Do you consider the 14th amendment to the Constitution as a part of the Constitution? If you do this section further defines what the 14th amendment is. The 14th amendment gives information of who is qualified to be president of the United States and as you state the Constitution can have amendments so here you are, easy to explain and therefore an amendment to the Constitution already ratified and is not really a law but and amendment.

And the decision that Natural Born Citizen refers to the place of birth, not the parents, is not only held by the courts in Indiana and by Meese. Four state courts and one federal court have now ruled specifically on Obama that the meaning of Natural Born Citizen was defined in the Wong Kim Ark case (which incidentally was AFTER MInor vs Happersett and hence would have overturned it were not Minor merely dicta). And these five courts have all ruled that the Wong Kim Ark case defined Natural Born Citizen as including every child born in the USA except for the children of foreign diplomats.

And there have been numerous other cases. Such as:

Mustata v. US Dept. of Justice, 179 F.3d 1017 (6th Cir. 1999) (children born in US to two Romanian citizens described as “natural born citizens” of the US):

“Petitioners Marian and Lenuta Mustata are citizens of Romania. At the time of their petition, they resided in Michigan with their two minor children, who are natural born citizens of the United States.”

Diaz-Salazar v. INS, 700 F.2d 1156 (7th Cir. 1983) (child born in US to Mexican citizen is “natural born citizen” of US):

“Petitioner, Sebastian Diaz-Salazar, entered the United States illegally [from Mexico] in 1974 and has been living and working in Chicago since that time. *** The relevant facts which have been placed before the INS, BIA, and this court can be summarized as follows: The petitioner has a wife and two children under the age of three in Chicago; the children are natural-born citizens of the United States.”

Nwankpa v. Kissinger, 376 F. Supp. 122 (M.D. Ala. 1974) (child born in US to two Biafra citizens described as “natural born citizen” of the US):

“The Plaintiff was a native of Biafra, now a part of the Republic of Nigeria. His wife and two older children are also natives of that country, but his third child, a daughter, is a natural-born citizen of the United States.”

What made the third child different from her siblings? She was born in the USA.

In addition to the Wong Kim Ark case defining 14th amendment citizenship, it also defined Natural Born status. Here is the quotation:

“It thus clearly appears that, by the law of England for the last three centuries, beginning before the settlement of this country and continuing to the present day, aliens, while residing in the dominions possessed by the Crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, the jurisdiction of the English Sovereign, and therefore every child born in England of alien parents was a natural-born subject unless the child of an ambassador or other diplomatic agent of a foreign State or of an alien enemy in hostile occupation of the place where the child was born.

III. The same rule was in force in all the English Colonies upon this continent down to the time of the Declaration of Independence, and in the United States afterwards, and continued to prevail under the Constitution as originally established.”

That quite clearly says that the meaning of Natural Born comes from the common law, and that every child born in the country (except for the children of foreign diplomats) is included, and that the same rules that applied in England applied in the colonies, and in the early states AND UNDER THE CONSTITUTION.

That is why so far for state courts and one federal court have ruled on Obama that the Wong Kim Ark ruling applies and that he, and all the other 300 million of us who were born in the USA, is a Natural Born US citizen.

It clearly states the timeline conditions as I stated. Again, IF Obama’s mother was unmarried (not proven one way or another), AND IF Obama was born outside Hawaii (not proven one way or another as well), she could only convey citizenship to her son if she was over 21 years of age.

In any event, this only addresses the issue of “basic citizenship” not “natural born citizenship”, which is quite another matter.

I read the entire code and nowhere does it mention anything about persons who qualify as citizens under this code being eligible to be President of the U.S.

Additionally, you mentioned that there were 7 Presidents who had a foreign parent. I assume you refer to Washington through Jackson, who all had foreign parents and were “grandfathered” as eligible to be President, as part of the final draft of Article II, section 1, Clause 5.

However, you didn’t mention James Buchanan, whose father was born in Ireland and was a naturalized U.S. citizen at the time of James’ birth. Additionally, Woodrow Wilson’s mother was born in England but gave birth to Woodrow as a naturalized citizen; or Herbert Hoover, whose mother was Canadian and was similarly a naturalized citizen at the time of Herbert’s birth.

