Mexico Joins Legal Battle Against Arizona Immigration Law

June 28, 2010 by

Mexico joins legal battle against Arizona immigration law Mexico filed a brief with the United States District Court last Tuesday challenging Arizona’s controversial new immigration law. Officials with the Mexican government argue that the statute is unconstitutional and endangers the rights of thousands of citizens who legally visit the U.S each day.

The new law creates "an imminent threat of state-sanctioned bias or discrimination, resulting not only in individual injury but also in broader social and economic harms to its citizens," read the brief.

"Mexican citizens will be afraid to visit Arizona for work or pleasure out of concern that they will be subject to unlawful police scrutiny and detention," it added.

The motion also notes that the new law would adversely affect the relationship between the U.S. and Mexican governments, and could hamper the two nation’s collaborative effort to fight drug trafficking and border violence, according to Fox News.

By submitting the brief, Mexico formally joins one of five separate lawsuits that challenge the law, which is scheduled to go into effect on July 29.

In response to Mexico’s legal action, Arizona Governor Jan Brewer reiterated her belief that the "immigration enforcement laws are both reasonable and constitutional."

    There is only one thing the Mexicans have to consider. Are they Legal or are they Illegal. If they are legal they will have ID, if they are not they will not have ID; Not too confusing to me;

    • http://myronjpoltroonian.blogspot.com Myron J. Poltroonian

Better change that to “Legal, Valid Identification”. Mexico has a visa that they distribute like candy at a state fair, to any and all who ask for it; wherever they are.

      • Jana

        Myron,
Exactly and they also hand out pamphlets to instruct these illegals as to where to go in the US to get these free things, such as housing and health care and welfare.

What Mexico thinks about anything is superfluous , and contradictory to logical thinking , and is indictive of their enormously LOW I.Q . To even suggest those MORONS should have anything to say regarding U.S.A. polocy is insulting and disgusting beyond belief. Anyone that does not support the SB1070 law in Arizona is unamerican, and disloyal to the UNION . Arizon needs help, this help is also help for the entire U.S.A. to bad we have a govt that knows this and will do nothing about it . TAKE BACK AMERICA VOTE OUT THE the sludge in the govt , screw mexico and the boat they came in on they are no friends of ours.

  • trp 878

“We the People”… this is the US of A. Mex… has nothing to do with the US. they are not citizens or entitled to anything this country has, thus they don’t have any say in these matters. Common sense says there is no gray area and it’s either black or white. The only common sense answer is Keep your nose out of our business. We don’t interfere with you and yours when you corruptly deal with anyone that enters Mexico. Oh how the politicians have ruined our legal system.

Darn! the next thing we know, some country like “Kenya” will be making policy, and telling American what to do.

    • Isirio Abelon

Hi, Jerry. Darn… America is already run by Kenyan. Obama’s father is from Kenya!. Obama is 50% Kenya and 50% American. Hey its not President Obama’s fault, Obama does not have the experienced to be the President of the United States. Joe Biden, has quoted during primary 2008 that Obama is not qualified to be a president. Blame your Democratic elected officials and the morons who voted for them…
By the way, the Congress approval rating is 27%. Democrats has been in control since 2006, thats when the crises begun. Same Clintons cronies like Chris Dodd, Barney Frank and others are involved. Darn… Darn. Adios.

When the bastards, drug and mexicans are shooting at us, it it time to round up the beltways asses and have them stand on the border. When lead starts flying, lets see what the gut less lice from Washington plan on solving this breach of our borders? Since the thugs fired first, it is our option to see who fires the last solvo. We haven’t started to load yet. Tell the socialist Mexican to take a flying self intercourse in a rolling pastry, this is the USA not Mexico, if he wants to push it, we will just have to dismantle Mexico and take it over as a out reach planned country.

  • emerson

mexico can go to hell. we should all fire ANY mexican workers and boycott any mexican-owned businesses TODAY. mexico should worry about cleaning up its corruption and leave us the hell alone, they have been emboldened by these obama thugs

  • Bev

We need an AMERICAN president, NOT A MUSLIM!!!

    • J.M.R.

RIGHT ON BEV BUT PLEASE DON’T CALL HIM PREZ, HE A MUSLIM DICK-TATER

  • M.L.

