On Thursday, the House voted to hold Attorney General Eric Holder in contempt of Congress.

The House of Representatives is about to vote on whether to declare Eric Holder, our Attorney General, in contempt of Congress. And by the time you read this, the Supreme Court will have issued its long-awaited ruling on the Constitutionality of Obamacare.

Unfortunately, I’ll have to wait until next week to comment on both events. Thanks to publishing deadlines, I have to finish this column before the House takes its vote and the Court renders its verdict.

But I don’t have to wait another minute to predict that it’s just a matter of time before Holder is no longer our Nation’s top law-enforcement officer. While the list of unConstitutional excesses by this Administration is longer than both of my arms, Holder’s bungling mismanagement of the Fast and Furious crisis, followed by his outright defiance of Congress, is reason enough to color him gone.

What’s gotten lost in the whole contrived controversy over Holder’s claim of executive privilege is how this uproar began. In 2009, someone in the Bureau of Alcohol, Tobacco, Firearms and Explosives approved plans to let some 2,000 illegal weapons in the United States get into the hands of a Mexican drug cartel. The idea was to track where the guns went, so they could nail some drug kingpins.

A bad idea went terribly awry in 2010, when Border Patrol Agent Brian Terry was killed in a shoot-out with drug traffickers. A firearm found out at the scene was traced to the botched Federal program.

Congress decided to investigate how this whole mess happened. And that’s when Holder’s Justice Department made a huge mistake. It sent a letter to Congress in February 2011 flatly denying that any such program ever existed.

The House Oversight Committee didn’t buy it and demanded to see various reports and communications. One of the items that subsequently came to light was an email in March of last year from then-acting ATF Director Kenneth Melson urging the Justice Department to “back off the letter.” But it took another seven months before Holder’s agency acknowledged the existence of the Fast and Furious program and admitted its previous claims weren’t true.

That would have been a very good time for Holder to abide by the old maxim, “If you mess up, ’fess up.” Instead, he took the opposite tack and dug in his heels. So far, Justice has given Congress only a tiny fraction of the documents it has requested, insisting that all of the others are somehow protected by executive privilege.

Claims of executive privilege can apply when you’re talking about communications between the President and the people who work for him, such as the Attorney General. But not when you’re trying to keep a duly constituted Congressional committee from learning about communications within a Federal department.

In a lead editorial last week, The Wall Street Journal noted the curious contradictions and dangerous implications of what’s happening here:

Did White House officials know and approve Fast and Furious before it went awry, and did they advise the Justice Department on how to respond to Congress’s investigation into the operation’s failure?

How can the President invoke a privilege to protect documents he and the White House are supposed to have had nothing to do with?

And what is so damaging or embarrassing in those documents that Mr. Obama is now willing to invest his own political capital to protect it from disclosure—at least until after the election?

The last three words contain the key to the current unpleasantness. Obama would like nothing better than to put off any resolution until after Nov. 6. And I think it’s safe to assume that Holder would like to keep his cushy job for as long as possible. Who could blame him?

If a majority of House members do vote to hold the Attorney General in contempt, then what happens? It would be up to a U.S. Attorney to prosecute the case — which means he would be prosecuting his own boss. Does anyone see a potential conflict of interest there?

On the other hand, Holder could order the U.S. Attorney not to prosecute. Wouldn’t Republicans have a field day with that one?

Unless Republicans in the House agree to meekly back down (something I don’t see happening), it won’t be long before Holder is gone. Some 115 Republican members of Congress have signed a no confidence resolution against Holder. Dozens already called for his resignation. Several members of the Senate, including two members of the Senate Judiciary Committee, echoed that demand.

Holder has been very obliging in the past about doing whatever his boss in the White House wanted. This included refusing to enforce the Defense of Marriage Act and declining to prosecute New Black Panther Party members who were caught on tape in November 2008 trying to intimidate voters.

So I have no doubt that when Barack Obama wants to shove him out the door of Justice, Holder will quickly oblige. As I said before, you can color him gone. But don’t get me wrong. This doesn’t mean that justice has been done at Justice. We’ve got a long way to go — at least until January — before that happens.

