State legislators propose crackdown on birthright citizenship
State lawmakers are pushing for the Supreme Court to re-evaluate what they believe is an "erroneous" interpretation of the 14th Amendment of the Constitution.

According to The Associated Press, Republican leaders from several states unveiled their proposals during a news conference at the National Press Club on Jan. 5. The legislation aims to clarify the automatic citizenship law, which currently grants legal status to children of illegal immigrants who are born in the United States.

The draft bill, which was presented by members of State Legislators for Legal Immigration, would grant states the authority to bestow citizenship on individuals who meet the state's definition of a U.S. citizen — which would include children who have at least one parent who has no allegiance to a foreign country.

The legislation would also enact a compact between states that requires the issuing of two types of birth certificates: One for natural-born U.S. citizens and one for those individuals whom the state does not consider a citizen.

"We want to have our day in court," said Arizona State Representative John Kavanagh (R-Fountain Hills), quoted by the news provider. "All we're asking for is for these bills to prompt the Supreme Court to re-evaluate what we believe is an erroneous interpretation of the 14th Amendment."

Benjamin Johnson, the executive director of the American Immigration Council, said the proposals are an "embarrassing" attempt to reform immigration laws. Johnson added that denying citizenship to certain children would not decrease illegal immigration, but would instead increase the number of citizens without legal documentation.

This crap must be stopped by term limits. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
    Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.
    read the 1st sentence of section 1. it says, “…and suject to the jurisdiction thereof…” if they are illegally here, are they subject to the jurisdiction of the united states? the last sentence of section 1 says they can’t take away property, etc without due process. if you take that along with section 5, i’d say that congress has the right to pass legislation that would clarify this amendment or amend it. they sure as heck have found a way around it to confiscate the property of those found guilty of drug offenses. they took all of madoff’s money and property. they can do pretty much whatever they want, they just have to want it.

      I agree. A couple of years ago I saw a comment by a woman who had a baby in Dallas. Her room mate was illegal and bragged about it. Further, she bragged that this was their fifth kid and they hadn’t had to pay for any of them. The American had to pay over $8000. Doesn’t seem really fair, does it?

    Any baby born in the United States is free choose whether he will be a U.S. citizen or a citizen of another country when he or she grows up. If the baby later chooses foreign citizenship, no obligations to the United States exist. It is unacceptable to limit the recognition of U.S. citizenship to babies born of American citizens because the right to citizenship by birth is guaranteed by the Constitution.

    Like it or not, the United States will be dependent on a high rate of immigation for years to come. Since the Rowe v. Wade decision, an estimated 45 million American babies have been aborted, and the population of native-born U.S. citizens consists overwhelmingly of persons reaching retirement age. As they die off during the coming decades, the population will undergo a catastrophic implosion, and labor will be in very short supply unless immigrants enter the country to take the jobs. Without immigrants, the old and sick will be left uncared for, and there will be nobody to maintain the infrastructure of the cities. Europeans are already experiencing the same problem. The United States is lucky to have a supply of people from Latin America as immigrants because their culture is basically Christian. In Europe, the immigrants from the Middle East and North Africa have proven less prepared to assimilate into the culture because their religion imposes a certain degree of separation from non-believers. In Vietnam, many of those I served with were of Hispanic descent, while many of the non-veterans militantly working to exclude veterans from the universities and civil service employment are obviously not Hispanic. If you look at the casualty lists from Iraq and Afghanistan, you will find many of those who died defending our country are of Mexican descent. Anyone who fights to defend the United States should not be denied citizenship, and national origin should not be grounds for prejudice.

    What too many people overlook is the fact that no changes in the law are necessary. If anyone has something against illegal immigration, he should find out why our federal government is failing to enforce so many laws. Our immigration officials might also be asked why the kingpins of drug smuggling can obtain American green cards so easily, while their countrymen who come to perform useful labor are denied them.

      it is true that americans have too low a birth rate to sustain our country in the future. so, IN THE FUTURE, we can open our borders or – how about this for an idea – allow more LEGAL immigration. until then, they need to stay out, and the ones already here need to go home. they can leave their american babies here to be reared by americans, or they can take them with them. if the baby leaves though, american citizenship should be taken away never to be returned. we don’t want them coming back at age 18 to sponsor their whole families to come here.

