Young Mother Asks 911 For Permission To Shoot Intruder

An 18-year-old Oklahoma mother who fatally shot an armed intruder on New Year’s Eve will not face charges in the man’s death, authorities say.

The woman, Sarah McKinley, feared for her life and that of her 3-month-old son when she shot 29-year-old Justin Shane Martin to death as he and an accomplice tried to break into her home, allegedly in search of drugs.

McKinley asked a 911 dispatcher for permission to shoot the intruder, according to The Associated Press.

“I’ve got two guns in my hand. Is it OK to shoot him if he comes in this door?” McKinley asked the dispatcher.

“Well, you have to do whatever you can do to protect yourself,” the dispatcher is heard telling McKinley in a recording of the call. “I can’t tell you that you can do that, but you have to do what you have to do to protect your baby.”

The woman shot Martin after he spent about 20 minutes opening the door, which she had barricaded with a couch, and entered her home with a knife. While McKinley faces no charges, Martin’s accomplice, 29-year-old Dustin Louis Stewart, is charged with first-degree murder in the man’s death. Stewart reportedly fled the scene after hearing the gunshot.

McKinley’s husband had died about a week prior to the incident on Christmas Day, after suffering complications from lung cancer.

    This is a very good case for interpreting the 2nd Amendment to the Constitution. Scum like our President and his rotten Attorney General want to give this right only to governmental agencies like police, military and National Guard. We need to keep the interpretation established by president over two hundred years that all citizens have the right under the 2nd Amendment, to own and maintain a firearm without governmental interference!

      Bob, The 2nd Amendment has nothing to do with how the right to keep and bear arms is exercised. It is a restriction on the federal government to refrain from infringing on our right.

    Abraham Lincoln said “He who respects not the rights of others, deserves them not for himself.” In other words, whoever disrespects another person – as an initial act – does not deserve to have his own rights respected.

    IN other words, when the intruder went to her home, with evil intent, he automatically lost his right to any have good results. People are not entitled to do as they wish, without being held accountable.

    The lesson here is: If you do the behaviour, you pay the consequence. It should always be the perpetrator who should pay the conseqauence, not the person who defends himself or herself.

    Thank goodness she had some way to protect herself. She had already lost her husband and I am sure she did not want to die or have her baby die. With scum like those two she did what she had to do. I think she is a HERO for saving her baby and herself.

    I don’t know why someone would think she would have a problem with the law.I am proud of her for being able to take care of herself and her child and i’m proud of whoever taught her how to do so.Lawmen can’t be everwhere and one can’t bank on them getting there in time to save you.I know a lot of Lawmen and I do think they will allways come to a call ASAP. Where I live we can’t wait on police protection, we have to deal with it ourselves.We will put Sarah in our prayers,She has been through a lot.

    When I first saw the headline on CNN yesterday, I thought for sure the mother would end up losing her child and going to jail.
    The results could be as bad since Stewart (the accomplice) was arrested, charged with first degree murder and then released on $50,000 bail!

    Women shoots home invader who new she wouldn’t be charged. Go figure now at days I’m surprised her child wasn’t taken away and her in jail using the 911 tape as evidence. Back in the day we never locked our doors or our vehicles and if anyone messed with it you could shoot, no questions asked. After Katrina I lived in my neighborhood very soon. There was a curfew, and anyone caught on the road at night was up to no good. I called the Sherrifs department reporting looters on several occasions which they were slow to respond. They finally told me to take care of it myself. The looting stopped, end of story.

    We had a break-in on our block a few years ago in a city of about 150,000. City police were called, it took over 45 minutes for them to arrive. In our instance, the woman in the house caught the burglar hiding behind the crib and screamed so loudly at the burglar that he (and his friend still climbing in the window) ran off. In the end result, police don’t usually stop burglaries, they simply report what happened and (maybe) catch the perpetrators. We are each responsible for our safety and the push to remove guns from our society will only benefit the bad guys. Burglary, rape, robbery and murder should be dangerous professions. Isn’t it elegant that evil actions like this meet with such a just conclusion. My heart goes out to the woman who has had such a wrenching event piled on top of her life’s other personal tragedy. May her life settle back down to the daily grind for a while.

      I was once told by a cop that it isn’t the job of the police to prevent crime. Their job he said was to try and catch the criminal after the crime was commited. I can sort of understand that, you can’t arrest someone for something they haven’t done yet. But on the other hand there ought to be something more that could be done as a deterent. An armed populace would be one of those things. If I could make a law I would require that all households are required to have at least one weapon, it wouldn’t even have to be a firearm, tasers work well and the best self defense weapon ever made is the solid wood baseball bat. You could even hook it into some kind of tax rebate if the homeowner shows a certification from a qualified firearms instructor.

