The 1st Amendment And Truck Decorations

Let me be frank: Today’s column will discuss a pending obscenity case. A woman in South Carolina is facing a jury trial for choosing to decorate her truck with an object that the local police chief believes is obscene. The mainstream media would have you believe that, because the decoration in question could be construed as representing a part of the human anatomy, this story is merely funny or weird.

However, I feel that obscenity laws are like the Federal government’s own proverbial gateway drugs: First it makes obscenity laws, then there is systemic censorship, then the Constitution is being rewritten to leave out the 1st Amendment altogether… and that’s the day we wake up in Oceania, having always been at war with Eastasia.

The facts of the case, according to the Fox News article I’ve linked to above, are simple: “On July 5, Virginia Tice, 65, from Bonneau, S.C. pulled her pickup truck into a local gas station with red, fake testicles dangling from the trailer hitch. The town’s police chief, Franco Fuda, pulled up and asked her to remove the plastic testicles. When she refused, he wrote her a $445 ticket saying that she violated South Carolina’s obscene bumper sticker law.”

Tice found a lawyer, and was reportedly going to challenge Fuda in court — until the police chief beat her to the punch: “Fuda says he is pushing for a jury trial and hopes the outcome will clarify the state’s obscenity laws, leaving no room for misinterpretation.”

According to an article for WCSC TV in Charleston, S.C., “The South Carolina code of laws says ‘a sticker, decal or emblem is indecent when it describes, in a patently offensive way… sexual acts, excretory functions or parts of the human body.’”

“Genitalia is offensive,” Fuda said in an interview with the TV station. “As a law enforcement officer, I’ll advise that person if it warrants a citation I’ll issue a citation. As a father, I wouldn’t want my daughter looking at it.”

David Hudson, a 1st Amendment attorney and scholar, told Fox News that Tice could make a good case for challenging the law, because it is “unconstitutionally vague and unconstitutionally [broad], and it violates the First Amendment.”

The United States Supreme Court has an established standard for determining obscenity, called the Miller test, or the Three Prong Obscenity Test, as decided by Miller v. California in 1973. According to the Federal Communications Commission, the test is applied as follows to determine if the given material is obscene:

  • An average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest;
  • The material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and
  • The material, taken as a whole, must lack serious literary, artistic, political or scientific value.

Would the average person in South Carolina find that the decoration in question appeals to the prurient interest, or rather, appeals to or arouses sexual desire? Note, the decoration in question is meant to depict the genitalia of a bull.

Does the decoration in question depict any sexual conduct specifically defined by applicable law? In fact, what laws regarding sexual conduct are applicable here?

Does the decoration lack serious literary, artistic, political or scientific value? This would seem to be a sticking point. After all, what “serious” value does this decoration hold?

In another obscenity-related court case from earlier this year, Brown v. Entertainment Merchants Association, the Supreme Court struck down a California law that prohibited the sale or rental of violent video games to minors — games that the State had found to have no serious artistic value. Part of the court’s opinion read: “Under our Constitution, ‘esthetic and moral judgments about art and literature… are for the individual to make, not for the Government to decree, even with the mandate or approval of a majority.’”

Censorship always saddens me, but to see it in South Carolina — a State that has openly displayed its devotion to freedom on many occasions — is quite depressing. I would not decorate my vehicle the way Tice did, but that is my choice.

Remember: The 1st Amendment, when correctly applied, should make us uncomfortable — because it applies to everyone.

    So it’s alright to have Television programs embracing the homosexual life style and to pass out condoms to middle school children and to advise teen age girls about birth control methods with out the consent of parents, too murder babies in the mothers womb but it’s against the law to exhibit a pair of gonads on a bumper or trailer hitch, while I would never do anything that stupid I would defend the individuals right to do so.

      If you want to enforce obscenity laws, its time to check out some of the TV programing. What we see on TV now you use to have to pay to see on HBO…the language is hard to not understand. Watch “Two and Half Men” sometime…now that is filth. And who is behind it? What did you say?…Zionist???

      I pretty much agree with you. The schools are now the “moral” (rather amoral) teachers.

      The decoration is probably in bad taste but the products showing naked women are taken for granted. Commercials with half dressed women hanging all over cars, billboards with women with unbuttoned pants. And the cop wants to site a ticket for this?

