Two years ago, a woman named Elizabeth Lloyd sat down at a picnic table next to a Little League field in Manchester Township, N.J. Not long after, an 11-year-old catcher named Matthew Migliaco began warming up a pitcher in the bullpen next to Lloyd. And then, tragedy struck. Well, perhaps not tragedy. Tragedy implies human suffering on a grand scale. Had young Master Migliaco suddenly fired a rocket-propelled grenade at Lloyd, that would have been tragic. If the young backstopper had lept the fence with a bat and set to Lloyd the way Trayvon Martin — ahem, allegedly — set to George Zimmerman, that would have been tragic. No, what happened was purely an accident. An errant toss by Matthew hit Lloyd. Oops! A bad throw by an 11-year old. Bummer. The normal response would likely entail wincing, spitting out a stream of verbiage one would normally want to keep from using next to a Little League baseball field, an angry return throw and then a trip home to put a bag of frozen peas on the affected area.

But Lloyd is one of an increasingly large number of Americans who thumb their rhetorical noses at “normal” on their way to the courtroom. Two years after Matthew accidentally hit her, Lloyd and her husband are demanding $150,000 for medical costs and punitive remuneration for pain, suffering and something her husband, a party to the suit, calls a loss of “services, society and consortium.” I’m no lawyer, but I’m going to guess that means Lloyd, once viewed by her husband as the Gisele Bundchen to his Tom Brady, is now less appealing to him than a week at a nudist colony with Roseanne Barr.

Lloyd took a baseball in the kisser while sitting next to a baseball field in use by a group of 10- and 11-year-old baseball players. As anyone who’s watched The Bad News Bears is already aware, 10- and 11-year-old baseball players tend not to possess the talent — much less the aim — of Derek Jeter. Therefore, sitting next to a field on which a game between two teams loaded with the best talent the local plumbing-supply house can sponsor would carry with it what one lawyer friend of mine described as “an assumption of risk.”

Yet Lloyd believes Matthew targeted her with the malice of Randy Johnson staring down a rookie who’s crowding the plate, and she and her husband managed to find a lawyer willing to charge the proverbial mound. Their attorney is the kind of roach-with-a-briefcase who illuminates the reasoning behind Shakespeare’s famous line from Henry VI, Part II, Act IV, scene ii: “The first thing we do is kill all the lawyers.” The Lloyds’ lawyer is merely the latest in a long line of ambulance chasers who tear this country apart bit by bit — another galling example of the parasites who ply the emergency rooms and emblazon bus stop benches and phone book covers with their grinning mugs, looking for their next slip-and-fall payday.

These are the foot soldiers in the liberal campaign to turn us into a Nation of squabbling twerps who can turn even the most innocent mishap into a battle royale of mistrust, resentment and recrimination. While the Lloyds’ decision to abduct Matthew’s innocence and dump it in a ditch is appalling, it’s hardly isolated. Of course, the granddaddy of all idiotic lawsuits would be the infamous case in which a woman sued McDonald’s after she spilled hot coffee in her lap and burned herself. That she won close to $3 million is testament only to the perverse courtroom skills of her attorney and the frighteningly high number of exceptionally stupid people in the jury pool. Perhaps the most famous of the practitioners of this sort of law would be former Democratic Vice Presidential nominee John Edwards, who made an estimated $50 million pile while convincing juries to reward his clients for all manner of questionable ills.

And the Lloyds’ lawyer, much like Edwards and the rest of their legal-beagling siblings, are sucking the life out of us all. When someone takes the case of Lloyd vs. Migliaco, America’s Pastime, et al., a little of the joy in all of us dies. Baseball fields get shrouded in protective rubber matting to protect picknickers. Then the players themselves get wrapped in the stuff as well. Baseball begins to (as an 11-year-old might put it): “like, totally suck big time.” They go home and play Xbox all day. They get fat, and then their parents sue Microsoft for making the Xbox. Little League folds, and the commissioner gets so upset that he spills his coffee in his lap and burns himself. He sues McDonald’s, and the cycle continues.

Someone sits down next to a Little League field, gets hit by a baseball and sues the ballplayer. Someone else spills hot coffee in his lap and sues McDonald’s. Someone else slips in your driveway and sues you, the driveway contractor and anyone else their attorney can hit with a tsunami of paper.

Don’t mistake my intent. I would part with The Bard and acknowledge that not all lawyers need killin’. Beyond the defenders of decency in the civil courtrooms, our justice system needs someone to stand up for society in the criminal docket as well. If we abandon the legal profession to the Johnny Cochrans of the world, who will guide the jury to recognizing that the only real choice should have been about into which of O.J. Simpson’s arms to stick the needle? In fact, the Simpson murder trial is a perfect example: Simpson had the master showmen Cochran and Robert Shapiro. And justice retorted with Marcia Clark and Christopher Darden.

