With One GOP Vote, Senate Committee OKs Kagan's Nomination

The Senate Judiciary Committee voted Tuesday to approve President Obama’s nomination of Solicitor General Elena Kagan as a Supreme Court justice to replace John Paul Stevens who is expected to retire later this year.
The only Republican to break the ranks with his colleagues was Senator Lindsey Graham (R-S.C.). The remaining GOP members of the committee have repeatedly expressed their concerns about Kagan’s limited legal experience outside of academia and her political involvement during the Clinton administration.
Obama praised the vote, saying his nominee is “one of this country’s leading legal minds,” and expressing his belief that she will be a fair and impartial Justice.
However, many conservative organizations—such as Family Research Council (FRC)—disagree with this assessment.
Its president, Tony Perkins, commented that Kagan’s ascent to the Supreme Court will endanger constitutional governance.
“Today’s vote ignores Elena Kagan’s troubling record of impassioned liberal activism and disregard for the law,” he said, adding that she “has trampled every obstacle standing in the way of her pro-abortion, pro-homosexual agenda, which calls into question her ability to be an impartial jurist.”
Earlier this month Perkins testified against her candidacy, focusing on her ban on military recruiters when she was dean of Harvard Law School because of the army’s “don’t ask, don’t tell” policy.
