Phoenix mayor: Immigration bill is 'unconstitutional' and 'unenforceable'Just a few days after Arizona Governor Jan Brewer signed into law a historically aggressive immigration bill, Phoenix Mayor Phil Gordon indicated that the city may soon file a lawsuit challenging the legislation on constitutional grounds.

Gordon told Fox News the bill is not only unconstitutional, but also makes the state less safe, as police would be forced to spend an exorbitant amount of time focusing on this "unenforceable" law.

"It tramples civil rights," Gordon told the news source. "Now everyone has to show and prove that they’re a legal resident or citizen." He also warned that the new law may create "a division within the state that could lead to violence."

The Phoenix mayor also attacked the author of the bill, state Senator Russell Pearce, by comparing him to late Alabama Governor George Wallace, a well-known segregationist leader in the 1960s, KTAR.com reports. He said that Pearce is more concerned with making headlines than battling the real problems that face Arizona, such as violent crime and the drug trade.

Gordon indicated that he will ask the Phoenix City Council later this week to join him in his fight against the law.

    Of course this racist law won’t stand… Arizonas Sheriffs associantion came out aginst it….Sheriff Clerence Dupnik said he won’t enforce… The American Nazis did come out in support of the law…..law enforce says they have their hands full already and the law isn’t funded…

        As I’ve said before, the libs believe that the murder and mayhem Americans suffer every day at the hands of illegals is an acceptable trade-off for “human rights”.

        It will only be when someone in his own family is injured, a child abducted or someone murdered from his house, that he will understand why we’ve had enough. There is nothing racist about wanting to protect your home, family, neighborhood, country from the constant violations being committed on an increasing basis, or upholding the laws in place to do so.

        Libs live in an idiology that works only in their own minds. They are completely out of touch with the real world.

    i know a few people that live in az might move there one day, but unless you live there and have to deal with illegals running thruough your yards and streets, deal with the violence and the very real dangers that being the kidnap capitol of the world or darn close brings with it.

    many lwas require you to carry your drivers license, or wear a seatbelt, i loathe wearing a seatbelt i feel it should be my decision on if i want to wear it or not, are those vilations of my individual rights? i think they are but they have been held up in court.

    so now mexican residents are obligated to show their papers if asked for them boohoo, like that is any different than having to have your driver license or photo id available if asked for it.

    the dems just want the illegal votes from illegals, no check at the voting office, free health care, cheap labor for those that have to keep it under the radar being here, and i suppose given enough time the dems would be happy to give than all free welfare to send back to mexico.

    if you here legally, god bless you, you might be asked to show your id and documents a bit more, but really how is this a bad thing unless you are here illegally and avoiding the laws.

        GW did propose a “comprehensive” immigration bill, but it did not get enough support to pass. Dems wanted amnesty for illegals while the grass roots American public wanted border security first. Congress did finally pass a bill to build a fence on the border, but as you know that has stalled out now that the Dems have majorities in both houses of Congress and the administration.

I has stopped animal migration routes very well,but it’s already been climbed and dug under and cut through…The East Germans learned that walls between countries don’t work…little kids read books about countries building walls that don’t work. We need a longterm solution that doesn’t strip our rights as citizens, and the Repubs won’t help in that…their answer is arrest anyone you don’t like the looks of and stick them in prison.

        I have to admit that the Republicans don’t have a very good record on managing illegal immigration either. We agree on that. So, in my opinion, we really do need another grass roots effort by the American people to help find good solutions to this problem and force our politicans to legislate accordingly. I haven’t seen very much of value coming out of Washington on this topic, from either party. Have you?

        We need leaders from both parties to come together to solve a tough problem…but, the ‘illegal’ issue is being blown out of proportion compared to other problems. Most ‘illegals’ work hard, don’t commit crimes and have been coming across the border to work for decades. They are enhance our economy w/ their spending and working. Beijeng China had a guy that crashed a school gate with a motorcycle then attacked 5 school children with a hammer. He then doused himself with gasoline, grabbed two more kids and tried to set himself on fire. the children were snatched from him just in time as he flamed up and burned to death. the wounds the five children suffered were not life threatening, but very well could have been.
        Just think if he had barred the door from the outside and doused the building as well as himself? All the kids could have died! Guess it doesn’t take a handgun does it???

    Remember, the Constitution is there to guarantee the INALIENABLE RIGHTS of the Citizens, NOT those who are here illegally!