We need decent people to stand in a courtroom when one of Edwards’ colleagues demands $3 million for pain and suffering caused by spilled hot coffee to respond with a legally appropriate version of: “The plaintiff is a doofus.” For every Edwards, we need an Antonin Scalia to talk the jury off the roof. For every ambulance chaser whose chosen profession has pushed malpractice insurance — hence, healthcare costs — into the stratosphere, we need a dignified jurist to remind people that “yes, the patient has a reduced quality of life following his heart surgery, but he is alive, and it’s a good thing the surgeon didn’t go to law school instead.” And for every Elizabeth Lloyd and her attorney, there must be someone with an understanding of both basic decency and the law who can stand up and remind the jury that she was sitting next to a baseball field on which 11-year-olds were playing — of all things — baseball, a sport in which baseballs are routinely used and often leave the field of play.

It would be a dereliction of duty if I didn’t note the political bent of the sort of people who sue Little League baseball players when their clients are hit by flying baseballs. They’re the same attorneys who filed the lawsuits against McDonald’s for hot coffee and the same who filed suit against McDonald’s on behalf of parents with fat kids. They’re Edwards, Cochran (were he still alive) and Shapiro. They’re also Attorney General Eric Holder and President Barack Obama. They bend, twist and deform the law to assuage their greed for money and/or power. And they crush the dreams of Little League players, force doctors into the poorhouse, deny justice to murder victims and diminish the quality of the lives of virtually everyone with whom they cross professional paths.

Even if Matthew successfully fends off the Lloyds’ abominably frivolous lawsuit, they and the lawyer who took their case have stolen a big chunk of Matthew’s childhood. We all lost a little bit when Matthew was served with the papers for this suit. We all lose a little bit every time some lawyer plays the lawsuit lottery like this. All of us, that is, except the lawyers.

Maybe Shakespeare was right all along.

    but this is survival of the fittest, is it not. per supreme court directive kids have been taught evolution in school, that they really came from gorillas, baboons or apes (they’re still working on which one, stay tuned), and that one must dominate or die. so they graduate (after cheating and plagiarizing) and become lawyers, bankers, senators, mbas and executives and all of a sudden they’re supposed to be altruistic?

    Omg I actually grew up in that crappy town, I have since moved out of the communist state of NJ. This is a sad example of the dirt bags at the top who do this kind of thing to the American people! Liberals are poison to this country! They have ruined that state and the whole north east! Now the whole country is getting a taste of the evil these people spew. We have to have a loser pays cost system like most other countries. Until we do, this type of thing is going to just keep getting worse! And Ofcourse get rid of king dirtbag in the white house!

      I was born and raised in NJ and would seriously consider moving back if I could afford it. I will always stick up for my home state. (although Manchester Twp. is probably considered more to be in South Jersey, which is a different state.). No matter where you live, it’s only as good as YOU make it.

    It gets worse. Rapists sue their victims. Burglars sue home owners who they robbed because they got hurt there while committing the crime. I hear of dog owners being sued by home invaders because the dog bit them defending the property. Such is the system we label “Justice”.

      True story. This happened to a friend of mine. He has a large dog for his kids. It can jump his fence but don’t while he is home. When he is not home, he chains it to a tree in his yard to prevent it from getting out.

      He came home one day to find where someone had plowed into the fence with a vehicle. The dog was running loose but was still on the chain. He called the police – who told him the following.

      A man driving by saw the dog and decided it would make a good dog to enter in dog fights (illegal). He deliberately ran his truck into the fence to knock it down so he could get in. Then he unchained the dog from the tree. The dog wouldn’t follow him, so he began to whip the dog with the loose end of the chain. The dog finally got mad and bit the man who jumped in his car and left. He went to the police and wanted to file a complaint so he could sue my friend. Instead, after hearing his story (he told all of it) the police arrested him for damage to private property and attempted theft. The thief didn’t think that was a bit fair. So far he hasn’t found a lawyer stupid enough to take the case.

      Wit, is there a “system” of justice that you would like imperfect humans to oversee? WE could have a system of “justice” that chops off hands of children for stealing! Stones to death women that their husbands don’t trust! Jerks you around because you don’t follow the “majority” religion that you don’t adhere to! There are a lot of “systems” other than ours!
      I was connected to the court system for 35 years and juries and/or eIected judges got it “right” in my opinion well over 95% of the time! It was not always “swift” nor was it always popular but it was about as good as imperfect humans can get it! In other words, our system ,while not always perfect, beats h*ll out of the system in second place! It always need minor adjustments but NEVER REPLACEMENT?

        If it wasn’t for the corruption and the lack of justice for the poor, ours would be the model system! Justice has become for sale in this country! You go back to the old Jewish laws in the Old Testament and impartiality was STRESSED!!! The taking of bribes severely condemned!         What about the death penalty moratorium in some state(s) due to innocence of the people incarcerated there?

        What about the Texas 26, found guilty on the subsequently discovered lies of a paid informant who the judge in the case refused to either retrial or release?

