Vice President Joe Biden defended the administration’s latest Supreme Court Justice nominee on Tuesday, telling ABC’s Good Morning America that Elena Kagan does not have an anti-military bias.
Conservative leaders are heavily criticizing Kagan for the decision that she made as the dean of Harvard Law School to ban military recruitment on campus due to her condemnation of the "don’t ask, don’t tell" policy, which prevents openly gay individuals from serving in the Armed Forces.
"She has taken very few policy positions, and the one policy position that she took in favor of gay rights when she was dean of the Harvard Law School, directly contrary to congressional law … troubled many," Senator Jon Kyl, (R-Ariz.) told Fox News.
Meanwhile, Senator Jeff Sessions (R-Ala.) said on Good Morning America that Kagan will be forced to answer questions related to her controversial decision as well as her lack of practical experience with the law.
In response, Biden noted examples of other successful Supreme Court justices who had minimal judicial experience.
"She is Main Street," he added. "This is a woman who has lived in the real world."
