The Tenthers Are Coming!

When the Tenth Amendment Center co-hosted three events at the Conservative Political Action Conference in Washington, D.C., this month, the No. 1 question we heard from people when talking among the crowds was: “The 10th Amendment. Hmmmm. Which one is that?”

Seriously? Yes. Over and over again, we heard the same question. At first, I thought they were joking. Consider all the Tenther hype from people like Rick Perry, Newt Gingrich and other mainstream conservatives. And at a recent Fox News/YouTube debate, the most requested question from conservatives around the country was about the 10th Amendment. Maybe they were testing us to see if we knew what we were talking about.

But, no, I was wrong. A large number of the people we interacted with at the biggest and most mainstream conservative event in the country had no clue what the 10th Amendment even is.

And they wonder how this country could end up with someone like Barack Obama? Yeah, well, that’s another column altogether.

After being asked that same question about the 10th a dozen or so times, I decided to give a much simpler reply. It went something like this: “The 10th Amendment is the one that says that Feds are allowed to do only certain stuff. That stuff is in the Constitution. Everything else is left to each of the States as we the people decide.”

That got some really positive responses. Good, because it’s true.

Practical Examples

After I got home to Los Angeles, I started to think about that question more and more. And, yes, while the basic principle I shared with people in Washington is true, I recognize that people want and need to see practical examples of how something like this is actually playing out.

Talking about how things “should be” is one thing. But sharing examples of how people are taking action on Constitutional issues right now is far more powerful.

When it comes to the Constitutional “rule of construction” known as the 10th Amendment and actions being taken around the country to reject Federal laws, regulations and mandates enacted outside the scope of their Constitutional limits, there are loads of examples to share.

In a quick one-on-one conversation, I’ll still continue to give my short-version answer about the 10th. But in a forum like this, there’s a great opportunity to share a bit more. Like this:

The 10th amendment is the one that says the Feds can do only the few things allowed to them in the Constitution. And that means people like you are empowered to do something about it when Federal politicians violate those rules. In fact, people around the country are doing something about issues all across the political spectrum right now. They’re standing up and saying something that you and I should be saying to Washington every single day: No.

That’s right. A law passed outside the limits of the Constitution is no law at all. It’s an act of usurpation. And when the Federal government passes “laws,” regulations and mandates that aren’t authorized by the Constitution, you are not bound to obey them.

Happening Right Now

Being early in the year, this is the time when State legislatures are working with people to find ways to say “no” to Washington. Here are some of what I consider to be the biggest and best examples happening around the country today.

1. Banning Health Insurance Mandates

Last fall, 66 percent of Ohio voters and a majority of every single political demographic, approved Issue 3: the Ohio Health Care Freedom Amendment. This State Constitutional Amendment says that “no law or rule shall compel, directly or indirectly, any person, employer, or health care provider to participate in a health care system.”

Ohio is the 10th state to pass something along these lines, and six other States are considering similar measures already this year.

2. Rejecting Indefinite Detention

Ten years ago, if you had called the Patriot Act “moderate,” I probably would have puked. But compared to what Obama signed into “law” on Dec. 31 (primarily sections 1021 and 1022 of the National Defense Authorization Act), that George W. Bush-era tragedy for American liberty is mild.

When due process is eliminated, these so-called “indefinite detentions” are little more than government-sanctioned kidnapping. I believe there should be serious ramifications for kidnapping, whether the kidnappers work for the government or not.

Tennessee is currently considering a bill that would do just that: sanction Federal agents with kidnapping charges in that State. Other States are taking the position that they will provide absolutely no material support in any way with the Federal government on this issue. The Virginia House of Delegates passed a bill which would make law that no agent of the Commonwealth could participate in supporting the Feds in arrest without due process. The vote on that bill was a whopping 96-4.

So far, six States are considering similar bills — what we call the Liberty Preservation Act in our model legislation at the Tenth Amendment Center.

Harder to tame than a willful statehouse might be a cluster of counties, towns and cities, each one individually working to nullify these new kidnapping powers through local law. In just days, a number of localities began to consider similar legislation, and already seven have passed — most recently in Northampton, Mass.

