Gays can’t get social security or military benefits. Your family gets it. Why can’t theirs?

It’s like lynchings, joe. If someone is harmed because they are hated for being who they are it guarantees that there are other hateful things being done to folks. Sven, The purpose for the Executive Branch of the national government, is to execute the laws enacted by the Legislative Branch. Presidents take an oath to do that. If a president is allowed to ignore the laws he disagrees with, or thinks they are unconstitutional, he has replaced the functions of the Legislative and the Judicial Branches. That’s empiricalism.

Smilee, That’s the silliest thing I’ve ever read. The U.S. Constitution created the federal government, it has no laws in it. It empowered Congress to make laws by delegating certain powers to it in Article I, Sectiion 8. The Executive Branch is supposed to execute the laws that Congress enacts pursuant to the Constitution. And the sole authority to declare such laws unconstitutional rests in the Judicial Branch, that is, in federal courts and ultimately in the U.S. Supreme Court.

You are the one who does not understand the Constitution. The 3 branches of government, Executive, Legislative and Judicial are separate, but interdependent. If Obama does not believe DOMA is constitutional, it is his responsibility to submit a lawsuit to the Supreme Court for their decision. It is NOT Obama’s right to decide the constitutionality of a law written by the (significantly bi-partisan-in this case) Legislative branch and signed by the Executive branch during the administration of a previous President. He is, in fact, breaking the law if he does not support an executed law of the country.

This is only one of many Constitutional responsibilities and laws Obama has broken. The first and most egregious is campaigning for and occupying the Office of President as a Constitutionally ineligible candidate/president. You are the one who does not understand the Constitution. The 3 branches of government, Executive, Legislative and Judicial are separate, but interdependent. If Obama does not believe DOMA is constitutional, it is his responsibility to submit a lawsuit to the Supreme Court for their decision. It is NOT Obama’s right to decide the constitutionality of a law written by the (significantly bi-partisan-in this case) Legislative branch and signed by the Executive branch during the administration of a previous President. He is, in fact, breaking the law if he does not support an executed law of the country.

This is only one of many Constitutional responsibilities and laws Obama has broken. The first and most egregious is campaigning for and occupying the Office of President as a Constitutionally ineligible candidate/president. The enormous fraud he has perpetrated on We the People is enormous and frightening. Obama’s stated goal has been to change America from a federal republic to a socialist state. His goal has always been to destroy the Constitution and bring the great nation of America to its knees.

Tyranny is a man acting as President and subsituting the rule of man (Obama’s rule) for the rule of law (Constitution.) All laws that congress makes has to be covered under the constitutional or it is unconstitutional and until that is decided it should not be defended. You did say that there are three independent branches of government and the Congress cannot dictate to the president what he is to do nor visa versa but the courts can and sometime I believe they will ON THIS ISSUE and if the President is supported by them then he was right. DOMA just happens to be the law of the land right now and Obama and Holder are under oath to defend that law. Change the law if you don’t want it, by proper channels and authority, but until then, it is the law of the land and as such, the President and his Attorney General are obliged, under oath of office, to uphold, protect and defend that law. To not defend the law of the land is an impeachable offense and neglect of duty and breach of contract of their Oath of Office. Period! He is also breaking this same oath by not defending our borders, again which is the law of the land at present. So, until the law is changed, they are under oath to defend the law.

This is for those of you who just HATE that this man is OUR president!

Liberty, The issue in Bob Jones University v. U.S. (1982) was whether section 170 and 501(c)(3) of the Internal Revenue Code, should exclude nonprofit private schools, that prescribe and enforce racial discrimination, from acquiring a tax-exempt status, when the law didn’t actually say that. The District Court held the IRS revocation of the University’s tax-exempt status, had exceeded the law’s scope and ruled for the University. The Appeals Court reversed, holding that racial discrimination is an understood disqualifier of that law.
The Supreme Court agreed with the Appellate Court, and admonished Congress for not revising that law. There is nothing wrong with a president taking sides on such issues, when it’s in court.
However, DOMA (1996) specificly excluded same-sex marriages from federal benefit rolls, there was no question what it meant. While I agree that federal courts would hold that part of the law (if challenged) unconstitutional, it is not the role of a president to do that. He must enforce the law as it is written.

My observation here is that not many on this site do understand the Constitution and it is clear you do not. Quit twisting the oath to read laws when it does not!!

After all, it disproves any claim that Obama must fight for a law that he believes to be un-Constitutional.

BTW, if the SCOTUS shoots down the DOMA will you accept it or claim that they are ligislating from the bench when they toss it out?