The problem that Iam having as I have mentioned before is what about the rights of the two thousand Americans that are raped and murdered each year. Perhaps that should be brought up in court not just the one rancher. I think they deserve some reconition. For Heaven sake these are our fellow Americans. There is no comparison in in the number of deaths and the so called racial profiling, the only defense thewy have.

  • Michelle

is there anyone out there that is willing to file suit against Mexico? because maybe we should do the same thing to them for killing our citizens and stealing our jobs, food, housing, healthcare, etal.

  • Michelle

This is an absolute disgrace. The United States should file a law suit against Mexico for stealing our jobs, health care, housing, food and money. Since when do forgein governments have the right to sue us for upholding our laws? But since our own ignotent president hasn’t read and does not want to uphold the law does this actually surprise anyone?

    • 45caliber

We should also file a suit against them for growing and shipping drugs into the US.

    • JC

That’s because most recently and most notably the Kenyan has
turned the office of POTUS into a disgrace.

  • s c

Mexico can go hump itself. They’ve worked long and hard to put new wrinkles on the face of border hypocrisy. Only in a country where politicians tend to be incompetent, basically worthless and budding CRIMINALS could a forked-tongue geekoid like Calderon be treated with any respect.
Does it have to be said what’s wrong with a country like Mexico having higher immigration standards than the US? If Calderon’s elevator ever went to the top floor, he’s managed to find a way to act just like an American politician (full of himself, arrogant, nothing-between-the ears and fit only for public ridicule).
Being a Mexican politician must be like finding a job at a place where they can’t keep their employees. Either there’s something in the water in Mexico, or they’re brought up to confuse genius with retardation.

  • Peg

Robert, I agree, The Inmates are running the Asylum!!

  • J.M.R.

HEY MEXICO CLEAN UP YOUR OWN COUNTY, ITS NONE OF YOUR BUSINESS WHAT OUR LAWS ARE.

    • Isirio Abelon

J.M.R.,Bravo, agreed. Mexico suing Arizona? how stupid Americans we are, they invaded our country, they rape, murder our citizens, distribute tons of drugs, we pay their health care, we pay their educations, they take our job. What part does our elected official do not understand. If you are s Democrats, voted for Democrats, you are a moron and stupid. Support Arizona. Gov. Jan Brewer is doing the right thing for you and I. Adios.
      isirio

      • a sceptic

Well, you’re getting carried away here. “They” rape, “they” murder, “they” distribute tons of drugs?? Mexico as a country is responsible for none of these. There may be individuals, as with from any race, who commit these type of heinous crimes, but your commentary shows that you are willing to label all Latinos as offenders. Where is the evidence to show this? If anything, statistics in other border states are showing a lessening of criminal activity not the all-out pilaging that you´re claiming.

While it does seem rather odd that Mexico would want its day in court, a simpler explanation for this is that it wants to ensure that the perspective of Mexican within the U.S. (legally or illegally) gets heard. No one here is going to speak up for them… or indeed, ever listen to their stories and hopes for a brighter future.

America until lately was always the land of opportunity, and people came from nations around the world to try to live the American dream, with their only requirement for entry their willingness to work hard to make it. By far the majority of illegals are hard workers… just ask anyone in construction or agriculture. (The same can’t be said for most white folk.) Some may abuse the welfare system… but the percentage is much lower than with other races, and if that’s really the problem then clean it up… for everybody.

In the meantime, people, Amerika is rapidly becoming the land of government surveillance and sealed borders… along with a substancial dose of xenophobia that is turning quickly into outright racism and violence. Does that sound vaguely familiar… like maybe something out of WWII?

Isorio, do you even know any Latin families? My advice is: Chill out!

Take an evening and watch a Clint Eastwood film… “Gran Torino”, for example.

        You

      • Jana

        a sceptic,
If Mexico allows its citizens to grow and distribute drugs, and helps their citizens to come across the border illegally, and by the way they do, then yes, MEXICO is responsible. Don’t think for a minute the United States isn’t blamed for some of the things their citizens do that is bad or wrong.
Of course I realize you don’t really want an answer, you just want to spout your Socialistic ways and will not want to accept reason or common sense.
You said no one is speaking up for the Mexicans either legal or illegal. That is not true. There are a lot of people speaking up for them, Obama being number one. By the way you are speaking up for them, are you a no one?
One more point, we love immigration here in this country, its the illegal immigration that we are opposed to, but you already know that.