Yes, the purpose was to establish her citizenship. The opinion states she is a natural born citizen because both her parents were citizens. The opinion also mentions a class where children born within the jurisdiction, but found it not necessary to rule on this since she qualified under both parents. If you’d like to take it to the extreme the opinion said, “SHE”. Am I to infer that, ‘natural born’ only applies to women?

An analogy: If I said “It was never doubted that if you wore both suspenders and a belt you would hold your pants up” does that mean that you have to wear both suspenders and a belt to hold your pants up? Does it? Obviously it doesn’t. Well, that is what the quotation from the Minor vs Happersett case says.

Minor had both US citizen parents and was born in the USA. She was a NBC by having both of the factors, but she could also have been an NBC based on only one of the factors. The court did not say, and it said that it did not have to say.

In any case, it should be obvious, that saying that it was never doubted that having citizen parents and being born in the country makes a Natural Born Citizen is NOT a statement that both are required. It is not a statement that both are necessary any more than saying that it was never doubted that if you wore both suspenders and a belt you would hold your pants up is a statement that both are necessary.

And in any case the Wong Kim ARK case was after the Minor vs. Happersett case, and hence if the Minor vs Happersett case were actually a ruling (which obviously it wasn’t), the Wong Kim Ark case would have overturned it. And the Wong Kim Ark case said that every child born in the USA except for the children of foreign diplomats is Natural Born.

A possible source of the so-called “birther” issue–or at least a potential cause of the rumors that have dogged President Barack Obama–has been identified.

Obama’s former literary agency misidentified his birthplace as Kenya while trying to promote the then-Harvard Law grad as an author in 1991.

According to a promotional booklet produced by the agency, Acton & Dystel, to showcase its roster of writers, Obama was “born in Kenya and raised in Indonesia and Hawaii.”

Miriam Goderich edited the text of the bio; she is now a partner at the Dystel & Goderich agency, which lists Obama as one of its current clients.

“This was nothing more than a fact checking error by me–an agency assistant at the time,” Goderich wrote in an emailed statement to Yahoo News. “There was never any information given to us by Obama in any of his correspondence or other communications suggesting in any way that he was born in Kenya and not Hawaii. I hope you can communicate to your readers that this was a simple mistake and nothing more.”

From CNN’s Anderson Cooper to so-called conservatives Ann Coulter, Glenn Beck and Bill O’Reilly, useful idiots have lined up like good little sheep to proclaim that they have some special knowledge of the messiah’s birth that nobody else is allowed to see, and that on that basis, they have determined for all of mankind that Obama is eligible for office, even though none of them seem capable of comprehending the most fundamental facts of the case. Also lookup the Electoral College, part of its purpose is to insure the intent of the clause, ‘natural born citizen’ and the Electoral College passed Obama. At some point you’ll have to trust the system.

You only have to do a search on US Code Title 8, Section 1401 and with Obama’s mother being a citizen of the US entitles Obama to also be a citizen. You can also be born of two parents being a citizen but this section defines for even the least of us to understand having one parent allows us to be a citizen by birth no matter where the child was born. The case stated was both of her parents was in the US illegally.

The meaning of Natural Born Citizen comes from the common law and includes every child born in the USA. That was decided by the Wong Kim Ark case, which ruled six to two (one not voting) that the meaning of Natural Born Citizen comes from the common law, and that EVERY US citizen who was born in the USA is Natural Born (only naturalized citizens are not Natural Born):

In fact, birthers and two-fers tried to convince the members of the US Electoral College of the parents requirement, and not one member changed her or his vote out of the belief that two citizen parents required. Not one.

And four state courts and one federal court have now ruled specifically on Obama’s case that the US Supreme Court defined the meaning of Natural Born Citizen in the Wong Kim Ark case and that it said that the meaning comes from the common law and that it includes every citizen born in the USA.

If the founders had wanted a difference from the common law, they would have said that they did and specified how that difference would apply. Since they did not state that there would be a difference from the common law, and since the normal way of using the term Natural Born at the time referred to the place of birth, not the parents, there is no evidence that they intended to use the term any differently than in its most common sense, its use in the common law, and that is what the courts have consistently held.

There have been seven presidents who did not have both parents as citizens of the US.

So far no one has clearly defined, ‘natural born citizen’. Personally I believe it is anyone that would naturally receive citizenship. He is cousins with six U.S presidents, including Lyndon Johnson, Harry Truman and Gerald Ford. He is also linked to American artist Georgia O’Keefe, the Duchess of Windsor and two men who signed the Declaration of Independence.