3. Advancing Constitutional Money

With the economy coming apart at the seams, a growing number of people would like to see Article I, Section 10 of the Constitution followed. It states that “No State shall… make any Thing but gold and silver Coin a Tender in Payment of Debts.”

It seems pretty straightforward, but it hasn’t been followed in ages.

Following Utah’s lead from last year, five other States are working on legislation to allow sound money to actually be used without sanction. And while this is really just scratching the surface, it’s moving faster than waiting for Washington to somehow give up its power to inflate and bail out their friends.

There’s Plenty More

Rejecting mandates, restoring due process and supporting sound money are just three important issues that define what’s happening in the Tenther Movement today. But there’s so much more. States around the country are considering similar actions on issues like 4th Amendment violations by the Transportation Security Administration to 2nd Amendment violations by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

From mandates to milk, from weed to wars without declaration and everything in between, very little of what the Federal government does today is authorized by the Constitution.

But even though the establishment politicians and establishment media will never tell you this, we don’t have to sit around and take it. When 25 States refused compliance with the REAL ID Act of 2005, that law remained on the books in Congress, was never challenged in Court, but was rendered virtually null, void and unenforceable in most of the country.

Saying “no” works.

When enough people stand up and say “no” to Washington and enough States follow their lead and pass laws backing them up, the Feds are going to have a hell of a time trying to force their unConstitutional “laws,” regulations and mandates down our throats.

    With the upcoming election, we need to LISTEN to the real platforms of each of these candidates! Many of them are NOT abiding by our Constitutional rights! I am an Independent voter and still have not decided who I will vote for, but with the debates not projecting/ focusing on the actual candidates platform views on who wants what, we are forced to listen to the nit picking going on which eliminates our abilities to actually listen to what the actual platforms are of each of these candidates in regard to the Constitutional laws. If the News Media would get on the right track and start asking these candidates how each of their ideas are different from the other, perhaps we could pick the right candidate. (although I have not chosen a candidate yet) I think Ron Paul has his ideas closest to the Constitution rights of the people., but how do we really know – we can’t seem to get any direct answers from the candidates with the questions asked by the News Media at the time of the debates! Perhaps if we all write to the people who are heading up the Debates, we could get the answers most of us are looking for – that is – What is your platform and how does it differ from one another to protect our rights as stated in the Constitution! Have any of you heard that from any of the people/news media asking the questions to the candidates? I don’t think you have, so we need to get on the band wagon and demand this in order to pick the right candidate with the ideas that protect the American people with their Constitutional rights! Also, remember, the views may be good, however, they still have to depend on Congress to pass them, if Congress doesn’t pass what they are standing for (their platform) then they can’t accomplish their ideas, so we really need to think about our Congressional people that are supposed to be in office to keep the American people within the rights of the Constitution – they aren’t doing that, so when you vote, think about your Congressman’s points of view, as they will be the ones that will decide on our rights, not necessarily the candidates. Another question that should be asked to the Presidential candidates is how do you intend to get Congress to pass the points of your platform! (That is what has happened to Obama’s platform) – Congress refuses to vote on the things he had on his platform!!

    AMEN TO THE TENTHERS! There does come a time for Christians to stand and we should “obey God rather than men” (Acts 5:29). This happened to me on one occasion when I knew THE LORD was leading me. I, along with 21 others, were put in jail that day. Later as I stood before the lady Judge she asked how I pleaded. I replied, “Guilty to being obedient to the Lord.” She found me guilty. I went away rejoicing because I knew it was God’s will. His perfect peace was with me even as I was being arrested. We were spontaneously began singing the old hymns of the faith as we were arrested and also later in jail. I knew none of the other 19 men and 2 ladies before that day; but I knew it was The Lord that had sent me there for such a time as this. There may come a time for some of you to obey God rather than men.

If we delve a little deeper you can find the real source of power and who is bought and paid for. Beleive me they are on both sides and totally against America as we think we know it or how we have been taught to know it. Sometimes you have to unlearn to learn. We need to get the lobbyist out of government because they are the prostitutes for the Corporations. They corrupt those who are weak minded and those they can’t corrupt they extort or threaten. Open your eyes but most of all free your mind from what they propose is happening and what is really happening. When we get the Federal Reserve Bank under control and kick AIPAC out, when we start following the Constitution and rid ourselves of the UN, NATO, IMF, GATT, NAFTA, CFR, and Trilateral Commision,etc. Our country will prosper and become a leader nation instead of a waring nation hell bent on control through overthrow of governments of other nations through Tyranny and Occupation only for those in the backround who only care about power and control of all resourses. To them YOU are one of those resources and an exspendible one at that. Wake Up!