      Oh, and let’s not address YT and all the filmed teen violence.

      While I am rather conservative, CA has taken over and everything goes now. It used to be this thing would stand up in court as being offensive but where is in real definition? I’ve seen normal trailer hitches look just as much the same.

    I’m not sure it could be called a criminal offense, Disgusting, yes it is. Mainly because of tiny Tots that see it. It refelcts the ignorance, stupidity and rudeness of the driver.It makes you wonder if they are some sort of mental deficient scum bag. A sexual deviant, sex offender? Shame!

    I wonder if there are any strip clubs in SC or lap dances going on? I find them offensive but guys love them. They are protected under freedom of expression. If my child asked me what they were I would just tell them. Children have more common sense then we give them credit for and they would probably think it was just dumb. Send your kids to public school now and they learn in elementary school how homosextuals have sex and that it is a good thing so I would consider this a big to do about nothing.

    to sybucket ….if you interpret the 1st amendment your way … then any language or saying is permitted … death threats … screaming obscenities in church … foul language on TV and radio … kiddie porn … etc .. and the famous “yelling ‘FIRE’ in crowded theatre when in fact no such fire exists …” and then there’s libel and slander laws ..in fact the .. the amendment does apply to political speech .. not advertising .. inflaminmg and obscene and/or disruptive speech … if you think not .. then email me your home address so I can have the westboro baptist church set up an anti-gay demo in front of your house at 0300 hours subday morning..

      According to my local police force, death threaths are not against the law. I was threatened, made a police report and was told, ‘Sorry, but a death threat is not a crime. An actual crime has to be committed before we can make an arrest.’ If that’s true, then drinking and driving is not a crime because it’s only the threat of a crime because a crime has not yet been committed. As far as the bull testicles – I’d rather see them than the people at Walmart. How do you explain to a young child why a woman is wearing jelly rolls instead of clothes? Disgusting but I had to LMAO. The only way for the feds to create stupid laws that take away our rights and liberties is to begin ticketing people like the truck driver. Perhaps her freedom of speech is gross and different from other’s, but that’s what freedoms are all about. It’s her right to display it, and it’s our right to disagree with her and turn our heads. What we need in this country is moral and ethical leaders and parents. There are none, for the fact is a moral human being (leader) would not give the same rights to homosexuals as they would heterosexual and force people to accept it as politically correct. The only thing politically correct about it is the votes liberals would lose if they didn’t give them equal rights. We have scum who lead us, so who’s to judge people like the truck driver?

        The problem ISN’T that “a moral human being (leader) would not give the SAME rights to homosexuals”.
        The problem IS that Government is giving MORE rights to homosexuals and others than the rest of us get.

      Frank, you are so right and that’s why we have those things going on today. Freedom of speech is to allow everyone to state their opinion, not to threaten, libel, or otherwise infringe on another’s liberty to life, liberty, and the pursuit of happiness.

    I agree with James Maxwell. I feel sorry for the officer’s daughter. If her dad wants to keep her from seeing or hearing about stuff like this, he needs to make sure she doesn’t attend health classes at school and she is in for one big shock when she leaves home – oh and if she marries, oh my gosh what will she see?!!!! Also, when at the circus, zoo, seeing animals in pastures, police horses up close, I guess we need to cover the anatomy of the animals so as not to offend people and horrify the children who may ask questions. Growing up in farm country, animal genetilia was not obscene to us. We were not protected from animal mating even as small children. It was a fact of life! With all the violent games our kids play, see sexual organs and body parts blown off of the people in the game, seeing a sexual organ on a vehicle is not a big deal!

      Cat Lover, I think you and others are missing the officer’s point (when he spoke as a father). There used to be a time in society (which still exists in the circles I run in) when young ladies were protected from all types of things like coarse language, offensive behavior, lewd acts or suggestions, etc. Boys were taught from a young age to be gentlemen, to protect ladies, to walk on the road side of a sidewalk to shield them from harm, etc. These were marks of gentility and good upbringing. They were once considered desirable traits. I have eleven children and we own a farm. My children are quite educated on farm births and most of the older ones understand breeding. However, we do not go around making lewd, coarse suggestions about human sexuality nor do we “cover up” the farm animals anatomy. We still lunge at the TV to avoid robbing our children of their innocence due to all the filth on TV and in commercials. This used to be expected of parents. Now, much of society thinks even young children should be exposed to the most vile things. Reminds me of the Roman empire’s lust for the profane…right before their destruction.

