A Wisconsin judge has ruled that people in that State have no “fundamental right” to consume any food, own or use dairy cows or consume the milk their cows produce, without government permission.

The ruling from Judge Patrick J. Fiedler was in response to a suit filed by the Farm-to-Consumer Legal Defense Fund on behalf of Zinniker Family Farm and several other farms against the Wisconsin Department of Agriculture, Trade and Consumer Protection.

Wisconsin is one of the most restrictive States in the nation where the consumption of raw milk is concerned. Raw milk sales are prohibited, but private cow share agreements (where people purchase shares of their own cows) are exempted.

A copy of the judge’s ruling can be read here. On page four the judge writes:

  • “Plaintiffs do not have a fundamental right to own and use a dairy cow or a dairy herd.”
  • “Plaintiffs do not have a fundamental right to consume the milk from their own cow.”
  • “Plaintiffs do not have a fundamental right to board their cow at the farm of a farmer.”
  • “Plaintiffs do not have a fundamental right to produce and consume the foods of their choice.”

This ruling begs the question: What country does this fascist judge think he lives in?

    This is not just an issue for Wisconsin, sometimes these rulings grow legs and travel interstate. And it is not just an issue about Dairy-the FDA seems to think that they can tell the US citizens what they can or cannot eat or grow and push GMOs on us. It is about corrupt public servants and corrupted government ideology. I also consumed raw milk as a child and never got sick-in fact I have a very good immune system and never had any childhood diseases and don’t even get so much as a cold today-maybe thanks to raw milk. While you are at it look at the ingredients that are in the bread at the grocery store. Take the challenge and see if you can get some mold to eat that bread. These ingredients were added in the 90s to allow the baking industry to be lower their sanitary standards and extend the shelf life of their products. This trampling on our Constitution and our liberties and rights have to stop now! It is my opinion that our best hope is for Dr. Ron Paul to win the 2012 Presidential Election. I for one just got a second house in Wisconsin and will follow the link.

    The Government Watch Dog is going way too far. It’s time for Wisconsin and other victimized States to stand up and do some legal yapping to get rid of the BS they are handed.”This Government” does not know what is good or bad. Look at the mess “The Government” has put us in. Now, we are not to drink or eat our very own products?! Looks like a BO “agenda” that is being carried out to the fullest. We have to figure out a way to rid ourselves of the huge epidemic and that is Big Government!!!!!

    Judge Patrick J. Fiedler must be a disciple of Cass Sunstein.

    Perhaps he needs to have a meeting with Patrick Henry and Samuel Adams. I am sure that they would offer a desenting opinion to his “radical hippies of the 60′s” diatribe.

    After reading this article I was applalled by the “gall and the oddasity and arrogance” of this judge. By what precendence did this judge use to base his ruling(s) on? If this ruling doesn’t give the meaning of “Absolute power corrupts absolutely”, then I don’t know what does. Do you? It is obviously clear he is mentally duranged in his mental capacity to make fair and just decisions. He has clearly shown that he is mentally incapable and he does have an ego to satisfy (Power over the people). I do not know what the proceedures are for your state but he has demostrated that he needs to take a “permanent” vacation from his position as judge for the state of Wisconsin because of his irrational thinking. How was this judge put into his positon? Was he elected by the people or by the state legislature. If he was elected by vote from the people then logic dictates that the people can remove him from his chair by special vote due to his “Mental Incompatence.” His thinking processes has failed him, obviously, which will give justification for his removal. And for his past rulings, to include this one, would become automatically become “null and voided”. So I say to the people of Wisconsin, ban together to stand against “his will” or be ruled under “his will”. The choice is yours. So I ask the people to do the “right thing” and help this judge for a much needed rest form his judgeship. This judge needs to understand that the people need relief to pursue about their own business without fear. This judge must understand he needs this rest. Remember, the people of Wisconsin have a choice but the judge cannot because he is mentally encapable of making any rational decision(s) on his own any more. Therefore, the people must prevail in this matter as soon as possible. The longer you wait, the longer it takes to replace. Remember, remove him for “No Confidence” and other charges for his sake. He needs rest and soon.