    And we havn’t seen the end of this unlawful action as long as we have ilegals in hi places. Especially after we opened the voting booth to apes , coons ,and possums that dont even have to be a citizen or pay taxes. Vote for some imposter , not even fitting the criteria given by the constitution to be potus and the overwhelming vote buying with wellfare and food stamps.. There are more stupid people than ones with the ability to reason than you think.

      Good point Shirley. I thought FEMA stood for Federal Emergency Management Administration or something like that. Last I knew of them doing anything to help anyone was helping all of the black folks in New Orleans after Katrina. Here we are in Colorado with fires everywhere, close to 400 homes burned to the ground, people displaced with not much more than the clothes on their backs and what are we hearing from FEMA? nothing! It appears to me that FEMA only responds to an emergency when it suits the government and their agenda. We’ll see what happens today. Obama is on his way here to survey the damage. There are people here who plan on telling him that we need Federal assistance financially. We’ll see how he handles the situation. Could be that FEMA’s new job is NOT helping in emergencies like this but only in uprisings against the government as has been predicted.

        FEMA says we will help by evacuating everyone to our protection camps; we have stores of food for just this sort of situation. You will stay until things, the killing etc., dies down.

    Chip you better be careful with using the words “color him gone”. You know a lot people might take that as racist. Never mind that justice is supposed to be blind – in AG Holder’s world she’s always peeking under that blindfold to see what skin color the justice is for. I think he’s being told to cover for the real mastermind of the FF game and that it is someone in the White House who was calling the shots. It’s time to get some of the lower players to roll on the top by offering immunity (etc). At least now with a civil contempt a judge will be able to peruse the documents that Holder’s claim are protected by executive privilege. We will see won’t we; although I know it won’t be today but there is no statute of limitations on murder.

    First of all, let’s get one thing straight. The plan was NOT to track where guns went as stated in this article. There is absolutely no way to track a gun once it is in the hands of anyone unless there has been a tracking device, such as a micro-chip, installed in the weapon so that it can be electronically tracked just like in the spy movies. No such tracking devices were installed in any of these weapons. The whole agenda for this botched operation was to provide the Obama administration with evidence that American gun dealers were selling guns to drug cartels so that Obama’s anti-gun people could convince American voters to pass more gun restrictive legislation to further impede our freedoms to bear arms. THIS WAS THE AGENDA AND THIS WAS THE PURPOSE OF OPERATION FAST AND FURIOUS. Do not try to call it anything other than this. Thank God for individuals within the BATF with a conscience and moral fiber and with the intestinal fortitude who came forward to expose this Federal scam. It is sad that it cost the life of one of our brave and courageous officers, Border Agent Brian Terry, and even now, in the shadow of this loss of life, the Obama admistration is trying to justify its outrageous act of deceipt by imposing executive privilege. To me, this is an obvious admission of guilt on the part of this counterfeit President. A continuation of cover-ups just like all the others that continue to follow everything about him from his scholastic records, birth certificate to his illegal social security card to his forged selective service card. Everything about this administration stinks of corruption.

        The National Debt has now increased more during President Obama’s three
        years and two months in office than it did during 8 years of the George W. Bush
        presidency.

        The Debt rose $4.899 trillion during the two terms of the Bush presidency. It
        has now gone up $4.939 trillion since President Obama took office.

        The latest posting from the Bureau of Public Debt at the Treasury Department
        shows the National Debt now stands at $15.566 trillion. It was $10.626 trillion
        on President Bush’s last day in office, which coincided with President Obama’s
        first day.

        The National Debt also now exceeds 100% of the nation’s Gross Domestic
        Product, the total value of goods and services.

        Mr. Obama has been quick to blame his predecessor for the soaring Debt,
        saying Mr. Bush paid for two wars and a Medicare prescription drug program with
        borrowed funds.

        The federal budget sent to Congress last month by Mr. Obama, projects the
        National Debt will continue to rise as far as the eye can see. The budget shows
        the Debt hitting $16.3 trillion in 2012, $17.5 trillion in 2013 and $25.9
        trillion in 2022.

        Federal budget records show the National Debt once topped 121% of GDP at the
        end of World War II. The Debt that year, 1946, was, by today’s standards, a mere
        $270 billion dollars.

