New Mexico Sheriffs Standing Tall

Gun Owners of America member Dr. Ray Seidel alerted me to the stirring of freedom that is taking place in his village of Ruidoso, N.M. I have already reported on the first battle with Mayor Ray Alborn and how he tried to impose an unConstitutional gun ban in the village.

I recently interviewed Seidel on my Gun Owners News Hour weekly radio program and asked him about several acts of local interposition in the surrounding counties — all of which underscore the importance of the office of the sheriff and the militia.

For example, near Deming, N.M., is the Gila National Forest. The U.S. Forest Service wanted to make almost all of it off limits for people — until the militia of Luna County intervened. The militia told the Feds that it would resist any effort by the Forest Service to restrict access to visitors. The result? Visitors have continued to access all of the Gila National Forest.

In the Southeast corner of the State, many landowners have working oil wells on their property. The Environmental Protection Agency told the oil operators they would have to stop operating their wells because there was too much risk of harming the environment. At a town hall meeting convened by the EPA, a woman in her 60s rose to address the Feds. She pointed out that her land had been in her family for more than 200 years, and she was not about to let some official from an unConstitutional bureaucracy tell her what she could or could not do with her land.

The woman ended by warning the Feds that her family has many guns and a huge supply of ammunition and they would use all of it, if needed, to keep the EPA off of their land. The locals who had packed out the hearing room jumped to their feet with a shout and prolonged applause. That was in August. So far, oil is still being pumped at full tilt.

In Otero County, villages in the mountains are surrounded by forests. The county commission voted to establish an 80,000-acre plan to manage forest overgrowth. Residents wanted to cut fire breaks to protect their homes in Cloudcroft, but the Forest Service said, “No.” The residents responded that they had to for safety’s sake and were going to construct the fire break in spite of the Forest Service. Residents were told that if they cut down any trees, they would be arrested. But Sheriff Benny House told the Forest Service that if they made any arrests, they would be arrested for false arrest.

Not only were the trees cut down with no opposition from the Feds, but the first tree was cut down by Representative Steve Pearce (R-N.M.). I wish there were many more people like Pearce. The folks in New Mexico’s Second District are blessed with a Constitution-supporting congressman and a number of Constitutional sheriffs backed by the militias of their counties. This is the way that local governments can push back and help the Feds live within the limitations that have been placed upon them in Article 1, Section 8 of the U.S. Constitution.

As you can see, there’s a lot happening in New Mexico. Seidel has been at the center of a lot of it. Two weeks after the people of Ruidoso prevailed in the gun ban debate, the mayor decided to seek revenge. He went to the State capital of Santa Fe and met with Federal officials there. That same week, Seidel got a notice from the Internal Revenue Service stating that he had until a certain date to file his taxes, which he has refused to do for several years.

Seidel makes no secret of his refusal to submit to the IRS, which he considers part of an unConstitutional regime in Washington. The IRS intended to encumber his assets if he did not bend his knee. Seidel visited the county sheriff, who understood what Seidel was trying to do and told him he would have his back. The same was true for the village police chief, the same officer who refused to have his men arrest people who were defying the Ruidoso gun ban by carrying openly in the village council chambers.

Not only were the sheriff and police chief alerted to the possibility of IRS action against Seidel, but so was the militia in Lincoln County — more than 200 men who keep their rifles and battle bags in their vehicles 24/7. They can muster in about 30 minutes at any place in the county.

Seidel visited with the village assessor, who would be the official to place the encumbrances on his assets. Seidel explained (as he does with everyone) that Title 42, Chapter 1, Subchapter 1, Section 1983 of the Federal code would be used to sue her personally for violating his civil rights. That is, he would sue her if any of his assets were encumbered without having first secured a warrant from an Article III court.

Seidel has frequently argued that he will gladly submit to a Federal court (authorized under Article III of the U.S. Constitution) as opposed to a mere tax court (which is an unConstitutional creature within the IRS). As with many administrative agencies, the combining of legislative, executive and judicial powers within the same four walls constitutes the very definition of tyranny, which James Madison warned us about in Federalist 47.

Seidel has used Title 42 on other occasions. One involved a state trooper with an anger-management problem who falsely arrested Seidel’s son. Since being served with a Title 42 suit, the officer has been able to control his anger.

The deadline is long past and the IRS has done nothing, so the assessor is off the hook for now. But New Mexico is becoming a textbook example of how the Founding Fathers envisioned the States would rein in an out-of-control government.

As stated by Alexander Hamilton in Federalist 28: “It may safely be received as an axiom in our political system that the State governments will, in all possible contingencies, afford complete security against invasions of the public liberty by the national authority.”