    This is bizarre. I know WI is a diary state but it is full of pockets of the old type Europeans. I wonder how they are dealing with this.

    I just watched Vanishing Bees. They are gone–not just dead–gone. The few bees I had this year, after an absence of five years, were black and white, not yellow and black.

    That SB510 is dangerous. It was said it wouldn’t effect the back yard garden but we are seeing it.

    At first, I wondered about the insane behavior to protect us from ourselves but now I am beginning to suspect the government knows what is going on and the pollinators are are infected with GM stuff that reacts to medicines. Small wonder the doctor asks what medicines one takes. It certainly isn’t for our health but for the possible interactions.

    I too grew up with local dairy milk and didn’t have problems with lactose intolerance until much later in life. My kids also had real dairy milk. I wouldn’t feed the grocery store crap to my dogs, much less drink it.

    I find myself now a days almost continually awed by the wisdom and foresight of our Founders! I’m 63, growing up when I did we had a lagre amount of trust in our Government. Oh yea there was corruption, but by todays standards the Congresses of my youth would be considered a Saintly group!
    Got a little off track there sorry! What I wanted to share is a statement by Thomas Jefferson that when I first read it , I couldn’t understand th significiance of, NOW I DO! “If the people let the Government deciede what foods they eat and what medicines they take, their bodies will soon be in as sorry a state as are the souls of those who live in Tryanny”

      Same here. Now the hay fields are being attacked. A man trying to build a house on his own property is being fined by the EPA for not planting trees on it and waiting 3 yrs to see what the eco system does.

      We are in trouble. The farmer down the road came down to see what I was planting in my own yard. Rarely ever saw him in 13 yrs, now it is more like every week.

    Lord o mercy, Ijust found out I gotta die. after raising a bunch of kids on the farm and myself,drinking raw cows milk. my my I’m only 80 years old and expected to go way past 100. I’ll quit the cows milk and start on Jack Daniels, it isn’t pasturized

    That judge is what some like to think of as an “intellectual.” Some “intellectuals” have all the common sense of a cracked brick. That particular judge in Wisconsin should be told straight to his face that NO Wisconsin judge has the right to breath air or to continue to live without the advanced, written permission of the people of Wisconsin.
    This kind of insane behavior is to be expected, but it should NOT be tolerated. A judge is supposed to be a source of wisdom and knowledge, and when that isn’t forthcoming, then the people have the RIGHT to protect themselves.
    That same RIGHT also covers elected lower life forms in all 50 states [57 states, according to a certain Washington yahoo]. We are very close to having to protect ourselves daily, and our non-leaders need to know that the days of gradualism are over.
    Tyrants MUST get what they deserve. If they don’t like it, let them flee to another country. Period. We do NOT need permission to be FREE!

      Agreed, 99% of people do not know what the Constitution says. Our family reads or listens to the Constitution, Bill of RIghts, and Declaration of Independence at least one time a year and often more. We make it a point on Memorial Day, Independence Day, and Labor Day to listen to at least one of them, if not all. It is a real eye-opener.

      While I sincerely hope that the percentabe is significantly lower than 99%, I believe that a vast majoriety fall in that group. The saddest part of that is it is only 14 pages long including all 27 Amendments and, I, believe even the Declaration of Independence!
      Again I’m awed by the foresight of the founders. I believe that it was T. Jefferson that said “If a Nation expects to be ignorant and free, in a state of civilization, it expects what never was and never will be”

And they didn’t all agree with the new ultra-conservativism that is going around.     small family run dairy farms have been raided by swat teams for selling raw milk. tell your congressmen to get out of our lives. we have a right to eat what we want. the fda, epa fcc etc have become the big bother henchmen for obama and the progressives.

    Pasteurized milk was done to extend the shelf life of milk. This extends the profit from the product. Pasteurized milk is dead milk. It has very little value to us. The protein structure is changed in pasteurization. This helps to cause people to be lactose intolerant. Many people who are lactose intolerant have no problems with raw milk. Raw milk is safe if you get it from a farm that is careful with the care of the cows and the handling of the milk.