      You have a good point about population problems. The need for immigration reform is obvious (amnisty is not reform). But I would also argue (based on your abortion input) that legalized abortion on demand needs to reformed (I do not mean SCOTUS interpreting the constitution). True reform, in my opinion, requires securing the border (even use the military in the short term), set-up a low cost (about the same cost as getting a passport), no quota immigration application process. Illegal aliens in this country have a set deadline to leave and apply from their country of origin. Strengthen and heavily fine business for hiring illegal aliens, and mandate a federal verification system (this is the business protection or illegals using identity theft). Implement streamlind procedure for deportation (we know there will be some mistakes, but it should be the citizens responibility to ensure their proof). Proof of citizenship requirements for elections! Take the political vote pandering out of the debate.

      However, illegal aliens break the law and should not be rewarded with amnisty or birth-right citizenship. I like Eddie47 idea where the baby and parents are deported. When the child is 18 years old, then the child can make an informed consent and chose his/her citizenship.

We, as a country managed to take care of ourselves way before all the illegals crashed our country. We can take care of people, EARN A LIVING,obey our laws, SPEAK ENGLISH, and function very well without them. All illegals have done is, TAKE,TAKE,TAKE.     We just arrived in the US (legally and for a limited period of 2 years)and I will be having a baby in a few months.
    If I understand correctly my baby will become a US citizen automatically – we no not have the option to refuse US citizenship for our child.

    According to the laws of my country the baby will also receive a european passport. (because citizenship if granted on the basis of the nationality of the parents and not the location of your birth)

    Taking into account that we will not be staying in the US and our child will most likely never live in the US (except the first 2 years of his/her life) US citizenship can actually be an disadvantage to him/her in the future from a taxation point of view. I find it odd that we do not have a say in the matter. ( I still have to do some research on our options if any, but at this moment this is how I understand it)

    That being said I find it totally acceptable to limit the granting of US citizenship to babies who we born out of US citizens.

      See my notes above on this. There was a law at one time (which has not been repealed to my knowledge) that stated that any child born here will have dual citizenship with the country of his parents UNTIL HE REACHES 18 YEARS OF AGE.

      At that time he is expected to make a declaration of what country he is a citizen of. If he chooses to be American he must go to an American embassy and declare in oath that he will be a loyal citizen of the USA. At that time he will lose his dual citizenship and cannot become a citizen of the country of his parents.

      If, on the other hand, he chooses to be a legal citizen of his parents’ country, he has only to do nothing. He will become a sole citizen of that country by NOT going to a US embassy.

      If you are really concerned, you might check that. But I do understand your worries about taxes. I would be willing to bet that if he was to become rich, our government would certainly be willing to tax him if they can.

    No one has mentioned the fact that these mexican children are citizens of mexico. That’s what their laws say. So, are they dual citizens or what? Seems to me that you should not automatically declare them U.S. citizens. If their parents are seeking U.S. citizenship when they are born, then they would become citizens when their parents do. If the parents are illegally here, so are the babies by default. It’s not our fault, it is the parents fault. No one should be able to profit from breaking our laws. Nuff said

    America NEEDS to take a serious look at what passes for “immigration laws.” And the Supreme Court NEEDS to take a serious, Constitution-grounded look at WHY Uncle Scam ignores immigration laws, open borders and common sense.
    If anyone on the Supreme Court knows anything about history (especially old Rome), they already know that open borders helped destroy old Rome. It won’t do anything good for America (regardless of what that airhead Johnson is paid to think).
    Mr. Johnson would do well to move to another country. We have all the useful idiots, generational pimps, losers and traitors any nation can tolerate. Up the rebels!

