find Connecticut on a map, Eddie?

    It will be very interesting to see the results of a comprehensive study of the crime statistics for this jurisdiction in about a year. A 10 year study that would bookend the years of the open carry ban should prove most instructive and add considerably to the ongoing discussion of the effects of concealed carry/open carry on the crime rates.

    Most nut jobs that have killed many people at one time have done it where they knew they had almost no chance of being shot themselves. The theater, Army base, churches, ect. have been the prime locations. If a nut job checks out his possible hit and sees many guns on persons then the nut job will pursue another location.
    The main negative I see about open carry is the person will be the first shot at by a nut job in a crime scene that the nut job has not cased first.

    In the 80′s I lived in Florida which adopted a gun carry policy. You never heard so much wailing and crying about what the new law was going to do from the liberals in your life. It’s 30 years later, the law is still in place, and the crime rate has dropped. Even the former anti-gun leaders are admitting that the law was a good thing.

    It amazes me how we have let the feminine mind set change how we act in public and how easily we have given up our safety because they are scared to see a gun and piddle all over themselves .In the past it was not the gun you saw that was the threat , hence the laws against concealed carry . Now its completely the opposite , if you are allowed to carry it must be concealed . If a weapon is to deter crime and self protection it should be visible and ready to use . Just being visible is enough to give most criminals pause .

      I hope that by the feminine mind set you are not referring exclusively to women.There are over twenty thousand women in the United States who belong to gun clubs and i suspect a lot more who are weapons educated that we don,t know about,such as i who have been in the use of many types of guns.

    I live in a suburb adjacent to Overland Park (we’re both in the Kansas City Metro on the KS side of State Line.) I was a little surprised to here about this vote – not that they had overturned the ban but that they had a ban on open carry in the first place. Pretty sure KS is an open carry state and a few years ago, a state law was passed which prevented municipalities from defying state gun laws. OP should not have had the authority to pass a ban in the first place. Lousy reporting at local and Lame-stream levels.

    With the millions of rounds of ammunition that Homeland Security has purchased, they and other Obama’s groups, this doesn’t seem like a good idea as Obama’s groups will be able to immediately focus on those carrying weapons. The Obama administration has compiled a llist of all of gunowners.

      I agree with allowing open carry. However, just because I agree with it doesn’t mean I expect all people who carry to carry openly. I personaly would continue to carry concealed instead of open carry myself because that way the bad guys will have more difficulty knowing who is carrying.

        Independent Thinker, I agree with you that it shouldn’t all be open carry. What about women? Are they expected to wear a holster while wearing a dress? What’s wrong about having a gun in a pocket book? Also with only open carry, it might deter criminals from tangling with someone obviously carrying a gun, but that would leave everyone else not carrying as open game! If they had to think that, perhaps this person they’re about to rob might have a gun that they can’t see, it might be more of a persuasion!

        Which is exactly why the 2nd Amendment makes no limitation as to HOW we will bear arms. Yes that is our license to carry concealed in all 50 states. But like any law, if it is not enforced it is useless.

        Bonnie, of “Bonnie & Clyde,” carried a .38 cal. Colt Detective Special taped to the inside of her upper thigh for emergeny use. I suppose she figured the distraction of hiking up her skirt to get the gun would cause enough distraction to give her the necessary time to get the gun and protect herself. Who knows? In any event, one should know where the gun is and how to effectively retrieve it. I feel open carry gives the best presentation and warning to a would be attacker. If they can see the gun and still want to try, they deserve what they get. The only obvious danger in open carry is the possibility of someone seeing your gun and managing to take it away from you. In that case, a holster such as the Blackhawk Tactical holster is the best protection against such an event. That’s what I use for my Glock 23.

    The nest thing that needs to be implemented is a swift death penalty, and a public executions. That will really stop criminals. At least they will think twice, especially when they see people do the walk of death. It is amazing how many people are afraid to die, especially in public.