        What about defence lawyers being allowed to propose totally ficticious stories to try to show innocence on the part of guilty defendents?

        The judicial system is corrupt and is supported by judges, prosecuters and defence lawyers for their own gratification. I personally don’t happen to think it is the best in the world – it’s probably no better than many other systems, though a lot better than that operated in some dictatorial countries

      Wrongo – we label it Law, from which justice may or may not follow. Unfortunately, that notion is immaterial to our courts – but nicely portrayed in the form of a blindfolded statue.

    Unfortunately, the remember about the number of idiotic people in the jury pool, happens to be so true. I know this from personal experience. I said on a jury years back (the first jury I had ever sat on) and it was a civil lawsuit type. Having to do with contract law. There were six of us. The other five had no idea what was going on. I ended up explaining the basics of contract law to them. I ask them how many had credit cards, they all did. I said well you signed a contract when you got your credit card. But they all had this glazed look in their eyes. Finally one of them asked me how I was going to vote. I told them the case against the party being sued had not been made. They actually voted the way I told them, too. And that was a sad day to me!

      At least they listened to you. A friend served on a jury trying an injury suit. There was a train car (flatbed) with telephone poles. The poles were banded together, they were set between uprights to keep them from rolling off, and they were chained to the rail car. A man where I worked went out (without orders) and removed all the restraints. He testified that he tried several things to get them to roll off the car including jumping up and down on top of them. Finally he found a timber hook and rolled a bottom pole off on top of himself. Others then rolled off onto him too.

      Because it happened at work, he was placed on Workman’s Comp even though he had done this without permission, etc. He was ruled an invalid and all medical expenses were covered and he received a check he was to get the rest of his life. A lawyer convinced him to sue the company that provided the poles for not sercuring them well enough to prevent this “accident”. The jury my friend was on only needed a partial jury to find the company guilty. My friend tried to convince them that it was his own fault – and all agreed. But the rest decided that he deserved the money since he was hurt and “the company has plenty of money and can spare some”. They awarded him $150,000. The insurance got one third to cover their costs for medical treatment and he lost all Workman’s comp. Further, the lawyer got one third. He received $50,000 to do him the rest of his life. The only one who benefited was the lawyer.

    This Lady is a well know New Jersey photographer and the extent of injury to her face is not clear. At 45 did it kill and discolor her teeth? Who knows?

    Chances are it was a lob ball and not much “heat” applied to it, by a 11 years old, it didn’t come off a bat. Still, that would hurt and do damage.

    Well, that is what our court systems are for. ~ right?

    This will affect all organized sports and insurance companies with this legal search for liabilities.

    Where one waives ones rights at such an event or someone accept liability, the courts will decide.

      Do you know why our church will not build a playground for the kiddies?! LAWYERS!!! You see a lot of that these days, nothing for the kids to play on because everyone is scared to death of a law suit!

        As an MD with 7 years of training, if I no longer had a license to practice medicine, folks would ask “why?’ Did I do something very wrong? Was I convicted of malpractice? Did I break the law in some significant way?

      I could be wrong but if Dr. Corsi’s book “The Obama Nation” is correct, I’d say it had to do with an illegal real-estate deal that the two of them concocted with their FRIEND, one of the South Sides biggest slum lords, Tony Rezko. Something to do with the zoning of a vacant lot ajacent to their Chicago home.

    For the record, the context of the Shakespeare line was not that lawyers should be killed because they were evil, but that lawyers should be killed because they would be the ones to oppose government overreach. As Dominic says above, ‘lawyers are the last bastion of the police state.’ While many lawyers are deserving of scorn, a lot of them are doing some of the most important work in the fight for liberty. Don’t be surprised if the supposedly evil ACLU is your strongest ally in future fights. They end up on the right side more often than conservatives like to acknowledge. They were even on the right side of Citizens United.

    Simple solution that no one seems to be willing to take on. Probably because most of our politicians are lawyers first. Loser pays. The loser in the lawsuit pays all costs for the the winner, court costs….everything! That would at least take care of the lawyers who file numerous lawsuits every day hoping just one will settle out of court and pay them a good living for being a leach. When there is no risk why not go after the free money. Oh wait, that would put too many lawyers out of business and free up our courts for legitimate purposes. What on earth was I thinking!

      Dan Quail once gave a speech to the American Bar Association. In it he specified three things that needed to be done to control the court suits. The first was to put a maximum penalty price to law suits. The second was to make losers pay the court and law fees costs of the winner. I forgot off hand what the third items was. He was almost riden out of town on a rail since all there had made their living by suing. Most damage suits will pay the actual costs and a penalty cost. The penalty cost might be in the millions. With the loser NOT paying the costs, most frivilous cases are settled out of court for a few thousand dollars, which pays the plaintiff to sue. If it actually went to trial the plaintiff would lose – but wouldn’t have to pay anything even to his own lawyer (who is pay 1/3 to 1/2 of the money won) while the victim would have to pay everything. If the loser had to pay, no one would sue for stupid reasons.