      You are very right. I have a friend who has 5 children and because of intolerance of pasteurized milk for some of them had 3 different kinds of milk (if you can actually call soy and rice milk…milk) in his refrigerator. After some research he tried raw milk and all of his children drink it without issue. He now has one kind of milk in his refrigerator.
      The state government and the federal government need to stay out of it.

      I had my own cow, and I can tell you that the milk was still fresh 21 days out! It is all in the handling. Pasteurization just gave the milk producers/sellers an excuse to be sloppy. Even Louis Pasteur would not drink pasteurized milk!

      Are you trying to tell us that there is no milk sugars in raw milk? It’s the lactose(milk sugar), and the non-production of the lactase enzyme by the pancreas that causes lactose intolerance. And don’t try to tell me I don’t know what I’m talking about. I happen to be lactose intolerant.

        Yes raw milk contains milk sugars. But raw milk also contains a full complement of enzymes and lactase-producing bacteria the body needs to break down and assimilate milk sugar lactose. These are killed when the milk is pasteurized and homogenized. Many people who are lactose intolerant can tolerate raw milk, but not all.

        I don’t recall saying that no one should drink cows milk. I just said that milk contained the sugar lactose and some people do not produce the lactase enzyme.

        Lactose intolerance occurs when the small intestine does not produce enough of an enzyme called lactase. Your body needs lactase to break down, or digest, lactose (the sugar found in dairy products).

        Lactose intolerance generally develops in individuals as they age. People tend to become lactose intolerant around their teenage years, or during adulthood (ages 30 to 40). Over generations, these ethnic groups don’t pass on the enzyme to break down dairy because they aren’t consuming dairy.

    This judge’s ruling is unenforceable and should just be ignored and disregarded. Is he going to send government thugs to each and every dairy farm to make sure no one is consuming the milk from the cows they own? I suggest the judge himself should go on a one way trip to Siberia, where he may find the legal situation more to his liking.

      All judges should be required to pass a test proving that they understand the constitution of the US. It appears that the meaning of the constitution is not taught in law school, and most of the members of congress are graduates of a law school.

    Wisconsin milk laws were established to protect consumers of milk from a host of diseases passed from cows milk to children. Roll back progress 100 years, then Cry ” Foul Loudly” when your children are dying. Study history not hysterics!

      Sorry your argument of Dying Children is ridiculous. People have been consuming milk for centuries and it has not caused any problems in the general population. There are those who due to their own body chemistry do not consume dairy products, but overall it is healthy to humans.       People all over this country are drinking raw milk and have been for years. I haven’t heard anything about dying or sick people from it’s consumption. Maybe you should be standing on your podium screaming about cantelope!
      It is my right to choose what I want to drink and what I don’t. I choose to not drink soda and haven’t had one in over 20 years. I would rather they outlaw soda than raw milk – it would certainly make more sense.
      This isn’t about raw milk – the heart of this argument should be that the government is taking away your right to choose! They should not have the right to tell you what you can and can’t drink!

      The only reason cows milk would be harmful to people is because through government overreach, they have managed to debilitate our immune systems from which they were designed to work. Read the stats fool, even the use of all these hygenic,(?) bacteriacide hand washes have killed of the beneficial bacteria that we need to have a healthy immune system and combat the harmful ones.
      I grew upon a farm not a grocery store and the raw milk never hurt us children or our parents or our relatives who came for the summers to live on the farm. The problem is, we live not with “Mother Nature” but in concrete and brick superstores which have taken over our lives and bodies. How many toxins do you think you eat everyday even without you fear of raw milk? It will scare you fool!!!

        Combat Seabee has a point about raw milk. As I also have grown up on a farm with milk cows I agree that raw milk is safe to consume. But we on the farm also know when it is fresh and kept refridgerated. We also would have to get our milk cows certified by a veternarian to sell or consume the product. Therefore it is fresh and safe to consume. When it gets old we would discard it. I was watching a 20/20 type show that exposed the lack of refrigeration and freshness in our food transportation. Reefers (refridgerated semi trucks) not being turned on. Perishable food in semi trailers standing to be unloaded for hours, unsafe temperature levels in transport, etc. The industry does not keep close enough attention or control on the products you and I consume and bacteria etc. enter our food chain.