      • Jeep

Septic tank, your assessment is completely wrong. Of course, your true colors show through with, “The same can’t be said for most white folk”. Really? You deride others for using generalities, too bad you don’t follow your own advice. Well, that’s typical. Instead of “chilling out” why don’t you go spend a few days on our border with those mild mannered illegals streaming across into our country.

Fact- they are breaking the law. Nothing more needs to be said.

Fact- Arizona’s law is less restrictive than Federal Law.

Fact- There is a legal method for becoming a US citizen available.

There are many more appropriate responses, such as the costs associated with illegal immigration, that could be argued. But, what else needs to be said? It’s illegal.

      • 45caliber

“There may be individuals, as with from any race, who commit these type of heinous crimes, but your commentary shows that you are willing to label all Latinos as offenders.”

They ARE all offenders! Perhaps not of those stated crimes but they are certainly an offender of our immigration laws!

      • J.M.R.

That is because they really think they have won and are part of this country. It won’t be long and it will be a reality. Our government does not give a damn about us or the constitution. It is terrible what your government has given away.

That piss pot called Mexico will remain that way untill it’s own people stand up on thier hind legs and take back thier country. How many other nations have taken over Mexico in the past? Too many. Mexico’s people have the numbers, if each one of them would would pick up a rock and toss it against a Federalies, politicians or a dope dealers skull they could take back thier nation. Don’t bring your trash here to dump it.

Your post though interesting, its focus is some what distantant from what anyone who is of Hispanic decent who is here “Legaly” really feels.

I have countless friends of Hispanic backround who live here and have done all that was required of them to be here as Citizens of the United States.
I can say that not a single one feels that Mexico is acting in a manor that is rational or logical.

Hey, Ms Sceptic or Mr Sceptic. I don’t want to be rude, I want to address you appropriately. Most of my best friends, co workers and Military buddies are Latinos. My Grandfather last name is Rances half Spanish. I have a great admiration to all Latinos or other immigrants who immigrated here to the United States legally. I came here to the United States legally, however, my sister is still awaiting for her call from the US immigration office. This has been since 1988. The delay, is because of the influx of illegals who jump over the fence,
across the borders without any respect for the Laws of our country. I don’t know what your current position. If you are illegally in this country PLEASE TURN-IN YOURSELF AND DO IT the RIGHT way. There is no limits to anyone who desire to come here in this great Country, provided they do it the right way. STAY IN LINE AND WAIT FOR YOUR TURN.
I am not getting carried away… its the facts, they rape, murder, they distribute tons of drugs, take away our jobs, we pay their health care, we pay their educations etc. Sceptic, where have you been, are you listening to the news. This is the reason why Gov. Jan Brewer set up a new immigration law in Arizona. My respect to Congress Woman Gifford (D) AZ who supports the Arizona Immigration law
as well. Listen to Fox news or Rush Limbaugh. You don’t have to believe them but at least you have to compare who is telling the truth. I have confidence in all Latinos, they are good people, conservative, religious and believe in the almighty.
I am a retired Military and I have an obligation to uphold and protect the Constitution of the United States against domestic or foreign enemy. You should be proud yourself as I am, enjoying the generosity of this great Country, the Freedom and pursue of happiness. Stand up for America, be American. Tell your illegal friends to do the thing. Stay on line and wait for their turn. Adios.

Wake up do your research We the people of America are a laughing stock. They the illegals laugh at us as we pay for their schooling and their medical bills they. Also donot have to pay taxes they come in and take take take and we are supposed to protect them? Just what message are our children getting that one can come in and do all these illegal things and protect them they get benefits what do you think that is teaching American children. When are we going to stand up for America where is the faithfulness to our country ? No but we cator to these illegals I will say it again Illegals because what they are doing is illegal period wake up !!! You may enjoy being walked all over I will for one support Arizona and hope the rest of the union will follow suit! I for. • ROBERT

This is beyond absurd. It’s like the Sheetheads building a mosque in the shadow of Ground Zero as a monument to their victory over the USA, and Bloomberg the Boob allowing it. The inmates are running the asylum.