    Read the 14th Amendment, and you will see that the wording is simple and clear. If anyone wants it violated, amended, or repealed, that person is interested in eliminating guarantees of personal liberty. If we can get rid of the 14th Amendment, deprive people of due process, and eliminate their rights to equal treatment or citizenship, we can also get rid of the 2nd Amendment and deprive people of the right to bear arms. We can get rid of the First Amendment and have “thought police” like those in Communist countries. Children can be encouraged to report whatever their parents say so that they can be arrested and sent to labor camps for speaking against the State. If you are overheard criticizing a politician, you can be branded a terrorist and arrested and sent to a “reeducation camp.” How about that pesky Fifth Amendment? Torture is the quickest way to get confessions, and then we can also do away with jury trials and just put the person away for as long as the government wants. By the way, there is no provision of our Constitution that protects abortion. That was just a bit of “judge-made law.” The part of the Constitution that requires very difficult procedures to amend it has already been nullified, and now Supreme Court justices can change it any time they want by a 5-4 vote. Hands off the Constitution and its current amendments, especially the 14th!

      You’ve got this wrong too, Che. The wording is “clear” for making achor babies citizens as long as you don’t read the intent of those who wrote it. Let me help you along:

      In 1866, Senator Jacob Howard clearly spelled out the intent of the 14th Amendment by stating:

      [i]Every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons. It settles the great question of citizenship and removes all doubt as to what persons are or are not citizens of the United States. This has long been a great desideratum in the jurisprudence and legislation of this country.”[/i]

      This understanding was reaffirmed by Senator Edward Cowan, who stated:

      [i]“[A foreigner in the United States] has a right to the protection of the laws; but he is not a citizen in the ordinary acceptance of the word…” [/i]

        His intent was not stated in the fourteenth amendment and these two senators only got one vote each and they voted on the language in the amendment as did everyone who voted on it and not on their intent, that contradiction is clear, only a future amendment can change its meaning despite your wishful thinking.

      14th Amendment
      The ratification of the 13th Amendment was a major victory for the North, and it was hoped that with the Emancipation Proclamation and the 13th Amendment, the effects of slavery in the United States would quickly diminish. The original plan to readmit states after acceptance of the 13th was supported by President Andrew Johnson, but the Radical Republicans, as they became known, wanted more than just a return to normalcy. They wanted to keep the power they had attained during the war years. The South did not make it easy for Johnson, however, and the so-called Black Codes started to be passed in Southern states. Congressional inquiries into the Black Codes found them to be a new way of controlling ex-slaves, fraught with violence and cruelty.

        The history of the ratification of the 14th Amendment is interesting but not relevant to the final product. An illegal immigrant is not on a diplomatic mission for his country, so it is not relevant whether or not the children of ambassadors and consuls to the United States are entitled to citizenship at birth. The simple fact is that Amendment 14 gives every American a guarantee of his rights to equal treatment, certain kinds of due process, and citizenship if born here. Removing anything from this amendment takes away a guarantee of rights that are important to all of us. People who want to take away human and civil rights for any reason, such as national security, public safety, or xenophobia might be happier living in another country where the government tell everyone exactly what they can and cannot do. Cuba is close and has a nice climate. They have nice parades in North Korea. Other suggestions could be Belorus, Zimbabwe, Myanmar, or Vietnam. The United States has gone far enough along the road to a totalitarian state, and it would be nice to see this trend stopped. Maybe it is time to strengthen the 14th Amendment by extending civil rights guarantees to such groups as veterans and whistleblowers who report illegal government activities. It might also be time to cut back on some of the extremist measures imposed on airline passengers.

        Where does it say that the 14th Amendment applies only to black former slaves? I do not read that anywhere in the amendment. It says rather that every American citizen has a right to equal treatment under the law. It is the amendment used as the basis for every civil rights law since 1871, and these laws prohibit discrimination based on race, religion, national origin, and previous condition of servitude. It has also been made to apply to descrimination based on gender. If you can get away with violating the rights of members of one race, religion, or national group, you can get away with violating the rights of members of any group. That is why we need the 14th Amendment as it is.