    As the article points out, by suing Mathew the Lloyd’s have inflicted both monetary and psychological damages on him and his family. If they win, they get paid. If they lose, their only risk is the lawyer’s time on the case. So assuming a given percentage of losses and wins, over the long run, the sue-er’s side wins; not unlike the way the House at the casino always wins in the long run. The problem with this system is the sue-er and her attorney have nothing to lose. People would be much less likely to sue over such trivial matters if their loss required them to pay damages and all expenses to the parties they sued. And lawyers would be much less willing to take such trivial lawsuits if they were required to pay the defendant’s attorney fees.

    There once was a plane crash here in the city where I live. The only survivor was an attorney. The reason he lived? No slot available in hell that day.

    But seriously folks….I spent 10 years of my childrearing years at the little league ball park. I’ve been hit by flying baseballs, had my car window smashed by flying baseballs and the logical solution is this…if you don’t want to get hit don’t go to the ballpark or at least learn to dodge.

    Oh, so if a corporation makes money it is all right to sue? Where does the responsibility of the person who is sueing come in? The woman who sued McDonalds had a responsibity not to place the coffee in her lap while driving. That makes her to blame, not McDonalds.

      True, but lawyers have tried to make our society one where no one is responsible for his or her own actions. They are trying to establish as law the principle that if someone is hurt for any reason, someone has to pay. The biggest problem is we have turned the law over to lawyers and judges – two of the most corrupt groups in our country. It is time to take their power away from them.

        Bob:

        Some years ago I was told of a law that was passed in the late 1700s – after the US was a nation. Many judges were ruling (like the British judges did) without regard for the law. Their judgements were determined solely by their acquaintence with those in court.

        The new law stated that if you felt that your Constitutional rights were ignored, you had a chance of redress. You would make three copies of a letter addressed to the judge, informing him that you felt your rights had been ignored in his decision and requested him to explain why your rights had not been ignored or that he would correct that problem. You would take the copies to the County Clerk who would notorize them. He would then send one copy on to the judge, who had 30 days to reply.

        If the judge did reply, you had a chance to argue the matter, before another judge if necessary. If, however, he ignored the letter you would go back to the County Clerk who would make a statement on the bottom of the second letter that the judge hadn’t replied. Then you would take it to the County Sheriff. The sheriff was required, by federal law, to collect $100,000 from the judge to reward you for the judge’s failure to honor your rights. (Note that this amount was in about 1785! It would be worth millions now!) The law even specified in what order the sheriff was to collect the money. He could take EVERYTHING the judge owned, including the clothing he wore EXCEPT for his wedding ring. It eliminated all lawyers and judges from any decision on purpose.

        A group in Texas called the Patriots had discovered this law. They used it against a judge in Houston who would put people in jail for claiming their Constitutional rights had been violated. The judge insisted that only he could decide law in his court. Not the Constitution, not Congress, not the state – only him.

        I’ve never heard that this law has been repealed since Congress didn’t want the people of the US to know about it. I wonder if it is still a legal law…

    Ben, you are right: there are too many lawyers and too many who are lowlifes like John Edwards, but it is the fact that he is a democrat and liberal that makes him a trashbag lawyer. My oldest son just graduated from law school as did my daughter’s fiance. I have two best friends and numerous friends who are lawyers–I am an M.D., D.M.D. surgeon. The stupids who mindlessly say kill the lawyers are no better than the occupiers who say kill all the businessmen. They are the cowpatties on the soles of elitist liberal feet and would be crushed by the liberals who like Pol Pot would destroy all of the educated successful people like the ignorant savage rabble did in the French Revolution. The real enemies of freedom are all of the proles wanting and grasping for something from the hands of those who are smart and work hard.

    Great read Ben, fun and informative! I have been in three juries, each time some of the jury members seemed so clueless as to what was actually going on. Anyway I would like to know what is the judge’s responsibility is? Why can’t a judge throw out a frivolous law suit and charge the accusing attorney court costs and attorney fees?

    Robert smith – I’m for companies/corporations making money… lot’s of money! It is the American dream! There is nothing ethically wrong as long as they do so morally and treat their employees with decency. McDonalds is a great company with great food and great jobs – everyone wins. It is your choice to go as often as you want and eat those calories, if employed to stay or advance to another job when your experience and abilities proves you are worthy.

        I would use an attorney in a New York minute, if I needed to right a wrong that resulted in the use of the legal system. The difference is, is that I would like to right a wrong. I acknowledged that we were but i knew if someone offered him a couple of bucks that he would sue me. He advised me that was the game was played. I informed him that i did not consider it a game and would take it real personal.

        I do have an attorney in the family. The family is well aware of the blinders used by our loved but sometimes disappointment in our family member.