    I discovered the 10th Amendment in 2009 when a local judge had an article in the paper stating”Stop Ignoring Our 10th Amendment” aimed at our politicians. After I read it it made perfect sense.
    The POWERS given to the Federal Govt. were “few and defined” they consisted of EXTERNAL affairs like war, peace, negotiations and foreign commerce.
    The POWERS given to the States were ” many and undefined” and consisted of INTERNAL affairs like LIFE, LIBERTY AND THE PURSUIT OF HAPPINESS.

    The 10th Amendment was put in place by our founders to protect us from a corrupt government. Since they fled tyranny and slavery to form a free nation they knew that if men became too powerful it could return. SO LETS GET OUT THERE AND STOP THEM.

      I would say the Bill of Rights was put there to protect us. The first part of its Preamble reads: “THE Conventions of a number of the States, having at the time of their adlopting the Constitution, expressed a desire, in order to prevent misconstruction or abuse of its powers, that further declaratory and restricetive clauses should be added:…”
      The Bill of Rights starts with “Congress shall make no law…”; the 9th Amendment says this restrictive theme includes all rights whether enumerated therein or not. And the 10th Amendment reminds Congress that “powers not delegated to the United States by the Constitution…are reserved to the States respectively, or to the people.”

        This is true and that’s why we have to hold all those for the distruction thereof accountable for their actions. It’s going to take new blood in the Congress and Senate. The Presidency has to change hands also. We can do it if we wake enough people up and make sure we have a true and honest free election. We need change in the way the News is reported and we need to hold them accountable also for false reporting because it is only commiting an act of fraud on the American people and people of the world. It makes me sick to think Journalism has been destroyed in this country.

    Interesting comments from all . I might point out however , the Constitution says what it says in plain and straight forward language , One has only to be familiar with the language common to the founding fathers and the 18th century . The Constitution was not drafted in some legalese double speak , it was the common language of the day and so that everyman could understand . Sadly , our Supreme Court Justices of liberal bent began adding their own ideas on how it should be interpreted . Liberal Presidents select Justices who in turn rule in favor of that President wanting some grey area of legislation. LBJ got a civil-rights amendment into law that favored the black portion of our population. Had the Constitution been adhered to , no amendment would be needed , blacks here were citizens of the United States therefore protected by the Constitution . And the same reason applies to women’s rights, they too are citizens . If the Constitution is enforced they are protected with no need to interpret or add specific amendments .
    And then we have those who simple ignore the Constitution in order to promote their own agenda. They start with something small and work their way up to bigger things . They speak out against our Constitution calling it outdated and obsolete. Our Justices belittle it publicly. These people are sworn to uphold our Constitution not destroy it or to change it to suit their whim.
    Our founding fathers knew the dangers of big government and to much power in one persons hands . They drafted the Constitution to have checks and balances and prevent a consolidation of Absolute Power by any individual or legislative branch . This is what the Socialists of our elected officials do not like . It blocks their attempts at power and allows the people a voice . America’s government is for “We the people and By the people . It has served us fairly well for over 200 years and barring tampering will continue to serve us well. Tell Washington no , and vote out the dead wood and those who want the Constitution rewritten to favor how they think it should be .

      The founding fathers were not the only ones who wrote the Constitution, it has been amended 27 times since the founding fathers wrote the original over a period of 201 years (1791-1992) and can again be amended in the future. The founding fathers never intended that the Constitution as they wrote was cast in concrete or they would not have placed it in the constitution, meaning for every generation coming after them to change what they had created and they did not restrict it to the culture of their time. The Constitution belongs to every generation not just theirs. I find your understanding of the Constitution to be sorely lacking in its correct understanding.