  • Carol

This is rediculous that Mexico should be able to file suit in our courts against our laws. Apparently, Mexico doesn’t want these people either since they want to force us to keep them. This tells me they are either criminals that Mexico doesn’t want to house in their jails or that if not criminals they are a means of more money being sent to Mexico. I believe it is both reasons equally. Right now, American money needs to be earned and spent in the USA, considering how our economy is taking a hit.

  • Fay

I agree with Time, Peg JC and Stephen Smith all sound like good ideas to Me.

  • David in Ma.

Isn’t it about time someone read Mexico’s immigration policy?

Perhaps the illegal Mexican immigrants flooding America should be processed under Mexican Law & not U.S.Law, then there would be no argument from Mexico,’cuz if there were they would have to change their law in order to bitch about any other countries immigration laws.

Look into it, check out Mexico’s & other countries immigration law, you might be supprised by them.

Mexico needs the money immigrants (legal & illegal) send back to Mexico, otherwise the country would crumble from lack of funds to operate…the taxes the drug peddelers pay just can’t carry the corrupt Mexican government.

    • john

Mexico’s do as I say do, not what Mexico does, is their stance.
I think anything that 3rd world toilet bowl has to say, should have NO impact on what one of our sovereign states decides to do to protect their borders!

Mexico wants the US to accept ONLY Mexicans here. The rest should be shuffled off. And they do their best to insure they do – one way or another.

    • L. Sintros

Al, are the Arizona people firmly behind the governor? I hope nothing upsets her. I see that even old McCain has done an about face. For years I wondered why the people kept sending him to the Senate as he has always advocated open borders and Amnesty, i.e.,the McCain-Kennedy Amnesty Bill.

      • Al Sieber

L.Sintros, yes, a vast majority of the citizens here are for it. the illegals aren’t.

      • rwnut

  • Stephen Smith

The most absurd briefing from a foreign country about their illegal criminals!!!
Do they not care about their own responsibility in allowing illegals across the border? Maybe we should take over Mexico over this issue!

I suggest that we send the legal bills to Mexico for all illegals (past and currents).
2nd, Have the mexican Govt pick them up with PROOF OF ID! No proof no releast, but still pay the bill for their lock up. What do you think Mexico does?

Then see if there is just cause for REPEATING violators for criminal/felony lockup… Mexico pays the bill!!!

Then see how the US/Mexico turns out!

    • William

well Stephan that would be a good idea but for one thing. mexico cant and wont pay the bills, what we should do is start executing repeat offenders. look at the americans who have been killed because of the laxness of our own government officials who should be charged tried and convicted of dereliction of duties ans violation of their oath of office. if a lowely enlisted man were found guilty of violating the same oath he-she would be dishonarably discharged as a minimum,

      • Richard Pawley

William, what most don’t know is that more Americans have been killed by illegal aliens then were killed by terrorists on 9/11! Don’t believe it? Do the research, look it up. On top of that there have been over one million sex crimes committed by illegal aliens. This is just considered a “cost of doing business” by Congress but the blood of those Americans is on the House and on the Senate. They may not consider it important but the law of the Universe apply whether one believes it them or not. THEY WILL BE HELD ACCOUNTABLE! I suggest that before the Laws of the Universe apply that these Congressman be held accountable NOW and that we vote them out in November. If we wait until 2012 will be to late! It is NOVEMBER OR NEVER!

7/1/10, Rich, don’t get your hopes up too high; the GOP sold us out, too. To quote the one & only Bob Grant: “It’s over, folks. We’re slipping & sliding precipitously into third worldism.” ~~p.weiters~~

      And one more thing…

And President Obama wants to give Mass Amnesty to these illegals!!!
      NO WAY!!!

      • http://myronjpoltroonian.blogspot.com Myron J. Poltroonian

One Executive Order too far, leading to Mass Amnesty, will lead to Mass Insurrection. Plain and simple. If “We, the People” win, we all win. If “They, the Statists” Win, “We, the People” lose. Perhaps forever. (Remember: Always aim just below the blue helmet. No matter what color it is.)