        The ACLU’s defense of conservative principals or individuals fall into two main camps. Number one is the simple fact that regardless of which group you indentifly with, they are not always right, nor are they always wrong. So in simple language, you and I, and others, or organizations are never always correct. Nor are they always incorrect.

        The ACLU does sometimes do what those that oppose them do, and that’s taking the same position. So they may, and have, done worthy legal work that many on the right agree with. But that is a rare bird.

        Number two on why the ACLU takes on a cause(s) that falls in the conservative camp, is cover. A masquerade, to fool as many as they can, that they are truly an independent and reasoned minded group of legal eagles, bent on a fair rendering of the constitution and civil and criminal law. These actions which have little long term cost attached to them, feed the misconception, which results in vast interest on the investment and rich rewards in their future endevors.

Think about this in connection with what you said, when you FEAR the Lord it means you believe! Why would you fear something you didn’t believe in?! So if you fear the Lord and you believe in His omnipresence, you know you don’t get away with anything, so you won’t do those unethical things cause you know he sees all, and thus you don’t get in trouble down the road from the consequences of those actions that eventually come to light no matter how well we might keep them hid!

I am proud to be a trial lawyer. Conservatives get blinders on when it comes to what we do.         I beleive your comment is clearly incorrect. You may have been better served to state, some, not we. Your use of “we” denotes “all” or ‘vast majority.” The evidence points away from all or the vast majority of lawyers being altruistics or fair. Note, I didn’t imply “all” attorney, or even the vast majority of attorneys are pond scum sucking leeches. Many lawyers, like most of those in the various professions or other labor pursuits, fall some where in the middle too. But most of them are not over represented in our law making, or in positions of doing great harm to the rest of the citizens if they chose to be malevolent. I personally found your defense of the law profession, to be quite weak. I could do a better job of defending the judicial system, while still keeping myself with high integrity. In fact I just did. I just did not put on blinders to look in only one direction, be it positive or negative.

        There must be a reason that thoughout history, societies have had suspicions and distrust of lawyers as a whole.

        Shane, people often distrust those who have unusual (perceived) power derived from specialized knowledge that most of us don’t understand. In our Founding generation, most New Englanders were lawyers. You didn’t have to have a licence or swear fealty to the British monarch in order to practice law in those days, and the average person was more able to represent himself in court if he so desired. That’s why somebody-or-other famous (I forget who) said we were “a nation of lawyers.” Of course, there were fewer laws, too. But we’ve mostly lost that as a culture, and people feel disempowered as a result. I think if people understood law, procedure, and the relationship between statutes and law a little better, we could recognize the evil among the attorneys more easily and not fear them so much.

        I personally think that the lawyers that represent the people and stand up for justice should be applauded and thanked but the vast majority of lawyers don’t fall into that catagory. Many lawyers need to be taken out behind the tool shed and taught the difference between right and wrong, if that doesn’t work they should be disbarred and learn to do real work for a living, such as cleaning out the stalls at a horse ranch so they can smell what they have been shoveling to the rest of us. There is an old joke that is appropiate ” What do you call a thousand lawyers at the bottom of the ocean? A good start.”

        The judgement was for $2,700,000. The final amount that was eventually reached, does not in any way change the infairness of the original judgement. Nor does your opinion include the highly increased cost of defense of both the unfair original judgement and the successiful attempt to have that judgement lowered.

        What I don’t understand is that McDonalds STILL keeps their coffee too hot. It STILL takes 30+ minutes for it to get down to drinkable temperature, if you keep the lid on it. On a 45 minute drive home recently, even after adding cream to cool it, I still could not comfortably drink the coffee until I was within ten miles of home.

        Actually I blame 7-11 for this; back in 1974 I remember a frequent radio ad touting their “HOT, HOT, HOT coffee!”

        You’re looking for absolutes in a world of grey. There is likely negligence on both sides and I believe the jury apportioned fault thru cmparative negligence. But the societal issue deals with McDonalds, not the Plaintiff. Do we want companies placng coffee into commerce that WILL burn people badly? If you want to restrain such behavior, the tort system may be the only way. I know you’re a model of personal responsibility and rectitude, but we can’t all measure up to that standard.

