NRA Sues Over Requirement To Report Bulk Rifle Sales At Mexico Border

The NRA has sued over a gun law restricting rifle sales in some states.The National Rifle Association recently filed a lawsuit over new Federal legislation that requires gun merchants near the Mexico border to report bulk sales of some semiautomatic rifles.

According to The New York Times, the NRA decided to file the lawsuit on behalf of two firearms dealers in Arizona, claiming the President Barack Obama Administration overstepped its boundaries when it implemented the regulation last month without Congressional approval.

“NRA has always viewed this as a blatant attempt by the Obama Administration to pursue their gun control agenda through back-door rule-making, and the NRA will fight them every step of the way,” asserted Wayne LaPierre, executive vice president of the NRA.

The Times reports that the regulation requires licensed firearms dealers in California, Arizona, New Mexico and Texas to report within five days when someone purchases more than one semiautomatic rifle with ammunition larger than .22 caliber and that can accept detachable magazines.

Fox News reports that Attorney General Eric Holder told reporters the “action we have taken is consistent with the law.”

    There is another aspect here folks, and that is the Obama Administration once again shredded the US Constitution by implementing a law/regulation without the consent of congress.

    If we focus on removing the politicians that do not adhere to the constitution, the problem can fix itself.

    Just a point of curiosity…
    How many of us have EVER actually bought more than one at one time?
    I know I’ve been interested in/obsessed with some particular caliber (say, 44 Spl), and picked up several in quick rotation as I spotted ‘em; also, time being in the short supply that it is, and travel becoming as onerous as it is, I could see a case for buying two or three bargains at the same time. But toys being as expen$ive as they are, I cannot imagine anybody buying even two AKs or Maks at once for personal use…

      I have a friend that has the money to buy any two he wants and the background to do it legally!! He is, right now looking at a 5.56 and a mini 14. If he so decides, he will buy both! He worked sometimes 16 hrs a day at good pay and now is retired, into guns, coins and gold!! He’s doing quite well in all of them!

    Whoever wrote the article doesn’t seem to know the difference between Legislation and regulation! I saw NOTHING in the article to indicate that the REGULATION was the result of LEGISLATION. Of coarse that makes it worse1

    This “bulk” gun control smacks me more as the government’s way of trying to keep families from defending themselves against the criminals coming across the border then preventing drug cartels. Sounds more like control over us so we can’t fight back!

      They want to prevent the dealers in ther border states from even selling guns – and they certainly want to take away the guns belonging to those along the border. After all, if they can do that – insisting it is for the good of all to prevent guns from going to the cartels – they can sooner or later do the same to the rest of the country.

      That is the entire purpose of Fast and Furious in the first place. They wanted to “find” some of those guns and insist that the cartels bought them from dealers at gun shows so they could shut down all gun shows nationwide and also all dealers along the border.

    Since when does what the laws or courts say have any effect on the antichrist’s headlong punge into hell? He ignored the courts on O-care and the drilling moratorium and congress lets him get away with it. he ignored the minimum standards it takes to be a prez. He ignores any law or court decision he chooses to ignore and once again, congress, the bunch of lickspittle lapdogs they are including the new tea party puppets in training, just lie there under the porch and watch.

    I hope the NRA does fight them over this.

    I’m a member and have been for many years but I’ve always felt that the NRA was more interested in saving the guns of a collector than they were in hunting and self defense rights. Of course, someone who can afford to collect is a lot richer than I am too.

      45caliber, I’ve never felt that way about the NRA and I’ve been a member for 40+ years.

      45, the NRA has always recognized that the easiest legal fight to win is for the collector. And, if you can legally keep collecting justified, then it’s a short legal hurdle to keep guns for self-defense. The NRA has been successful in defending both collectors and then self defense owners for many years.

      But, you are not wrong in that many collectors are either privately or corporately wealthy. And, legal challenges are not cheap.

    Gee, don’t you get what Eric is attempting to do? Of course they want to know who bought a few guns that MAY? be sent to the Mexican Drug Lords? After “FAST and Furious” Eric wants to be sure his ATF people can AGAIN track which Drug Lord in Mexico gets the guns to be sure it is the right group. This would be a far better way to screw up than that silly “Fast and Furious” debacle!

      I’m sure there are American police involved in our drug wars but I doubt if Holder is choosing a drug cartel to support. I pity the homeowner who only wants a weapon to support his home and loved ones and has to be caught up in these hyped up debacles. I see little rational or truth coming from either side of the gun issue.

        The TRUTH is that we as citizens have the right to own and carry a gun if desired. The TRUTH is that the government doesn’t want us to have that right as it lessens their control over us and doesn’t fit in with whatever agenda they are following at the moment. The TRUTH is that there is a conflict in the two points that the government wants settled in their favor.

        Yes 45 Caliber Your right and TRUTH—The GOV does NOT want us with WEAPONS of any CALIBER but the SUPREME COURT shot (no pun intended) them out of the water.
        Bravo to the NRA, (Iam a Life-time MENBER) and I also have weapons for protection, LEGALLY, I might add.
        The FAST AND FURIOUS was a bad MISTAKE in the first place, the ATF said so and begged them to stop it but was ordered to STAND DOWN. by Whom? That question was NEVER answered to start with. It should be answered NOW.
        I watch C-SPAN as much if not more than the news, when ever possible. That way I get it from the HORSES mouth so to SPEAK.

        I get the feeling that the ATF wants to be a player in national politics. They never have been but they want to try. Waco was as much of a fiasco as Fast and Furious was. Those are the only two things I’ve seen them try and both flopped.

    Cry me a river! The NRA and Fast and Furious:They both try to be wolves in sheep’s clothing and doing a lousy job. A gun runner is a gun runner whether the government is selling/distributing weapons or a private entity. Neither side gives a rat’s patute about the law but what is in it for their own prestige.

      Oh, I beg to differ…it was not the NRA that was allowing guns to be purchased and illegally taken into Mexico, it was the BATFE(Fast and Furious) with the support of the US Federal Government and this, Obama’s administration…but I don’t expect you to ever admit you’re wrong…such continual negativity towards the NRA…my my!

    The federal law which requires reporting to the BATFE refers specifically to “handguns” whether Eric Holder likes it or not, and the NRA is, of course, correct again. The Administration has no legal authority to require such reporting, so the Obama team loses per the letter of the law…

    The NRA is of course right to challenge the law; but this is mainly a headline grabber for the Fed…to help fix bad publicity from operation “Ooops! I (blanked) up.” And, once again, the Fed has to violate ‘states’ rights’ to get the job done. The dealers in question have to have an FFL but the state issues the dealers’ business license and all reporting of ‘unique’ sales goes to the state first, then into NCIC. This has the potential to cut the states out of the loop. The proof is in the nature of the law, specifically its legal requirements:1)state and Federal laws already prohibit ‘bulk’ sales to anyone without an FFL
    (so, how does a Mexican drug dealer get one of those?) and 2) in five days the culprit can have the guns sold and be vacationing in Guatemala.

      Further to that thought…why would these drug lord’s with literally “billions” at their disposal be trying to get gund from Fred’s Sporting Goods when they can have absolutely anything they want brought in by the plane or boat load from anywhere in the world?
      The whole premise is ridiculous and if it weren’t for the Kenyan and his merry band of pirates, they would get very few, if any, guns out of the US.

        I agree. Further, they get boatloads (or planeloads) of guns now from the federal government. Stuff the rest of us can’t even consider buying, such as RPGs and grenades.

        They even get bulk discounts.