        Mr. Obama doesn’t mention the National Debt much, though he does want to be
        seen trying to reduce the annual budget deficit, though it’s topped a trillion
        dollars for four years now.

        As part of his “Win the Future” program, Mr. Obama called for “taking
        responsibility for our deficits, by cutting wasteful, excessive spending
        wherever we find it.”

        His latest budget projects a $1.3 trillion deficit this year declining to
        $901 billion in 2012, and then annual deficits in the range of $500 billion to
        $700 billion in the 10 years to come.

        If Mr. Obama wins re-election, and his budget projections prove accurate, the
        National Debt will top $20 trillion in 2016, the final year of his second term.

        That would mean the Debt increased by 87 percent, or $9.34 trillion, during his
        two terms.”

        Sharon, did bush “bungle?” 69 million Americans in 2008 thought bush had “bungled” and a lot of us, especially those who lost their jobs under bush or later as the recession deepened, think that we are still suffering from his “bungling” and it may take years to get over the bush bungling!         Somehow I feel a little more confortable with the Dow above 12,000 NOW as opposed to the below 7000 it was at the depth of the bush recession? Same for the S&P!!!How do you feel about that? However, legislation creating that recession was initiated by Nancy Pelosi and Harry Reed, then accelerated under Obama. (You may recall BOB laughing about the lack of shovel ready jobs during a news conference) Further, Obamas multiple stimulus bills and the railroading of Obamacare capped hiring and deepened the recession.
        Now Sharon do you realize the majority of jobs lost during the Obama admin were among women???? Bet you don’t know that. So, Sharon who do you think economically harmed women ( as in the “war” on women) …. non other than the lord, dictator in chief BOB.

        Economists are generally agreed that the Depression was lengthened and deepened by FDR’s socialist policies. Just as Obama is doing with the recession they say no longer exists.

        As for those without work, ask them whether or not we’re in a recession.

      Many people voted for Obama because they were encouraged by his energy and his promises and also disillusioned by President Bush. It had nothing to do with the fact he was half black. They voted for him because they believed his promises and they were duped as the Emporer has no clothes. Anyone who votes for him again is foolish or stupid. Has nothing to do with his being half black. He has no substance. When minorities groups get over whining about race, they will move ahead. Women did just that with affirmative action. They didn’t cry and pout every time they were slighted or discriminated against. They took their lumps and moved ahead. They became lawyers, doctors, stock brokers, business people, politicians and worked within the sytems. Now no one thinks having a woman doctor or lawyer or accountant is unusual. Go to school and get good grades, work while in school, go on to college, dress decently, bag the drugs, don’t drive like a maniac, learn manners, pay your debts and the world is yours!!

Of course, that would make your namesake very happy, as his original sponsors would then RUN the country, the way they ran a good number of cities for a long time. Most times this is justified as in eddie47′s case but occasionaly a perfectly innocuous post goes to moderation because of a hiccup in the system. In the latter case if you politely call Mr Livingston’s attention to it he will get it corrected as quickly as he can.

Firing or resignation are not enough , arrest , trial and conviction are the only justifiable actions . And Barry Obama needs to be replaced along with Holder , arrested and tried right along with him . Should it be determined that he is an illegal president , then charges of treason should be brought against them .

Valerie Jarrett (who pretty much is a Muslim and responsible for much of the leftist policy from this White House) said no, he can’t quit, it’d look bad for the Obamation. Frankly, Holder’s inevitable contempt citation from Congress I predict, will fare much worse for King Obama come November, when voters rightfully kick the trash to the curb! So, despite the fact that a border agent lost his life tragically in this bungled fiasco of incredible proportion, there is one small silver lining to the whole deal.

If Obama can control the outcome of a supreme court ruling how far do you think we are going to get with convicting Eric Holder or getting the ” executive privilage ” documents on Fast and Furious?
    This is only a dog and pony show the republicans are putting on because they can’t do anything else. Only way to nail Obama or Holder is to vote in another president with some testicalar fortitude. Then bring them both up on charges of treason.

      If Obama is not re-elected, he would most likely issue a pardon before inauguration of the new president. If he is re-elected, he has the luxury of time in that he could let the investigation, Grand Jury deliberations and indictment play out before he either throws Holder under the bus, or ultimately pardons him.

