Critics blast Obama administration's decision to read terrorist suspect his Miranda rightsRepublican leaders heavily criticized the Obama administration last week for allowing officials to read Faisal Shahzad his Miranda rights soon after he had been taken into custody for allegedly attempting to detonate a car bomb in Times Square over the weekend.

Senators John McCain (R-Ariz.), Christopher “Kit” Bond (R-Mo.) and Joseph Lieberman (I-Conn.) all conveyed their disappointment with the administration’s decision to not classify Shahzad as an enemy combatant, a move that would have allowed investigators to hold the suspect indefinitely, according to The New York Times.

Officials with the Federal Bureau of Investigation (FBI) said that Shahzad was originally interrogated under a public safety exemption, and was then read his Miranda rights soon after authorities determined there was no imminent threat. Officials with the FBI said Shahzad provided them with "valuable intelligence and evidence" both before and after being advised of his rights.

In response to the incident, Lieberman announced on Wednesday that he will propose a bill that would strip alleged terrorists of their citizenship immediately after being detained, CBS.com reports. The senator indicated that he would attempt to amend a current law that revokes a person’s citizenship if they join a foreign army.

    It’s becoming more obvious and clear that people who are discrediting the Tea Party movement are overcome with fear that the era of the goose that laid the golden egg may be drawing to a close. Entitlements are going to take a hit so your only option may be to acquire a skill that will allow you to earn an income. Good luck.

    I doubt that any of you have read the Miranda case and the judge’s opinions that accompanied it. If you believe Shahzad is a piece of flotsam, you should see what Miranda perpetrated as a crime.
    Don’t get it twisted, I’m of the opinion that Shahzad, should be executed by the state, but after the due process of law has run its course. I also have extreme reservations about the language of the bills proposed by “Tail gunner” Joe Lieberman and his cronies. Have any of you read (and understood the implications) of The Belligerent Act? (McCain and Lieberman are the authors) What we find is a further extension of powers being concentrated in the Executive branch of government a la Pat 1 and 2, the Victory Act, (this act allows the government to confiscate your money, keep it and allows no forum for redress). Google Executive order – May 7 2007 and check out how GWB via Executive order virtually eliminated the checks and balances outlined by the founding fathers.
    Be careful what you ask for, (especially you Tea people) one day you
    might be designated as a “terrorist”.

    Shahzad has no legal rights. He lost those rights when he tried to blow up a section of New York City and kill thousands of people! He is proven out of court to be a terrorist. He spilled his guts, with a little squeezing, so what was he promised if he told on his fellow terrorists? If the US judicial system doesn’t hang him, his “buddies” will. Plans to blow up areas of the United States and infiltrate America by Muslims is not an over-night decision. Plans are in the making sometimes for years. No Miranda Rights for any known terrorist. That’s my vote.

    While I disagree with most of what this administration is doing, if this terrorist is an American citizen then he deserves the same rights we all have. There still is the right to try him of treason, but only if he is a citizen. Under this administration, anyone opposing their policies could be deemed a terrorist – so we must protect all citizen’s rights.

    Senator Lieberman is a perfect reflection of crack pot extremists when he suggest that the mere detention of someone as a suspected terrorist result in their citizenship being pulled—and this man is a Senator of the US? Mr Lieberman would find a more comfortable bed for his ideas with the Iran administration. He sits there, one of the fat cats wallowing in all the wealth and benefits heaped on him by this wonderful country and then, burps,and makes such remarks. A revengeful person might suggest when Senators are no longer the Statesmen such as Goldwater and Dole, Kennedy and even Hatch, they should have their Senatorship status–immediately rendered VOID!

    It’s not easy to tell if Owhoever confuses law with entertainment. This could be an emerging form of bread and circuses, folks. If it’s put on national TV (why not?), then perhaps Ohopeandchange could compensate for his mainstream media whores having such low ratings.
    Anyway, it will all come out in the wash, so to speak. I’m just glad that Otransparentethics is so concerned about the many rights of terrorists – as opposed to the rights of Americans. One must always have one’s priorities straight.