      It saddens and disgusts me that most of our society thinks they have become so enlightened and have progressed so far as to scorn what once was the accepted code of decent society. I agree they’ve progressed, but it has been a downward progression. Lest you think I’m fondly remembering ancient days, I am only 44. I still step to the side for a gentlemen to open doors. Most of the time, sad to say, the men stop and stare at the door and look at me and wonder why I’m not opening it. Whatever happened to good, decent training? I suspect all you people so accepting of offensive behavior (cloaked in the first amendment) had a part in its demise.

        It is offensive and I agree, men are no longer gentlemen nor women ladies, part of the great progression of some groups. Yeah, it used to be family decision, now it is a society’s decision.

        Common sense and good upbringing sort of got pushed aside.

        I agree that society in general has progressed to a different standard mostly because of being PC and the womens movement.But Freedoms and liberty are just that our choice not anothers demand that we live by what they feel would be right or wrong,you just can’t have it both ways.What is obscene to one is art to another.What was acceptable once but what is not today.Freedom is not a compliance to laws that take away liberty but what God gave us and that includes morals.When they take God out of the picture they also take morals away also.

        I believe in Liberty for all, regardless of sex, regardless of race, regardless of religion.
        If you and like-minded people want to observe social niceties, I say great, more power to you. But I just want Government and their force to butt out unless somebody is trespassing on the bodies and property of others.
        Personally, since I respect the freedom of women to work and play just as men do, I am disappointed when a woman walking in front of me makes no effort at all to keep the door from slamming in my face. I think it’s rude for guys to do that, and I think it’s rude for girls to do that. But Government has no place in enforcing rules of etiquette.

        DaveH, Well said. I agree with that, but would just add that police power to enforce moral codes is a State matter, not federal. And not all States have the same moral codes. Some States allow nude bathing, but most don’t. Some cities allow topless bars, many don’t.

      Animal genetilia is part of the normal, natural world and our attention is not pointed to that part of the body in particular. In the case of the ornament hanging from the truck, it is neither normal nor natural. Trucks are not male or female and things of this nature on display are gross. The devil is depicted as a little red man with horns. Wonder from where came the idea for red testicles?

But when I see it on a womens truck than to me it means she either got it in the divorce settlement or that she may be the one that wears the pants in the family.

    OMG – People, lets get this straight, “Freedom / Personal Libertys” implies that offensive things either by way of Speach, or Pictures, or hand signs, or what ever form it may be is all part of “FREEDOM.”

    When you start sliding down the slope of what offends one person or the other by controlling what you can say, think, wear, or promote is when you slide straight in to the total opposite of Freedom.

    I know we as a nation have been doing this for years to ourselfs so its nothing new. Thicker skin is needed, as well more {open minds} thats why we are loosing all of our Freedoms, as the “thin skined wankers” who are total Control Freaks, Passive Agressives, or outright IDIOTS who can’t stop complaining about others behavior.

      I completely agree with you. The “politically correct” attitude is too pervasive in our lives and has spilled over into every aspect of our society. While one may think an act might be in bad taste, that is their opinion, and some of their actions may be construed as bad taste by many others. Are we to be judged and convicted for our attitudes unless they conform to another’s standards? That’s how the green movement made so much headway making it impossible to generate energy for growing communities. My motto in life it this, “You’re entitled to your own opinion. You’re also entitled to mine.” I don’t care what you do with my opinion but I am allowed to express it and shouldn’t have to worry about being jailed for it.

    The Constitution of the federal government did not define the moral character of a state or community, nor was it ever allowed to interfere with the religiously founded moral underpinning of the same until the last 50 years. No one ever had the right to intentionally offend the moral standards of of a local people on the basis that the 1st amendment gave them the right to do so. Your view of “conservative” federal intrusion is little different from the “liberal” view.

