Legal challenge to Arizona immigration law mountingAs the controversy surrounding the new Arizona immigration law continues, more individuals and organizations are threatening to sue the state over the provision they consider unconstitutional.

On April 29, Mexican American Legal Defense and Education Fund (MALDEF), the American Civil Liberties Union, ACLU of Arizona and the National Immigration Law Center held a news conference in Phoenix to announce a legal challenge to the recently signed SB1070.

"A vigorous and sophisticated legal challenge will be mounted, in advance of SB1070′s implementation, seeking to prevent this unconstitutional and discriminatory law from ever taking effect," said MALDEF president and general counsel Thomas A. Saenz.

The announcement came as a Tucson, Ariz. police officer Martin H. Escobar asked that local law enforcement be exempt from enforcing the new immigration law in a lawsuit filed in Federal court on April 29, according to CNN.

Escobar was quoted by the news provider as saying that the bill will "seriously impede law enforcement investigations and facilitate the successful commission of crimes."

The law’s opponents allege that by making it a state misdemeanor for foreign nationals not to register and carry their documents with them, and by allowing police to inquire as to the immigration status of persons they consider "reasonably suspicious," the law opens up doors for racial profiling of ethnic minorities.     the only way we can stop this invasion is to immediately close the border to all immigration legal or otherwise. then we should clean up our voting precincts, every voter should be identifiied and cleared, and fingerprinted/photo. the voting system is the most corrupt operation going now and we will never remove these marxist politicians with the status quo. acorn is going strong and the media is their lap dog.

    What is the problem with enforcing the federal laws tha the gov’t wont.
    I live in Illinois and back the Arizona law totally. I think the only ones that are against it are those of Mexican heritage and the criminals themselves the illegals. I would back it here in Illinois, if someone had the backbone to institute it.

    That they would be ‘constitutionally’ challanged is unbelievable. Obama et al have totally ignored our Constitutional rights, and when a state finally has the courage to do what should have been done decades ago, they come under the gun. What’s sauce for the goose is also sauce for the gander…so to speak.

    How can there be a LEGAL challenge to ILLEGAL immigration? It is beyond comprehension. How do they even have supporters and money for attorneys? How are they rallying in the streets? I am all for immigration, but there are rules and procedures for these things. For every ILLEGAL immigrant, there is a person out there trying to LAWFULLY come to the United States, and we have to be more stringent about allowing people over legally because of all the illegal ones. Why do we always punish those who are trying to do things properly? It’s the old – ask forgiveness, not permission, and it shouldn’t fly.

    Arizona bill SB 1070 is pretty much a mirror image of the Federal Law already in the books on Immigration. It only adds that Police Officers also have the right now to question your legallity here. Its a good law and meant to help Americans regardless of Race.
    E Verify can find out if the ID is real also. Many many illegals here now are using info (SSN, address, etc.) that they get from records of Dead people.
    My advice is “don’t break any local law while here illegally and you probably won’t be bothered. Also, learn English, its a dead give-away when you can’t answer in English.

    It just blows my mind that there is even an issue with Arizona.
    They’re keeping with the law!! The Constitution is the foundation for Americans not illegals who come here illegally.
    Escober should be fired for no enforcing the law he is paid to uphold.
    The MALDEF AND ACLU are nothing more than trouble makers who love to usurp the law, in this case Federal Law that other states won’t stand up and enforce.These states AND their statesmen should enforce these immigration laws as well,or be fired.
    If all the illegals where forced to leave, thousands of new jobs all over the U.S. would open up for U.S. citizens.
    And as far as illegals’ babies born in the U.S. and their child automatically becoming U.S. citizens, that is one of the most absurd law ever written.
    Send ALL illegals back to their country, if it happens to be Mexico they should start their own revolution(like we did)not come here and take our jobs,get on welfare,commit awful crimes(like shooting border patrol officers). America can’t afford to turn a blind eye any longer.

    I guess the only thing left to do is to take the law in your own hands and give the illegals a bus ticket to New Mexico or any other state that advocates for the illegals. It would be cheaper then paying
    for their medical and or dental. Even a bus ticket to DC would be better then keeping them in AZ. See how long before they change their tune about rights for the Mexicans. California is broke, NM is having to cut in a lot of areas, and it all boils down to not just Mexicans, But many welfare people who have made it a “life style” to live off of the government.Lets send our welfare people and our criminals to Mexico and seal our boarders once and for all.

      I think sending them to New Mexico is a good idea since their governor Richardson is so again the AZ law. How long does he believe the people in his state can support all the illegals, lost jobs, healthcare fraud, and criminal activities.

      This law was a cry for help by every citizen in Arizona that believed they lived in a country of laws that were enforced as laws.