    The Miranda Rights basically is a warning to the arrested suspect. This allows US to use anything the arrested suspect (citizen or not) says, against them in a court of law, otherwise whatever the arrested suspect says, isn’t permissible in a court of law.

      Addendum: Neither the Miranda Decision, not the Fifth Amendment makes any distinction as to citizenship. Miranda merely states that the suspect must be advised as to his rights and that all statements obtained AFTER having been “Read his Rights” may be used against him/her in a court of law.

      All persons accused of a crime in our country, citizen or not, will be advised of their rights. It’s the law, and until it is changed, all government officials are obligated to obey. In the NYC attempted bomber case, how did reading him his Miranda warnings hurt the government’s case? It hasn’t. He is still talking and giving very valuable information. And remember, he was questioned first without Miranda warnings under the public safety rule exception.

      Let’s see this “political” nonsense for what it is. The Republicans, out of power (And McCain desperately fighting for his political life against an extreme right wing who never agreed with Miranda rights in the first place)are trying to say and do anything to get back in power. That don’t even agree with the self-serving political rhetoric they are using now. How do I know this? Because when the conservative/Republicans were in power, THEY GAVE MIRANDA WARNING!

      Constitutional rights are not privileges. If they were, they would be called constitutional privileges. The fourth, fifth and sixth amendments, for instance, are not “technicalities” as the right often claims. The are the very heart and soul of what our entire system is about. They should be understood, appreciated, and defended by all of us against political con artists.

      For years Limbaugh railed against the fifth amendment. He said, “innocent people don’t need to take the 5th and be silent.” Then what happened? He got into illegal drug abuse problems and the first thing he did was “take advantage of his 5th amendment right to silence.” Interesting isn’t it, he’s not bashing the 5th amendment anymore. Another con man hurting our country while he makes millions.

      David, you’ve lost sight of the real picture here. You do not grant citizen’s rights to individuals who performs such attacks on the citizens of our country. This was an act of an individual whose belief system has made us their enemy and thus is an act of war, not a civil matter to begin with. You can read the miranda to whoever you want that is being arrested for anything from a DUI to a homicide, but not to an enemy combatant of our people. Get that straight. This piece of crap was trying to kill innocent Americans just like those SOB’s did when they flew passenger jets loaded with innocent people into the Twin Towers. It doesn’t matter if they “slipped through the cracks” and were granted citizenship. They are not us and will never be us. They are the enemy of our country and our way of life. Our civilian laws are for us as American citizens. When we recognize that someone who is living in our country really isn’t one of us, we should deal with them as such. In this case, turn him over to the military as a prisoner of war and an enemy of the American people, which he is.

S. bred and born citizen/military vet, and told me I was suspected of committing a crime and he has come to arrest me the prosecutor would hear about it at trial if he didn’t read me my Miranda rights. I have a feeling you would want it too.
        Like it or not, ShObamazad is a citizen – Taliban trained, financed, assisted, mosquerader and radicalized. But unless the judge declares such evidence inadmissable he gets tried on those things on his day in New York City court. That will be what Obama wants – maybe the bomb wasn’t a misfire after all.     I am far cry from a bleeding heart liberal. However, I think the laws we have in place are there for a reason. I don’t have any sympathy or empathy for those who break our laws. We must find a way to screen those who seek to do harm to our country BEFORE they become American citizens. AFTER they have become American citizens really complicates the matter.