    Martin and his buddy dumped their constitutional rights the minute they decided to go to this girl’s home. She is a genuine hero for killing this scum bag. Only a liberal prosecutor would even think of filing charges on her, the outrage would involve the entire nation. Sarah is a first class patriot and she represents everything the founders intended in the second amendment. I hope the NRA makes her an honorary lifetime member.

      First, I agree with everything said here. The reason I am using your comment to reply to is not to take issue with anything you said but because you mentioned the 2ND Amendment and the NRA in almost the same sentence. Anyone out there who truly believes that the framers of the Constitution intended the 2ND Amendment to protect the rights of hunters to be able to sport hunt or sport shoot is loopy. In fact, in the days that the Constitution was being put together, if you didn’t hunt or fish, hell, you didn’t eat. Folks, understand that the 2ND Amendment was intended for the true government, “WE THE PEOPLE” to be able to arm and protect ourselves from a tyrannical centralized government whether is was led by the likes of King George and Parliament OR BHO and the bicameral houses of congress. I appreciate hunting and hunters more than most people, but the ONLY reason the 2ND Amendment was put into place was to prevent future forms of government from instituting oppressive rule over us. The day that our federal government overturns our right to possess and bear arms is the day the very last hope of our continuing freedom ends. When the government fears the people there is freedom. When the people fear the government there is tyranny. God help us all.

    The woman was certainly justifued in shooting the guy – to protect not only her baby but herself. However, it was foolish of her to ask the 911 operator. A smart lawyer can manipulate that into pre-determining murder. She also was foolish to waste the time to ask.

    More women should be motivated to arm themselves by this story.

I think she acted like a kid getting permission to protect herself and her little one from what she thought to be a “grown-up” via 911 —

She was a mother seeking to protect herself and her child, and did exactly what the law required her to do. She did the right thing to defend herself and her child. Or would you have rather seen her another statistic as a murder or rape victim?

        Her state of mind, one might only guess but a serious load for any age.

As a young woman she probably still felt the need for some sort of permission. I don’t think she was stupid, actually very intelligent and protecting herself from perhaps being thrown in jail.         Deborah–libertytrain is one of the most sensible people on this site. And I happen to agree with libertytrain. I was 19 years old with my first baby, I really do not know what I would have done. Probably shoot the creep or do a lot of screaming. We didn’t have “911″ back then. When confronted with a horrible situation, it would be hard to imagine what any of us would do if we were at a young age. Now that I am older, I know exactly what I would do.

      The only warning shot she should have given was the one she gave…to the head once he was inside. My understanding is in a court of law, warning shots do more to hurt you than anything. The thug knew what he was doing was wrong. He came armed with a knife. He was breaking in.

      I say ‘Good for her,’ and I pray that she is hannot getting advice from people who are going to tell her she is going to have a breakdown for saving both the life of her baby and her life from these thugs. Choir boys don’t break into houses.

        Deer Bob–Your comment about holes in the house–I talked to my nephew last week, and he now has 27 deer slugs in his house. His property is next to mine, and his house sits close to the woods. My other neighbor’s horse was shot in the shoulder but he is going to be okay. I have No Trespassing and No Hunting Allowed signs all over my property. But the weekend warriors are psycho this time of year. The game warden is aware of things, perhaps this will help. I would love to live on my property, but it is not feasible with my husband’s health issues. He has to be near his doctors/hospitals. But if I did live in the country down there, my dogs would probably get shot.

    For Don and the others wondering about where the police were, I would imagine the sheriff and/or the deputy were more than likely out on patrol in a far distant part of the county. And yes, there are places in Oklahoma, just as in Missouri, where it can take an hour to get from one end of the county to the other, even driving well in excess of posted speed limits.

      CP – nice try but the city of Norman (population over 100,000) is about 12-15 miles away. If the sheriff or deputy was on the other side of the county, the 911 operator certainly could have called for help from Norman, couldn’t she?

        Depending on Oklahama laws Norman police might not have jurisdiction in this case. I would have to look it up to be sure but to the best of my knowledge where i live tho local (city) police do not have jurisdiction outside city limits unless in hot persute or specifically called upon by the neighboring city chief of police or the county sheriff to help.

    Our justice system stinks because it allows criminals to have more rights than the victims. So, hats off to Sarah McKinley who did not allow the criminals to freely walk off. It’s time for all of us to take matters into our own hands, especially when our lives are at risk.

    It took them at least 20 minutes to do breaking.
    If she was unarmed she would now be dead.
    This is a good case for an idea armed citizenry.