    My recommendation for immigration reform:

    Immigration

    I say let anyone into to this country that wants in, With these stipulations:
    You do not have a criminal conviction in any other country’
    You provide two medical reports done at not more than 6 month intervals and within a year before the time of application for entry into the U.S.showing that you are disease free (HIV, Hep, etc.)
    You come here on a five year permit.During your “Permitted” time you will:
    Register for a Social Security Card and have your card before you may work here.
    During the time your permit is valid, you will submit to double the normal rate for SSI payments
    Any children born to you while you are still on a valid permit will not automatically become a citizen of this nation. They have the same status as their parents (temporary, until all requirements of the parents is met for citizenship).
    You will not be permitted welfare. It is not a option don’t ask.

    During the time your permit is valid, you will : Learn to speak english, Use it in everyday life. You must become fluent. If you come here, do not expect us to learn your language in order to communicate. English is spoken here!
    While I understand the diversity of cultures in this country The nation was founded by the British Colonists as such, the official language is English.If you want to keep your cultural language alive, that is fine, but you left your country and now you are here, so when in public, Speak English..
    Let’s all have at least one thing in common….One Language…English!
    You will learn the history and Constitution not only of the nation, but also of the state where you live.
    You will submit to a test to validate that you know these things and you will then be sworn in by your oath as a citizen.
    Failure to attain Citizenship within the five year permit time, revokes the permit and you return to your country of origin, no sad tales, no excuses. Your stay here is over and you may not apply again for five years.
    Anyone caught in the country without the valid permit to be here will be jailed for a period of one year first offence 5 years for any subsquent offense. Also, while incarcerated inmates will have no recreational equipment,TV’s etc….eats and sleeps nothing more. While incarcerated, all inmates will work 10 hour days 6 days a week in a variety of jobs, from gardening, raising pigs and cattle as well as making license plates. This way the citizens don’t have to support them.Prisons are for punishment, why should we support you? Don’t complain if you end up there. The gardens ,cattle , pigs ect. will be used to both feed you and to clothe you (any excess will be sold to the local community at a fair market value, which will in turn clothe you).Once in one of our prisons, any violations of law will be dealt with according to the crime(but, I see a lot of people in good old fashioned stocks and pillory, as well as the good old fashion public floggings).

        I do not believe that changes to any law should be made retroactive…it was against the law when someone did it….it doesn’t mean that if the law changes tomorrow…it is excusable (while I agree that the punishment should be less severe if the laws were to change while awaiting trial… but the bottom line is…illegal IS still illegal).

      A.J.-You make some really good points. The only thing I would change is, the prison example. I would say deport them and they too could apply for citizenship in 5 years, but that would also mean they would have a criminal record in the States so that means no entry what so ever after being caught (even once) illegally coming into our country.

      And it should be retro no alien should be given amnesty.

        We do not let convicted felons enter this country legally. We have laws to fine employers, we have laws to send illegals to prison after the second time they are caught but there are so many we don’t have the space or money to incarcerate them. What we need to do is seal our borders and then tackle sending the illegals home. They should have to get in line like everyone else that respects our laws. They do not deserve to shove a person out of line to get what they want and they have no right to demonstrate in my country because they have no rights here as a criminal.

    We see hundreds of Mexicans on TV “demonstrating” in the streets. Smearing refried beans on buildings and throwing bottles at police. Are these the illegal Mexicans who came here looking for work and a better life.. or just the criminal minded aliens that commit the crimes, rape and murder? It seems to me that while they’re all rounded up we should call in the National Guard and herd this mass of obscenity into cattle trucks, drive them down to Mexico and dump them out. Since our “leaders” don’t understand the meaning of illegal either, load them up too and dump ‘em.

    I just love all of the people screaming “Racial profiling”. Let me see if I have this right. Az. is a border state…correct?…..it borders…Mexico….correct? Az. has an influx of illegal aliens…..correct? So, by this reasoning, where would most of those illegals be coming from?…..I know…..they must be Canadians…yeah that’s it… or maybe Chinese….makes perfect sense to me…lmao.     It is time a contingent of Americans goes to the FBI under the freedom act of information and get the numbers of American deaths for the last three years other than the drug cartell. It will blow your mind. That is the time the Democratic liberal party has been in power. Two former FBI agents mentioned it on the air more than a year ago, and it numbers into the thousands. We need to add these people who admittingly live in fear due to the deaths of their loved ones, to our marches and make sure America sees the violence on our own soil by the illegal aliens.

    I have not yet read the legislation. As usual, the mainstream media have not done a good job of explaining the important details. So, at this point, I am not sure of whether this is good law, or very bad law. It is good if it helps enforce existing valid immigration laws without resulting in any bad unintended consequences, and without opening doors for further repression of freedom by the establishment. It is very bad if it adds to the decline in individual freedom and continues the destruction of the Constitution.