    You are certainly correct chvielvet for there should be no attempt to go back and punish these babies or children. They should remain legal citizens but the issue has to move forward. Should the 14th Amendment be amended and should any Amendment be changed? I’d like to see less growth coming from south of the border or from any other place in the world. We definitely need a more orderly immigration system and only allowing in what is needed or what our environs can sustain. If we need more immigrant workers and they bring their wife or girlfriends then they should be required to use birth control.If a child is born then it should become a US citizen even if the parents can never be. Most of these immigrants should prepare themselves to become citizen before they come across the border so they can apply for legal status right away. Those who don’t want to become citizens will have to keep reapplying for their green card as in the past. We can’t always control pregnancies and it is no different for these “anchor” babies and these babies don’t automatically give their parents legal status.

      Technically, you do have a point. Since a baby is not considered a viabel human by law(thus abortion is legal), the baby is not really an illegal alien. Thus the child did not break any laws. But what about that pesky umbilical cord?

      But then I could argue that this baby is really an extension of the mothers body by law (thus she can legally have an abortion as it is her body). Then that would mean the baby is an illegal alien prior to birth and subject to deportation. So the baby is guilty even before birth.

      The point is that debating about the baby is not the issue. The parents are illegal aliens and the birth of a child does not negate the child from the same status. Citing equal rights of the Constitution universally is absurd. Who is this document addressed to? US citizens! Since when does this document cover the citizens of all nations. By this logic, sharia law should be applicable to Muslims living in America. They would then have the right to jihad in America. Sounds stupid. The 14th amendment has been and is being hijacked by your emotional pleas for the babies!

      The baby because it is born in the US is now a citizen so the parents also get to stay so they can take care of the citizen. The anchor baby is being used to help the non citizen parents stay in the US. Then the extended family gets to piggy back on the baby’s US citizenship.
      There is nothing wrong in sending the entire family back to the parents home country.
      This why the child should be declared a citizen of the parents home country. All this mess would be eliminated.

      chvietvet: The parents of these anchor babies knowingly and willingly break our laws to come to the US to have that baby because they know our ignorant officials have made it possible for the baby to become a Citizen and eligible for all kinds of entitlements that the AMERICAN TAXPAYER HAS PUT OUT.       You are correct. The baby can become a citizen… but his parents can’t just because he was born here. So officially the parents should have a choice. They can be sent back to their country with the baby or they can give the baby up for adoption as they leave for their own country. Since none of us really want to seperate the parents from their child, he should go with them.

      The law USED to be that on his eighteenth birthday he could go to an American embassy and declare for the US – whereupon he would be sent back here as a citizen. But he came without the rest of his family.

      When did that law change? As far as I’ve been able to find it, it hasn’t. It’s just been ignored.

      but the parents are the ones who get welfare, medicaid, food stamps, low-income housing, etc.. even though their kids get free breakfasts and lunches at school 9 months of the year, they get the same amount of food stamps as they do for summers when the kids are at home. they don’t get food stamps just for the anchor baby, it’s based on how many are in the family. and as long as they keep having babies every 4 years, they can keep getting public assistance. if you have a child under 5 years of age, you don’t have to get a job. that’s also true of americans on public assistance, and it needs to change. anybody who has another baby while getting welfare should not get a dime extra for it, and the parents should both have to get jobs as soon as the youngest one born before getting public assistance turns 5.

      Monica, the 14th Amendment had nothing to do with immigration, as 45 Caliber said, it’s purpose was to extend citizenship to the just-freed slaves that were already here, and assure that they were to be treated equally as other citizens. Our immigration laws define the process foreigners must go through to enter the United States and become citizens. However, the 14th Amendment’s: “All persons born…in the U.S. …are citizens of the United States,” is a loophole that illegal aliens rely on. It should either be reworded or repealed.

      Agreed. I might allow the child back as an American citizen AFTER he and his family are sent back to their home country to stay. It used to be that such a child was given the opportunity to go to an American embassy on his/her eighteenth birthday and swear aligience to the US and become a citizen due to birth – but his family did NOT come with him. Nor should they be allowed to come here. What they found then was that very few of those who might be allowed citizenship ever bothered to try.