    I think I have to disagree with DPL their interpitation of the 1st Amendment. Having a copy of the Bill of Rights in front of me, it says nothing about Political speech. It say “Congress shall make no law……abridging the freedom of speech”. That seems pretty clear, just as does Justice Holmes statememnt that “Freedom of speech still does not aloow one to shout’Fire’ in a crowded theater.” As to DPl’s further claim that “Early court rulings confirmed that view”-That may be correct but if the court fulings were limited to just politicks, than a good hundred years of “Art” and thousands of books would be in the trash barrel….not to mention Playboy…so I won’t.

    Irrespective of DPL’s seemingly narrow view of what the First Amendment should stand for, I’m dam glad it takes a very broad view of my “Free Speech.”

    In this particular case, I suppose the testicles could be interperted as a “Political Statement” but as it isn’t artistic, written literature,a painting it will be interesting to see how it plays out. I suppose it could be sculpture……

      I think we need to make a distinction between freedom of speech and freedom of expression. The founders said nothing about freedom of expression while placing one’s freedom of speech as the number one amendment. Clearly they intended a distinction? Just food for thought.

    Sounds like another ACLU case to me. This is where censorship has taken us. The “moral” group will continue to get their way. It’s their way or no way.

      Thinking About (what?!)…where have you been for the last 40 years? The “moral” group (to which I belong) almost never gets their way. Society has become so depraved that about the only thing you can’t do in public is pray to God. And, personally, I think the ACLU has done much damage to the decent, moral fiber of our nation.

        Now that I have your attention there is very little difference in the ACLU and moral group. Both wants to change choices we need to make ourselves. What politician decided the ornaments was in need of having a law enacted. The moral groups has decided what to censor and so others rights are shut down. If you don’t like ACLU then others don’t like the actions of the “moral” groups.

    Displaying “Mountain Oysters” on the bumpr of a truck is a little silly to me. I think most people do it as a joke only. It is not
    exactly what I would care to see on a vehicle and not on any of mine
    for sure. But I feel the same about baggy pants, tatoos also. Not
    my cuppa tea. Freedom of expression is a slippery slope that while to some degree I have to admit we need some control over this seems to be one officers opinion that is rather puritan in its enforcement. I wonder how many of the 18 wheelers comming thru his are he has stoped and ticketed for this offense along with the nekid
    lady mudflaps? Considering the verses of the music we hear from the hip hop, gansta crowd the spherical bouncers are minor on the radar. Our entire nation has lost its direction of what is acceptable in public. You look around and you see young girls dressing up like street walker imitating the entertainers they admire, you hear language that has not respecte for anyone becomming common place in the public. We need to stop a lot of things but it starts at home not in the government.

      I believe this is all symptomatic of the Leviathan Government we have that snoops into almost every aspect of our lives.
      I gave my daughter almost complete freedom, and she certainly cut up but since she had nothing to rebel against she quickly learned from her mistakes. She was amazed years later that the kids she used to hang with still had not grown up.
      Adults, like teenagers, behave their worst when somebody (read Government) is trying to dictate their every choice.
      A free People are the most well-behaved people in general.

        A few well thought rules strictly enforced is all that kids need to grow up well. Worked for my grandparents, my parents, my siblings, my daughter and nieces and nephews. We have generations of proof.

    Very interesting, as they used to say on LAUGH IN. Here in Kansas such decorations are often cast brass or bronze, some are even chromed. It is a silly thing to waste money displaying. But like they say, “boys will be boys” and the brass or plastic vehicle ornament is to be preferred over the teal thing, which is sometimes seen sewn to a pick-up truck.
    On a more practical matter, almost half a century ago, there was an organization called The Society Against Cruelty To Naked Animals. I saw it on the TODAY SHOW one morning. The President was on with one of the talking heads.
    He had pictures of cows with dresses, bulls with pants, also cats and dogs.
    He said that the animals were embarrassed to be seen naked. A request for money and support was made.
    A year later, he was back on TV to report it was a college thesis paper study to see how gullible people were. Anyone wanting their donation back could write and request it. He said he had raised several million dollars.

    I have to admit that I find the article in question to be offensive. I think it represents someone who enjoys being crude. So what if children see it; so what if Granny nearly has a stroke? Some people just seem to enjoy offending as many people as possible. I don’t think it represents free speech or do they make some that talk? That said, I am pleased to say that I haven’t seen any of the offensive articles hanging off any trucks in Kentucky (where I live)in quite a long time. You can call us hillbillies, but we’re hillbillies with class. And proud of it!!