    I just read a hair raising article that the Feds are getting ready to SELL off the Infrastructure we paid for. Interstate Highways are to become Toll roads some at 75 cents a mile from coast to coast owned by Foreign Investors. The Feds don’t own what we PAID for with Gas Taxes, & we have to step up & prevent the sale of even one. Do YOU realize what Food, Fuel, & everything we buy will COST coming over Toll Roads? Prohibited COST will make you a Prisoner in your own home. You will have to ask in Chinese for permission to travel. The cost of finding work or holding down a job will go through the roof!

    You “Tenthers” lost in 1865 – with the defeat of the southern rebellion. There is a reason why we have a strong central government – because that’s what the American people want. They were tired of the “Boss Hog” type of local politics and chose a central federal type of system.

    The first three words of our constitution say “We, the People.” So, the question is “Who is the Government?”

    WE ARE! Weither you like it or not. The problem is most people DO NOT VOTE. We have surrendered our Republic to a “professional” electorate rather than everyone voting their own self interest – which is what the Framers wanted. Believe me, if everyone who COULD Vote DID Vote, we would have a totally different government.

      I say “ostensibly” because no doubt our Leaders really had ulterior motives for both wars, as they usually do.

        Secession is not a power delegated to the United States by the Constitution, and is therefore reserved for the States or to the people.

        It has to do with that 10th Amendment that you seem to hate so much, and insult real Americans for supporting. I can understand your position though, because if you acknowledge the 10th Amendment for what it is, then your entire house of cards comes tumbling down.

        I think we should all just ignore flashy. There has never been a legitimate argument from that quarter. The moniker should be fluff and puff. Because smoke and mirrors seems to be the order of the day from those that refuse to see the light.

        But ignorance is bliss. Right flashy? You must enjoy every blissful moment of being an obstructionist. You should read world news from a reliable source, go back to school then return and be constructive. Unless you plan to bail out your big gov ideas with your own money. Stay out of my pocket.

        Pascal Salin (born 1939) is a libertarian economist, professor at the Université Paris-Dauphine and a specialist in public finance.         Flashy claims that a state does not have a justifiable and legit claim to being able to usurp federal jurisdiction and law.

        States do have the power (and the DUTY) to resist any UNCONSTITUTIONAL law or action by the federal government. The 10th amendment addresses this by saying what powers the states do NOT have.

        I looked over the Constitution and there is no limit on the states refusing to obey unconstitutional laws. I didn’t see anything there about states being limited to remaining in the union either.

    The federal government has way too much money. Income tax should be abolished and FICA should be a separate account. Elected officials could be paid by the corporations that put them their in the first place. Maybe they won’t have so much money to spend on those annoying ads. Maybe our elected representatives would then remember that their position is one of service to their country. Maybe then the individual states could do their job of serving their constituents instead of relying on the feds for handouts.

      Every politician does serve it’s constituents. Each and every one of them will take money from Washington and put it into building projects within their states. Every Senator or Representative will advocate for their constituents by taking their share of the pie. Most constituents willingly accept this “gift” from the government to help handle financial necessities within their state. That hasn’t changed in several generations and Conservative states and more Liberal states take the money. .

        In addition to Alex Jones reasons, I have some personel incite that I beleive to be true.

        Fox News since it’s inception has been an intrigal part of MSM. Rupert Murdoch/Roger Ailes (both are CFR members) reguraly attend Bilderberg meetings either in person or via surrogate. Therefore the recent turn of events should be no surprise.

        The initial practices of exposing government crime and coruption by Fox News was designed to gain maximum market share. Now that maximum market share has been acheived, their reporting is now giving way to standardized mainstream propoganda coverage. Soon, if not allready, Fox will be indestinguishable from alphabet news channels.

        Even at Fox’s finest hour when exposing crime and coruption, their coverage would allways fall short of exposing true culprits, the wizard behind the curtain so to speak. That’s why Beck left, because of unseen, unwritten limitations imposed on him as to how far he could go.

        Now that Napolitano is gone, I expect that Stossel’s days are numbered as well. All to be replaced with nondescript shows like “The Five” where no real issues are disclosed, just an hour of chit-chat.

It seems to me, that conservatism doesn’t sell that well these days and they are moving more toward the middle of the line with a heavy slant on propaganda against all enemies of the Sunni Muslims…. The Saudi rulers have made trillions in investments into this country, from hotels to beverage (Coke) to car companies (Ford) to TV stations (FOX) and the only people that can stop them on their way of ruling this country are their religious and political enemies. Through the super pacs, TV and radio station ownership, Saudi Arabia and other countries buying the American elections and they have a lot more weight and money then the citizens of this country.