Most surprisingly, Obama — the man who became America’s first African-American president — is linked by ancestry to Robert E. Lee, who commanded the armies of the
Southern slave-holding states during the American civil war.

For heaven’s sake, get it together. Have you ever traced your genealogy? You’d be surprised what you find if you go back far enough and wide enough. I too have Cheaneys in my family tree, but we’re so far removed as to make it pointless. The world is a whole lot smaller than one might think.

You know, I was with you until you said that he had shown his long and short-form birth-certificates, as each (one in multiples) have been proven to be forgeries.
Until and unless he does come up with proof (who does not have his or her b/c these days?) that he is what and who he says he is, questions will always be there.

One final thing, “e”; it was not the health-department (anywhere) that posted these announcements. It would be family who’d have sent the information in to the local newspaper(s). And, no, the birth-certificate was not used as any proof to state such information was true. These birth announcements were akin to brag-books; “look at what my kid did!”

Try reading US Code Title 8, Section 1401 and you will find the requirements for being the president of the United States, and the specific is a parent. Obama could have been born anywhere and with his mother being a citizen fo the US it allows him to have citizenship here also. I know this is not going to make any difference with the birthers or Donald Trump but at least you will have the correct information whether you choose to use it or not. Donald should take his information to court to prove he is right but that has not happened. The Donald loves the cameras, probablly is getting ready to do another show and this is free advertizements. BTW, there have been 7 presidents which have not had both parents as citizens so keep up the game. You are correct, Walt, a natural born Citizen is born IN the Country to parents who are both citizens OF the country. As children always automatically take on the citizenship of their parents, the above is the only possible definition of a natural born Citizen. Therefore, a child born in the U.S. with one or both foreign parents, also automatically claims dual or multiple citizenship at birth, possibly owing allegiance to other countries–and is never a natural born Citizen.

RichE, Wong Kim Ark case refers to 14th Amendment citizenship. Any time a citizen becomes a citizen by written law, that citizen can never be considered ‘naturally born a Citizen.’ Throughout this case ‘citizenship’ is referred to according to the 14rh Amendment–citizenship by law.

To Thinkabout, I have not read US Code Title 8, Section 1401, but if it does actually state only one citizen parent is required to become President of the U.S., then the law is unconstitutional because it negates Article II, Section 1 of the Constitution. The Constitution cannot be changed by law–only by Amendment, ratified by the sovereign People.

As stated in numerous supreme Court cases, it has never been doubted that a child born in the country of parents who are its citizens is himself a citizen. That is a native, or natural born Citizen. But a for child born of foreign parents in the country there is doubt. ‘Native born’ has been used to refer to any child born in the U.S., but it does not necessarily equate with ‘natural born’ Citizen.

The meaning of Natural Born Citizen comes from the common law and refers to the place of birth, not the parents.

The SS number (042-68-4425) currently being used by Obama was issued to a man named Jean Paul Ludwig, born in France in 1890 and emigrated to the U.S. in 1924 and spent most of his adult life in Connecticut. Ludwig was assigned the above SSN in March of 1957. However, Ludwig spent the last few months of his life in Hawaii, where he died. Conveniently, Obama’s grandmother worked in the Probate Office in the Honolulu Hawaii Courthouse, where she had access to the SS numbers of deceased individuals.

It is alledged that Madelyn Paine Dunham scoured the records for somebody that had not received Social Security benefits and selected Mr. Ludwig’s SSN for her grandson to use.

That is a birther lie, a deliberate lie. The transcript of the tape recording, and the tape itself, both show that the Kenyan grandmother repeatedly said that Obama was born IN HAWAII. The birther sites simply cut off the recording before she answered the question: “Whereabouts was he born.” And, in another interview, she said that the first that her family in Kenya had heard of Obama’s birth was in a letter from Hawaii.

In fact, Obama has shown his birth certificate twice—short-form and long-form—and three Republican and several Democrat officials in Hawaii have confirmed the facts on them. The existence of a birth certificate for Obama is also confirmed by the Index Data–a public volume that has been out there for years and which show Obama’s birth certificate listed under 1961. And it is confirmed by the birth notices in the Health Bureau Statistics section of the Hawaii newspapers in 1961, which at the time were sent to the papers only by the DOH, and at the time the DOH only sent out the notices for births IN Hawaii.

The key word here is “intelligent”.
