Arizona Supreme Court Affirms Ruling Barring Woman From City Council Due To Lack Of English Proficiency

The Arizona Supreme Court affirmed a ruling that had barred a woman from running for a city council seat due to the fact that she was unable to speak English at a proficient level, The Associated Press reported.

According to the news outlet, the State’s highest court ruled that Alejandrina Cabrera should not be allowed to appear on the ballot for the March 13 election in San Luis, but failed to list a reason for the decision. A spokeswoman from the court noted that a full written ruling will be released at a later date.

The AP reported that the case attracted widespread attention after Mayor Juan Carlos Escamilla filed a court action that asked for a determination of whether Cabrera has the necessary English skills required of the position.

The Los Angeles Times reported that Cabrera acknowledged that her understanding of English is weak, but she noted that she knew enough of the language to represent San Luis. Up to 99 percent of the town’s residents are Latino, and Spanish is reportedly spoken throughout the city.

    I love it Arizona , hang in there . You do have some of the best Americans in the country there. Your Govenor , Sherif Joe, and many more that are fighting to keep us American You dont deserve to be shot down by the likes of the POTUS.Now that may be a clue to speaking . So many of his followers said they voted for him because he was such an elequent speaker. But we dont want that many elequent speakers fron Mexico either. Just plain english will do, but only english.

    So … since most people in town speak Spanish, the officials don’t need to speak English. I wonder … do they teach English in their schools there?? And I’m sure those officials would never need to confer with people outside of town …

    If you want to live in our wonderful country,speak and understand English.My father was an imigrant from Italy,but he learned English.Obama’s illegal relatives learned English enough to scam the welfare and Social Security system,I guess they now speak English.

    Frankly, I don’t care if Alejandrina Cabrera is a fine woman and a credit to her community and she’s a candidate for sainthood. IF SHE CAN’T COMMUNICATE VIA THE English LANGUAGE, SHE MUST LEARN!
    Most of you aren’t familiar with that part of the country. People, this is NOT a popularity contest. Being able to speak English is a REQUIREMENT. Anyone who wants to speak another language and not learn English needs to move to the country where a preferred language is spoken.
    Look at what poor language skills have done to America. We are INFESTED with people who have TITLES, but they refuse to communicate in English. We have JUDGES and elected vermin who speak non-English and pc crapola, and we even have ‘Biden-speakers.’ It has severely damaged America. We have people in Congress who think it’s a waste of time to READ and UNDERSTAND legislation before they pass those damned laws!
    We’re stuck with a prez who speaks Obummerese, but CAN”T define transparency, character, budget, or hope-and-change. English is America’s language. If you speak other languages in addition to English, good for you. BUT, NEVER forget that ENGLISH is our language. If you’re an ‘educator’ who thinks being brainwashed and pc makes you a ‘good American,’ please LEAVE America and find a country that has low standards for adults. GO, Arizona, GO!

    English is our primary language. If the lady wants to run for an office where there are at least 7 different languages listed as primary, then she should move to Switzerland! I don’t feel sorry for her; had she paid attention while in school, she would have learned English. My guess is that her family is illegally in the US and has been squatting here for a few years and she has learned to thumb her nose at our laws, Constitution, etc. Furthermore, if she needs an interpreter for daily conversations, then she should not leave San Luis!!!

    Back in the 80s, during the Reagan administration there was a bill in Congress to make ENGLISH the official language of the US. It was defeated. There is no official language in these United States, so there could possibly be some ramifications from this decision. I suspect the bliss-a-ninnies at the ACLU will be lining up to take this case.

    I believe we should have a law requiring English as our official language, however because there is not, new citizens may elect to have the oath of allegiance, required to gain naturalized citizenship, delivered in their native tongues, NOT English. Of course, most of us actually speak American and technically not English, but that is splitting hairs.

    That said, with the way the economy is going, we may all want to start learning Putonghua…(the ‘common’ speech of China) for when they come to collect the debt….