      You’ve got a serious problem if you don’t believe that all these stupid lawsuits aren’t pushing the cost of everything in this country through the roof. Malpractice is just one lawsuit claim that has adversely effected everyone requiring medical treatment. It’s also the reason you find more and more doctors in clinics rather than in private practice. For your info, given the fact that the moron burned by the coffee suffered because she put the cup in her lap while driving, I would think she’s the type that would gladly go into the McDonald’s and throw a fit if her coffee wasn’t hot enough to suit her. Today large companies, even though most of them have a large froup of attorneys representing them, they just pay settlements on these cases instead of going to court. Why? The cost of court time, attornetys, etc. is higher than just paying the settlement. One more reason the cost of everything you purchase is going up. I can tell you from working for a manufacturing company, the demand for warning labels on every item a consumer purchases is another side effect of these stupid lawsuits. And you want to scream that Bob is in favor of the 1%?! When your health insurance premiums go up one more time remember to thank the ambulance chasing attorneys. When the cost of ANY item manufactured in this country goes up, remember to thank the attorney who got the settlement because of the spilled coffee and our defunct government demanding stupid warning labels. Anybody who doesn’t know that coffee is HOT shouldn’t be drinking it. Also should she really have been driving and keeping something hot in her lap? So much for taking responsibilty for your own actions. And we somehow wonder why it takes forty forevers to get legitimate lawsuits through courts! It probably doesn’t have anything to do with these stupid lawsuits that are on the docket thanks to greedy attorneys and people who refuse to accept that the problem was caused by their own actions. I have an example of my own. I was hit by a drunk driver. She was so drunk she couldn’t even give the police officer her name. Not only that but the person with her had driven away from the scene with the car. That lady was arrested as soon as the police officer tried to talk to her. She served some jail time. By the time she was released the insurer of the car had paid for the repairs to my car. (No I didn’t sue for anything-personal injury or anything else.) Once that lady was released from jail she found an ambulance chaser to help her file suit against me for causing the accident. He had never bothered to even look at the police report. As soon as I told him that she had been arrested, he ended the phone conversation and I never heard from him again. And you want to tell me that ambulance chasing idiot attorneys aren’t affecting the cost of everything in this country?! My assumption Robert is that you’re another somebody who doesn’t believe in taking responsibility for your own actions. We all gladly thank you for making life more expensive and causing legitimate lawsuits to get bogged down forever in the courts, some even long enough that the ACTUAL victim has died before the suit reaches the court! Yes I could tell you about more than one like that too.

        Does it bother you at all to have such strong opinions based upon completely inaccurate information? You know nothing about this woman or the case and you’re 2nd guessing everyone involved including the jury who had no stake in the case.

        The case was about whether McDonalds’ economic decision to sell coffee at temperatures guaranteed to cause 3rd degree burns makes their coffee a dangerous product. No, the woman was not driving. But many people do drive wth coffee because it is considered a safe product. People don’t wear hazmat suits when holding a coffee cup!

        Companies make economic decisions knowing a certain number of people will be injured by the company’s failure to take safety precautions. The calculation involves the “cost” of the precaution vs. the damages they’ll likely have to pay out to those injured.
        This happens regularly with auto makers. A five dollar part in 200,000 cars vs, serious injuries to X number of people.

        McDonald’s is no different. They knew how dangerous the coffee was at that temperature and continued selling it because it increased their profit margin. Does “personal responsibility” not enter into the calculation or does that apply only to the poor and powerless?

I feel that Lawyers should be banned. and let the simplest mindeed person you can find write the laws. No maybe and what ifs just a+b=c. How hard is it to read the law and understand it? if it becomes difficult it is a way for them to purpetuat themselves. Suing has a place in some but very few cases. But people need to take responsiblity for their own actions and resulting fate.         Look up the “original 13th Amendment.” It would have banned attorneys from serving in Congress. Several states ratified it, but not enough yet. Even though it’s very, very old (1830′s I believe?), there’s no time limit on ratifying it. We could still do it if enough states took it up.

      I don’t think however that Ben is a 1 percenter. He just needs to do a little homework. The fact that the coffee was hot wasn’t revalent. It was HOW hot it was (at boiling), and the fact that Mickey D’s tried to avoid any responsibility whatsoever. I’m quite sure that if they had offered to pay this woman’s medical bills, reconstructive surgery bills (yea, it was that bad!) and lost income this might not have become headline news. But like with many other stories there was McDonald’s, the woman, and the truth which I’m sure was somewhere there in the middle.

      And everybody hates lawyers! Until they need one. I’ve needed one on several occasions, not to screw somebody over, but to make sure what I needed to accomplish was being done legally to protect mine and any other interested party’s legal rights. Expensive, hell yes! But a lot cheaper that trying to go off half-cocked on my own and risking my livelyhood, savings and reputation if I’d not dotted an “i” or crossed a “t”.

      For a laugh, look for an episode of the 1990s science fiction show “Sliders”. It’s one where they fall into a parallel dimension in which everybody is a lawyer, and sues each other at the drop of a hat. It’s pretty funny.

He does stil owe my mother child support, but after a minor turns 18 the remainder is exponged unless that now adult seeks the support. While there is some truth to what he says, my Mother and stepfather did get into some trouble and left to make a fresh start. The truth is I came MANY time to visit his family but he was to busy with his own life to make an effort to visit me or was shoved away because of the condition he was in when he did show up. The truth is that even if what he thinks was true he can only throw up the actions of a child because that is how well he knows the 31 year old women I have become. I am also sure he will tell you all of my feminazi ways, if having my own thoughts and beliefs makes me such I guess I should be proud. Like I said my Mom has made many mistakes in life but she did learn from them and has been a valuable tool in my life as well as my children. But before you go off on me , find and read the details of the coffee case. I used to believe as you did prior to researching it. As I read the case, it became clear that it was far from what was being portrayed by (some biased) casual observers.