Let’s use them for live fire exercises, wont cost the government a dime,we already paid[SS etc] and let them earn the right to be here,if they survive they stay,if they dont too bad. We should send him home with a couple of hundred thousand illegals under each arm.

      • Jeep

        LOL…YES!

    • Diana

Good thought. However, I believe it only refers to the majority minority of our day, that being TAX PAYING, WORKING AMERICANS.

      • JC

In their unimaginable kindness, those are the Americans that have been quiet too long. But that is changing.

      • Jana

        JC,
        YAHOOOOOO

  • Peg

Since when does Mexico have any say in the United States laws? As for Mexicans afraid to visit Arizona, only the illegals will be afraid, and that’s how it should be! Anyone here legally, only has to show their papers and all will be fine. No legal papers and off you go to jail!! I think every state should adopt this law!!!!

    • David in Ma.

Showing papers to prove one is in America legally is already required, it’s nothing new!

      • Jana

        David in Ma.,

I went on a trip to Singapore a few years back. The first thing I was told was to keep my passport with me at all times. I did. I never did anything to be asked for my papers, but if I had been asked I would have gladly shown them.
The same thing happened when I went to Germany, France, Scotland and Ireland. I kept my passport in a holder that went around my neck. In other words, I complied with the laws of that particular land.
Mexico is showing they have no respect for our laws, they are trying to bully us into compliance. Obama is trying to bully Arizona into his compliance. Shoot, he is tryng to bully all of us into Socialism and Communism. He surrounds himself with Communists and has stated he likes and feels comfortable with their ideologies.

      • Diana

Really! Ever tried to write a check (even if you’ve done business with the stupid bank for years) without any ID – or an expired ID?!? Not to mention another “required” ID.

      • Bud in San Antone

Diana, when the new health programs begin everyone will have a national ID then. They have tried every other way to initiate this and now it’s a done deal.

      • LocalYokel

There was a time when owner operators of any business or local government servant knew and respected all their customers and voters on sight. Population and government explosion paralleled by continued devaluation of currency has caused the necessity of business expansion to the point where the means is no longer visible from either extreme. Security measures have evolved into being more of an insurance requirement or indirect monetary protection a handled by hired hands thereby sheltering the elite from the filth of parasitic competition between insurance moguls and overpopulated barrister ranks. Now guess who pays their added expense.

    • William

peg since so many IDIOTS voted for the clown who is defiling the oval office now.

    • Margi Popp

Peg, I agree, if you are legal then you have nothing to fear. Living in Arizona myself gives me new fears for traveling to California to see my best friend and she is concerned with travel to Arizona as well. This is not fair, this is my country not Mexico. We will still travel to each others homes however we will be more alert to our surroundings. This has to end, we need our country back and the freedoms of which we all have earned through sacrifice through loss of our loved ones protecting our country.

      • Jana

        Margi Popp,
As far as I am concerned, if they are afraid to visit Arizona (which I highly doubt) then let them stay home or visit someplace else!

      • L. Sintros

        I live in Florida (5th generation)and we need a law like Arozona’s.
The illegals are taking over our state! Not only from the southern border but also from the Caribbean. 29 illegal Cubans landed yeaterday!

    • john

      Peg,
You are right on the money!!!!!!!!!!!!

    • L. Sintros

      Absolutely!

    • Allan

There is something called the Alien Tort Act which allows foreigners to sue. Not sure if it is what applies to a country. But really it boils down to how liberal the judge is who decides whether there is cause.

    • Linda

It is because of Mexico that they are all here! Tell Mexico to take them all home and pay for their sorry asses instead of expecting the Americans to be a charity all! let’s boycott Mexico and don’t buy anything imported from there! What a bunch of hyprocrites their laws are more strict than ours! These people are ILLEGAL time to step up to the plate Americans and take our country and our English back!

      • LocalYokel

One would think that the idea would be widely accepted since the cost of flying them all back at first class rates is cheaper than a year of entitlements forced onto them by waiting government agencies.