Sexuality is a very strong influence on each of to ignore this is to opt for confusion and the bondage of these strong emotions, which we must fight to keep in perspective. Sexuality within the bonds of marriage is wonderfull & beautiful. It brigns about bonding & children. Why are we distroying the meaning that our Christian cultural heratage without hardly a thought. Are we fools? We are without the ability to live as respecting human beings. This is one of our liberties “the right to life, liberty & the persuit of happinerss.” Practicing Christians have the right now to be insulted & offended on every venue, but we don’t have the right to protection from insults & offences hindering our happiness & life at every turn. We are not animals doing whatever our fallen race is led to by our strongest desire or instenct at the moment it moves us. Lets rise up to break the chains of slavery & animal desires.     Why is this a first amendment issue, and why would a judge allow it to be heard as such? It’s an open display of obscenity. I saw one once, and was disgusted. Bumper stickers can be thougnt-provoking, witty, and sometimes really funny. I didn’t see anything funny about seeing a disgusting set of hoo-hoo’s. They belong in the barnyard, not displayed as an accessory.

    This ridiculous obscenity complaint would/could be taken so far as to require cover of genitalia on domestic pets, farm animals and creatures living in zoo’s. It’s there, a system of creation that is difficult to censure from plant life (flowers) to all animal species. Just live with it. I do remember some elementery school teachers in a panic when us students viewed creation in progress by two dogs in the street in the mid 1960′s. It is hilarious now remembering how our teachers reacted chasing the dogs in the street to separate them!

    I have seen them before and I didn’t like them at all but to arrest someone for putting them on a truck I guess it wasn’t a man so it is not OK but the reason why I don’t like it is because of the children that might ask questions as to what they are that is why I don’t like it at all.

      I agree. Granted we have that good ole’ freedom of speech thingy, but that doesn’t mean that everything has to be said. As Christians, we are hopefully brought up with a certain set of ethics and morals which would prevent us from displaying or saying something that would purposely make someone uncomfortable. (Just because you can say something doesn’t mean you should.)

      The first amendment has been bastardized and trampled on in so many ways and so many directions that the founding fathers would roll in their graves.

      Overall, I think the testicle ornament says more about the person who puts it on their vehicle than it alludes to some bovine genitalia.

    I’m surprised a more conservative writer like Bob Livingston doesn’t know his Constitution any better. Rulings of modern liberal courts not withstanding, the 1st Amendment was meant to protect POLITICAL free speech, not the sorts of perversions it’s been used to protect for decades. Early court rulings affirmed that view. Like everything else nowadays being 180 degrees backwards, you see widespread attempts to stifle political free speech, from McCain-Feingold to more recent efforts to shut up opposing views, while that which the 1st Amendment was not meant to protect being trumpeted from the mountain tops.

      And remember that the Supreme Court is a branch of the Federal Government. Their rulings are not necessarily gospel. Their tendency is to rubber-stamp anything their gang (the Federal Government) dictates. In fact, I know of no instances where the Supreme Court has overturned a significant Federal Law.
      All one needs do is look at the Supreme Courts abuse of the Commerce Clause to realize that they are not interested in strictly enforcing the Constitution:

        DaveH, Your link is confused. If 935 State laws and 222 City Ordinances were held unconstitutional, it wasn’t so declared by the U.S. Supreme Court. It would have been by State Supreme Courts. State government powers and federal government powers are two different things. The powers DELEGATED to the federal gov’t. in Article I, Section 8, were given up by the States when they created the federal government (see the 10th Amendment).
        You don’t seem to know that States have constitutions, governors, legislative bodies and judicial systems. And yes, I’m the ‘James’ that argued the 2nd Amendment does not apply to the States. In McDonald v. Chicago, the Supreme Court didn’t say the Chicago ordinance violated the 2nd Amendment, it said the ordinance violated the ‘liberty’ that all Americans have, which includes the right to bear arms.

        Dan az, The U.S. Supreme Court is not a trial court, it’s an Appeals Court. Federal District Courts are trial courts, with juries. If a District Court decision is appealed, it goes to one of the Circuit Courts of Appeals, then if further appeaaled to the Supreme Court.