    This issue has been brought forward before but Congress will not follow through with promoting an amendment that would make “English” the official national language. Thank God the Arizona Supreme court held up that decision. If it had not, no telling how many other Hispanic/Latino possible candidates would emerge and start raising hell over it. Texas, Florida, New York, who knows which one is next. Uh Oh, wait a sec, where’s HOLDER? HOLDER isn’t going to sue the state of Arizona over this??? Well oh well oh well. . .

      Throughout the world the founding documents are written in the language that is accepted as the National Language. Go to Mexico and try to get along speaking only American English. The Declaration of Independence and United States Constitution are written in English, so there should be no question concerning the national language.

      Early immigrants insisted that their children speak only English as it was taught in school, and they learned it from their kids. But they came here to be Americans living in the United States, not maintaining their original lifestyles and languages. It was a good time to be living in this country as everyone was proud to be here.

        I have a first generation American friend that immigrated here in the sixties from Italy, He was a trucker over there and spoke SEVEN different languages. Here he speaks only english, with an accent, but only english! the only exception I’ve ever heard was when a new immigrant asked a question that he understood. He answered the question and then told the guy to take classes to learn english as he was now an AMERICAN!!

    If one cannot speak and understand the language of where they are then she are obviously disadvantaged.

    It is called incentive – learn it or remain marginalized.

    If you EXPECT society to change to you, they you are misguided. Of course it was worth a try as in some parts of this country this has occurred (think Miami, FL where it appears that you have left the US due to signs even at the airport that are in Spanish first)

    This needs to be rolled back.

    “State law requires elected officials to know English, but Cabrera’s attorneys claimed the law doesn’t define proficiency in the language.”

    And, “Yuma County Superior Court Judge John Nelson ruled on Jan. 27 to strike Cabrera’s name from the ballot. Her attorneys appealed to the Arizona Supreme Court three days later and asked for an expedited ruing because of a deadline for printing the election ballots.

    “Cabrera, who last year launched two unsuccessful attempts to recall Escamilla as mayor, was one of 10 candidates who filed petitions to run for the council.

    “Nelson’s ruling was based on tests administered by a sociolinguistics expert, as well as Cabrera’s inability to respond to questions posed to her in English at a hearing.

    “The action against Cabrera also stemmed from a Dec. 14 complaint made by former mayor Guillermina Fuentes that Cabrera isn’t fluent in English, according to The Sun.

    “Fuentes claimed she has acted as an interpreter for Cabrera.

    “Sociolinguistics expert William Eggington presented the court with results of three different tests he administered to Cabrera, who graduated from Kofa High School in Yuma. One measured her English-speaking skill, another was to determine if she reads the language, and the third was to assess her level of English comprehension.

    “Eggington’s report said Cabrera’s English skills did not meet the level of language proficiency needed to serve on the council.”

      Well the “rest of the story” actually raises even more questions/concerns. If she graduated hight school here how is she not proficient in the English language? This is at the heart of the real issue. We allow too many places to place other languages over English – can you say “press one for spanish – press two for english”! Equal rights and discrimination should not include language – everyone in AMERICA should speak its language – learn it or go home to where they do speak the language you know.

        She probably graduated high school without being proficient in English, because schools get sued if they fail a minority for not speaking English. They get sued for discrimination; so schools are pretty much scared to try and really teach someone and hold them back a year.
        Abolish all the damn discrimination laws, seriously.

        It continues to show up as to why “common sense” has been placed on the “Endangered Species” list. Common sense has been replaced over the past three decades with participation certificates and trophies. Try to imagine how they react when they have to suffer through a power outage in the middle of an ice storm. . . :) Oh yeah, I know, global warming is the cause of all ice storms. LOL!!!

        There aren’t any “laws” put on the books regarding either of them that are to “encourage” them. BAD bigoted laws preventing freedoms in America have been REMOVED from the books.