      If people washed their hands, bacteria wouldn’t get into the milk, thus negating the reason for pasteurization. Raw milk is a healthy and safe food for consumption, and in our modern times of vast knowledge you’d think people would know how to wash their hands. That’s where the transference of impurities come from. Now go wash your hands and keep the good food clean.

      Wisconsin milk laws are in place to protect big business… pasturisation only extends the shelf life of milk… not make it safer. Homogenized milk is not good for anything…
      Organic Pastures dairy in California, which since 1999 has sold 40 million servings of raw milk and raw milk products without one reported illness. California in the same period experienced at least 20 recalls of pasteurized milk products.

    I am a european from the Netherlands, a small but big dairy country and also dominated by the farm industry. BUT we have our own freedom and responsebility to consume raw milk and raw milk products. These are full of essential healthy foodstuffs in stead of the dead pasturised products from the factories ! It is a shame for the USA to have such a Wisconsin gouvernement.

      The problem with our country is that we have a government that is in bed with special interests – every big industry from coast to coast. There are very, very few politicians at any level of government, from local to national, that truly care about the people they govern. In addition, common sense in American government is the rarest of commodities.

      I think that many Europeans are seeing the plight of the US. Hopefully, and we are begging, European countries will continue to fight buying any GM products, seeds, food, etc, and make it to the international news. Only then will we see a change here in the US.

      Even little Haiti with their starving people refused US GM food. BM corn has just about destroyed Mexico’s corn crops. France outlawed GM products because the bees disappeared.

      We may not need bombs and military support from the EU but we surely need support for the food supply.

    People rise up and take back your state and force these judges out and any other politician who supports them, and that is your right under the US Constitution. If you feel the judges are in the pocket of the milk industry don’t buy any milk from that industry as well.

    Just don’t drink cow milk at all. Cows milk is for baby cows – NOT humans. Read “The China Study” by T. Colin Campbell, Ph.D.
    Even my granddaughter’s pediatrician told us she did not need cows milk.

        Gerald, You’re off to the right start. However, how about for every dollar a union, corporation, non-profit organization…. gives to a candidate they must give the same amount to the Federal Govt. for use to bring down the debt or maybe first pay back the IOU’s to SS and the PO. Maybe we should make it for every dollar spent pay back two dollars? Either they stop giving or our debt is paid quickly. Maybe we should charge the candidate the same. You take money from the above, you pay the same to the government. This way normal people can run for office.

        “Get the money out” – that’s just about the most counterproductive amendment I have ever seen! Only the very wealthy (e. g., George Soros) could run for office under that scheme. And don’t even get started with “public financing”. That gives the bureaucrats the opportunity to control who runs and how they campaign. It wouldn’t take long for the bureaucrats to figure out they can pick the candidates most likely to cave in to their government employees’ union!

        If you want to reduce the influence of money on politics, you must first reduce the influence of politics on money. If we didn’t have politicians or judges usurping power that doesn’t belong to them, we wouldn’t have people thinking it useful to bribe them. After all, nobody will waste a bribe on someone who can’t do what the briber wants.

        A few days ago Obummer came to California to raise campaign funds. To attend the meeting, tickets were $7500 and the dinner was $800. Now who could afford that but the rich and they will expect and receive favors for their contributions. It seems insane that Obummer has any suppoort from the Democrats.       Your are correct that you should not consume pasteurized milk. It is a dead food. Raw milk however, a staple in the human diet for thousands of years, is an excellent food that provides helpful bacteria, helps to build natural immunity to allergens and contains the helpful bone-forming enzyme alkaline phosphatase.

        I grew up drinking raw milk and it is fine. Not sure why more americans do not have a cow in their back yard along with chickens and a few goats. they would eliminate the need to mow the lawn. I have been really surprised that the EPA has not eliminated the use of mechanized lawn mowers.