    If the Fed’s had enough guts to actually put up the wall at the border and police who comes in, rather than trying to invade our (the Citizens) CONSTITUTIONAL, US SUPREME COURT DECISION PRECEDENT, RIGHT TO FREE TRAVEL then we would not even be talking about this!

    Bottom line is, if the border was secured, we would not have the problem. The ILLEGALS are just that, ILLEGALLY HERE! ANYONE who argues that probably believes that it is ok to steal too, Oh ya, they are the ones who support welfare for the illegals too.. I forgot!

Mandating that cops check the papers of people they suspect of being here illegally means that they will wind up asking for papers from legal citizens as well and especially those who may ‘look’ like illegals but are actually citizens, because, obviously the cops won’t know who is actually illegal…it will have to depend upon racial profiling and will be an invasion of privacy for anyone the cops ‘suspect’. The constitution has a provision in it called the ‘privacy clause’. It’s a right to unreasonable search and seizure. How is it reasonable to base a search of a person based upon skin color or other behaviour? It;s not.

      You people are letting the fearmongering frenzy push you into stripping all of us of our rights…now, for instance, we can’t even leave the country w/o a passport because you’re terrified of a threat that pales in comparison to getting into your car every day. Now you’re willing to be stopped at the whim of a policeman on the street and if you don’t have your papers maybe go to jail until you can produce them. Of course, most white people aren’t overly worried because they think that it will only be darker skinned people subject to the law…maybe, though you give police this kind of wide and subjective power ans who knows….

        What part of “the Arizona Immigration Law” supports the Federal Immigration Laws won’t you understand? A cop cannot arbitrarily check anybodies ID’s or paperwork, legal or illegal. That’s the law!
        A person must commit a crime or a violation before they can be checked. The left and the feds are commiting the “fearmomgering”, not the law. Roll over and cry and whine to somebody that will buy into your crap, or don’t go into Arizona.

        Washington – As the Obama administration considers a potential legal challenge to Arizona’s tough new immigration law, a professor who helped draft the bill is defending the state measure as supportive of existing federal statutes.

        Professor Kobach said the Arizona law is supportive of federal immigration laws rather than seeking to supplant them

        “I think the critics who are claiming the bill will not withstand legal challenge need to read the bill,” said Kris Kobach, a law professor at the University of Missouri-Kansas City.

        “The bill will withstand any preemptive challenge,” he said, because it reinforces existing federal immigration laws and creates no new immigration crimes.

        “The bill adheres to the doctrine of concurrent enforcement – the legal principle that preemption will not be found where a state law prohibits conduct that is already prohibited under federal law,” he said.

        Reasonable suspicion’The most criticized aspect of the Arizona law is a mandate in Section II that state and local law enforcement officials must verify a person’s immigration status “where reasonable suspicion exists that the person is an alien who is unlawfully present in the United States.”

        Racial profiling? Kobach said the Arizona law itself bars officers from relying on illegal factors like race, color, or ethnicity in making reasonable suspicion determinations.

        Reasonable suspicion? what does that derive from? Appearance, skin color, manner of speech, clothing, type of car driven? How would a cop have ‘reasonable’ suspicion based upon anything other than profiling? Would a cop suspect a blond,blue eyed female model of being ‘illegal’?? No, it can’t be done w/o racial profiling unless absolutely EVERYONE is stopped on the street or in a car…that means you too.
        I just heard that the cowardly AZ legislature has already backed off and changed the ‘law’. Now no one would be subject to search for papers unless stopped for another issue.       You’re right. The Dems have a well-oiled organizational machine that develops positions and makes sure everyone has them to repeat in conversation and debate. This wouldn’t be so bad if the main stream media didn’t simply repeat these talking points without challenge. Too many people simply assume if they hear something on one of the MSM outlets it must be true, but especially if they hear it on two or more of these outlets. If you are a student, and you hear one or more of your professors repeat these talking points as well, you just know this is absolutely a fact……ugh.

      I’m convinced the Dems are over reacting to the Arizona bill because they see this as another possible TEA Party movement. They want to control this debate and steer it towards the conclusion that the only reasonable solution to illegal immigration is amnesty. They don’t want a grass-roots movement steering the debate towards border security, identification and deportation or illegals, etc. So, they are using one of their old PR tools to try to defeat this movement; exaggeration and discrediting the law and people behind it. You notice that at the heart of their claims is that this law is “racist.” They like to use that line a lot to intimidate people into doing what they want them to do, or not do. It’s been pretty effective for the past couple of decades. Hopefully, it won’t work this time.