    A much easier way to resolve all this is to remember, the federal government was formed to serve the people, by the people, not the other way around. People need to take a stand and say NO and disband the federal government, and then as it was formed originally, form a new federal government with all new laws. There’s just too many thousands of laws the feds have passed to be going down the roster, reviewing each one. That would take decades if not more than a hundred years to do. Obviously, the federal government is broken. What do you do when something breaks? You try to fix it and then throw it out. The federal government is not fixable. You can’t fix greed and power mongers. You can only throw them out and we as the people have the right and the power to do that. We need a few leaders who will do that. We the people need to stop electing politicians and start electing ordinary people. If we elect people who are rich, do you really believe they will have the common people’s interests at heart? Like Romney said, he doesn’t care about the poor. If he becomes president, he will prove that to us and it’ll be more of the same, taking care of his personal cronies just like Bush, Obama, and other presidents have done, leaving the White House more super rich than when they came in, leaving us, the people poorer. Time to wake up People! Before it’s too late. Elect a common man, not a rich politician……

      There is really no way to disband the federal government. Remember who the federal government is, what it is comprised of and how it function.

      The federal government is like a black hole, once it was put into place it feeds on the same mater that created it and gets larger and it is self sustaining. Unless a larger black hole comes around and swallows it up, nothing can destroy it.

      So unless you change the whole political system in the US from ground up, i.e. from the school board to the town, to the county, to the state government and then the federal government NOTHING will change.

      I.M.H.O. the only way to get rid of federal government is to either swing into a full blown anarchy, or a 1 person dictatorship and the collapse that will follow. Or dissolve this country into individual states or blocks and let everyone fend for them self….. and frankly that’s the future I see for this country.

        I do think we need to start over with the federal government, and have advocated for some time that we limit the legislature to only repealing laws for several terms. But, as you point out, this is unworkable in practice. So, the best alternative may be for the citizens to withdraw their consent to be governed at the Federal level, and remand the authority to the individual states for the time being. Some level of anarchy may result, but I think it can be minimized, again at the state level. Once the initial shock passes, the states can elect new representatives to the new Continental Congress, and form a new federal government. The biggest problem I see is the military, control of which would not easily be wrestled from the hands of those in power, and which control could not easily be divided among the states.

        Wow! Did that ever sound like sedition! I can’t believe I’m talking and thinking like this, but it just illustrates my level of frustration with the status quo. We the people have to take our country back somehow.

        I hear a lot about people claiming the federal government is broken and they want a new one.

        Well I say it is NOT broken. The people WE elected to run it are not capable of running it and should ALL be replaced (with the possible exception of Dr Paul). The current people that we entrusted with representing us obviously can’t. They don’t even read the laws they pass. Why would we believe they have read (and understood) the Constitution itself.

        Let us return to the limitations on the Federal government imposed by the Constitution. We don’t have people wise enough currently to rewrite the Constitution or to write a better one. We see all around us evidence of how little is understood about the WHY of the Constitution. How then could we imagine people wise enough to be able to improve on it.

        We could try repealing the 16 and 17 amendments and see if that is really the only thing “wrong” with the Constitution itself.

        I.M.H.O., the time is not ripe for the federal government to fully enslave the American people… it will take another generation or two. It will not happen under Obama. too many old timers that remember the “”good ole times”" are still around and they are fit and fisty.
        In a couple of generations of course when the people that live remember nothing but the current governments ideology (as pushed by both parties) conservatives will be a small minority. Already today conservatives are considered cooks, just wait another 50-100 years and today’s progressives will be considered the conservatives…. And if today’s conservatives would rise up and try to overthrow the government…well, they will say thank you because they just saved them years on implementing their plan.
        So, whats the solution? its simple, education… do what India did, have a peaceful revolution, a revolution with real education NOT colored by idealism and rhetoric… and thus make sure that there always be a lot more conservatives around. And for this we need a cool head, name calling, Birther claims or other equally minor nonsense will NOT win over the average citizen…. The average citizen looks at people that proclaim we are nothing but a private corporation and birthers as if they are nuts…and frankly i don’t blame them. After all, those claims are so far out for the average citizen that they rather call you a loon and walk away then try to learn anything.