    The 14th Amendment provides for equal treatment under the law, as well as providing citizenship rights. Calling for its appeal is like saying that people should not have equal rights. Abridging equality is the same as abridging personal liberty. If you can take a right away from somebody else today, the government can take your own rights away tomorrow. Communism is all about totalitarian government, which can give and take away rights according to whatever the dictator want to do that day. If you hate certain people so much that you would call for the institution of a lawless state just to harm them, somebody who hates you will deprive you of life, liberty, or property by applying the same logic you use. Sorry I have to tell you this, but all of those babies already born can never have their citizenship taken away retroactively under any system of law that exists outside of totalitarian states.

    CJ is right but the Supreme Court takes the 14th Amendment literally, it reads: “All persons born…in the United States…are citizens of the United States and of the State wherein they reside.”
    The amendment never intended for that to apply to births by illegal aliens, but it doesn’t say that. The amendment should be amended to read: “All persons born of citizens of the United States…are citizens of the United States and of the State wherein they reside.” This would cover American citizens who give birth in a foreign nation as well as here. It would limit citizenship to children of citizens of the United States, wherever the birth occurs.

      Nothing will change this amendment unless the Constitution is amended to change it and that is not likely. Congress is not likely to be able to garnder two thirds majority in both houses to get it started.

      What really upsets me patrick, is that as a god-fearing conservative I am denigrated and cursed by the liberal media for my right to free speech and political dissent. At the same time I hear none of the media point out the vitrol and extreme speech of far left (Van Jones, Pivens, and Black Panthers come to mind). They can openly and vehmently voice their political dissent without media reprecussions (except conservative talk radio and conservative websites catch them). But most Americans will hear the liberal media bash the conservative voice of peaceful poltical dissent and never hear a follow-up to correct their errors. a month to 6 months from now these people will still think the Tea party and Sarah Palin shot a congress woman.
      In relation to this particlar issue, the media will call us racist, bigots, and anti-immigration. Even now (and PLG is guilty of this) the media is stealing the words from this debate. They are not to be called illegal aliens, but we have to use the PC term undocumented workers or undocumented immigrants. The key word is ILLEGAL. The term immigrant has the conotation that they are going to conform to the American society (like speak english, obey our laws, honor the American flag, and support US soveriegnty). The very act of illegall crossing our borders has nullified at least 2 of the examples I listed. Therefore the term alien better fits the debate.
      Liberals do not debate an issue, they simply yell and scream. They know that they lose if they debate, but screaming and accusing gets them noticed (think Mr. Weiner). The general Jerry Springer crowd says, “Yea, that is awful.” Never bothers to fact check or follow-up on the actual details of a debate. The Liberals win by attrition because the general public has an attention span of zero.

      So in this regard, the liberals are correct about one thing. People listen to the loudest emotional spin, but not the logical discourse.

    Just how does taking a Constitutional right to citizenship from a person born in the United States conform to the concept of personal liberty? When the colonists came to Jamestown and the pilgrims to Plymoth, what kind of immigrant visas did they have? If they came illegally, then their offspring cannot be considered citizens under the proposed new law, and the illegal status would be passed on to each subsequent generation. So everybody whose ancestors migrated into colonial America, get out!

      Maybe before you try to put two unrelated points together, you might engage your brain, if you have one. The 14th was written to enable those who were previously under the U.S. laws. This EXEMPTED foreign diplomats who may give birth while in the U.S. (as one example) and when somebody is here ILLEGALLY, then they should not be allowed to gain from their illegal act. Yes, the baby had no choice in the matter, but Constitutional Rights are NOT absolute. There are exceptions, meaning somebody will be left out. We are tired of liberals giving away OUR rights to those who are NOT entitled.

        To start off I do not respect people who have to insult others for voicing their views when the insulting people seem to feel their opinion, whatever it is is ok or appropiate but no one elses is. Voice your opinion/views but leave the other person alone.

        Everyone is given the privilege of coming to the US legitamately. They do not have to come illegally and then bleed funds that others have paid into all of their lives. I have worked since I was in my teens and paid into Social Security but the way it looks there will be nothing there when I get to the age I will be eligible for the benefits (which will be in a few years).