    The bill is a good shining light, it is 16 pages long, short and too the point, fact is the most illegals, are criminals, first, breaking our border laws, second, bringing in drugs, using our welfare programs and medical care as a free hog trough, to wallow in.       I’m pretty sure this bill is NOT unconstitutional. The Dems are playing politics with this issue because they don’t want to see another “TEA Party” type movement get started where grass roots American people tell the government what to do. They want to control this debate to steer it towards amnesty for all illegal immigrants. This is one of their key strategies for increasing the number of Democrat voters, so they’ll scream bloody murder if necessary to stay in control of this issue.

    Amen Rob! I’m also tired of the “race card”. I speak Spanish and have quite a few Hispanic friends. And, besides, our Constitution doesn’t cover every person in the world, just those who are U.S. citizens. So, to call this unconstitutional is just plain stupid. As far as people saying it infringes on their right to privacy, if this bothers you, I hope you didn’t fill out the census form for 2010. It was a hell of a lot more intrusive!

    Apparently making a law to enforce the law is unconstitutional – Mayor Gordon is a “TWIT” instead of suing his own state who is tring to enforce the law our federal govt. will not, he should be suing the feds for not complying with enforcement which is dereliction of their duty. Get of the soap box lefists there is nothing hateful or racist about this law it is only to enforce laws on the books – read the law for a change instead of whining about something you do not take the time to understand.

    I agree with Scott Camp. The illegal aliens are costing us taxpayers, those of us who get up and go to work each and every day, millions of dollars. Not only are their children receiving discounted meals at school, they are teaching them ESL. Why not teach our children SSL (spanish as a second language.) They continue to ride on our coat tails, free medical while our insurance premiums continue to rise to cover their ‘free’ hospital stays. I support anyone who chooses to come to this country, as long as they do so the way my family did from Germany and Poland. The right/legal way, no free rides. Most of the illegals who work, work for cash, they do not pay ss, medicare, taxes, instead they get WIC to buy groceries and so many benefits of which you and I are picking up the tab.

    OK….if this new bill is unconstitutional, then all you have to do is QUIT giving out FREE assistance to NON citizens/undocumented individuals. We are asking WHY the states are being bled with budget problems? It is beyond me how they are receiving these benefits in the first place. FREE healthcare, Free education, Food stamps, and the list goes on. As a US citizen/taxpayer, I find this disgusting. So show me an American citizen who doesn’t break the law repeatedly…should we ship out or lock up citizens who cheat on their taxes,speed on the highways,run red lights,commit minor insurance fraud? All of those things cost the whole society and put people at risk and even kill others. What I do take issue with is the BACKDOOR/ILLEGAL entrance to the US and the use/misuse of benefits meant for the LEGAL citizens of the US. Again, we donot address how and why ILLEGALS have or are given these benefits in the first place. How are they entitled. You mentioned a concern regarding dark skinned people, this is not the issue for me. We have ILLEGALS in this country of many races that have entered this country illegally. Money???         Of course there is a ‘front door’ path for immigration…there’s also a program for migrant workers to come and go, mostly for the ag workers.
        I don’t want to be over run by immigrants or by too many native born Americans either…we already have way too many people in this country and should be using tax policy to also discourage people from having so many children. Citizens benefit monetarily by having 5,6 or 10 kids and it’s ridiculous to think that we can just keep expanding
        our population forever, and not ruin our land and society.

It is libs who don’t honor the rule of law, don’t respect the rights and property of others, and who feel that if they get away with breaking a law, then no foul.

        I think it’s also fair to say that a good deal of time the penalty for a citizen caught breaking a law is more severe than when an illegal is caught. In any case, the fact that citizens break laws in no way justifies the behavior of foreign nationals.

        Yes and a lot of the “legal” immigrants still work under the table for cash, pay no taxes, get social services, have their own bankers and live in subsidized housing. So what ever happened to the part of the immigration law that says you must be self-sufficient to come here or your “sponsor” must take care of you until you can make your own way?

        The fact is that millions of Americans are out of work, our social welfare system is burdened beyond what it can support, our schools are filled to capacity, and our health care system is over-run with non-paying people. These illegals are not holding low or menial jobs, they are in construction, landscaping, irrigation and industry. These are all jobs that Americans would certainly take if they were available.