If there were more sheriffs like those in New Mexico serving around the country, we would be well on the way to safeguarding our liberties against Washington’s “invasions of the public liberty.” It also might occur to the Congress that more examples of sheriffs interposing themselves might result in shrinking down the Federal government to do little more than just funding the national defense.

      What the boog fails to clarify is the extent his stance is opposed and causing a ruckus in Grant County.

      See..that’s one of the problems with the extremist Right. They takle a position, most others sit bck and say ‘ummm….that’s loonier than Daffy Duck…you may want to go foam in the corner for awhile until the meds kick in”.     It is reasurring that Sheriffs are responding to the illegal immigration problem the Federal Gov’t is ignoring…Illegal immigrants are actually committing a crime, and govenment responds by treating them as honored guests…at the expense of the taxpayers.
    Bringing home our military will help in guarding our borders…having them wll not cost more but less.

I am a federal employee, removed from a supervisory position after making a private statement to a peer about my Christian beliefs regarding the Gay lifestyle. I also intend to sue the managers involved after going through the EEO process. The government and the individuals need to be held to account for their actions.

      If Americans merely comply with an unlawful regime, why wouldn’t it become tyrannical! There is no doubt the Feds need to be “challenged” at every turn.

      Every Governor, every State official, the Military, the Police, the Judges, all must make themselves aware of their Constitutional Rights as applied to the power of the States vs Feds. It is the duty of all Americans to see that government is kept in its place and does not usurp more power than it was “granted by the States.”

      Again, the Governors of these Fifty States, and their local governments, can and must challenge unconstitutional acts, mandates, or laws coming out of Washington. Americans need their States to protect their freedom from an out-of-control Washington.

      Americans have no representation in Washington, as we have seen for the last three-plus years. Congress, the people’s representatives, are willingly greasing the slide of America into Marxism. The States must rescue the people and the Constitution.

        Not only do we have no representation in DC, but the government has officially turned against we the people. We are now at war with them.

        We just have to decide what kind of weapons we will use, because if we wait too long, we will be struck down before we know what hit us.

        Truth and information are our best bets, and standing firm… Noncompliance with false “laws”. With truth and justice on our side, that already gives us an edge.

        Remember, “Greater is He who is within Me than he who is in the world”.

      Insurgent it is my opinion that elected federal officers suffer from the effects of swamp gas that leaks up through the foundations of all government buildings that were originally built on a landfill of a large swamp. How else could you explain the turnaround of people who look upon voters as intelligent people while running for office and gibbering idiots after election time?

      Very simple, once they arrive in Washington D.C., they must willingly, under oath, submit to established Federal Laws which have respectably placed “common sense” on the “Endangered Species List”. Therefore, they, without question, must relinquish all rights and honors of using “common sense” as they may have once been capable of. This is the manner in which preferred Federal Law can, will and is imposed to benefit those that are self acclaimed “Powers that Be”. HA, sound a bit “Federally”. . . :)

        Why of course they are Ret. I was merely joking about the lack of common sense used in Washington. Besides, there have been instances of Federal Law being side stepped just as Obummer has circumvented Congress. Example, Cap & Trade – that didn’t go anywhere with Congress so they turn it over to Cass Sustein (one of Obummer’s prized possessions) via the EPA and the regulations that have come forth since are astounding. Again, I was merely joking about the lack of common sense in Washington.

    It’s great to know that Uncle Scam’s addiction to power also has a downside. Cloudcroft, in particular, is located in an area where it takes effort to get there. It’s beautiful, and the idea that Uncle Scam has ‘plans’ for that area sickens me.
    Uncle Scam’s power addiction has limits, and like all bad habits, it will be countered by those who know the difference between justice and raw criminality. Way to go New Mexico!

They had been marching to their own tune until the tea parties across America rose to the occasion…had it not been for them, the debt ceiling would have been raised to God know where without a single heart beat. The Demorats should change their name to the Socialist/Marxist party as that is what they have become. Vote in 2012 like your very life and that of your family depends on it, because it literally does. If we allow these people to collasp America, we will never be able to get our Republic back. Every state should be doing what New Mexico did. When Gov. Perry of Texas tried to stop TSA from groping and violating your constitutional rights at the airports, Obama said he would shut down airlines from coming to Texas….had I been governor, I would has said go ahead if you think you are big enough…stop the airlines, and I’ll stop the flow of oil north. We have to, at some point, stand our ground and draw a line in the sand and dare them to cross it. The states, according to the Constitution, trump the feds on most things, and it is time for us to show them that they do not have tolitarian rule.

        Yes, you’re correct. The underpinnings of the fascist “union” started with Lincoln. Although Lincoln was venerated when I was taught in grammar school, it wasn’t too long before my opinion changed. However, I am one of the few, as can be noted by the fact that the Lincoln memorial still is maintained as is Mt Rushmore.