        These were THIRD DEGREE burns that required reconstructive surgery. Not just a little pink skin and a few days of misery. I’m a Libetarian myself, and I agree in principle with everything Bob has said. My point on the “coffee case” is simply whether or not we agree, the jury felt thet the preponderance of the evidence proved that the coffee was way too hot. Sure the woman was, and probably reacted like a dummy. But I’ve spilled hot liquid I was about to drink on myself on more than one occaision. And I’ve never suffered third degree burns. So would some compensation for the reconstructive surgery be reasonable? From our perspective we can argue ’till were blue in the face, but someone out there thought so.

      Actually, I suspect those were not the jurys’ words but the shysters’ all prepackaged and ready to use by a jury who simply wanted to punish MacDonalds because they detected (i) an individual with some injury, and (ii) a nearby source of deep pockets from which they could legally extort money to assuage her “pain”.

      Some of us do actually experience accidents resulting in injuries (on others’ property) for which we do not seek compensation.

        It’s called personal responsibility RM! If I got hurt and it was my fault, I take responsibility. If it’s the fault of another, I sue only in the case that they try and deny responsibility! If they offer to take care of me, i try my BEST to work with them without a lawyer. The only bad thing is that the way the system is set up, you have to have a lawyer or you take the chance of being the one who gets screwed! In other words the system punishes you for refusing to play the game!!!

      So McDonald’s was responsible for the lady placing a cup of hot coffee between her legs and attempting to drive with the coffee between her legs resulting in her spilling the hot coffee on herself and burning herself. While there are a handful of good lawyers like Jay Sekulow, the overwhelming majority of lawyers serve no useful purpose. O course, it is the greed and selfishness of the American people that keeps these vermin in their BMWs and country estates. We have become a country full of lazy, selfish people always looking for an easy and quick way to get rich. We need to teach our children that life is about doing honest work and that those who look to live off of others will someday face a fiery judgment for their sloth and selfishness.

        The rule of law can only work in a society where justice is meted out with equity. Just when did Lady Justice trade in her blindfold for a pair of Transition sunglasses whose darkness or clarity depend on the size of ones’ bank account? When it comes to lawyers, I sometimes tend to agree with William Shakespere. I believe that our once great nation is getting dangerously close to the tipping point.         Actually, in Shakespeare’s time, the word “lawyer” referred to a legislator- or someone who MADE the laws- not the people who “tried” the laws in a Courtroom. And while I do not defend most lawyers (please give those doing decent work a break!), if this woman was not looking for a way to make a fast buck, there would be no case to try.       So, “good” lawyers are those who represent entrenched interests (as long as they’re sufficiently rapacious or right wing) while “bad” lawyers represent people who don’t have a lot of money, right?

      This whole call for tort reform has been going on at least since Reagan and it is mostly bogus. If you make a product that you KNOW will injure people unnecessarily (like coffee 30 degrees too hot), why should there be no accountability for that decision?

      Reagan used to tell an apocryphal story about a guy who got hit in a phone booth by a reckless driver and then sued the phone company. He always got laughs from the know-nothings in his audience. The real facts were that people had been hit there before and the phone booth door malfunctioned, trapping the person. Does that make a difference?

      I don’t know anything about the baseball story but you can be sure if she received no injuries beyond a little swelling, she’ll be lucky to get $150, let alone $150,000. If someone gets injured by someone’s negligence, the injuries get compensated. And the fact that you remember breaking someone’s window when you were 11 and it only cost you a lecture and $5 from your piggy bank is really not relevant, is it?

        While your comment has merit. This article, and most of the coherent comments related to our judicial system are about balance, not absolutes. Taking one of your points, the McD coffee incident. The amount of compensation, regardless of fault, tilted that judgement as illegitimate and unprincipled. One must remember, Jeff. That a considerable aggregate of the lawsuits brought forth through our judicial system are soley about excessive compensation or control. Note the word “excessive.” While it’s possible many times to gain compensation for a wrong that is considerably above the original wrong’s value, that does not make it moral or right. But many in our society see a lawsuit or threat of lawsuit as a way to riches, be it small or large. Kind of like a lottery without purchasing a ticket.

        But I will give our judicial system a thumbs up. For we do have if not the best, nearly the best judical system in the world. But judical is not justice, just the mechanism for the practicability of possibly reaching fairness. So as far as justice, consistent justice, I see little of that in our country.

        I think I see where you are going. You’re concerned that the large jury award (The case settled for much less during endless appeals.) does more than compensate the victim for her injuries. That’s true. It’s designed to punish the corporate tortfeasor for its monetary decision to do something sure to injure a certain number of people. How do you punish a multi-billion dollar business with a $100,000 verdict? You don’t.