        Okay Bob Livingston no argument with you about pasteurizing milk but since you do defend business interests what should they do to keep their products safe and transportable? What about shelf life for dairy products within a supermarket? Can whole fresh milk stay safe from lets say salmonella while sitting in a grocery cooler and for how long?

        whatever the pros and cons are, i am one who is all for the freedom for a person to make their own choices … to choose whether or not they want to find the answers and weigh the consequences, whether perceived good or bad for their own selves. sadly, too many people in this country have given up their ability to think and choose for their own selves. this has allowed too many others to think and choose for them to the point that mass deception reigns and even common sense barely exists for them, if at all … resulting in freedoms usurped and lost. holy yyyyyyIKEs, batman!

        I am allergic to cow’s milk, so I grew up on goat’s milk and (Yuckee) soya milk. Of course this would be illegal in Wisconsin since the goats belonged to my uncle who was also allergic to cow’s milk. His goats were cleaned, and the equipment for milking sterilized after each milking. I can’t stand the goats milk they sell in stores today. It tastes terrible. And also, can anyone tell me why they homogenize goat’s milk??? It comes from the goat already homogenized.

        Actually Frank.. there is little known about the reason Abe Lincolns mother died and yes many said it was “milk fever” but the milk fever then was thought to be caused by toxic plants fed to the cow. If I am not mistaken pasurization will not fix that.

    have to ask “WHY” does this man comport himself this way? Is it just possible that he is serving the
    interests of the milk industry, which in turn presumes to control the government and the courts to do

        If it was an illegal Act in the first place, then it is null and void, right? Are we bound by illegal, unConstitutional Acts of Congress just because they say so? I would seem that most people believe that we are. But that would put us at the mercy of a government that is supposed to be limited…by…US. Meaning, they are ALL POWERFUL.

        Does any of this make sense to anyone? What if we, as a PEOPLE, declare our right and intention to ignore and void all ACTS and STATUTES which are unauthorized by SUPREME LAW and therefore cannot bind us?

        Paranoia at it’s finest Thomas. “Christians burned at the stake”. Historically it was Christians who were burning other Christians they disagreed with. Should rules be relaxed on milk and dairy products for personal consumption? Yes I believe so as long as there is a disclaimer on the product that you eat or drink and do so at your own risk. The same with any food,beer,vitamins(herbal)that you grow or consume on your own or are willing to sell. Like any product buyer beware and it should be packaged to say so. We had a Listeria outbreak in this country and 20 have died and about 200 are still sick so will those farmers take responsibility for making one sick if they allow someone to consume a bad product? Pasteurized/Homogenized products should remain in all supermarkets to protect the consumer and the business.

        If the farmers are responsible for the listeria outbreak then maybe car makers should be responsible for all traffic accidents, ladder makers should be responsible for everyone who falls off, liquor distillers should be responsible for every drunk..well, you get the idea. I do not believe in willful negligence but I often wonder where these food borne outbreaks really originate. Obviously, the listeria didn’t grow on the food. Who put it there? That is what we need to ask. I also think, before we go hog wild finger pointing at the farmer’s responsibility to protect the consumer, we need to assess actual risk. The three things I mentioned cause FAR more deaths than tainted lettuce, milk, melons, etc. Yet the government isn’t pulling out all the stops to “protect” us from those evils. Look at legal drugs and our hospital care. How many deaths are caused by those entities. Is anyone shutting them down? I think we need to ask why the frenzy concerning raw milk and why the attack on the “little guy”.

        What is the big fuss about raw milk? Hell I drank it from birth until I was 18, sometimes direct from the cow. I’m 76 now and in good health. And buy shares in your own cow? What kind of BS is this? The original cows in a farmers herd were most likely purchased, and then the herd was expanded through breeding, and now to consume the milk, or meat from that cow he has to buy it again. Who the hell does he have to pay, himself? One of the most ridiculous decisions I have ever seen handed down by a judge.

        We have a rotten self serving government. Pastuerization destroys the Life Force of most if not all liquids and makes them dead food. Add to that the genetically modified produce which if only is making farmers forced to buy their seed from Monsanto. Then some foods are radiated which also make them dead food.