      Because once everything is on the book, and ready to go even though it is not enforced, future congress will find a way to declare the states clauses and constitutional additions invalid and with one swoop all the hundreds of items will be implemented. Simple isn’t it? By then, 99% of the people will be drugged and docile sheep depending of the pharmaceutical industry to survive.     One rather important element of the 10th amendment is that it is a States Powers Amendment and not a States Rights Amendment. The 9th Amendment discusses rights and they ALL belong to The People.

    States are government and thus have no rights. Only powers. Same as the Federal Government. They have only powers and a very short list at that.

    Thus governments can only have such powers as The People delegate to each government. Our Constitution and the constitutions of each state describe those powers and also powers that we are NOT allowed to delegate to government even if we wanted to.

      Yes, I agree Vicki. A legitimate government is one that is selected freely by the citizens it “governs”. Such a government has only two tasks, the first is to provide a “level” playing field for ALL of its citizens, everyone must be given equal opportunity. What individuals DO with that opportunity is the individuals concern and they must be permitted to experience the natural result of their choices. The second task is to protect that “playing” field from enemies either foreign or domestic. Government has no business in private choices about ourselves and our bodies. It is in trying to control those choices that we have gotten into such a terrible place with our economy.

        9th Amendment – “The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.”

        This means that the rights of the people and the States are many and indefinite, while the powers delegated to the Federal government by the Constitution are few and limited. It was added to assure that Article 1 Section 8 not be construed to expand the powers of government to violate rights not mentioned in the Constitution, and to state that rights within the Bill of Rights are not “granted”.

        So with your idea of a state violating the 14th Amendment by refusing federal healthcare legislation, and also claiming that the Confederate states had no right to secede, is destroyed in the face of the very amendment you ask others to recite.

        It doesn’t give the states anything. The 14th does. It says everyone is to be treated equal under the law. For the federal government, that means the federal liberties and freedoms are above any right of the state to restrict. It means, federal law prevails in any clash with state law.

        Sniffer, Article VI seems to imply that federal laws always trump state laws, but VI also says “and the Laws of the United States which shall be made in Pursuance thereof”. To me, this last clause says that federal laws that follow the Constitution may not be superseded by contrary state laws. But what about federal laws that violate the Constitution? If a federal law (such as Obamacare) violates constitutional rights of individuals, then that law is NOT “in Pursuance thereof”. In that case, I believe states’ rights, which are reserved to each of them by the 10th amendment, would supersede the federal law. I believe this argument is the basis for states such as Ohio passing legislation that contradicts Obamacare in order to force the SCOTUS to decide.

        Notice above I said protected. Not granted. The Constitution grants NO rights to anyone. It is a specific list of limitations on what powers we can delegate to the Federal government. It is ALSO (see 10th amendment) a list of limitations on the states and was so from before the 14th amendment.

        PEOPLE have rights and powers. Governments (at ANY level) have ONLY the powers the people choose to delegate to their government.

        Our forefathers wisely included a list of powers that we are NOT allowed to delegate to our government at any level. Those powers are most often seen as the powers that states are NOT allowed to have (coining money) but include powers that would infringe on the rights explicitly listed in the Bill of Rights. Thus while the first amendment clearly only restricts the federal government, the 14th amendment extends those restrictions to the state governments. All the rest of the amendments clearly restrict governments at all levels (with or without the 14th amendment)

        The whole of the Constitution becomes much clearer and less ambiguous when you realize that it is a contract to create LIMITED government and not to grant rights and powers to people.

        That is quite a stretch to construe the constitution to expand the powers of central government. The 10th Amendment does not say, “what the Federal government chooses not to use” it says, “powers not delegated to the United States by the Constitution are reserved for the States or to the people”. This means, the states and the people do have more say and more power than Federal government concerning the powers ‘not’ delegated to the United States. That would include any and all rights which are violated by federal law, construed and legislated to expand the powers of federal government.

        Good question Jeep. Douglas took the position, and I agree with Douglas, that we haven’t figured that out yet. No one has asserted any “right” with the 9th protects.         That’s the problem…what it means to you is just an opinion and nothing more. The government isn’t a”referee of sorts”…it’s role is clearly outlined in the Constitution.