        Maybe some portion of punitive damages awards should go to a fund of some sort, I don’t know. But punitive damages can be the only way to reign in corporate excesses. Health insurance companies often deny claims for illegitimate reasons. There is currently no effective way to combat this. Until about 25 years ago, a company could get hit with a bad faith claim and have to pay out millions for a small denied claim. This get their attention and may alter their coverage decisions. Having to pay the original claim plus some attorney fees years after the fact is no penalty at all.

        Is there nothing a corporation can do to make them negligent or is it always about the individual’s “personal responsibility”? Companies have entire departments of economists (bean counters) to determine whether it pays to spend an extra dollar or two per widget/vehicle/unit to save X number of lives. Part of that calculation is how much they will have to pay out to the few who are injured.

        I know you’re way too smart to ever be injured by corporate negligence. That’s why you hang out in right-wing chat rooms. Some day it will be you or someone you know and these same right-wingers will be asking how stupid you can be.

        If a person is so stupid as to place a cup of hot coffee between their legs and then attempt to drive and as a result spills the coffee then of course it must be the fault of the vendor who sold the coffee – NOT. This person and her lawyer should have been laughed out of court and then made to pay all court costs as a result of this stupid law suite. What ever happened to personal responsibility? The lawyers and politicians have eliminated the concept of personal responsibility.

        There is an old adage that states that a town with one layer has a person struggling to make a living but when the same town has two lawyers the town has two very wealthy individuals.

        Jurors are to blame also because the believe that it is only the insurance companies money but in fact it is the peoples money. This is because every time an insurance company has to pay out a large amount from a law suite they raise their premiums in order to make up for the lost money, thus causing all of us to pay more for the insurance.

        Before you spout off, you should know SOMETHING. She wasn’t driving. She was in the passenger seat and the car was parked. Liquid in a cup will spill some % of the time. It might be that a child or a dog hits it or it might be that the lid comes off in a manner producing a spill. If the liquid is so hot that it melts the skin on contact, burns are sure to occur in a good number of people.

        Certainly, McDonald’s was aware of the heat of its coffee. It determined it could sell more if it was hotter – hotter than anyone could drink it. Does this create a safety hazard? Apparently the jury thought so and punished McDonald’s with 1 or 2 days’ coffee sales – later reduced in settlement during the appeal.

        Sometimes, “personal responsibility” applies to someone other than the victim.

    The author Ben Crystal thinks that this strange lawsuit is typical of lawsuits. It only makes the news because it was NOT typical. In reality “lawyers” protect us from real dangers. Mindless people deride lawyers while they in their everyday life use products that would be dangerous if not for the “lawyers”. Yet the kooks are unaware they are fighting the people on their side.

    But the real proof in the pudding is ythat the author said that maybe Shakespeare was right. He refes to the line in the Shakespeare play “Kill all the lawyers”. In reality the line was uttered by a sinister Fascist person. Shakespeare’s point was the opposite of what the Crystal inferred. Shakespeare was ridiculing Crystal, and Crystal was too out of it to realize that the it was he who Shakespeare was deriding.

      Paul a little history for you, at one time back during our earlier days (13 colony days) lawyers were not allowed to practice their trade with-in the town’s limits because the towns people already knew how they could twist, spin and confuse the real issues. maybe that’s where we need to get back to. Since our Gov’t is made up of lawyers, and anyone can see the mess they have created, looks like we need a few Teachers, Doctors, Bus Drivers etc. making the laws.

        I am amazed at how many law schools there are, pumping out hundreds of lawyers every year. Does any one know how many mathematicians, engineers, scientists, doctors are pumped out every year?
        Sorry, but I am becoming increasingly convinced that people go into “law” for the big bucks they hope to make, and some, I think, like Obama go into law to find out just how to screw it around so he can get around it, take advantage and make big bucks and friends of just as dishonest people as himself.
        Growing up I never thought about lawyers or government. But at 65 I can say that everything I do now, I hesitate and wonder will someone sue me, will I get dragged into court if you get hurt on my property. And don’t even get me started on the government. I think, of course this is only my perspective, but there is real fear about the government. It used to be just what the IRS could do, rack us over the coals, make our lives miserable for years with audits. But now, I think more and more people are really concerned with what the rest of government can, is doing and will do more of in the future.

        So, I have a question: if Obama gets re-elected, heaven forbid it, will he want to be called King, Czar, Dictator, Master, because he sure won’t be president of a free people.

      Lawyers are no longer interested in justice, only money, and the proof of this is that a lawyer actually took this case. The first thing they do is look to see if there are any “deep pockets” to tap, then they go for it all. The boy surely has no money, but maybe the parents do, or maybe the Little League organization or maybe. . . If you go to the game and sit in the line of fire, expect that you might get hit. That’s just life.