      Given the disrespect for the rule of law that Obama cherishes, he could even pardon Holder the day after he is re-elected, thereby nullifying any subsequent legal action during a second term.

        In case you have any doubts, please refer to AG John Mitchell’s prison time spent for EXACTLY the same actions Holder and Obama are taking now. Once again, executive privilege does not, and never has, extended to information involving a coverup of illegal activity.

From what i understand, no documents as to any BshII operations under the program have been asked for. In fact, such offerings have been refused. Holder and the AGs office did turn over everything up through Oct. 2011. What remains are those communications from Oct through today. Is this correct?

        Next..party line votes on the subpoena for the most part. Suspiciously looking like partisan politics witch hunt doesn’t it?

        Flashy, I believe the subpoenas cover the inernal memos and e-mails within the DOJ subsequent to the February 2011 letter. To quote Mr. Wood, “…Holder’s Justice Department made a huge mistake. It sent a letter to Congress in February 2011 flatly denying that any such program ever existed.”

        That, combined with insider tips and Holder’s nine appearances before the House/Senate in which he was caught in lies about when he first knew about F&F, are not smoking guns but present a reasonable doubt about the forthrightness of the DOJ. Add to that the exertion of executive privilege, which is tantamount to a coverup of either Holder’s actions, Obama’s involvement, or both, and you have a basis for investigation.

        Although Committee vote was purely along partisan lines, 17 Democrats in the House crossed party lines on the contempt vote.

        Iran Contra proceeded to appointment of a special prosecutor, Judge Lawrence E. Walsh, in the absence of any “smoking guns.” The prosecution was largely unsuccessful, in part due to immunities and divulgence of damaging information during the pretrial Congressional hearings.

        You may decry the “witch hunt” aspect or playing of politics during an election year. But you then must also remember the impeachment of Bill Clinton, in which conviction in the Senate was roadblocked by a purely partisan Democrat vote after perjury was proven. It was not Ken Starr, it was the Democrats who wasted “tens of millions of dollars for nothing.”

The operational portions of both Wide Receiver and F&F are already known, and as Jay Carney said, those pertinent documents have been provided. Sufficient legal doubt is present, and the executive privilege throws gas on the fire, ot doesn’t douse it.

        Unfortunately for this country, this may very well be of national security as the entire operation was conducted without the Mexican government being informed. Now that more than 2,000 weapons have crossed the border into the hands of suspected drug cartels without permission or involvement from the Mexican government and resulted in hundreds of Mexican civilian deaths, this could very well be considered an act of aggression against a sovereign nation.

        Obummer knows this and that is undoubtedly why he has protected them from going public. Don’t get me wrong, I in no way agree with this Imposter-in-Chief or his race baiting AG Holder.

        And if you and others like you are truly Liberal, and truly believe in Liberal causes like social programs, gun control, “fairness”, etc., then you’re going about it all wrong attempting to defend this administration at every turn. All of these utopian ideals Liberals want simply don’t mesh with what this administration has been doing, and Liberals need to admit this. Then maybe, just maybe Liberals can engage Libertarians and Conservatives in a truly honest dialogue between mature adults about how to accomplish some sort of middle ground. But as it stands, Fast and Furious walks like a duck, looks like a duck and quacks like a duck, and the Alan Colmes’ of the country keep trying to call it a Platypus.

        Operation Fast and Furious was pure and simple a sneaky attempt by a bunch of arrogant bastards to manufacture a crisis in an attempt to weaken the Second Amendment. Only they handled it like the Three Stooges and it blew up in their faces. And no, I don’t have solid proof, but most reasonable, honest people with a modicum of common sense can connect the dots. It’s time those people on the opposite side of the political isle admitted this scam. Then, like the Democrats said in the 1990s, we can all “Move On”.

I hope our Representitives are on the ball, aand get this stopped. Treir are 130 signatures on a letter to the Pres. that are trying to do just that. But that won’t be enough.

The basic ethics, integrity, and honor of the modern society is based on the socialistic feel good values of the sixties hippies. This Nation is so far gone that I don’t see a return to the good old 50s as a viable probability, ever.