        You are also correct in pointing out that the federal government has been taken over primarily by those whom I would classify as sociopaths. Why not; what better platform for people with limited consciences to feed their egos and pocketbooks than in an overwhelming bureaucracy?!

        I can only hope that the stirrings which are evident result in a breakup of the USA union. It served its purpose in prior times, but it’s grown to cancerous size.

        I agree. Lincoln was one of the worst Presidents in our country’s history. He trampled the Constitution as if it were nothing, and every President since has used him as a model of how to strip our rights. He was forced into signing the Emancipation Proclomation, and that only freed the slaves in the rebellious states. Washington, D.C. is rapidly losing touch with the real world. They are starting to act like the aristocrats that the original colonists rebelled against. Some families (Kennedy in particular) seem to have hereditary seats in the House and Senate. If we the people don’t start acting, we will soon lose what freedoms we have left. Try to encourage everyone you know to vote. Remind them that it is their DUTY to do so. Too many people think that their vote doesn’t count. This is true only when they don’t vote. The people of this country need to get involved again, and fix the mess we have allowed to happen.

        I’ve come to think that Abraham Lincoln probably did exceed his constitutional powers when he invaded Southern states to forcibly keep them from seceding from the union. However, I don’t think this was the beginning of the federal government’s over reach. You can actually see signs of this beginning in George Washington’s administration. It seems many of our Founding Fathers, Alexander Hamilton chiefly among them, were in favor of a strong federal government from the very beginning. So, the struggle between Hamilton and Jefferson has never been resolved in the minds of the American people regardless how the courts have ruled, and will likely continue until the American population finally resolves it one way or the other.

While hedge fund, junk bonds, hostile take overs, and sell offs, forced retirement, and leverage take overs and downsizing became common place all across American. Some Americans did rather well during those years while many did not fair a well.

        Today , we still suffer from what Reagan unleashed. Those were the beginning years of “disparity” that continue today. The years when lobbyist setup shop on Capitol hill and was warmly received.

        There is a smoke and mirrors game here that even I fall into from time to time. We blame Obama for out of control spending. This is not the key to the story. CONGRESS, specifically the House creates the budget. The president merely asks for money from them. THEY are the ones who provide the money. Even the senate merely oks the budget. So to see who or what is really the cause you need to dig deep into which party is in Congress and how much more or less than the President asked for did they authorize.

        This is a non trivial task.

        Since Bob brought up President Reagan as one of the spendthrift Republican Presidents let us look for a moment just at his situation.

        There are many ways to look at the national debt. One thing is for sure. Our federal government has been accruing more and more debt year after year, regardless which political party held the Presidency. Another thing is for sure. We cannot sustain our government with all of its obligations at the current rate it is accruing debt. Most experts I listen to tell me that our social programs, especially Medicare and Medicaid, are the chief drivers of federal debt. It doesn’t appear to me that the new Obamacare law will do anything but make this situation worse.         My reading of the data tells me the federal debt has already gone up to just over $15 trillion with much more coming in social spending that’s on “auto pilot.” The owners of this debt can be divided into near equal thirds; 1) Federal reserve, Social Security, and other government programs, 2) foreign countries, and 3) American public. The sad part is that the real owners of #1 are largely American taxpayers because ultimately the only way to pay back loans made from government programs like Social Security is to increase tax revenue. In other words, the way Americans will get the benefits from these government programs is to increase taxes on themselves. At some point, the cost will exceed the benefit, so even if we increase taxes enough to sustain these programs, the cost in additional taxes will be more than the benefits we will receive. The other thing that Americans should know is that bondholders (#2 & #3)will take priority over American citizens who are promised social benefits. When the crunch comes, the government will have few options to balance the books. One will be to cut social benefits, because defaulting on their bonds will always be the last thing they will do. The sooner we modify these social programs to reduce costs, the less pain there will be.

        There have been several citizen grand juries assembled, as well as a very big public court in New York, put together by Rev. Manning to investigate O’s legitimacy to hold office. They had brought in a true volunteer judge and real attorneys, and huge numbers of people showed up. It went on for a number of days, yet was completely ignored by the press.

        How many of you have heard anything about these citizen actions? The press ignores them, so officially they don’t exist.

        I’ll bet that if we could come together, all of us who seek justice and remedy for the superimposition of an false government upon the people of America, we could make an impact. There are more of us than anyone thinks, and that is why the guv is working so hard to cut us off at the knees before such a movement becomes too formidable.