      Now, now Harry. Let’s not exaggerate. This law simply codifies the federal immigration laws which are already in place, and standardizes Arizona law enforcement agencies across the state on how they should deal with enforcement of these federal laws. (Up to now, each agency had to decide on their own whether to devote resources to enforce federal immigration laws. Some chose not to.) It does not attempt to strengthen the federal laws, or instruct Arizona law enforcement agencies to process illegal immigrants outside federal agencies. No doubt this law will encourage more and better training of local law enforcement officers on how to lawfully detain people so that they don’t violate racial discrimination/profiling laws. So, in the end, I would argue that this law will probably help to reduce those kinds of problems rather than increase them as you are obviously concerned.

      Democrats are playing politics with this law. They obviously don’t want to lose the initiative on reforming our immigration laws to the states. My guess is they see this as another grass roots political movement (like the TEA Party) which if not stopped quickly may cause them to lose control of the immigration issue. After all, the feds want to tell us how our immigration laws should be constructed and managed. The last thing they want is for the people (states) to tell them. Think about it……

        I am glad someone else has read the 16 page law. I will lay odds that there isn’t one person in Washington DC that has even read the document, especially the ones that are throwing the race card at Arizona. Other states need to read this document and mirror it in their states, especially our border states, north and south. If you have ever lived in any other country which I have, you need a passport to go from one country to another. Canada has just started this requirement for the US when we enter their country. So what it the difference if its the other way around?

      Mayor Gordon says the law is unenforceble only because he don’t want to enforce it. The new law is based on the Federal immigration law, which is only unenforceable because the Feds do not want to enforce it. It is time that Phil Gordon was kicked out of office alone with Barack Obama, Harry Reid, and Nancy Pelozi for dereliction of duty. Why should the taxpayer continue to pay the salaries and bloated pensions of elected officials who are derelict in their duties? Governor Brewer and the Arizona legislature has my support.       What the heck – you must like the fact that Arizona and the rest of the US is going broke trying to deal with illegals. There’s criminals, drug wars, fraud in social services, hospital emergency rooms are over run with free health care for illegals, schools are over populated and forced to educate in English and spanish to the detriment of American children and these people are costing the United States more than both wars combined. So what are you thinking?

      There are no “constitutional” rights for illegals in this country same as there are no rights for convicted felons. They have “constitution” rights in their own country and should do the right thing and go back, stand in line like every one else seeking to immigrate to this country.

      This certainly is not racial profiling and the police are not actively enforcing immigration laws. The US immigration laws state that if a person is stopped for criminal activity or traffic violations they must show ID and if they are not legal the local law enforcement agency is to contact ICE to pick the subject up. They are merely checking for legal status once a person is pulled over or arrested for a crime. That is the same as with every legal citizen of this country. The racial profiling is just a liberal spin to make us feel sorry for illegals.

      You might want to do some research and check on what these illegal and immigration in general cost US taxpayers by going to the following website: http://www.cis.org/illegal. Also while there check out what the 1986 amnesty costs us and is still costing us as taxpayers.

      The fact is that illegal is still illegal no matter what spin you put on it. Our borders are so open that terrorists could carry bombs across and our government does nothing to stop this. The 1980′s amnesty just opened the gates for more bad behavior because these people get rewarded for breaking our laws.

      During the 1930′s many States REQUIRED that a part of a City Charter would be that it was required to have a clause that made it a crime for a politician or public official to NOT enforce federal and State laws. I wonder if Phoenix does’t have the same. I know Minneapolis does. I believe most cities even include such a clause in the oath of office for Mayor, City Council people, as well as law enforcement officials. Now we have some idiot politicians saying it is unconstitutional to enforce the “Federal Law”. And unconstitutional to have State Laws that require the enforcement of “Federal Law”.

      People need to begin to be serious about the borders and immigration. We simply cannot afford not to. The figure of ten million illegal aliens is also a joke. Having traveled to many, mant U.S. cities this year I can tell you that EVERY city and town in the United States is over run with illegal aliens. From New York to California, from Minneapolis and small towns in North Dakota and Nebraska to the gulf coast. And the fault goes to Republicans as well as Democrats. One wants more votes, and the other wants “cheap labor” that will undercut U.S. workers.

      Every State should pass a law that they require ALL state licensed police officers to enforce ALL laws including immigration law. Now we have a Secretary of State telling people that the U.S. Government and a President I voted for will sue a State for having the same law and enforcing the Federal law. This Democrat will probably change his vote in the next two elections.

If the law that was already in place had been enforced to begin with, there probably wouldn’t have been a need to pass another law.