        Our government has embezeled the funds to fund other programs to benefit themselves (votes, kickbacks, dividends, whatever) and voted to give the funds to illegal aliens. If anyone took money intended for someone else or something else it would be considered embezelment. Why is this not considered embezelment.

        There is an email going around asking citizens to contact their Congressmen and Representatives to place themselves under the same standards, laws and responsibilities as all citizens. They should not be able to vote themselves raises when they already make thousands more a year than most citizens and vote down cost of living raises for the other citizens. They should have to relinquish stock in any companies that have to do with utilities, oil or services that they vote or enact laws that govern these compdities. It would be conflict of interest in any other business.

        Once they are out of office their full salary should stop. Just like the common citizen, they should only get a porting of the salary and their benefits should be the same os ours. When they no longer hold and office they should be under the same laws as we are.

        If they had to live off Social Security and/or Retirement they might not have a hard time relating to having to choose between human food or dog food. Paying their light/fuel bill or buying the human food or dog food. If their medical was guided by the laws ours is they might work harder to cut down on the greed of the drug companies and other companies that are a necessity and not a luxary.

      chvietvet. I’m not sure how you came up with this one. The Pilgrims and Jamestown happened in the early 1600′s. The Revolutionary war and US Constitution came over 150 years later. Anyone that survived during that time period was one tough human. I’d vote now to “Grandfather or Grandmother” them in if that makes you feel better. (Since we now have a US Constitution) Perhaps others would also. Many do not support illegals having children who become US citizens. The 14th Amendment should be repealed.

      That seems like a reach of logic. As Laststanding put it, the constitution wasn’t implemented until after the the Revolutionary war. At any rate, I think you are confusing the issue. Rule of law. Many feel the 14th amendment has been hijacked by illegal aliens and their supporters.
      Not to sound completely uncompasssionate to the children (as we know the left will scream “Oh the poor helpless children, it is not their fault, why do you want to kill innocent babies), I believe the compromise is to accept previously issued birth certificates and set a deadline. All future births by illegal alien parents are denied citizenship and deported with the parents. This would also solve your weak attempt to accuse the supporters of this issue of prolifagating a generational lifestyle. The problem is solved at the first birth and deportation!

        Someone born in this country may not be a subject of any other country including the country their parents came from. They then may be subject to the laws of this country. This issue makes a lot of assumptions to come to the conclusions that many are coming to one this site and other conservative sites. To get the change they want they most likely have to amend the constitution as it has been interpreted this way for years and not likely the Supreme Court will here this case.

      14th Amendment
      The ratification of the 13th Amendment was a major victory for the North, and it was hoped that with the Emancipation Proclamation and the 13th Amendment, the effects of slavery in the United States would quickly diminish. The original plan to readmit states after acceptance of the 13th was supported by President Andrew Johnson, but the Radical Republicans, as they became known, wanted more than just a return to normalcy. They wanted to keep the power they had attained during the war years. The South did not make it easy for Johnson, however, and the so-called Black Codes started to be passed in Southern states. Congressional inquiries into the Black Codes found them to be a new way of controlling ex-slaves, fraught with violence and cruelty.

      The ensuing Reconstruction Acts placed the former CSA states under military rule, and prohibited their congressmen’s readmittance to Congress until after several steps had been taken, including the approval of the 14th Amendment. The 14th was designed to ensure that all former slaves were granted automatic United States citizenship, and that they would have all the rights and privileges as any other citizen. The amendment passed Congress on June 13, 1866, and was ratified on July 9, 1868 (757 days).

    Half measures, always half measures. The aim should focus on the retroactive deportation of illegals wrongfully extended the title of citizenry under the guise of the misinterpetation of the 14th ammendment by the greedy vote seeking Democrats.

    Initial implementation of said initiative should commence in The Oval Office.

        Nice response!!! This is a good thing…if neither parent is an American citizen, the baby born here when they snuck in illegaly, should not be considered an American Citizen!! but till now they have been, ans qualify for all the freebies!!! RIP the taxpayer!!!