      That’s a good point Robin. BUT, first we have to recognize that this war we are fighting is nothing like WW II nor Korea. Like Viet Nam, there are no defined battle fronts. Your local air port, your shopping center, the football stadium can all be the new battle front with this new enemy that does indeed, embed themselves in our society and then strike when the time is right to remind us that we are not safe anymore. Fortunately, we do know what they look like, where they come from and sure as hell what their religious preference is. That’s why we have to profile. Screw the ACLU and all of the people that think these people have the same rights as NORMAL God fearing American citizens do. The only reason these jihadist seek citizenship is to use our own Constitution and our own governmental system against us for their protection and benefit. Anytime an individual sets out to cause death and injury on a massive scale to the American citizens, this should be considered an act of terrorism and an act of war and should be dealt with as such. That individual should be captured, placed under military arrest and treated as an enemy combatant by our nations military courts system. Their handling should NOT be under any civilian court. It is NOT a civilian matter, it is matter where the individual has attacked the innocent people of this country just as sure as the Japanese attacked the people of this country at Pearl Harbor. Let’s get that straight right now. You don’t grant rights to the enemies of your country when you know damn good and well that the individual is an enemy of your country even if he HAS been granted citizenship. Look at them for who and what they really are at heart and treat them as such. Strip them of anything and everything they have and turn them over to the military to deal with as a military prisoner of war. That is the ONLY way to deal with these animals. Give them their “fair” trial and then execute them.

    The point really is…If you come to the U.S. and obtain citizenship just to embed yourself as a sleeper agent, then yes, you should have citizenship revoked…along with your skin (stripped from you). You should not have been given citizenship in the first place had people in charge been on the ball in knowing who you are, instead of fast-tracking your citizenship.     It was my understanding that he was an American citizen. If so, I disagree that he shouldn’t have been read his Miranda rights, nor that he should be stripped of his citizenship. If he was here illegally, I wouldn’t have any issues at all that he wouldn’t be treated as an American citizen. But, if he is an American citizen, his rights should not be stripped until he is proven guilty.

      All the reports that I have seen are saying that he is a US citizen. With that in mind he is afforded the right of a US citizen. This is a test of our patience, perservance and integrity and one that we can not afford to fail.

      We have to remember that if the government can take away the rights of one of us it can take the rights away from all of us.

        That’s why Obama and his cohorts have not screamed bloody murder. In fact, I wouldn’t be surprised to see him advise that something of this nature would be a great idea in the “War on Terror”. Take away the citizenship rights of any and every one who disputes Obama’s agenda. Can you see cella, Am Lib, Eyes Wide Obama or ay of them saying anything but “Yes! Hoorah for Obama! He’ a genius t take conservatives’ rights.” Most of them have said as much at one time or another and about 1/3 of America agrees with them.

        Guys like Shazad (the Times Square car bomber) or illegal border jumpers should be read Miranda to protect Obama’s friends. But, American born, tax paying, military veteran, patriottic, Christian life-style citizens who criticize Obama’s government should be villified in the strongest terms and disenfranchised.

        Of course then he’d cite anyone who shows up at a Tea Party gathering, on a conservative blog, name on a conservative petition or what have you that advocates a return to good, honest, responsible government. If that causes your sphincters to twitch then they’ve already won the battle cause that’s the objective – fear. The traditional tactic of each and every despot that ever subjugated mankind…collapse money and debase everything of value to make everybody paupers, point out the “hate worthy groups”, demonize and collect all the weapons and then send out brown shirts at midnight.

      I agree with what Robin said. I’m no liberal, but if you disagree just consider how those same citizenship stripping laws might be used against you or me someday for the least provocation and to keep you living in fear given that former President Clinton has already called Tea Party protesters terrorists, and the last time I checked they are just people who espouse the beliefs of the founding fathers and have concern for the welfare of this country. The proposed law should scare you more than the terrorists. You’ve got to think ahead and stand up for what is right. I sympathize that the decisions are not easy. Freedom is messy business. As for the court system, I have no doubt Shahzad will get the death penalty in whatever court he is in, and I have faith in the system, but when I heard the story I did figure that going outside the military court system was an Obama decision to avoid having to be personally involved in signing the death sentence in a military court case as commander of the military.