        The Feds are not allowed to handle any issues not explicitly listed in the Constitution; their prerogatives are limited to what the Constitution explicitly states. The Constitution clearly says that the Feds’ role is only to provide for the common defense, manage foreign relations, protect citizens’ constitutional rights, establish federal courts; apply and explain federal law (in the judiciary’s case); and a few other minor issues. No branch of the Federal Government is authorized to handle any other issues. So the federal establishment should be strictly limited to these tasks; all others should be reassigned to the states, local governments, and individual Americans.

      Hi Vicki. In referencing the 10th amendment you’ve probably heard ad nauseum that belief in the 10th amendment equals belief in slavery. Whoopie Goldberg, Sen. Boxer, Feinstein, Reed and company always use this to justify centralized government. Actual history tells another story. In the day, the “Supreme Court” “ruled” that any slave captured in the North must be returned by law to the owner. Thats right, it was the “law of the land”. The feds went into Wisconsin and Illionois to take runaway slaves back to their masters. The local governments and people laid claim that the law was not enforceable because it overstepped the Constitutional authority PERMITTED to the Fed. The peoples and their State government laid lawful claim to the 10th amendment and recaptured the slaves from the Fed gov. Yes, at gun point. We’ve all been denied a great education concerning our constitutional rights as individuals first and local governments second, by the Fed Gov education system that intentionally withheld this information from us and our children so as to keep us from questioning their grip on our lives.         FF, the US military will NEVER revolt against an elected government. One that cancelled all elections, shut down Congress, and banned all opposition political parties – yes the U.S. military would DEFINITELY revolt against such an adminstration. But there is a problem with this, the Obama administration will never do ANY of those things. Obama will run in the scheduled Nov. 6 election. Right now it looks like he will win a narrow victory 51% of pop vote (not 53% like last time) and around 285 electoral (not 365 like the last time). Of course a lot can happen in 9 and a half months. He might very well lose a close election if the Republicans could get their act together and unify behind a candidate that the majority find acceptable. Right now this doesn’t look too good.

        I advocate a draft for HS graduates giving two options. Military or a CCC. Military would be for 2 years, a CCC for 3 years. Both provide training and income. Both provide a means to set aside funds (or a government guaranty of funding) for college or advanced trade school skills. Employers would have a highly skilled labor force.

        In a military which is all volunteer, you have professionals. Who are trained to think that they are special because they are in the military. They have, they must have, to be effective a distinct identity and pride.

        As it is, there have been several instances where military officers have been forced to resign because they forgot our system has a military ultimately under the rule of a civilian government.

        because of the low trunover, the increased identity , the mindset becomes a “we” versus ‘them’. They seperate from the identity and understanding of the civilian segment. they think they are different, which evolves in tinking they have some better insight into matters. They view a lack of discipline in the civilian segment as bad and see that organization is better.

        Soon, it become a seperate force in society. That way is the oath of military intervention in civilian rule. I didn’t make the path, it’s shown throughout history.

        A draf would insert civilian forces into the military. It would maintain the mixing of civilian and military identities. And it would provide the necessary training for a strong civilian presence to counter balance in case of rebellion in the military. It also has everyone having a stake in any military action. it’s no longer some faint ideal of ‘our guys’ … it becomes very real when it’s everyone’s sons and daughters at risk. And any military operation then has a heightened scrutiny and requires higher legitimization …

        And it would provide the means for the youth to be able to serve their country, their Nation.

        So..what’s wrong with that?

        Bryan, most people that talk about the military like you do, have probably never worn the uniform. Arm chair quarterbacks. Most people that want a return to the draft have never been in the military and are to old to be drafted. Thats why they talk about all of the peoples kids being involved instead of talking about themselves directly. They never think about themselves being the one drafted. Our military is the most educated in the world. All volumteer too. We aren’t blind robots following orders. Most of us are giving orders, at some level.         From a former active duty Marine. When this country was founded, the Patriots “violated” and “disobeyed” the Kings laws and edicts. Had they not done so, you would not have an American flag today. In the military, it is the obligation of every member to refuse to obey unlawful orders. The folks of the day rightfully declared the 10th amendment forbid them from following this LAW. Sir, the law is an ass.       Third…there is a minor matter which settled the ranking of state powers and the role it has in our federal system, it’s often referred to as The Civil War. You know…where the federal system was established within the confines of the Constitution, and it was decided that there is an umbrella covering all citizens and territories where everyone enjoys the same basic Rights and Privileges. Toss in the 14th and how it protects the citizenry from a state run amok by small groups of extremists and perhaps even the 9th (read the decisions by Justice Douglas for comments on the 9th and the mystery it holds.)