    Most states make it a crime to falsely identify oneself to police authority. This is usually only pertinent when there is some connection (suspect, witness,victim, etc) to a crime or suspected crime being investigated. There is no specific or absolute provision for printed identification. Verbal identification fills the requirement. For example, if one witnesses an automobile accident, police will record information about the accident from a witness. It makes sense to record the name and contact information of that witness. But that witness has no legal or other obligation to produce printed identification (driving license, photo “ID:, etc.). We are, and SHOULD ALWAYS BE, free to walk the streets of any city with nothing on our bodies except the clothes that protect other persons’ privacy from being invountarily invaded by our privacy (nakedness). Nobody should be compelled to carry “their papers” in a free country. Verbal identification should not include such crap as Social Security number, fingerprints, etc. Many police departments today have a policy of recording the Social Security number of a person who seeks help, such as filing a report of a simple theft. This is unconstitutional and will lead to increased tyranny. You should not carry a Social Security card, should not memorize the number, should use it only in banking/investing/taxing situations (NOTHING ELSE!), and decline to give it on any police report or ever as a means of identification. Don’t let the Communists/Nazis end up having the last laugh on us.

    So that’s where it stands. If the new Arizona law helps to properly enforce proper existing immigration laws without violating the above principles, then it is probably good. But if it further intrudes on individaul freedom by further pushing the envelope on violating those freedoms, then it is VERY BAD.

      Federal laws require immigrants to carry identification. Arizona law does not change any federal laws. The law only grants law enforcement the ability to ask for immigration status or a passport when someone has been stopped for another violation. They CANNOT stop just anyone! All the hype against the bill is to remove states rights, keep the border open and grant amnesty to all illegals in the country and continue to do so.

        michelle i am a 60 plus white man with no criminal record i do not drink or do drugs i have been driving for about 50 years i try not to speed and stop at all trafic signs i have been stop for walking down the street on a cops idea i may look supect and ask for id i have had a dri lic from the time was 16 and never been revoked i have been pulled over and asked some of the stupidest ques that had nothing to do with why i was stopped so my point being if you go out of the house without id it is your fault we have a law here in alabama were the law can put up road blocks and stop you for no reason but to check your papers and if you do not show them they can impound your car and possibly you to, do i think stuped goverment offical like c rangel and obama and more of the left liberal need get on tv and encourage illegals that have no rights to demand ,you can bet that holder and nepalitano have under cover agents at the tea party rallys but it is ok that crooks and illegals can have rallys and demand rights they don,t have , arizona has a legal and morel right to enforce it laws and protect in people we can not servive as a nation by giving right to people that are here illegally and the only rights they have is arrest detain deport

      spoonerist,this a good,much needed law since the congress is so afraid to protect our borders because they will lose votes.under the arz.law they can not stop a person or car just because they think they might be illegal.the police have to have a primary reason to stop them such as speeding,running a light or if they match the description of a robber.after stopping them for another reason then they can ask for proof of citizenship,legality,etc.really nothing different than what happens everytime me or you gets pulled over,first thing we have to do is show an ID

      spoonerist the arizona law mirrors federal law it just gives state and local enforcment to do what the federal goverment refuses to do on the ss number it is not a id number it is aginest the federal law to ask for it for any thing other then employment or matter relating to ss and one more point if you leave home with out id and something happens like you get hurt you are taken to the hospital with no id the doctors don,t have any idea who to call or what to give you my point being if you choose to not carry id and have an accident and they do happen ever day you could die but that is up to you

    The MALDEF challenge that Arizona’s law is unconstitutional is constitutional ignorance at its best. All the 14th Amendment says is that “No State shall…deprive any person of life, liberty, or property, without due process of law.” All that says is that no state may imprison a person, or take his life or property without due process of law, which means that, by due process of law, it may do such things, as long as they apply their laws equally.

Just let one of those individuals who represents socialistic views of “let others work so we don’t have’ be affected by an illegal commiting or continuing the crime of identity theft — then they will sing a different tune. If you ain’t been affected, then you should keep your nose out of the business of judging whether others need protection by such laws as AZ 1070.     There are at least two issues that need to be stressed in this Trojan Horse media event. First, the state of Arizona must make it clear that border states are being forced to protect themselves against a) an indifferent government in Washington and b) a steady influx of CRIMINALS. Second, Washington needs to be seen by the public as indifferent and not but motivated to enforce illegal immigrant laws that already exist.
    Washington politicians would rather protect criminal behavior than enforce existing laws, and that means it is willingly acting in defiance of the Constitution.
    Arizona is not the only state affected in this matter. Because Washington’s indifference will affect every state, Washington and its incompetent
    “leaders” must be singled out and driven out of office.
    When citizens can’t tell the difference between criminals and elected officials, the states are allowed to do what they must to insure that its citizens are safe. Let America’s social engineers and its elected criminals howl at the moon. The people are not being protected. Enforce the laws and preserve the Constitution.
    As long as a sitting prez will not discharge his constitutional duties, then he is as guilty as those who try to enter America illegally.