        Speaking of California…I saw a video of a town meeting up north…Amador county, I think…where law enforcement and the local government has awakened to the intrusion of the feds, and are refusing to comply with the land grabs. We cannot rely on the corrupt courts and the communist judges twisting our laws to suit their agenda. We have no other recourse but to use the threat of physical force and i have been saying this for a long time. What ails us cannot be solved through the courts and the ballot box. There are too many stupid people voting in communists masquerading as Democrats. It will eventuallycome to a real life version of the movie Red Dawn except the enemy will look and speak like Americans instead of Russian or Cuban but they will truly be the enemy within. I don’t see how any other outcome is possible. There can be no compromise between what defenders of Liberty believe in and what communists believe in. We are as different as night and day. Just as there could be no compromise between the Allies vs. the Nazis, The Colonies vs King George, The North and South in the Civil War, East and West Germany, North and South Korean and so on. One side or the other will have to prevail and the other side is going to have to surrender or die. We cannot keep going the way we have with the two sides always trying to steer the same car. It doesn’t work and it’s not what the FF envisioned. They never meant for their to be 2 political parties always fighting for their vision of this country to prevail. Gov’t was just supposed to be very limited and basically just provide national defense and everyone was just supposed to go about their lives. It was never meant to be this bohemeth it has become.

        The solution is simple to say, but hard to carry out. First, McCarthy was right about Hollywood! Vote with your feet and cut off their funding. The next thing to do,if possible, is move away from liberal areas. You’ll get no support there. Move to a conservative small town/suburban area with like minded people around you and organize the way those people did. We must also support local food growers and resist the FDA. Get them out of our food supply. By supporting local farmers, you’re choking corporate farms, giant food corporations and the FDA. There’s more, this is just a start. Let’s keep it rolling.

        The viewing of all comments, which all are well taken . The first step, in my opinion, is to use the ballot box as a must in being the first line of defense. Secondly, a well regulated militia, under control of every county sheriff, is almost impossible in the present stage of an out of control Federal Government. Once again, in my humbled opinion, the first step is in the power of the ballot box in voting term limits not to excede two consecutive two year terms of office. Having the terms of election to be on the last year and first year of the sitting President’s last of the first year and first of the second year. The “”"GOOD OLE BOY Click”" issue would be nearly impossible to exist.

        eddie I think a large part of the story has not to do with Seidel not paying the income taxes (That is something a great many people myself included question both validity and fairness). It was also about the Second Amendment and the likelihood that there would be armed resistance against an overreaching federal government.
        Can you imagine the headlines should the EPA decide to shutdown the oil wells during a shoot out? Or how about Forest Service shoots homeowners over firebreaks? It would have made a public relations nightmare for this administration. On a personal note I think that we need more of this kind of disobedience. It might end up forcing some common sense into the business of governing. As it stands now as exampled by attitude there is a mindset of superiority and not equality that permeates the fed. I doubt that the fed will just let these incidents lay. They can’t allow this to grow.
        By the way unless I made myself clear I support fully these actions. Replace the income tax with a sales tax where everyone pays including the 48% and I will support that too.

Lets get back to the basics we all stand behind this document but so few have actually read it “Constitution for the united States of America” (1787) adopted circa 1791.         Believe it or not Kate and Mike there is another side to the story so don’t drift off to sleep yet. Yesterday anti-tax “champion” Douglas Bruce in Colorado was found guilty of fraud and avoiding taxes. Douglas has even run for public office and says the same things I hear on this site. For better or worse he is a constent cog in the wheel always jamming things up in Colorado. He once had alot of supporters but few follow him anymore because of his extremism’s. It’s one things to want fair taxes or even lower taxes but he didn’t want to pay any. You know,make the other guy pay. Well we are all the other guy! You have the Freemasons(militia) in Montana doing the same thing and refusing to pay any taxes. They also have mucho guns to prove that they won’t succumb to “government tyranny” (pay any taxes) as they say. How about the Sovereign Nations who refuse to pay taxes and killed those two police officers in Memphis over a traffic stop. They figured any one who works for the government deserves to be shot.There is way too much insanity on the right to fall for this entire story in the article. So I have no intentions to “emulate them” as Mike says.

        That is the thinking of the brainwashed masses. We are supposed to be free from direct taxes. The 16th amendment (which is what is professed as the act that allows for personal income taxes)changed nothing. The IRS has conned everyone into thinking so. It is unconstitutional. In states of the union the constitution affords the federal government very limited jurisdiction. Our labor is our god given right and the federal government has no right taxing it. The personal income tax is a fraud and hopefully one that will soon be exposed!

        I would very much admire anyone with the guts to defy the money-grabbing feds, aside from the fact that such taxation is a violation of our humanity. When it is being used for things that we abhor, and yet those things are being done in our name, it is right and just to refuse to pay up.

        I am seriously considering moving to New Mexico and joining a militia myself. The rerst of the country needs to emulate them, not denigrate them.