      And don’t try the “plain reading” crap. You guys aren’t able to state how many Rights are specifically mentioned in the Constitution, have no concept of the decisions of the SCOTUS in applying the Constitution to a changing modern society, and who are attepmpting to appply simplistic unreasonable interpretations which few agree, basing it on a 19th century agragrian society, and insisting what ever you say is correct. When it ain’t.

      As long as it doesn’t affect you, burdens others which you don’t like, you’re fine with it. But apply the same rules to you and you’ll scream …

        The Commerce Clause was instituted to give the Federal Government the Power to make trade between the States “regular” (thus the term regulate). That is, to keep the States from protecting their in-State companies from competition with tariffs, quotas, taxes, etc. If we believe the Liberal/Progressive lie about the Commerce Clause, then there is absolutely no reason for any of the other Enumerated Powers, because everything we do in our daily lives involves some sort of Commerce:

        Forcing one to purchase or supply fund for a product or service he/she doesn’t want or need is tyrannical. Why explain how enforcement of Health Care legislation will work, if it is morally detrimental to not allow it to work?

        Such things are not settle by the barrel of a gun. The only thing that was settled is that the Federal government usurped State powers protected under the 10th Amendment, and subjugated them under central governmental control unconstitutionally. The ‘decisions’ afforded by the victors, who usurped those rights to begin with, are meaningless.

        It’s not rocket science, or twisting a definition… secession is not even mentioned in the Constitution; not even how a state ‘could’ secede (no provisions), therefore secession is not a power delegated to the United States by the Constitution, and therefore reserved to the States or to the people.

The ‘changing modern society’ argument does not mean that you can change the interpretations of the Constitution, to insist that whatever you say is correct. As you would accuse others of doing… you have done yourself.

        You are referring to instances where the Federal Government overstepped its bounds as cases that settled Federalism. They certainly where not in the bounds of the constitution. The Civil War was a power grab. It had nothing to do with freeing slaves at the outset. The freeing of slaves was a ploy to cripple the southern states. By the by, the northern state all had slaves that just a few years prior the Civil War states freed on a state by state basis. The same would have happened in the south as it had in the north and all across the other countries in the world. Keeping slaves was not economically feasible with the industrial revolution. Lincoln and his cohorts wanted to ship all the “freed slaves” out of the country so they would not get in their way. Check out the history of Liberia.

        Just because the Federal Government got away with a power grab does not mean that we are to bow to them again and again. I believe we need to get involved and change back some of the “settled law”. It should not be settled at all when it is contrary to the constitution.

        Similarly the SCOTUS is only intended to rule on Federal matters never on State matters. Federal matters are the deliniated ones and any arguments between states. The states are meant to be different. If an individual does not like the laws of its state they are free to move about the country or change them. You see this happening now and it would be a lot more prevelant if the states actually said no to more of the unconstitutional federal laws.

        The constitution is in plain language so that we can understand it. We don’t need any overeducated lawyers to tell us what “is” is.

        14th Amendment – “…No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

        I see no violation of these rights for a state to refuse federally forced Healthcare legislation.

        And the Commerce clause is to allow the Federal Government to regulate commerce between states, not force it upon them.

The 14th doesn’t give power to the Federal government to pass unconstitutional legislation that override laws passed by the states. The 14th specifically protects the “citizens”, not the states. It prevents the states from abridging the rights of individuals, just as the 10th prevents the Federal government from countermanding the rights reserved for the states and the people. The 14th is about keeping state governments in check, just as the 10th is about keeping the Feds in check. It’s about smaller, less-intrusive government at all levels, you schmuck.

READ HISTORY it is replete with atrocities and they can all be traced back to government doing it or sanctioning it. Much as you see with the OWS’s today.