    • http://zzzz Preston

7/1/10, Peg, The BHO gov’t has sold us out even prior to assuming office.
We should demand a barrel (42gal.)from Pemex for every single wetback that invades our territory. Instead we get a lecture before Congress by Calderon on why Arizona’s 1070 is so bad. What’s wrong with us? how did we elect such a tinhorn dictator? Stupidity, maybe?

      • LocalYokel

No doubt, judging by his latest admission that all southbound shipments INTO Mexico are all inspected.

  • TIME

Our court system {should} toss this case out as not only a frivolous suit, as it clearly is insufficent as a matter of law.

But as well ventures into a form of Extortion by Mexico to the United States to allow behavior that they as in Mexico clearly will not allow within their bourders.

The maddness of this issue is beyond Absurd.

    • William

time. if we had a president instead of the fake who is defiling the oval office this would never be happening. eric holder should be fired and obummer should be IMPEACHED immediately. maybe in nov. 010 and 012 we can clean house and hopefully get some people in office who will uphold the constitution which these slimeball are trying to destroy,

      • jomama

        William -
Remember – no other president has done anything about this either. NOW – the Mexican president is using blackmail to get what he wants/demands from us.
Like everyone else before him (Obama) – he will crumble. He will give the whole damn country away to whoever he can (like Elena Kagan, Sonia Sotomayor & also the illegal aliens) before he is done.
        Picture this:
Tough military men & women running from the front lines with their limp wrists flapping in the breeze.
        Or:
Obama with a gold & red velvet crown on his head.
Yeah, it’s coming – sooner than you think.

      • 45caliber

The Democrats neither like nor trust the military. They consider anyone who would volunteer to be a frustrated murderer.

I think their big push for gays in the military is because they KNOW that many already there would quit. They want to reduce the size of the military by making it a gay sex club.

      • Diana

America is becoming weak due to its division and lawlessness. As a result, Americans no longer have the will to make sacrifices necessary to fight and win wars. “We are not prepred to die to defend our security, as we were in the pat, ” Gerald Flurry writes. “This is the supreme sign that our will has been broken — and that our republic cannot stand.” That broken will was prophesied in Leviticus 26:19, where God said He would “break the pride of your power.” The unwinnable war in Afganistan being fought w/a politically correct “just war” strategy, is a result of that curse. Can you see it?

      • LocalYokel

But can you embrace the statement made by Patrick Henry on March 23,1775? Notice that even then he chose to remain active in state politics rather than risk what Santa might deliver to him in national politics.

      • Diana

Amen to that, William. What other president OF ANY COUNTRY would allow another country to file a suit in an American court? When God was talking about human government in the last days, He said through Isaiah 1:7 “Your country is desolate, your cities are burned with fire: your land, STRANGERS DEVOUR IT IN YOUR PRESENCE, and it is desolate, as OVERTHROWN BY STRANGERS.”

      • http://zzzz Preston

7/1/10, You are so right, Diana; Nikita Kruchev once told us he would bury us —-as he banged his shoe on the table.
Well….it’s now happening under the BHO gov’t. I’m almost 63 & I believe I will see armed revolution in my lifetime; everything points in that direction.
We are vulnerable to attack from enemies both foreign & domestic. It’s sad but true. ~~~~p.weiters~~~~

      • http://yahoo Daisysue

Well Obummer gave pres. calderon more than he alloted for the state
        of Arizona for border patrol.
That don’t piss me off half as bad as the $20,000,000 he gave to the People of Gaza ( HAMASS ) some sort of aid program. What a pile of it. Just donateing his cousins a little of our TAX MONEY for their weapons program. bad words bad words, bad words

  • K. D. M.

Talk about guts. The Mexican Government has no right to do this. Perhaps Arizona needs to counter sue them for all the illegals, all the damage and the drugs crossing the border. Better yet put the Mexican Pres on trial for the murders his people commited on this side of the border. Give him the death sentance…

    • Navy_seal

As a former seal I think we the people should get out of the Middle East and bring our troops home and line the southern U.S. border with the troops and that would stop all the illigals from crossing the border.
and yes the law passed be Arizona is the same law that the U. S. government has on the books now, but the problem is the Justice Department is too Woossy to enforce this immigration law, but yet the President keeps talking about reforming the immigration law. Which means that they want to give amnisty to all illigals already in the U.S.