    Anytime I have ever been stopped, I had to produce a license and proof of insurance. Is this that much different? As far as racial profiling goes, the police are supposed to be looking for those who meet the description of the lawbreaker, no matter what law is broken. And if they are here illegally, a law was broken. Why is that so hard to understand? Sure, it may be a hinderance to those who are here legally, but a small price to pay to rid our country of those who break our laws.

      The issues are subtle… For starter, Immigration is the exclusive jurisdiction of the federal government… this reason alone will invalidate certain clauses of SB 1070. The other issue is equal protection. The difficulty of enforcing the law, say, against an obvious American Citizen, versus someone who appears foreign (darker skin and/or someone who speaks with an accent) though also an American Citizen is troublesome. If the police officer relies on the skin color and/or someone who speaks with an accent to substantiate the reasonable suspicion requirement under SB 1070, then the reliance violates the equal protection clause. In short, if both people in the above example could not provide ID when stopped for say, jaywalking, and both refused to cooperate with the police, which one would the police officer detain until he could verify the citizenship status?

        Geno, be sure you are carrying a real ID…not a FAKE ones.
        I heard a lot of UnDocumented here in United states are buying and carrying fake ID, fake social security number and fake drivers license. Do you think the cops can determine what is fake or not? I need and answer of all these FAKES. I will be glad if they will impose the immigration law because I am sick of all these people that don’t have social security number and gets paid well and get a good treatment.

        Peter, The 10th Amendment describes reserved powers by the states and enforcing THEIR borders is a reserved right; especially in this case where the Federal Government (or Central as I believe it is referred to in that amendment)has failed in their responsibility that the states GRANTED them at the signing of our constitution.         Peter you make a mute point if you have no id on you that an,t the fault of the police have i been stop yes did i like it no did i have id you bet did they let me go my way yes, my nabor works for a land scape comp ,the illegals buy a ss number from one of the other illegals, here is what i say if you come on to my property without my permission and i tell you to leave and you do not then do i not have the right to make you leave by police or other forces or is it ok with you if i just move in to your house and demand you feed me ARIZONA HAS THE RIGHT TO PROTECT IT PEOPLE BY LAW that 70% of the voters vote for this law

        I believe you are mistaken on two counts. first, They are not saying they can’t be in the United States, just the state of Arizona. Second, BOTH could be detained!! If a police officer stops you for ANY infraction of the law and asks you for I.D. and you refuse to produce it you can and in all probability WILL be detained!!!

        It is not Arizonas place to say what other states say or do. As far as this sheriff Dupnik, he’s an idiot. La Raza means race, it is a racist org., and want to take over the government and make this a communist country just like they are doing in South America. Go to U-Tube see the vedio that the media cut out. The live coverage of the protest on 5/1/10 where they are passing out flyers on a revolution against this country and put communism here. This vedio was done by M Mslkon a known author. There are also others telling what they are going to do to americans and police officer if they don’t get what they want. And no illagals do not haave constitutional rights.

        This bill mirrors the federal law. SB 1070 is very important to the majority of Arizonans. If you don’t live here it is hard to truly understand what we are going through. Please don’t believe what you here on TV about this bill read it. This bill makes it illegal to racially profile. You can not ask about citizenship without reason. And because someone is standing on the side walk is brown is not a reason. These illegals that are here are not just looking for a better life, They are dangerous and their intent is to take over this country. There are over 20 million illegals here.

They treatens you, sabotage you, molist you, they are liars and they BANKCRUPTED OUR COUNTRY and most of all they make fun of you because they think they are better than we are (AMERICANS). How I wish the immigration law in California WILL BE IMPOSED too. I hope someday they will go after the private company and find those who ARE ILLEGAL AND SEND THEM BACK TO THEIR COUNTRY. Private company don’t check backgrounds and they don’t care if you are legal or illegaL…. they hire people from AGENCY. SOME AGENCY do illegal hiring, putting visitors to work without social security number. That is so DISGUSTING AND IT IS A SLAP ON THE FACE OF THE AMERICAN PEOPLE. Who are these people they are making fun with. WE AMERICANS. It is very sickening to see these people working without social security number and work with you and make stupid things that American citizens understand because of how we brough up and how understanding and liberated we are americans.       I wouldn’t say that it is a hinderence. The person was stopped for reason.Speeding, no lights, etc. finding the offender illegal is just one more law broken. I have been asked for my licence and insurance papers on a routine road stop to check if I have the currant stickers posted on my windshield.