      Dwight, what law ever STOPPED a crime? in fact, what penalty has ever stopped a crime? For the petty crimes, such as theft and robbery, the criminals don’t think they will ever get caught, and for crimes like murder, and yes, even rape, there is no thought about the law at all. In fact, for those crimes, many times there is no thought, period, or if there is, it amounts to I won’t get caught. The problem with immediate or near immediate death penalties is the plain and simple fact that police, juries, and judges DO make mistakes, and innocent people DO get sent to prison and even sentenced to death. Like it or not, it is cheaper all around to sentence someone to life in prison with no chance for parole than it is to sentence them to death, and the ability to correct an error a few years down the road is far greater.

Bank robbers and convenience store robbers open carry and almost always get away. Even when there are armed guards in the bank or the store owner is armed. Some of you may be right and some of you are terribly wrong. The drug cartels in Mexico and Columbia open carry and even citizens with guns are afraid to confront them(in Columbia). The Taliban open carry and are definitely not polite. Citizens who have guns know exactly who they are yet would never confront them and would certainly lose. Many citizens in Italy had weapons yet the Mafia (nothing more than militias) had even more and were scared to confront them. So if every one in the US was armed only those with the biggest weapon or have more of them would win and they would still be nothing more than vigilantes. The USA like most countries have had a history of crime but it is sometimes hard to tell who is more dangerous. The criminal or those militias and vigilantes. I’m aware there are good patriotic groups and “patriotic” groups who have nothing but evil intentions. I would not want one of the latter to be standing beside me no matter where I was. There is a big difference in protecting ones home and property or even car but enough of these false heroics in carrying where ever you choose.

Are you aware that when the 22 plus states allowed concealed and open carry,, by licensed ordinary citizens the crime rate unilaterally droped between 18 and 28 percent on average. That means some states were even as high as 40 percent. The problem with your way of thinking is that Police are there to bring the criminals to justice after violent crimes perpetrated against the citizenry. They do nothing to prevent violent crime. With regard to New York, the Sullivan Law has been in effect since 1911: The Sullivan Act, also known as the Sullivan Law, is a gun control law in New York State. Upon first passage, the Sullivan Act required licenses for New Yorkers to possess firearms small enough to be concealed. Possession of such firearms without a license was a misdemeanor, and carrying them was a felony. The possession or carrying of weapons such as brass knuckles, sandbags, blackjacks, bludgeons or bombs was a felony, as was possessing or carrying a dagger, “dangerous knife” or razor “with intent to use the same unlawfully”. Named for its primary legislative sponsor, state senator Timothy Sullivan, a Tammany Hall politician, it dates to 1911, and is still in force, making it one of the older existing gun control laws in the United States.

        Also, for your info New York has the highest guncrime stats in the US. So much for Bloomberg and his radicals trying to disarm the public. Guns for the Criminals, casets for the Victims. THat’s one way to beat rent control.

        Yes, Eddie47d.The American Revolutionaries were open carry too.In fact Samuel Adams was much feared by the British because of his open carry reputation.Thanks God that we had those men in the past with the bravery to open carry.With your kind of cowardice we would still be a British Colony.

        Open carry should be one of your basic, fundamental God given and Law confirmed rights. If it isn’t, then you need to organize by starting up a group to demand your legislators to introduce such a Bill to get it into law. Start by going to your Gun Shops, automotive parts stores and all places where people who love and own guns go……every one in the State and set up petitions to be signed by everyone who enters these stores. Then take these petitions to your State Legislators and demand that a Bill be drafted and sponsored into the State House for passage. Your voices have to be heard or you oust these politicians on the next go around.