As for the mans daughters having to look at it, they may not even know what it is or even care. I didn’t know what it was and didn’t even notice it until my husband saw it on a truck at the grocery store and started laughing about it. He thought it was funny. I asked him what he was laughing about and he told me ! At first I was in dis-belief and then I thought it was grose, kind of like wearing a rabbit foot on a chain around ones neck. Then I just forgot about it mainly because if a person doesn’t know what it is they could care less that there was something hanging from the bottom of that truck ! Unless this police chief plans on following his daughter around all her life and covering her eyes at everything he doesn’t think she should see, then I’m afraid his daughter is going to see plenty right in the text books at school. But,if we have any of those laws at all then it does become difficult to know where to draw the line…should we have no movie rating system? Should 5 yrs olds be allowed to watch porn in a theater w/ an adult? How about little kids allowed to watch the most violent and gory films?         The left can’t get their message out in a voluntary markeplace, Bob Wire, because most of their ideas have no logical legs, thus can’t draw enough listeners to support them. Air America is a good example. Without the support of Government those kinds of formats just aren’t successful.
        So the left must use the force of Government to silence their opposition. That’s what Media Diversity is all about. They aren’t trying to open the market for Liberal ideas, rather they are trying to close the market for Conservative ideas.
        The only way that Liberal ideas can survive is to create a vacuum of knowledge. You might be surprised to note that I stated “after they sinned”, and it was that very night! No one walking this earth has been perfect since, except Jesus Christ and He was clothed anyway.

Eating from the apple of good and evil….come on now,isn’t that pretty obviously a little kid’s fairytale? I think that it is more like a metaphor for the first humans gaining a human-like consiousness,thus opening up human activity to both evil and good,as no other animals have. We are the only ones able to make consious decisions that carry evil w/ them. That’s what the apple myth is trying to say. The Garden of Eden is actually the entire earth before the arrival of humans,through evolution of course,who had the power of their minds to change the entire dynamic of the planet. No other creature could or can willfully do that.

        Good and evil does not mean good plus evil, but rather, the sum total of all human possibilities. Another words, we were meant to experience all; murder, theft, lying, stealing, coveting your neighbour’s wife, drug addiction ect… hence, the laws, or commandments, which are nothing more than warning signs, or borders, fences, and that, for our own protection, and safety, as well, for societal stability!

        Once apon a time we were a sane nation. We had obsenity laws. They are not opressive, except to the degenerate who might think it is cute because they have lost their sense of perspective of humanbeings and sexuality. Now our nation is no longer sane or respect the worth of humans & sexuality. They can’t see the degrading power of the hardness of heart they show. Few seen to have the sensitivity or heart human should have toward each other. This is why we have this state of insanity and don’t know the worth of being human anymore. We need to humble ourselves, repent of our sin & foolishness and get a real life. We need to respect God’s intent for people & the strong influence of sexuality & its imiges on our lives.

I’ve seen those types of “hangers” and worse a few ,or should I say very few, times and although not repulsed by them thought they were a bit of juvenile humor. But I do realize it’s a matter of “each to his own”…whatever “floats your boat”, “live and let live”.
        As what seems to be the case more and more, the slow erosion of our liberty and freedom is taking place. It’s up to us, we the people, to put a stop to all of this “government” intervention in our personal lives. Looking forward to 2012.

        In regards to the balls on the truck. Back in the horse and buggy days when the whole family went to town, what was right in front of them? The horses balls. What it represents is that your truck is your horse and buggy or whatever 4 wheel device a horse would pull, but in todays world its your truck, your truck is your horse. plain and simple so get use to it, they did back in the day. Its not a sexual image as many think. Have a set on my own truck and get more laughs then disapointed faces in my rear view mirror.

      I would like to know, when the rancher hauls his cattle down the road to the slaughter house does he have to put underwear on them so thier bull balls are not swaying in front of some womans or childs line of site?

      I have seen those ornaments here in Texas too, as a christian i think it is funny, crude but funny. Hey it’s just nature. BTW i have seen people wearing T-shirts and pants that have things on them that can be condisered much more offensive than that. How about girls wearing pants with ‘Bit%$’ written on the backside?