      Toting guns and using guns are very different issues.My family enjoyed hunting which made using guns properly an important issue. i spent a career in the US Army where I learned a lot more about how to use weapons. Yes, we are livng in a free country but arming the people is not the answer– some people can not ever be sensible re the use of guns.Yes, I have a pistol in my car and in some instances I hook it to my belt. I do feel comfortable with the fact that I do have my own self protection if I really need it– but 200 million gun tooting citizens is not the answer!!!!Ron

      I can vividly remember when Arizona voted to allow open carry and concealed carry without any permit. My brother, a Maricopa County Deputy at that time, made the comment about how road rage and domestic violence had gone down considerably. Perhaps the people in Illinois, N.Y. and D.C. are completely disconnected with the rest of our contry…………or perhaps they have another agenda for their citizens. This can only serve to prove that American complacency is alive and well and continuing to ROT the soul of freedom.

      With the rise in murder and random shootings in some of our inner cities by gangs and druggies that rob to feed their habit I feel it is necessary for the average person to be able to protect themselves. With a open carry you don’t look like an easy target for the thug that is looking for an easy score. Thanks to the people that made this possible for their level headed thinking, it has given us the protection that the second amendment was meant to give us.

      I’ve been told since this open carry law was enacted that Kansas already has open carry on the books, and the city of Overland Park just decided to become constitutional. Wow -already on the books? I live in KS myself and have a CWP -I surely wasn’t aware of this. I’ll have to do some homework- if this is true I’m going to make an issue of it in the city where I live- it’s a lot more dangerous than Overland Park.

      Israel is one of the safest places to be, soldiers there carry their weapons with them, that made me feel safe, women and a lot of other people carry and very few rapes. I love a country with common sense.

        They are on occupied territory or the Palestinian people, who happened to do nothing to the Jews in WWII, yet THEIR land was stolen from these people. You should really read up on what it is that they did to the Palestinian people over the years, and how they treat them and Christians and Muslims.
        Perhaps it should make you feel better that Israel has control of all our data that is being collected. Or that many of the Christian killers from the USSR were able to flee any form of persecution for their heinous crimes by fleeing to the newly created “state of israel” because they were Jewish.

        By the way, the Aurora shooter was Jewish. The Columbine killers were Jewish (and their Trench Coat Mafia were also Jewish). The Natalie Holloway killer was Jewish. The screwdriver killer on the east coast was Jewish…. and etc, and etc, and etc. Many of these different people have been allowed to get away with their crimes.

      Robert Holmes (Aurora shooting) also open carried and he wasn’t very polite! Now don’t go all NRA on me and make somewhat false claims that if others were armed it never would have happened. It still would have happened and any more guns blazing would only have killed or injured more people. That killer in NYC also opened carried and didn’t give his victim any chance to react. Even if the victim had a weapon there was no time to use it. Then the well trained cops show up (also open carry) and blasted away at the perp thus injuring 8 people. So instead of having one dead body they ended up with I believe 10 who were hit. I’m sure there are also stories of guns saving the day but lets put the masochism away and look at each side of open carry.

The actual events that would have happened had the victims been allowed to carry firearms (Remember the movie theater was a self proclaimed “Gun Free Zone”) is that either the Aurora shooter would have found a gun-free zone to play in or he would have been shot down by one or more citizens exercising their GOD given right to defend themselves and their community.

        As to the NYC shooting, Mayor Bloomberg needs to get some REAL gun control policies for his police

Over 1 million crimes in progress are stopped by private gun owners each year but the media you watch daily only reports the nutjobs who occassionaly go out on a murder rampage while neglecting the many more times a day a priavet gun owner stops a violent crime!         Contrary to popular belief in the 6 years that Dodge City was up and running, only six people were shot dead. And all of them by law enforcement. The “Wild West” wasn’t nearly as Wild as Hollywood would have us believe. Why? Because almost everyone had a gun and drawing one would get you a lot of attention very quickly.

      I agree, as carrying levels the playing field. Don’t get too complacent on the issue as
      the UN mostly Russia and China have a treaty with the US signed of course via executive order as usual by Obama …..to disarm us, the citizens of the USA. Sen.
      Rand Paul of Ky had been fighting this issue, it waxes and wanes and resurrects from
      time to time, so if the issue is important to you, you might want to check from time to
      time on where that signed treaty now stands.
